Seismic Tomography For The Integrity Assessment Of Earthen Dams And Levees., Leti Teklu Wodajo Jan 2011

Seismic Tomography For The Integrity Assessment Of Earthen Dams And Levees., Leti Teklu Wodajo

Electronic Theses and Dissertations

Dams are a vital part of a nation's infrastructure. Considering the fact that many of the dams in the United States have approached or are approaching their projected life expectancy of 50 years, these critical infrastructures represent a risk to public safety. Minimizing this risk requires an ongoing safety inspection, monitoring, maintenance and rehabilitation program. This research examines the use of a non-invasive geophysical seismic method to provide additional information where the usual visual inspection is insufficient and the comboring investigation is not an option. Even though seismic techniques provide valuable information of the subsurface strata, the interpretation is not …

Specifying The Links Between Adolescent Substance Use And Traditional Delinquency Theories: A Negative Bionomial Approach, Anthony James Feuchter Jan 2011

Specifying The Links Between Adolescent Substance Use And Traditional Delinquency Theories: A Negative Bionomial Approach, Anthony James Feuchter

Graduate Student Theses, Dissertations, & Professional Papers

The consumption of alcohol and illicit drugs among adolescents has been a growing concern in sociology and related disciplines (Hayes-Smith and Whaley 2009; Embry, Hankins, Biglan, and Boles 2009; Herman-Stahl, Krebs, Kroutil, Heller 2007). The societal and financial effects of substance use in Montana have been detrimental. For example, methamphetamine use accounted for 33 percent of children in foster care and over 50 percent of children were in foster care for drug-related reasons in 2006 (Methamphetamine in Montana 2008). Also, Bryant, Schulenberg, O’Malley, Bachman, and Johnston (2003) found consistent patterns in the prior literature that high truancy rates and low …

Public Sector Labor Law And History: The Politics Of Ancient History?, William A. Herbert

Hofstra Labor & Employment Law Journal

This article discuss three books that address various aspects of public sector labor history. It seeks to contextualize the current debate over public sector labor law and relations through the lessons of relevant history. The first book discussed is entitled The Man Who Saved New York: Hugh Carey and the Great Fiscal Crisis of 1975, by Seymour P. Lachman and Robert Polner. It recounts the leadership of Governor Carey and public sector labor leaders in reaching negotiated solutions through collective bargaining that helped solve New York City's fiscal crisis in 1975. The second book is a long-forgotten 1948 treatise Government …

Peak Performance Training, Matthew Gabriel Hallett Jan 2011

Peak Performance Training, Matthew Gabriel Hallett

Electronic Theses and Dissertations

Peak performance is defined as an “episode of superior functioning” where an individual performs up to (and sometimes exceeds) their full potential (Privette, 1983, p. 1361). Most individuals do not consistently experience episodes of peak performance. After accounting for biological factors, motivation, and external constraints, the inability to achieve peak performance consistently is due to the challenge of successfully selecting and accessing knowledge and skills on demand while under pressure (Brown, 2009). This thesis describes the psychology of peak performance and skill training for peak performance. A peak performance training program is designed specifically for business professionals. The program was …

Modeling Mass Care Resource Provision Post Hurricane, Tammy Marie Muhs Jan 2011

Modeling Mass Care Resource Provision Post Hurricane, Tammy Marie Muhs

Electronic Theses and Dissertations

Determining the amount of resources needed, specifically food and water, following a hurricane is not a straightforward task. Through this research effort, an estimating tool was developed that takes into account key demographic and evacuation behavioral effects, as well as hurricane storm specifics to estimate the number of meals required for the first fourteen days following a hurricane making landfall in the State of Florida. The Excel based estimating tool was created using data collected from four hurricanes making landfall in Florida during 2004-2005. The underlying model used in the tool is a Regression Decision Tree with predictor variables including …

Family Law, Pluralism, And Human Rights, Ann Laquer Estin Jan 2011

Family Law, Pluralism, And Human Rights, Ann Laquer Estin

Emory International Law Review

Until recent years, authorities in the United States gave little serious consideration to the marriage and family traditions of other religious groups. Courts today accommodate cultural and religious diversity more generously, but always within a larger framework of law requiring nondiscrimination, freedom of conscience, gender equality, and protections for dependent or vulnerable family members. In this context, although the unofficial family law of customary and religious authorities has important consequences for individuals and families, those authorities have not been able to enlist the coercive machinery of the state to enforce their orders. This type of pluralism, characteristic of the United …

Regulating Religious Freedom In Africa, Rosalind I.J. Hackett Jan 2011

Regulating Religious Freedom In Africa, Rosalind I.J. Hackett

Emory International Law Review

In this Essay, using a wide-ranging set of examples, I wish to provide some background on the emergent discussion on limitations on religious freedom in Africa, especially how these relate to the current debates on family law that are the subject of this Symposium. My general objectives are (1) to consider the legitimate and illegitimate ways in which African state and non-state actors seek to regulate religious practice; (2) to examine how particular religious groups may be disproportionately affected by these measures; (3) to demonstrate how interference with manifestations of religion often leads to abuses of related rights and freedoms …

Successes And Challenges Of The Haiti Earthquake Response: The Experience Of Usaid, Paul E. Weisenfeld Jan 2011

Successes And Challenges Of The Haiti Earthquake Response: The Experience Of Usaid, Paul E. Weisenfeld

Emory International Law Review

The Haiti relief and reconstruction effort continues to be complex, presenting the difficult task of allocating limited human and financial resources between immediate humanitarian needs and long-term sustainable development solutions, which are intended to address Haiti's underlying problems. The ultimate measure of success for the relief and reconstruction effort will be the strength of Haitian institutions that the USG and international community leave behind. This Article focuses on the U.S.-led response, which demonstrated how present laws and practices are effective in responding to highly complex and large-scale natural disasters and highlighted potential areas for improvement.

A "Constant And Difficult Task": Making Local Land Use Decisions In States With A Constitutional Right To A Healthful Environment, Michelle Bryan Mudd Jan 2011

A "Constant And Difficult Task": Making Local Land Use Decisions In States With A Constitutional Right To A Healthful Environment, Michelle Bryan Mudd

Faculty Law Review Articles

This article first examines the role local governments play in four states that have constitutional rights to a healthful environment -- Illinois, Pennsylvania, Montana, and Hawaii. The author notes that while local governments have long worked as quiet yet integral third partners with state and federal governments by addressing environmental issues through land use regulation, for local governments in environmental rights states, environmental protection is not just an aspiration, but a constitutional mandate. Further, the author states, environmental rights cannot be fully protected in these states without the strong engagement of local government.

The article also describes the constitutional provisions …

Development's Victim Or Its Beneficiary?: The Impact Of Oil And Gas Development On The Fort Berthold Indian Reservation, Raymond Cross Jan 2011

Development's Victim Or Its Beneficiary?: The Impact Of Oil And Gas Development On The Fort Berthold Indian Reservation, Raymond Cross

Faculty Law Review Articles

This article assesses whether oil and gas development on the Fort Berthold Indian Reservation, given the critical geographic, legal, and socio-cultural differences which set it apart from the rest of North Dakota, will bring with it potentially devastating and unmanageable impacts that may overwhelm the tribal people of that reservation. The article seeks to fill an analytic gap in the existing oil and gas scholarship that has not, in the author's estimation, given sufficient regard to development's unique rights and impacts in Indian Country.

An Overview And The Evolution Of The Anti-Counterfeiting Trade Agreement (Acta), Margot E. Kaminski Jan 2011

An Overview And The Evolution Of The Anti-Counterfeiting Trade Agreement (Acta), Margot E. Kaminski

Joint PIJIP/TLS Research Paper Series

The Anti-Counterfeiting Trade Agreement (ACTA), a plurilateral intellectual property agreement developed outside of the World Intellectual Property Organization (WIPO) and the World Trade Organization (WTO), represents an attempt to introduce maximalist intellectual property standards in the international sphere, outside of existing institutional checks and balances. ACTA is primarily a copyright treaty, masquerading as a treaty that addresses dangerous medicines and defective imports. The latest ACTA draft, which is the final text available to the public before the signed text is released, contains significant shifts away from earlier draft language towards more moderate language, although it poses the same institutional problems …

More D (Deliberation) For California’S Dd (Direct Democracy): Enhancing Voter Understanding And Promoting Deliberation Through Streamlined Notice-And-Comment Procedures, Glenn Smith

Faculty Scholarship

This article seeks to enhance public consideration of the pros and cons of streamlining California's informal-administrative-rulemaking procedures for reforming the state's direct democracy. To provide a concrete focus for discussion and quick adoption, Appendix I includes proposed amendments to existing California statutory provisions. This article provides a context for considering the proposed legislation by elaborating on five questions: Why Deliberation? (Part I): In this Part, the Article makes the case, both on the substantive merits and on practical political grounds, for focusing on deliberation-enhancement as the best "next wave" of initiative reform.8 Why the Administrative Model? (Part II): This Part …
