Electronic Discovery- Sedona Canada Is Inadequate On Records Management - Here's Sedona Canada In Amended Form, Ken Chasse Jun 2011

Electronic Discovery- Sedona Canada Is Inadequate On Records Management - Here's Sedona Canada In Amended Form, Ken Chasse

Canadian Journal of Law and Technology

A paper record can exist without its records system; an electronic record cannot. To use, corrupt, or destroy a paper record, one needs physical access to the records system wherein it is stored. But to use, corrupt, or destroy an electronic record one merely needs electronic access to its records system, from anywhere. Therefore any set of rules or principles for controlling the use of electronic records for any purpose, including electronic discovery, should incorporate the established policies and practices of electronic records management.

As to cost, rules of electronic discovery are needed with which to punish par- ties with …

Legal Experiences Of Women Survivors Of Domestic Violence: A Need For Policies That Address The Justice Gap, Kimberly Ann Puhala Jun 2011

Legal Experiences Of Women Survivors Of Domestic Violence: A Need For Policies That Address The Justice Gap, Kimberly Ann Puhala

Graduate Doctoral Dissertations

The problems associated with the civil legal system for women who have experienced domestic violence have been persistent over time and still exist today. The current sociopolitical context in this state frames access to civil legal services either through a means-tested (and underfunded) program (Civil Legal Assistance) or as a privately purchased market service. This leaves a limited amount of low- or no-cost alternatives, which creates a gap in services for those women whose income is too high to qualify for Civil Legal Assistance programs, yet too low to afford to hire a private attorney. This study examines this two-tiered …

Bureau of Business Research Publications

The recent ―Great Recession‖ impacted all parts of the country and the economy. But, selected industries and regions were especially hard-hit, as is true in many recessions. In terms of regions, the western and mountain regions of the United States, the industrial Midwest and the state of Florida were impacted most. Among industries, the manufacturing industry was hard hit, as is typically the case during recession. For example, in the State of Nebraska, net jobs losses in the manufacturing industry accounted for 9,400 (33%) of the total 28,300 net job loss between December 2007 and December 2009. But, one unusual …

Cultivating Justice For The Working Poor: Clinical Representation Of Unemployment Claimants, Colleen F. Shanahan May 2011

Cultivating Justice For The Working Poor: Clinical Representation Of Unemployment Claimants, Colleen F. Shanahan

Georgetown Law Faculty Publications and Other Works

The combination of current economic conditions and recent changes in the United States’ welfare system makes representation of unemployment insurance claimants by clinic students a timely learning opportunity. While unemployment insurance claimants often share similarities with student attorneys, they are unable to access justice as easily as student attorneys, and as a result, face the risk of severe poverty. Clinical representation of unemployment claimants is a rich opportunity for students to experience making a difference for a client, and to understand the issues of poverty and justice that these clients experience along the way. These cases reveal that larger lessons …

CityLand - 2011

This issue of CityLand covers significant land use and zoning developments in New York City as of May 15, 2011. The City Council approved Harlem River Point, a mixed-income housing project in East Harlem, and advanced a large contextual rezoning for South Jamaica, Queens. The Council held its first oversight hearing on the City Charter’s “fair share” rules, examining the equitable distribution of municipal facilities. Separate rezonings were approved for Carroll Street in Brooklyn to support residential development. The Atlantic Avenue BID proposal moved forward, while a zoning text amendment was adopted to allow public and café seating in arcades …

Immigrant Non-Profit Organizations: How Do They Serve Their Constituencies?, Gustavo A. Amaya May 2011

Immigrant Non-Profit Organizations: How Do They Serve Their Constituencies?, Gustavo A. Amaya

Research Papers

Immigration has become one of the most important topics in the United States. According to the Census Bureau (2011), Hispanics are officially the largest minority group in the nation. This has a direct impact on new legislation and federal, state and local government decision making. The consequences of these actions directly influence the way public administrators do their job. To better understand the changes and its consequences, all these levels of government must understand the situation and all factors involved to the best of their capabilities. This research paper explores the services a group of Mexican immigrant non-profit organizations provide …

Fees, Incentives, And Deterrence: A Reply To Professor Fitzpatrick, Linda Sandstrom Simard May 2011

Fees, Incentives, And Deterrence: A Reply To Professor Fitzpatrick, Linda Sandstrom Simard

Suffolk University Law School Faculty Works

In his recent article, Protection of Investors in the Wake of the 2008-2009 Financial Crisis: Do Class Action Lawyers Make Too Little?, 158 U. Penn. L. Rev. 2043 (2010), Professor Brian Fitzpatrick asserts that "the optimal award of fees to class action lawyers in small-stakes actions is 100% of the judgment." The premise of Fitzpatrick’s proposal is that deterrence is the sole purpose of small-stakes class actions and an increase in fees will incentivize lawyers to file more small-stakes class actions which in turn will result in more class awards and more deterrence. This paper addresses two fundamental questions relating …
