Community Collateral Damage: A Question Of Priorities, Andrea Boyack Oct 2011

Community Collateral Damage: A Question Of Priorities, Andrea Boyack

Faculty Publications

Today’s soaring mortgage default rate and the uncertainty and delay associated with mortgage foreclosure proceedings threatens to cause financial tragedies of the commons in condominiums and homeowner associations across the country. Assessment defaults in privately governed communities result in an inequitable allocation of upkeep costs, and current law provides no way to prevent this spillover effect. But the collateral damages caused by delayed foreclosures and insufficient recoveries can be minimized by gradually increasing the priority position of the association lien.

In a majority of states, association liens are completely subordinate to the first mortgage lien. At foreclosure of the mortgage …

Student Victims Or Student Criminals? The Bookends Of Sexting In A Cyber World, Todd A. Demitchell, Martha Parker-Magagna Oct 2011

Student Victims Or Student Criminals? The Bookends Of Sexting In A Cyber World, Todd A. Demitchell, Martha Parker-Magagna

Cardozo Public Law, Policy & Ethics Journal

The article argues that criminalizing sexting as child pornography unfairly victimizes adolescents, contradicting the purpose of laws intended to protect minors. It advocates for a balanced approach that addresses the harm caused by sexting without imposing felony charges, which can have lifelong consequences. The analysis emphasizes that zero-tolerance policies and strict legal responses are ineffective and unjust, as they fail to consider the context of adolescent behavior and the unintended consequences of criminalization.

Thus, participation from various parties namely the stakeholders and public is very crucial in ensuring the success of the 3R strategies. This paper will analyze the perception of the general public and the relevant stakeholders in Malaysia with regards to 3Rs namely recycling issues. The perception between these two parties will be scrutinized to determine the factors causing such responses. Perceptions from the general public were obtained via public survey involving 655 respondents randomly selected in the …

The Use Of Portable Electronic Devices As An Evaluation Tool In The Clinical Setting, Tanya M. Custer, Lisa A. Bartenhagen Oct 2011

The Use Of Portable Electronic Devices As An Evaluation Tool In The Clinical Setting, Tanya M. Custer, Lisa A. Bartenhagen

Posters and Presentations: Radiation Therapy

The Portable Electronic Device (PED) is emerging as an effective tool which can aid in evidence-based practice along with supporting the educational needs of both clinical and classroom training (Honeybourne, 2006; Applegate, 2010). Specific types of PED’s may include personal digital assistants, smart phones, iTouch, iPads, laptops and tablets (Figure 1). Research on the use of mobile devices has been conducted in fields such as medicine and nursing; however, there is little research in the field of radiation science. More research is needed to determine how these devices can be used as an instructional aid and competency assessment tool for …

Migration, Vulnerability And Xenophobia: Central African Refugee And Asylum Seekers’ Access To Health Services In Durban, South Africa, Cathy Kaplan Oct 2011

Migration, Vulnerability And Xenophobia: Central African Refugee And Asylum Seekers’ Access To Health Services In Durban, South Africa, Cathy Kaplan

Independent Study Project (ISP) Collection

In 1998, South Africa passed historic legislation that bridged international conventions on refugees and asylum seekers with the protections and rights defined in the South African Constitution and Bill of Rights. The 1998 refugees act defined specific rights that refugees and asylum seekers are entitled in South Africa, the most important of which include the provision of legal and immigration documentation, employment, adequate housing, and health and social services. When asylum seekers arrive in Durban, many are in the need of immediate health services as a result of long journeys, pre-existing conditions, pregnancy, or illnesses contracted in refugee camps throughout …

The Barzakh Of Flamenco: Tracing The Spirituality, Locality And Musicality Of Flamenco From South Of The Strait Of Gibraltar, Tania Flores Oct 2011

The Barzakh Of Flamenco: Tracing The Spirituality, Locality And Musicality Of Flamenco From South Of The Strait Of Gibraltar, Tania Flores

Independent Study Project (ISP) Collection

Flamenco performance – which scholars often describe in terms of the three dimensions of cante, or singing, baile, or dance, and toque, or instrumentation – is a complex synthesis of cultural influences across several centuries. In discussing the evolution of flamenco, scholars typically begin with the history of the gitanos, the subgroup of the Romani or Gypsy people that settled in Spain. Drawing upon a large body of ethnographic, historic and scientific evidence, scholars agree that the gitanos originated in the northwestern regions of contemporary India and

Pakistan – specifically, Rajasthan and the Punjab region (Iovita 275; …

Tattered: Why The Tibetan Carpet Industry Of Nepal Is Declining, And How To Mend It, Dustin Becker Oct 2011

Tattered: Why The Tibetan Carpet Industry Of Nepal Is Declining, And How To Mend It, Dustin Becker

Independent Study Project (ISP) Collection

The Tibetan carpet industry of Nepal, once one of the country's leading exports, is quickly becoming unprofitable and uncompetitive compared to regional competitors. This is a trend that started over a decade ago, but requires renewed focus due to current alarming trends. My objective was to uncover why carpet manufacturers in Nepal are suffering from a decline in sales, and what separates the manufacturers who are still in business from those who are not. I stayed in the community of Boudha, where most of the carpet business owners live or work, and conducted interviews and electronic written correspondences with several …

Nato And The Arab Spring, Isabelle François Oct 2011

Nato And The Arab Spring, Isabelle François

Transatlantic Currents

The public debate that surrounded the North Atlantic Treaty Organization (NATO)–led operation in Libya gave an impression of an Alliance in trouble. There is, however, a good story to tell. The United States, as the host of the May 2012 NATO Summit in Chicago, may wish to present the case for a new type of operation and call for a strategy review on Libya in order to develop a balanced approach to Allies’ possible contributions to stability in North Africa and the Gulf region.

Human Rights Legislation In The Arab World: The Case Of Human Trafficking, Mohamed Y. Mattar Oct 2011

Human Rights Legislation In The Arab World: The Case Of Human Trafficking, Mohamed Y. Mattar

Michigan Journal of International Law

In the Arab World, human rights legislation has not always enhanced human rights. In fact, many national laws have been adopted that restrict human rights. Some countries' laws regulating nongovernmental organizations (NGOs) do not allow NGOs to receive funding from foreign entities. Media laws impose various limitations on the press. Jordan is the only Arab nation to enforce a comprehensive law on combating violence against women. Jordan is also the only country that has a law on access to information. Despite these gaps in human rights legislation, many Arab countries have passed comprehensive laws to combat human trafficking since the …

Mission Center Of Hope Bylaws, Maria Belen Gonzalez Sutil, Mikhaela Payden-Travers, Shane Engel

Governance

In creating the bylaws for the Mission Center of HOPE, our team strove to create a document that would not only reflect the nonprofit best practices and ensure compliance with CA law, but that would also provide clear guidance on structure, policies, and procedures. We also worked closely with the organization to ensure that the newly formed board could follow the policies and procedures set forth in the bylaws.

Communications Networks, Movements And The Neoliberal City: The Media Mobilizing Project In Philadelphia, Dan Berger, Peter N. Funke, Todd Wolfson Oct 2011

Communications Networks, Movements And The Neoliberal City: The Media Mobilizing Project In Philadelphia, Dan Berger, Peter N. Funke, Todd Wolfson

Government and International Affairs Faculty Publications

Using the Philadelphia-based organization Media Mobilizing Project as a case study, this article argues for a more sophisticated understanding of social movement networks. We argue that the fragmentation of the neoliberal city has increased the saliency of networked-based organizing. Contrary to much of the existing scholarly literature, however, we argue that such networks combine horizontal and vertical forms of organization, as well as online and offline media. Networks are not purely horizontal, nor are new media necessarily the best or most natural apparatus for developing networked social movements. Instead, we argue, radio and video may be better suited to connecting …

Accounting For Anticipation Effects: An Application To Medical Malpractice Tort Reform, Anup Malani, Julian Reif Oct 2011

Accounting For Anticipation Effects: An Application To Medical Malpractice Tort Reform, Anup Malani, Julian Reif

Coase-Sandor Institute for Law & Economics Research Paper Series

While conducting empirical work, researchers sometimes observe changes in outcomes before adoption of a new treatment program. The conventional diagnosis is that treatment is endogenous. Observing changes in outcomes prior to treatment is also consistent, however, with anticipation effects. This paper provides a framework for comparing the different methods for estimating anticipation effects and proposes a new set of instrumental variables that can address the problem that subjects' expectations are unobservable. The paper uses this framework to analyze the effect of tort reform on physician supply and finds that accounting for anticipation effects doubles the estimated effect of tort reform.

George C Marshall: An Enduring Model Of Leadership Effectiveness, Jack Clarcq, Richard Demartino, Michael E. Palanski Oct 2011

George C Marshall: An Enduring Model Of Leadership Effectiveness, Jack Clarcq, Richard Demartino, Michael E. Palanski

Articles

General George C. Marshall is universally recognized as a paragon of leadership. Marshall’s effectiveness as the leader of the U.S. Army during World War II, the State Department during the early post-war era, and the Defense Department during the Korean War are well known and documented. As a result of his many accomplishments, a number of researchers and historians have explored traits and factors that underlie Marshall’s success. While many of these efforts provide insight into Marshall’s leadership style, none employ original data (interviews) specifically focused on leadership, management, and character. This paper is based on interviews conducted in 1998 …

Ec2lab: Saas Using Amazon Elastic Cloud Compute, Manisha Gaikwad Oct 2011

Ec2lab: Saas Using Amazon Elastic Cloud Compute, Manisha Gaikwad

Master's Projects

The cloud computing is gaining popularity as it provides an infinite pool of hardware and software resources on demand. The Infrastructure-as-a-Service (IaaS) layer provides the physical resources, and relieves the users from the tedious as well as time consuming task of procuring and setting the server as well as the storage. This project harnesses the capability of the Amazon IaaS layer. The Software-as-a-Service (SaaS) application which is built on top of Amazon IaaS layer, helps the users to easily handle and connect with Amazon's Elastic Cloud Compute (EC2) instances.
