Enforcement Of Law Schools' Non-Academic Honor Codes: A Necessary Step Towards Professionalism?, Nicola A. Boothe-Perry

Journal Publications

As law schools strive to enforce their codes of student conduct, enforcement has called into question the legal standing of the schools, since enforcement affects the fundamental rights of students. Consequently, this Article will address the following question: to what extent can law schools fulfill their responsibility and opportunity to enforce behavioral codes-specifically codes governing non-academic conduct-with a goal of improving professionalism? Through analysis of law schools' enforcement capabilities, this Article will suggest a practical framework by which law schools can promulgate and enforce codes and rules affecting students' non-academic conduct.

Don't See, Don't Speak A Collection Of Short Stories, Jaroslav Kalfar Jan 2011

Don't See, Don't Speak A Collection Of Short Stories, Jaroslav Kalfar

HIM 1990-2015

This short story collection follows diverse characters as they long to find their place in the chaos of modern world. As the trend of postmodern literature traces our failure to understand our lives and discover a larger context, we find that our reality is ever-changing and there is not a single constant to follow. We are disappointed by modern political systems, our lovers, and our own individual capabilities. The issue of belonging means finding a place that, both physically and mentally, provides context and meaning for our existence. The five short stories presented here examine social issues, such as immigration, …

Man Vs Beast The Human-Animal Boundary In J.K. Rowling's Harry Potter Series, Jessica Auz Jan 2011

Man Vs Beast The Human-Animal Boundary In J.K. Rowling's Harry Potter Series, Jessica Auz

HIM 1990-2015

In her series of seven novels, Rowling constructs a society and a framework of characterization that allows her to explore the human-animal boundary in a variety of ways. She connects her novels to the ideology of the classical and medieval periods while still acknowledging the ways that the relationship between humans and animals has changed over the years by showcasing the influence of modern popular culture on her characterization of the human-animal boundary. Through her descriptions of werewolves, Patronuses, Animagi, and Harry Potter's and Lord Voldemort's abilities to speak Parseltongue, Rowling uses classical, medieval, and modern animal symbolism to showcase …

Legislative Reform Of California’S Direct Democracy: A Field Guide To Recent Efforts, Glenn C. Smith Jan 2011

Legislative Reform Of California’S Direct Democracy: A Field Guide To Recent Efforts, Glenn C. Smith

Faculty Scholarship

This Article seeks to enhance the ability of California-initiative process reformers to gain wisdom from the past by briefly, yet comprehensively, reviewing recent proposals considered in the California legislature. Specifically, this "field guide" to initiative reform seeks to orient interested travelers to relevant California legislative exertions from 1997 to the present.' Although our orientation is informed by the entire range of legislative proposals within the dataset, we give special focus to bills proposing to enhance initiative-process deliberation-the ability of voters to understand and meaningfully deliberate about initiative proposals. We also concentrate on two categories of initiative-reform legislation during the period: …

An Emerging Norm - Determining The Meaning And Legal Status Of The Responsibility To Protect, Jonah Eaton Jan 2011

An Emerging Norm - Determining The Meaning And Legal Status Of The Responsibility To Protect, Jonah Eaton

Michigan Journal of International Law

The responsibility to protect, from its recent nativity in the 2001 report of the International Commission on Intervention and State Sovereignty (ICISS), is the latest round in an old debate pitting the principle of nonintervention in the internal affairs of states against allowing such intervention to prevent gross and systematic violations of human rights. Advocates for the concept see it as an important new commitment by the international community, injecting new meaning into the tragically threadbare promise to never again allow mass atrocities to occur unchallenged. ICISS offered the concept of responsibility to protect as a new way to confront …

Dow Chemical Vs. ‘Coercive Utopians’: Constructing The Contested Ground Of Science And Government Regulation In 1970s America, Amy M. Hay Jan 2011

Dow Chemical Vs. ‘Coercive Utopians’: Constructing The Contested Ground Of Science And Government Regulation In 1970s America, Amy M. Hay

History Faculty Publications

In 1979, the Dow Chemical Company published an excerpt from a speech by H. Peter Metzger that announced an emerging conflict in American ideals and public policy. He stated that a new kind of individual inhabited Washington, people from the counterculture who were “coercive utopians” because they sought to achieve their agenda through covert actions and hoped to end the American free market economy. Following the 1962 publication of Rachel Carson’s Silent Spring and the subsequent banning of DDT in 1972, Dow and other chemical manufacturers fought to keep the regulatory climate favorable to industry. Dow found itself defending the …

A Riverbank Filtration Demonstration Project On The Kali River, Dandeli, Karnataka, India, Pamela Cady Jan 2011

A Riverbank Filtration Demonstration Project On The Kali River, Dandeli, Karnataka, India, Pamela Cady

Open Access Master's Theses

A small scale RBF system was installed in a village near the Kali River in the state of Karnataka to evaluate the performance of riverbank filtration (RBF) under the hydrogeological and climatological conditions of southern India. A series of hydraulic and tracer tests were carried out along with periodic biological and geochemical monitoring of various water sources in the study area.

Hydrogen and oxygen isotopes highlight the impact of evaporation and irrigation at nearby rice paddies on the RBF production well. Dissolved silica data used to determine the relative contributions of surface and groundwater indicate that this RBF system derives …

Characterization Of Hollow Particulate And Graded Composites Using Ultrasonic Technique, Bhaskar Ale Jan 2011

Characterization Of Hollow Particulate And Graded Composites Using Ultrasonic Technique, Bhaskar Ale

Open Access Master's Theses

An experimental study has been conducted to characterize hollow particulate composites (syntactic foams) using ultrasonic pulse echo techniques. Materials tested for this study consisted of low viscosity epoxy matrix with embeded soda-lime-borosilicate glass micro-balloons of different volume fractions. Three sizes of microballoons ranging from 30-65 microns were tested. Measurements of longitudinal and shear wave speed and attenuation of ultrasonic wave in syntactic foams were taken. These wave speed values were further utilized to calculate the various moduli of the material. After understanding the behavior of syntactic foams for low volume fractions, functionally graded materials (FGM) with linear variation of increasing …

Journal of the Arkansas Academy of Science

During September 2008 through June 2011, we compiled a biological inventory of Meacham Cave in Independence County, AR. Compared to other caves in the region, Meacham Cave houses few vertebrates, but non-aquatic invertebrates were relatively common. A transiently-increased bacterial load in the cave’s only pool of water indicated recent fecal contamination. The combination of vandalism, low vertebrate populations, and high coliform bacterial load reveals that human abuse of the cave has significantly disrupted its ecosystem. Gating the cave in such a way as to allow the movement of bats, salamanders and other animals, while excluding humans, may allow the cave …

Investigating The Role Of Nrg1p And Tup1p During Candida Albicans Chlamydospore Formation, Shannon M. Williams Jan 2011

Investigating The Role Of Nrg1p And Tup1p During Candida Albicans Chlamydospore Formation, Shannon M. Williams

McNair Scholars Journal

Candidiasis represents the fourth most frequent nosocomial infection both in the US and worldwide. C. albicans is the most common cause of candidiasis which has unacceptably high morbidity and mortality rates and important economic repercussions (estimated total direct cost of approximately 2 billion dollars in 1998 in US hospitals alone). The pathogenic potential of C. albicans is intimately related to certain key processes including biofilm formation and filamentation. C. albicans can grow as yeast cells, pseudohyphae or hyphae and produce chlamydospores with its form being dictated by its surrounding conditions. The ability to form hyphal cells has been fundamentally linked …

E-Textbooks Are Coming: Are We Ready?, Meg C. Murray, Jorge Pérez Jan 2011

E-Textbooks Are Coming: Are We Ready?, Meg C. Murray, Jorge Pérez

Faculty Articles

Textbook options are expanding and the electronic text is poised to become prevalent in the college classroom. Cost pressures are driving this trend even as the academic value of e-textbooks has yet to be established. Limited research is available that examines the effectiveness of the e-textbook as a learning tool. This paper presents the results of a study that compares student performance in two sections of an online course, one using an e-textbook and the other using a paper-based text. No significant difference in student performance was found. However, until e-textbook format and features are standardized and business models generate …

Athletic Academic Reform: Does The Level Of Spending On Academic Services By Athletic Departments Affect The Academic Progress Rates Of Revenue Sports?, James W. Batley

MPA/MPP/MPFM Capstone Projects

This study examines the relationship between the level of spending on academic services per student-athlete for 22 athletic departments within the Division I structure and the recently established performance measure outlined in the National Collegiate Athletic Association (NCAA) Division I Academic Reform: the Academic Progress Rate (APR).

The importance placed on student-athletes to learn, develop, and maintain academic eligibility has led to the implementation of a number of academic tutorial and support programs provided by college and university athletic departments. This analysis investigates the relationship between the level of spending on student-athlete academic services and student-athlete academic performance for two …

Should Pseudoephedrine (Pse) Be Moved From Behind The Counter To Prescription-Only? An Analysis Of Pse As An Otc Medication And A Precursor For Methamphetamine Production, Jerry Dillon Jan 2011

Should Pseudoephedrine (Pse) Be Moved From Behind The Counter To Prescription-Only? An Analysis Of Pse As An Otc Medication And A Precursor For Methamphetamine Production, Jerry Dillon

MPA/MPP/MPFM Capstone Projects

Kentucky State Senator Tom Jensen recently sponsored Senate Bill 45, which would change pseudoephedrine (PSE) from an over-the-counter to a schedule V prescription-only drug. The bill failed, but the debate continues as to whether Kentucky should make PSE, a precursor required to manufacture illicit methamphetamine, a controlled drug that is available by prescription only.

Methamphetamine abuse has been increasing in Kentucky as well as in the rest of the country, despite efforts to control the sale of PSE through federal and state legislation. The Combat Methamphetamine Epidemic Act (CMEA) of 2006 and Kentucky’s initiative to electronically monitor the sales of …

Socially Responsible Investing: A Comparative Analysis For The Bluegrass Community Foundation, Andrew Hedrick Jan 2011

Socially Responsible Investing: A Comparative Analysis For The Bluegrass Community Foundation, Andrew Hedrick

MPA/MPP/MPFM Capstone Projects

In the fall of 2010 the Blue Grass Community Foundation began considering whether an updated investment strategy that included Socially Responsible Investing would be advantageous and in line with the mission of the organization. The question was raised whether this type of investing meant that the return on investment from securities currently held in the Foundation’s portfolio had to be sacrificed in order to incorporate this type of investment philosophy into the existing criteria used to invest the organization’s assets.

This paper examines literature relevant to the topic and conducts an analysis of a sample of mutual funds currently available …
