Charity Law's Essentials, Dana Brakman Reiser Feb 2011

Charity Law's Essentials, Dana Brakman Reiser

Notre Dame Law Review

The boundary between charity and business has become a moving target. Social enterprises, philanthropy divisions of for-profit companies (most notably at Google), and legislation creating hybrid nonprofit/for-profit forms all use business models and practices to mold and pursue charitable objectives. This Article asserts that charity law must be streamlined in order to respond to these and other dramatic charitable innovations. My new vision of charity law centers around two essential requirements. First, charity law must continue to demand that charities maintain an other-regarding orientation, pursuing benefits for someone other than their own leaders and managers. Second, existing charity law must …

Virtual Takings: The Coming Fifth Amendment Challenge To Net Neutrality Regulation, Daniel A. Lyons Feb 2011

Virtual Takings: The Coming Fifth Amendment Challenge To Net Neutrality Regulation, Daniel A. Lyons

Notre Dame Law Review

“Net neutrality” refers to the principle that broadband providers should not limit the content and applications available over the Internet. Long a rallying cry of techies and academics, it has become one of the central pillars of the Obama Administration's telecommunications policy. The Federal Communications Commission's efforts to regulate the “onramp to the Internet” have attracted significant attention from the telecommunications industry and the academic community, which have debated, among other things, whether the proposed restrictions violate broadband providers' First Amendment rights. But there is an additional constitutional implication of net neutrality that has not yet been sufficiently addressed in …

Promoting Democracy In Prosecution, Russell M. Gold Feb 2011

Promoting Democracy In Prosecution, Russell M. Gold

Washington Law Review

Voters were meant to check prosecutors’ decisions, but that check has eroded because voters lack the information necessary to cast meaningful votes in prosecutor elections. Voters’ lack of an effective political check on prosecutors causes two related problems: (1) inefficient allocation of prosecutorial resources and (2) divestment of democratic sovereignty from the people. Prosecutors currently need not consider expenditures for incarceration or public defense because voters never see these costs and thus cannot hold their prosecutors accountable for them. Accordingly, these costs become an externality in the prosecutorial decision-making process, causing prosecutors to spend resources in socially inefficient ways. To …

Craigslist, The Cda, And Inconsistent International Standards Regarding Liability For Third-Party Postings On The Internet, Peter Adamo Feb 2011

Craigslist, The Cda, And Inconsistent International Standards Regarding Liability For Third-Party Postings On The Internet, Peter Adamo

Pace International Law Review Online Companion

This Comment explores the nature and purpose of the Communications Decency Act (CDA), the legislative upbringing, and the application of the CDA to Craigslist. It compares the CDA to approaches taken abroad through legislation and judicial proceedings. It explains, contrary to the one other commentator to broach the subject matter, how the CDA continues to provide robust protection to Craigslist. Finally, it explores potential avenues for redrafting the CDA as well as the difficulties and trade-offs associated with implementing such change.

After Katrina: Assessing The Uno Dru Initiative, Amanda Green Feb 2011

After Katrina: Assessing The Uno Dru Initiative, Amanda Green

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

Disasters, whether natural or man-made, and emergencies can occur at any time, causing destruction, devastation, and chaos. Hurricanes Katrina and Rita caused billions of dollars in damage and cost thousands of lives. Man-made disasters, such as chemical plant releases, nuclear reactor mishaps or the terrorist attacks of September 11 have demonstrated the need for preparedness and response capabilities at the state, federal, and local levels.

While these events require preparedness and response ready capabilities of governmental entities, they also show the need for institutions of higher learning to be prepared with hazard mitigation programs to make them more disaster resistant. …

Pre-Disaster Planning At Florida Community Colleges: A Comparison Of Fema Guidelines To Processes And Practices, Timothy J. De Palma Feb 2011

Pre-Disaster Planning At Florida Community Colleges: A Comparison Of Fema Guidelines To Processes And Practices, Timothy J. De Palma

DRU Workshop 2011 Presentations - Disaster Resistant University Workshop: Building Partnerships in Mitigation

The purpose of this study was to explore and describe the pre-disaster planning processes and practices used by Florida’s community college administrators as of December 2008. FEMA’s Building a Disaster Resistant University (DRU) model was the conceptual lens for this study. A mixed methods research design included 15 surveys completed by Florida community college business officers and six semi-structured interviews with staff most involved in pre-disaster planning. Data were compared to DRU guidelines to establish whether processes and practices were congruent with the DRU.

Six quantitative findings were reported in this study. First, five of fourteen (35.7%) survey respondents appointed …
