Engaged Client-Centered Representation And The Moral Foundations Of The Lawyer-Client Relationship, Kate Kruse Jan 2011

Engaged Client-Centered Representation And The Moral Foundations Of The Lawyer-Client Relationship, Kate Kruse

Faculty Scholarship

The field of legal ethics, as we know it today, has grown out of thoughtful, systematic grounding of lawyers’ duties in a comprehensive understanding of lawyers’ roles and the situating of lawyers’ roles in underlying theories of law, morality and justice. Unfortunately, the field of theoretical legal ethics has mostly lost track of the thing at the heart of a lawyers’ role: the integrity of the lawyer-client relationship. The field of theoretical legal ethics has developed in ways that are deeply lawyer-centered rather than fundamentally client-centered. This paper, which was delivered at Hofstra Law School as the Lichtenstein Distinguished Professor …

Belief Revision In The Context Of Reading Comprehension, Erinn K. Walsh Jan 2011

Belief Revision In The Context Of Reading Comprehension, Erinn K. Walsh

Master's Theses and Capstones

The goal of the present experiments was to explore the underlying cognitive processes that support individual belief revision. In three experiments the amount of relevant information pertaining to a misconception was systematically manipulated to assess the impact of text refuting a misconception and text explaining the correct information. Experiment I assessed the impact of the refutation. Experiment II assessed the joint impact of the refutation and the explanation. Finally, Experiment III assessed the impact of the explanation. Experiment I demonstrated that providing a refutation section that explicitly negated the misconception was sufficient to eliminate disruption when reading a sentence that …

Islamic Perspectives On The Crusades: Past And Present, Robert Noel Duprez Jr. Jan 2011

Islamic Perspectives On The Crusades: Past And Present, Robert Noel Duprez Jr.

Master's Theses and Capstones

It is important that scholars use a variety of researching methods when analyzing the effect of the Crusades, how they affected Islamic perspectives of the West during the period 1095--1291, and their imprint on today's world. Western scholars with a Euro-centric point of view have accomplished the overwhelming amount of research on the Crusades. It is not until the last decade that Islamic scholars have taken an interest in the Crusades, and their affect on the Muslim world.

This study came to the following conclusions: 1) Scholarship on the Crusades has mainly represented a Euro-centric viewpoint, 2) Contemporary Muslim scholarship …

Male Vs. Female Emotional Expression In Text Messaging, Stephanie Gruner

Undergraduate Honors Theses

This study focused on gender differences in emotional expression in text messaging. It sought to discover whether men or women use more emotionally expressive tools and words in texts and whether the gender of the person receiving the message affects a person’s emotional expression when creating text messages. Fifty female and fifty male college students completed a two-part study in which they created text messages displaying particular emotions according to given scenarios. The participants were instructed to create each message as if they were texting a member of the same sex, and then a member of the opposite sex. A …

The Power Of Culture In Diplomacy: The Case Of U.S. Cultural Diplomacy In France And Germany, Sofia Kitsou Jan 2011

The Power Of Culture In Diplomacy: The Case Of U.S. Cultural Diplomacy In France And Germany, Sofia Kitsou

Exchange: The Journal of Public Diplomacy

Cultural diplomacy represents a facet of diplomacy that has not been utilized completely in building better diplomatic relations and, although it could serve as a linking bridge toward better relations, it has been underestimated, if not neglected. Foreign positive perceptions of the United States declined considerably especially during the George W. Bush administration, as a result of various actions taken by the United States in the international arena that were unpopular. Anti-Americanism reached its peak in Europe because of the unilateral decision to proceed with the war in Iraq while the transatlantic rift between traditional partners such as the United …

School-Home Performance Feedback With Home-Based Writing Activities: The Effects On Elementary Students’ Writing Fluency, Jennifer Lynn Rymanowski Jan 2011

School-Home Performance Feedback With Home-Based Writing Activities: The Effects On Elementary Students’ Writing Fluency, Jennifer Lynn Rymanowski

Psychology - Dissertations

Parent involvement in education has been identified as influential in children's learning and associated with positive outcomes on students' academic and behavioral competency (Christenson, 2004; Doherty & Peskay, 1992; Henderson, 2007). Studies have suggested that parents and teachers prefer programs that utilize school-home feedback notes and provide parents with strategies for implementing educational activities at home (Gettinger & Guetschow, 1998). The current study examined the effects of combining school-home performance feedback with home-based writing activities on students' writing fluency in comparison to students who participated in a performance feedback intervention. A total of 101 third-grade students were randomly assigned to …

2010 Naps Presidential Address: "Fleeing The Kingdom": Augustin's Queer Theology Of Marriage, Virginia Burrus Jan 2011

2010 Naps Presidential Address: "Fleeing The Kingdom": Augustin's Queer Theology Of Marriage, Virginia Burrus

Religion - All Scholarship

Might attending to the texture of bodies in Augustine’s theology of marriage open up new interpretive possibilities? Eve Kosofky Sedgwick and Patricia Cox Miller give theoretical cues, Danuta Shanzer philological ones, for a dialogical reading of On the Good of Marriage and Confessions that seeks to defamiliarize, complicate, and broaden—in several senses, to queer—traditional interpretations of Augustinian marital theology. Shame and vulnerability, fear and desire, pain and pleasure, are all surfaced, as Augustine depicts marital figures that are shot through with ambivalence—open and torn, cut and bleeding, both cleaving to one another and ripped apart. Ultimately, he attempts to …

Leading The Multiethnic Church: Help From New Metaphors And The Leadership Challenge, Elizabeth Childs Drury Jan 2011

Leading The Multiethnic Church: Help From New Metaphors And The Leadership Challenge, Elizabeth Childs Drury

Great Commission Research Journal

Success in leading the multiethnic church (MEC) eludes assessment because of the variety of congregational configurations and the unique intercultural environment. This article describes how leadership in one MEC harmonizes with and differs from basic cultural standards as expressed in James Kouzes and Barry Posner’s The Leadership Challenge. It follows an earlier case study (published in the Summer 2010 issue) about weaknesses that emerged at a DC-area MEC when Dan, the beloved pastor, resigned. Three new categories describe designs: the mall, the cinema, and the blend. Six new metaphors describe relationships among different cultural groups: renters, investors, neighbors, coworkers, siblings, …

Exploration, Language And Application: An Approach To Teaching Beginning Instrumental Jazz Improvisation, Jeremy Todd Pownall Jan 2011

Exploration, Language And Application: An Approach To Teaching Beginning Instrumental Jazz Improvisation, Jeremy Todd Pownall

Theses and Dissertations

The purpose of this study was to provide preservice and inservice teachers with an alternative approach to teaching beginning jazz improvisation to instrumentalists in a classroom setting. It was determined that there exists a need for an accessible (to both teacher and student) method for teaching beginning jazz improvisation to instrumentalists. This is due to the lack of emphasis on jazz improvisation at both the public school and university level, as well as the inclusion of improvisation in both the national and Georgia state standards for music performance. The teaching method presented in this study is based on previous research, …

Constructing The Christian: Agency And Emulation In Old English Poetry, Jennifer Ross Jan 2011

Constructing The Christian: Agency And Emulation In Old English Poetry, Jennifer Ross

Theses and Dissertations

Old English religious verse - born out of a productive fusion between pre-existing Germanic ideals and Christian value-systems brought to England at the end of the sixth century - grapples energetically with the question of how people ought to live morally upright lives pleasing to God. In Beowulf, Judith, Juliana, and The Dream of the Rood, a model for the believer/God relationship is constructed from a common pattern of the Germanic thane/lord relationship, but, like garments cut from the same cloth by different tailors, each poem crafts its subject differently. Still, each is constructed around a …

The Supreme Court's Love-Hate Relationship With Miranda, Kit Kinports Jan 2011

The Supreme Court's Love-Hate Relationship With Miranda, Kit Kinports

Faculty Scholarship

In recent years, the Supreme Court has enjoyed a love-hate relationship with its landmark decision in Miranda v. Arizona. While the Court has not hesitated to narrow Miranda’s reach, it has also been wary of deliberate efforts to circumvent it. This pragmatic approach to Miranda can be doctrinally unsatisfying and even incoherent at times, but it basically maintains the core structure of Miranda as the police have come to know and adapt to it.

Last Term provided the first glimpse of the Roberts Court’s views on Miranda, as the Court considered three Miranda cases: Maryland v. Shatzer …

Patenting Genes And Genetic Methods: What’S At Stake?, Eileen M. Kane Jan 2011

Patenting Genes And Genetic Methods: What’S At Stake?, Eileen M. Kane

Faculty Scholarship

The emergence of genetic medicine following decades of molecular biology research has been accompanied by the procurement of patent rights to many medically significant genes and methods for their use. The intellectual force of reductionism in the life sciences – to explain biological phenomena with molecular precision – generates direct conflicts with patent law’s exclusion of basic knowledge from patenting: laws of nature, natural phenomena, and abstract ideas must remain in the public domain. This is a period of renewed attention to the issue of patentable subject matter in the life sciences, with a particular focus on genetic patenting. Patents …

Examining The Reality Of Foreign National Child Victims Of Human Trafficking In The United States, Bridgette A. Carr Jan 2011

Examining The Reality Of Foreign National Child Victims Of Human Trafficking In The United States, Bridgette A. Carr

Articles

Human traffickers prey on the vulnerabilities of other people. Poverty, lack of education, and language barriers are keys that human traffickers use to successfully exploit others. For foreign national children who have been trafficked in the United States, these same vulnerabilities are often ignored by the immigration system. From its inception, the Trafficking Victims Protection Act (TVPA) has been touted as a tool to combat grave human rights violations that affect children. In fact, the TVPA's legislative history is rife with stories, statistics, and anecdotes involving children-often young girls. The TVPA has always recognized the failure of a one-size-fits-all approach …

Exploring The Principal's Role In High Poverty Schools With High Literacy Achievement, Jill E. Jay

All-Inclusive List of Electronic Theses and Dissertations

The purpose of this qualitative study was to exploreEducational aspects which help explain high early-literacy acquisition in high-poverty elementary schools. Through this qualitative study, the perceptions of key staff members, including the principal, in four high achieving, high-poverty schools were explored in three areas: 1) contributing aspects of high-level, early-literacy achievement in their particular school setting; 2) role of the principal in a high-poverty school that attains a high level of early-literacy achievement; and 3) how high early-literacy achievement occurred in their particular school setting. The schools in the study were located in multiple states that the researcher had access …

Understanding Non-Native English-Speaking Teachers' Identity Construction And Transformation In The English-Speaking Community: A Closer Look At Past, Present, And Future, Shu-Chun Tseng Jan 2011

Understanding Non-Native English-Speaking Teachers' Identity Construction And Transformation In The English-Speaking Community: A Closer Look At Past, Present, And Future, Shu-Chun Tseng

All-Inclusive List of Electronic Theses and Dissertations

Building on Kachru‟s (2005) diagram of World Englishes and Norton‟s (2000) theoretical conception of identity, the researcher acknowledges that each Non-Native English Speaking Teacher (NNEST) comes to the English-speaking community with a different variety of Englishes. Each believes in various cultural values and norms, and his or her identity is an ongoing process that can be impacted when he or she is immersed in different contexts. Using a qualitative approach, this study examined the way NNESTs construct their self-perceptions of English Language Teaching (ELT) professionalism based on social and educational experiences in their countries. In addition, the study examined how …

Selecting Ell Textbooks: A Content Analysis Of Language-Teaching Models, Jeffrey Labelle Jan 2011

Selecting Ell Textbooks: A Content Analysis Of Language-Teaching Models, Jeffrey Labelle

College of Education Faculty Research and Publications

Many middle school teachers lack adequate criteria to critically select materials that represent a variety of L2 teaching models. This study analyzes the illustrated and written content of 33 ELL textbooks to determine the range of L2 teaching models represented. The researchers asked to what extent do middle school ELL texts depict frequency and variation of language-teaching models in illustrations and written texts. Using content analysis, they measured the range of depiction of the 4 language-teaching models and concluded that 4 of the 33 textbooks had considerable to extensive frequency and variation of L2 teaching models

The Veil Of Esteem: On Seeing Oneself Being Seen (Part Two: Riddle And Accident), Melba Vélez Ortiz Jan 2011

The Veil Of Esteem: On Seeing Oneself Being Seen (Part Two: Riddle And Accident), Melba Vélez Ortiz

Peer Reviewed Articles

This article is the second of a three-part series entitled: The Veil of Esteem: On Seeing Oneself Being Seen. Inspired by Walter Benjamin’s “reflection through vignette” method, the author inquires into the notions and interconnections between memory and esteem. Esteem is the truth of oneself through the eyes of the other, and any truth of esteem must be told from the perspective of that other, through the spectating other. Thus, the author finds that any story of esteem is veiled. This second part, Riddle and Accident, explores unconditional love as maintained without the merit-worthy, yet it is its esteem that …

Object Associations Of Early-Learned Light And Heavy English Verbs, Josita Maouene, Aarre Laakso, Linda B. Smith Jan 2011

Object Associations Of Early-Learned Light And Heavy English Verbs, Josita Maouene, Aarre Laakso, Linda B. Smith

Peer Reviewed Articles

Many of the verbs that young children learn early have been characterized as ‘light.’ However, there is no agreed upon definition of ‘lightness’ and no usable metric that could be applied to a wide array of verbs. This article provides evidence for one metric by which the ‘lightness’ of early-learned verbs might be measured: the number of objects with which they are associated (in adult judgment) or co-occur (in speech to and by children). The results suggest that early-learned light verbs and heavy verbs differ in the breadth of the objects they are associated with: light verbs have weak associations …

Sprucing Up Patent Law, David Vaver Jan 2011

Sprucing Up Patent Law, David Vaver

Articles & Book Chapters

This paper, commissioned for the now defunct UK Strategic Advisory Board for Intellectual Property, looks at some aspects of UK patent law and asks whether some of the activities it rewards deserve the protection they get. The argument is that patent law should more precisely match and reward the advance the inventor discloses, that patents should not be granted for activities that need no stimulus or are already adequately stimulated by other intellectual property laws, that specifications should disclose all the inventor knows about the invention to as wide an audience as possible, that only activities the patent holder and …

A Public Role For The Intentional Torts, Dan Priel Jan 2011

A Public Role For The Intentional Torts, Dan Priel

Articles & Book Chapters

The recent litigation that ended in the House of Lords’ decision in Ashley v. Chief Constable of Sussex Police has brought the intentional torts back to the focus of judicial attention. Most commentary on this decision has focused on a few dicta that purport to support a reading the decision as concerned with private vindication of rights. In this article I examine this decision against a broad shift that has been taking place within tort law, and in particular the tort of negligence, away from ‘private law’ concern with the particular individuals involved in the litigation and towards broader ‘public’ …

Cognitive-Behavioral Therapy For Immigrants Presenting With Social Anxiety Disorder: Two Case Studies, Brandon J. Weiss, J. Suzanne Singh, Debra Anne Hope Jan 2011

Cognitive-Behavioral Therapy For Immigrants Presenting With Social Anxiety Disorder: Two Case Studies, Brandon J. Weiss, J. Suzanne Singh, Debra Anne Hope

Department of Psychology: Faculty Publications

Cognitive-behavioral therapy (CBT) for the treatment of social anxiety disorder (SAD) has demonstrated efficacy in numerous randomized trials. However, few studies specifically examine the applicability of such treatment for ethnic minority clients. Thus, the purpose of this article is to present two case studies examining the utility of individualized CBT for SAD with two clients who immigrated to the United States, one from Central America and one from China, for whom English was not the primary language. Both clients demonstrated improvement on a semistructured interview and self-report measures. Necessary adaptations were modest, suggesting that therapy could be conducted in a …

Co-Creation Of Experiential Qualities, Vuk Uskoković Jan 2011

Co-Creation Of Experiential Qualities, Vuk Uskoković

Pharmacy Faculty Articles and Research

Cognitive sciences have been interminably in search for a consistent philosophical framework for the description of perceptual phenomena. Most of the frameworks in usage today fall in-between the extremes of constructivism and objective realism. However, whereas constructivist cognitive theories face difficulties when attempting to explain the experiential commonality of different cognitive entities, objectivistic theories fail in explaining the active role of the subject in the formation of experiences. This paper undertakes to compare and eventually combine these two major approaches to describing cognitive phenomena. It is argued that constructivist explanations inevitably refer to a ‘hidden’ ontological source of experience, and …
