Note – Don’T Steal My Sunshine: Deconstructing The Flawed Presumption Of Privacy For Unfiled Documents Exchanged During Discovery, Mary Elizabeth Keaney Feb 2011

Note – Don’T Steal My Sunshine: Deconstructing The Flawed Presumption Of Privacy For Unfiled Documents Exchanged During Discovery, Mary Elizabeth Keaney

UC Law Journal

Courts encourage settlement as a way to resolve disputes efficiently and clear congested dockets, but settlement agreements can have a sinister effect too. It is becoming common in modern litigation to draft settlement agreements that require the return of discovery materials and the sealing of court documents from public view. Legitimate privacy concerns warrant sealing pretrial discovery and other court documents. However, the practice of keeping information vital to the public health and safety sealed for a price is illegitimate, and should be prohibited. Legislative efforts are being made to monitor the impact that secret settlement agreements have on public …

American Policing At A Crossroads, Tom R. Tyler, Stephen J. Schulhofer, Aziz Huq Feb 2011

American Policing At A Crossroads, Tom R. Tyler, Stephen J. Schulhofer, Aziz Huq

Public Law and Legal Theory Working Papers

As victimization rates have fallen, public preoccupation with policing and its crime control impact has receded. Terrorism has become the new focal point of concern. But satisfaction with ordinary police practices hides deep problems. The time is therefore ripe for rethinking the assumptions that have guided American police for most of the past two decades. This essay proposes an empirically grounded shift to what we call a procedural justice model of policing. When law enforcement moves toward this approach, it can be more effective, at lower cost and without the negative side effects that currently hamper responses to terrorism and …

A Comparative Review Of Environmental Policies And Laws Involving Hazardous Private Dams: 'Appropriate' Practice Models For Safe Catchments, John D. Pisaniello Feb 2011

A Comparative Review Of Environmental Policies And Laws Involving Hazardous Private Dams: 'Appropriate' Practice Models For Safe Catchments, John D. Pisaniello

William & Mary Environmental Law and Policy Review

Generally, the world’s largest dams have been erected and managed
by governments, while individual owners have been responsible for private
dams. Both kinds of dams have experienced technical failures that
have resulted in tragic losses of life as well as disastrous damage to property
and environment, and this has generated serious concerns regarding
dams’ safety worldwide. In Australia, despite the fact that attention has
been focused on the physical and technical integrity of medium- to largescale
dams, the smaller private dams have been virtually ignored with
regard to their serious potential and actual problems. Specifically, private
dams pose threats to …

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

In the wake of the Virginia Tech tragedy and less than two years removed from back to back hurricane experiences with Katrina and Rita, the Board of Supervisors for the University of Louisiana System (ULS) made specific recommendations to all of its member institutions regarding increased preparedness and enhanced response for managing an active shooter incident on a ULS campus.  The ULS Emergency Preparedness Steering Committee (EPSC) was formed to undertake the immense task of implementation these recommendations by drawing on campus and system resource persons representing environmental health and safety, public safety, student affairs, academic affairs, business affairs, facilities …

Promoting Democracy In Prosecution, Russell M. Gold Feb 2011

Promoting Democracy In Prosecution, Russell M. Gold

Washington Law Review

Voters were meant to check prosecutors’ decisions, but that check has eroded because voters lack the information necessary to cast meaningful votes in prosecutor elections. Voters’ lack of an effective political check on prosecutors causes two related problems: (1) inefficient allocation of prosecutorial resources and (2) divestment of democratic sovereignty from the people. Prosecutors currently need not consider expenditures for incarceration or public defense because voters never see these costs and thus cannot hold their prosecutors accountable for them. Accordingly, these costs become an externality in the prosecutorial decision-making process, causing prosecutors to spend resources in socially inefficient ways. To …

Regional Assessment Of Tsunami Hazard Management Plans: The Case Of The Us Pacific Northwest, Edmund Merem, Yaw Twumasi, Joan Wesley, Benetta Robinson

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

The US Pacific coastal states continue to be at risk from both locally and distantly generated Tsunamis. During the past two centuries, all five states have been hit by Tsunamis which inflicted considerable causalities and damage. This susceptibility can be minimized by effective hazard management plans, better hazard mitigation practices and the construction of more hazard resistant structures such as steel reinforced concrete buildings. At the same time, no studies have been conducted to determine how local authority has incorporated Tsunami hazard management in their planning frameworks. The analysis of several costal counties in the states, indicate that most plans …

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

This presentation will showcase the work of two service-learning classes at Louisiana State University during the plan application and capability assessment phase for the DRU plan of Louisiana State University. More often than not, a consulting firm develops the Disaster Resistant University plan. There are many reasons why this might be a good choice for universities with limited personnel, computing resources, skills, experience, and so forth. Whenever universities produce their Plan in-house, they commonly tend to assign responsibilities to university administrators as well as faculty and staff members from public safety, risk management, geography, sociology, and engineering to name a …

A Content Analysis Of Crisis Management Websites At Four-Year Institutions Along The Gulf Coast, Steven Mccullar

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

College and university websites have become a very important tool in crisis communication over the past few years, especially after events such as the devastation from Hurricanes Katrina, Rita, and Gustav and shootings at institutions such as Virginia Tech, Northern Illinois, University of Texas, and Northern Alabama.  Stakeholders are turning to the university websites when a crisis occurs. It has become important for higher education institutions to have specific websites that deal with the possibility of a crisis.  This discussion takes a look at websites in the Gulf Region through the research process of content analysis. The goal of this …

Higher Education Emergency Management Program Accreditation: Seeking The "Holy Grail", Steve Charvat

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

University hospitals are accredited, college police departments are accredited and academic programs of higher education institutions receive accreditation. Emergency management accreditation programs and other baseline performance management standards are out there, but have yet to be applied to institutions of higher education. This workshop will discuss the various national and international programs and standards and provide a preview of what potentially is in store for colleges and universities. In these times of reduced programs and fiscal support for emergency management programs …

Executing The Will Of The Voters?: A Roadmap To Mend Or End The California Legislature’S Multi-Billion-Dollar Death Penalty Debacle, Judge Arthur L. Alarcón, Paula M. Mitchell Feb 2011

Executing The Will Of The Voters?: A Roadmap To Mend Or End The California Legislature’S Multi-Billion-Dollar Death Penalty Debacle, Judge Arthur L. Alarcón, Paula M. Mitchell

Loyola of Los Angeles Law Review

Since reinstating the death penalty in 1978, California taxpayers have spent roughly $4 billion to fund a dysfunctional death penalty system that has carried out no more than 13 executions. The current backlog of death penalty cases is so severe that most of the 714 prisoners now on death row will wait well over 20 years before their cases are resolved. Many of these condemned inmates will thus languish on death row for decades, only to die of natural causes while still waiting for their cases to be resolved. Despite numerous warnings of the deterioration of California’s capital punishment system …

Risk Based Models For The Optimization Of Oil And Gas Supply Chain Critical Infrastructure, Kingsley Oseloka Achebe Jan 2011

Risk Based Models For The Optimization Of Oil And Gas Supply Chain Critical Infrastructure, Kingsley Oseloka Achebe

Dissertations

The oil and gas sector faces a broad array of risks and uncertainties, affecting short- and long-term planning, and causing adverse effects in the energy sector. To predict and minimize them, risk based supply chain models were developed for the oil and gas supply chain critical infrastructure.

First, the events and activities were categorized as short term and long term, and their risk ratings derived, by analyzing data from past events and site visits. The result showed that events like the Israel – Arab war, successful hurricane, and production increase or decrease, had a risk rating of approximately 7.
