International Contracts A Quantitative Analysis Of Transnational Contract Formation, David T. Ackerman May 2011

International Contracts A Quantitative Analysis Of Transnational Contract Formation, David T. Ackerman

HIM 1990-2015

Globalization is the promise of the future, and it presents, quite literally, a world of opportunities not available in the past. International collaborations in science, research, and business now enjoy increased probabilities of success, in part, because of the advance in technology and the possibility of instantaneous communications. The convenience, simplicity and affordability of technology are helping to make the world accessible to almost everyone. With new availability of international concerns and the growth of global partnerships in all areas of interest, an increased need arises for agreements that memorialize collaborators' commitments, responsibilities and obligations. There is a corresponding concern …

Promises And Human Rights: The Obama Administration On Immigrant Detention Policy Reform, José Villalobos May 2011

Promises And Human Rights: The Obama Administration On Immigrant Detention Policy Reform, José Villalobos

Departmental Papers (PS)

This article evaluates the Obama administration’s efforts towards reforming U.S. immigration detention policies. Over the past decade, immigrant rights advocates have increasingly criticized certain policies of the U.S. Immigration and Custom Enforcement (ICE) system of immigration detention, including the widespread use of private contractors, lack of proper oversight, grouping of violent criminals and non-violent undocumented immigrants (particularly minority women and children) in holding cells, and neglect of detained immigrants in need of medical attention. In reviewing these developments, I contend that the Obama administration must take substantive steps towards reforming the existing system, particularly by instituting legally enforceable standards with …

A Planning Framework For African American Heirs' Property In Rapidly Suburbanizing Locales, Alison Rowland May 2011

A Planning Framework For African American Heirs' Property In Rapidly Suburbanizing Locales, Alison Rowland

All Theses

Heirs' property resulted from post-Civil War land acquisitions and purchases by African Americans that have been passed down through generations without clear title of ownership or a last will of testament (Mitchell, 2000; Dyer, 2008). As the surrounding landscape develops, growth pressures threaten community integrity and increase property taxes, making it difficult to retain properties (Rivers, 2007b). Encroaching development fails to maintain the cultural context of existing settlement patterns of heirs' properties as well as fails to integrate them into the surrounding landscape (Cross, 2008; Johnson, et al., 2009). The literature has been decidedly silent in addressing the strategies that …

A Season Of Change: Reforming The H2b Guest Worker Program, Jayesh Rathod May 2011

A Season Of Change: Reforming The H2b Guest Worker Program, Jayesh Rathod

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: Each year, as spring and summer arrive, Americans partake in range of seasonal traditions: beautifying their lawns and gardens; enjoying harvests of fresh fruits, vegetables, and seafood; and attending local fairs and festivals. Although these rituals have become part of the American cultural fabric, few know that they are supported by thousands of temporary guest workers who enter the United States each year under the H-2 visa program.' The H-a program allows U.S employers to petition for seasonal agricultural workers (via the H-2A program) and seasonal nonagricultural workers (via the H-2B program) to work in this country on a …

You've Got Mail The Study Of The Attorney-Client Privilege And The Use Of Electronic Mail, Justin W. Mcconnell May 2011

You've Got Mail The Study Of The Attorney-Client Privilege And The Use Of Electronic Mail, Justin W. Mcconnell

HIM 1990-2015

The prolific use of the internet and electronic mail within the legal profession presents novel challenges to the application of the attorney-client privilege; especially, in regards to protecting intended confidential communications relayed through e-mail. This thesis addresses the question of whether an attorney in Florida, through electronic mail use, can waive his client's right to the protections of the attorney-client privilege. After a review of current case law, law review articles, statutes, and texts, this thesis concluded that an attorney's communication through e-mail warrants a reasonable expectation of privacy, permitting the attorney to speak in reasonable confidence to clients through …

Getting Into The Field, Jay A. Mitchell May 2011

Getting Into The Field, Jay A. Mitchell

Journal of Food Law & Policy

A group of students enrolled in a law school clinic wanders through a large farmers' market. They stop to chat with the proprietors of a farm that has sold vegetables at the market for many years. They visit with a cheesemaker and an apple grower. A second group learns about the economic costs of organic production from a farmer and talks with an olive oil producer. Both sets of students seem unusually attentive to their surroundings. That may be because the first group helped the sponsor of the market rework the market's rules and regulations, and the second developed a …

Greater New Orleans' Small Business Lending Landscape: Recommendations For Seedco Financial-Louisiana, Department Of Planning And Urban Studies, University Of New Orleans May 2011

Greater New Orleans' Small Business Lending Landscape: Recommendations For Seedco Financial-Louisiana, Department Of Planning And Urban Studies, University Of New Orleans

Planning and Urban Studies Reports and Presentations

Small businesses play a vital role in stimulating the economy, bringing investment into disadvantaged communities, and helping women and minority business owners to become financially independent. While access to capital is a long‐standing problem, due to the recent recession there have been tighter restrictions nationally on lending criteria, reducing the access small businesses have to capital and services. Community Development Financial Institutions (CDFIs), as mission‐oriented organizations, help to fill these gaps and increase access to capital. In the six years, Southeast Louisiana has endured destructive hurricanes, a national economic downturn and the largest oil spill in US history. These community‐altering …

Fit Measures Of Work-School Congruence And Individual Outcomes, Kimberly E. Kluesner May 2011

Fit Measures Of Work-School Congruence And Individual Outcomes, Kimberly E. Kluesner

Honors Program Theses

Today, full-time college students are working part- or full-time jobs while attending classes. The demands of work, added to the already high demands of college, may result in negative effects on the individual. However, some aspects of working may lead to positive effects. Previous research has largely focused on the effects of job demands on school performance and other outcomes in adolescents. Current research is lacking in studying the effects of working on college students. The purpose of this thesis project was to research workschool congruence (similarities between aspects of a student's college studies and aspects of their employment), and …

Information Seeking Behavior: The Effects Of Relationalism On The Selection Of Information Sources, Chris Zimmer May 2011

Information Seeking Behavior: The Effects Of Relationalism On The Selection Of Information Sources, Chris Zimmer

All Dissertations

In a world where 'Google' is a verb, this research asks the question 'what influences an individual's decision to select one information source over another?' Previous works have discussed relational versus nonrelational information sources (Rulke, Zaheer, & Anderson, 2000). Other research focuses on the information quality (O'Reilly, 1982), source accessibility (Culnan, 1984, 1985), or source richness (Daft, Lengel, & Trevino, 1987; Daft & Macintosh, 1981) but all these prior works do not address the social aspects of information sources.
This research defines and develops the construct of relationalism which is reflective of the social aspects of information sources. An important …

Coordinating Loan Repayment Assistance Programs With New Federal Legislation, Philip G. Schrag, Charles Pruett May 2011

Coordinating Loan Repayment Assistance Programs With New Federal Legislation, Philip G. Schrag, Charles Pruett

Georgetown Law Faculty Publications and Other Works

For decades, law school administrators, faculty members, students and graduates have worried about the problem of the ever-increasing cost of attendance at the nation’s law schools, and the rapidly rising average debt of graduating law students. The problem was particularly acute for students who desired careers in public service, because starting salaries in the government and non-profit sectors failed to keep pace with the increase in educational debt of law school graduates. In response, many law schools created loan repayment assistance programs (LRAPs), through which they subsidized loan repayment for some or all of their graduates who undertook public service …

The Sustainability Of Hunger Relief: Analysis Of Emergency Food Providers In Low Access Counties Of West Virginia, Juston Chad Morrison May 2011

The Sustainability Of Hunger Relief: Analysis Of Emergency Food Providers In Low Access Counties Of West Virginia, Juston Chad Morrison

Graduate Theses, Dissertations, and Problem Reports (ETD)

Hunger in West Virginia has long been considered a problem that stems from high poverty rates and rural low access communities. The purpose of this study is to assess the stability of emergency food providers in economically distressed counties in West Virginia. Data was collected from Clay and Webster counties, of which Clay is considered low access and Webster is severely low access or a food desert. Administrators of emergency food providers were asked to complete a questionnaire regarding basic information about their program, changes in client usage, and possible threats to the existence of their program. The questionnaires were …

Implementing An Online Dispute Resolution Scheme: Using Domain Name Registration Contracts To Create A Workable Framework, Michael G. Bowers May 2011

Implementing An Online Dispute Resolution Scheme: Using Domain Name Registration Contracts To Create A Workable Framework, Michael G. Bowers

Vanderbilt Law Review

Online businesses have grown tremendously in the past decade. As a larger percentage of the U.S. economy moves onto the Internet, a larger percentage of people doing business online will find themselves disagreeing with each other. How those disputes are resolved presents an ongoing challenge in a world where traditional ordering mechanisms, like geographical boundaries, become increasingly antiquated. As contracts are formed across state and national lines, dispute resolution systems built around spatial locations become ever more unwieldy. The complications and costs of securing a favorable decision from a far-off decisionmaking body make reliance on geographic-based systems exceedingly difficult. Out …

The Nebraska Minority And Justice Task Force Final Report Apr 2011

The Nebraska Minority And Justice Task Force Final Report

University of Nebraska Public Policy Center: Publications

In the report that follows, the Nebraska Minority and Justice Task Force finds that minorities are overrepresented as defendants in the criminal and juvenile justice system; minorities are underrepresented in Nebraska’s legal profession and as court employees and jurors; and a substantial portion of the responding public, Nebraska lawyers, and court personnel perceive that bias exists in the Nebraska justice system.

The Task Force concludes that the data available prevent a complete analysis of the under and overrepresentation of minorities and that the findings do not prove or disprove systemic discrimination in the Nebraska justice system based on race and …
