A Better Beginning: Family Law In The First Year Of Law School, Wanda M. Temm Jan 2011

A Better Beginning: Family Law In The First Year Of Law School, Wanda M. Temm

Faculty Works

The American Bar Association’s Section of Legal Education and Admission to the Bar’s Standards Review Committee has focused law schools’ efforts to modify their curriculum with an appeal to focus on outcomes and assessments. A cornerstone of the outcomes and assessments discussion is skills training. The committee’s call for more skills training has prompted family law faculty to consider innovative methods to bring that training into substantive courses or to bring the substantive curriculum into a skills course. This essay discusses how law faculty are incorporating family law doctrines into first-year legal research and writing courses.

Will Gene Patents Impede While Genome Sequencing?: Deconstructing The Myth That 20% Of The Human Genome Is Patented, Christopher M. Holman Jan 2011

Will Gene Patents Impede While Genome Sequencing?: Deconstructing The Myth That 20% Of The Human Genome Is Patented, Christopher M. Holman

Faculty Works

A 2005 Science article by Jensen and Murray is widely cited for the proposition that 20% of human genes are patented, and has led to a pervasive assumption that thousands of human genes cannot be used, studied or even 'looked at' by researchers and healthcare providers without infringing a gene patent. Many have voiced concern that this perceived thicket of gene patents will impede the implementation of next-generation genetic technologies, particularly personal whole genome sequencing (WGS). In fact, Jensen and Murray only showed that, with respect to 20% of human genes known at the time they conducted their study, either …

Novel Neutrality Claims Against Internet Platforms: A Reasonable Framework For Initial Scrutiny , Jeffrey Jarosch Jan 2011

Novel Neutrality Claims Against Internet Platforms: A Reasonable Framework For Initial Scrutiny , Jeffrey Jarosch

Cleveland State Law Review

This Article examines a recent trend in which the Federal Trade Commission and other enforcement agencies investigate Internet platforms for behavior that is insufficiently “neutral” towards users or third parties that interact with the platform. For example, Google faces a formal FTC investigation based on allegations that it has tinkered with search results rather than presenting users with a “neutral” result. Twitter faces a formal investigation after the social media service restricted the ways in which third party developers could interact with Twitter through its application programming interface (“API”). These investigations represent a new attempt to shift the network neutrality …

Forensic Analysis Of The Android File System Yaffs2, Darren Quick, Mohammed Alzaabi Jan 2011

Forensic Analysis Of The Android File System Yaffs2, Darren Quick, Mohammed Alzaabi

Australian Digital Forensics Conference

The popularity of Android devices has resulted in a requirement for a process to extract and analyse data in a forensically sound manner. There is a wide range of devices which use the Android operating system, and hence a standard process for forensic extraction and analysis for all devices is not possible. Many devices use the Yet Another Flash File System (YAFFS), which introduces an additional layer of forensic requirements. Focussing on the internal storage of a Sony Ericsson Xperia x10i, a process to extract both logical and physical data from the internal NAND memory is possible after gaining super …

An Investigation Into Darknets And The Content Available Via Anonymous Peer-To-Peer File Sharing, Symon Aked Jan 2011

An Investigation Into Darknets And The Content Available Via Anonymous Peer-To-Peer File Sharing, Symon Aked

Australian Information Security Management Conference

Media sites, both technical and non-technical, make references to Darknets as havens for clandestine file sharing. They are often given an aura of mystique; where content of any type is just a mouse click away. However, can Darknets really be easily accessed, and do they provide access to material that would otherwise be difficult to obtain? This paper investigates which Darknets are easily discovered, the technical designs and methods used to hide content on the networks, the tools needed to join, and ultimately what type and quantities of files can be found on anonymous peer-to-peer file sharing networks. This information …

From Backpacks To Blackberries: (Re)Examining New Jersey V. T.L.O. In The Age Of The Cell Phone, A. James Sprung

Emory Law Journal

When the U.S. Supreme Court decided New Jersey v. T.L.O., cellular phones had yet to emerge in American society and public schools. Contemplating a world of physical possessions and tangible objects, the T.L.O. Court determined that public school students may expect only a minimal amount of privacy in their backpacks, purses, and other belongings while at school. The Court used these diminished privacy expectations to establish a heavily reduced standard of Fourth Amendment protection against unreasonable searches conducted by teachers and administrators.

Campaign Speech Law With A Twist: When The Government Is The Speaker, Not The Regulator, Helen Norton

Emory Law Journal

Although government entities frequently engage in issue-related campaign speech on a variety of contested ballot and legislative measures, this fact has been entirely overlooked in contemporary First Amendment debates over campaign speech law specifically and government speech more generally.

In Defense Of Individual Tax Privacy, Joshua D. Blank Jan 2011

In Defense Of Individual Tax Privacy, Joshua D. Blank

Emory Law Journal

The debate over whether tax privacy--a set of statutory rules that prohibits the federal government from publicly releasing any taxpayer's tax return--promotes individual tax compliance is as old as the income tax itself. It dates back to the Civil War and resurfaces often, especially when the government seeks innovative ways to collect tax revenue more effectively.

Expression And Detection Of The Fmdv Vp1 Transgene And Expressed Structural Protein In Arabidopsis Thaliana, Li Pan, Yongguang Zhang, Yonglu Wang, Jianliang Lv, Peng Zhou, Zhongwang Zhang, Yuzhen Fang, Shoutian Jiang

Turkish Journal of Veterinary & Animal Sciences

To explore the feasibility of developing a new type of plantderived foot-and-mouth disease virus (FMDV) oral vaccine, the plant seed-specific expression vector p7SBin438/VP1 carrying the VP1 gene of the FMDV strain O/China/99 was constructed and transformed into Agrobacterium tumefaciens strain GV3101. This strain was used for transformation of Arabidopsis thaliana via the floral-dip method. The kanamycin-resistant transgenic plants were selected, and the VP1 gene and protein expressions were confirmed by PCR and sandwich-ELISA, respectively. The ELISA positive plants were further confirmed by Western blot assay, and the VP1 gene in the transgenic progeny was confirmed by PCR. The results showed …

Infectious Pancreatic Necrosis In A Recirculating Rainbow Trout (Oncorhynchus Mykiss) Culture System, Nasrollah Ahmadi, Mostafa Akhlaghi, Ahmad Oryan, Arsalan Hosseini

Turkish Journal of Veterinary & Animal Sciences

During October 2009, a suspected outbreak of infectious pancreatic necrosis, with typical signs and high mortality, was observed in cultured rainbow trout (Oncorhynchus mykiss) fry (mean weight of 9 g) in a recirculating system in Fars Province, Iran. Tissue samples, including pyloric caeca as well as pancreatic tissues, liver, kidney, and spleen, were aseptically collected from 20 affected moribund fish for histopathological and molecular assays. Histopathologically, the exocrine pancreatic acinar cells exhibited the most notable pathology, including focal to extensive degeneration and coagulative necrosis with mononuclear inflammatory infiltrates. To confirm the diagnosis of clinical infectious pancreatic necrosis (IPN), a reverse …

Finding A Home For Orphans: Google Book Search And Orphan Works Law In The United States And Europe, Katharina De La Durantaye Jan 2011

Finding A Home For Orphans: Google Book Search And Orphan Works Law In The United States And Europe, Katharina De La Durantaye

Fordham Intellectual Property, Media and Entertainment Law Journal

The Google Books case and its proposed settlement have provoked heated debate. Objections to the settlement proposals have come from virtually all sides—from Google’s competitors to public interest organizations, state attorneys general, the U.S. Department of Justice, and even foreign countries such as France and Germany. While it is impossible to know what the terms of the final settlement will be, it is already clear that one of the settlement’s most important consequences will be how it changes the orphan works debate, both in the United States and in Europe. This Article argues that the Google Books case offers an …

Millennials And The Adoption Of New Technologies In Libraries Through The Diffusion Of Innovations Process, Heidi Blackburn

Criss Library Faculty Publications

Purpose – Literature on the features of new technology in libraries of every type and size is readily available, but looking at the factors playing a part in the process (relative advantage, compatibility, complexity, trialability and observability) will bring an understanding of how Millennials integrate technology into libraries. This paper seeks to discuss some of the issues involved.

Design/methodology/approach – This research focuses on Millennials and their adoption of new technologies in libraries through the process of diffusion and the stages of adoption as outlined by Everett Rogers: communication through certain channels; over time; and among members of a social …
