The American Dream Deferred: Family Separation And Immigrant Visa Adjudications At U.S. Consulates Abroad, Cain W. Oulahan

Marquette Law Review

In the mid 1990’s, Congress passed a series of punitive immigration laws designed to ramp up enforcement and deter illegal immigration. Among these measures are provisions know as unlawful presence bars, which prohibit immigrant visa applicants who have been unlawfully present in the United States for certain periods of time from obtaining an immigrant visa for up to ten years or more. These bars frequently result in the protracted separation of undocumented applicants from their U.S. citizen or lawful permanent resident family members. After more than ten years since the passage of the unlawful presence bars, it is now appropriate …

Medical Malpractice Mediation: Benefits Gained, Opportunities Lost , Carol B. Liebman Jul 2011

Medical Malpractice Mediation: Benefits Gained, Opportunities Lost , Carol B. Liebman

Law and Contemporary Problems

Liebman reviews two recent studies evaluating the use of interest-based mediation to resolve medical malpractice claims. The first studied cases brought against the New York City Health and Hospitals Corporation, and the second, Mediating Suits against Hospitals, studied cases brought against private New York City hospitals. How non-participation of physicians in mediations diminishes opportunities to achieve noneconomic goals that plaintiffs desire is analyzed.

Values As Part Of The Clinical Experience, Jaime Baker Roskie Jul 2011

Values As Part Of The Clinical Experience, Jaime Baker Roskie

Scholarly Works

This essay is based on a short talk I gave at the “Practically Grounded” conference hosted by Pace Law School’s Land Use Law Center. This piece discusses the University of Georgia (UGA) Land Use Clinic, specifically why and how I interact with my students in the classroom about values as part of the clinic experience. It attempts to tie my own teaching methods to those suggested in Best Practices for Legal Education.

Why Should States Pay For Prisons, When Local Officials Decide Who Goes There?, W. David Ball Jun 2011

Why Should States Pay For Prisons, When Local Officials Decide Who Goes There?, W. David Ball

Faculty Publications

In the United States, states typically pay for prisons, even though the decisions that lead to prison admissions — arresting, charging, and sentencing — are made by local officials. The practice of state subsidies is relatively recent: there were no state prisons in the early part of the country’s history, and even as state institutions began to be developed, they largely supported themselves financially, rendering the notion of subsidies moot. Given the political economy of local decision-making, local preferences are unlikely to result in optimally-sized state prison populations. This Article suggests that since state prison subsidies may not be desirable …

Order For The Courts: Reforming The Nollan/Dolan Threshold Inquiry For Exactions, Winfield B. Martin Jun 2011

Order For The Courts: Reforming The Nollan/Dolan Threshold Inquiry For Exactions, Winfield B. Martin

Seattle University Law Review

For decades prior to 2005, Fifth Amendment regulatory takings jurisprudence languished in a state of confused neglect. Rather than articulating a clearly discernable standard for determining whether a violation of the Takings Clause had occurred, Justices rebuffed government action that seemed to amount to “an out-and-out plan of extortion” and nodded in approval when they deemed the government to have “acted diligently and in good faith” or in furtherance of a “compelling interest.” In trying to parse this imprecise thicket, scholars have characterized the Court’s approach to regulatory takings as a “muddle,” in “disarray,” and “incoherent.” Professor Kent even noted …

Preventive Detention Distorted: Why It Is Unconstitutional To Detain Immigrants Without Procedural Protections , Whitney Chelgren Jun 2011

Preventive Detention Distorted: Why It Is Unconstitutional To Detain Immigrants Without Procedural Protections , Whitney Chelgren

Loyola of Los Angeles Law Review

There are two main problems with the current immigration detention system: the conditions of confinement and the procedural mechanisms that are used to detain noncitizens. The current conditions of confinement cast serious doubt on the constitutionality of the detention system. Although it is purportedly civil, immigration detention is very much a punitive institution. Moreover, there is no binding regulation governing the operation of detention facilities or the conduct of detention staff. The problems that stem from this lack of regulatory oversight are compounded by the fact that many detention centers are run as for-profit businesses. More fundamentally, noncitizens are detained …

Making Wto Dispute Settlement Mechanisms Work For Developing Countries: Designing The Strategy Of Public-Private Partnership, Amrita Bahri Jun 2011

Making Wto Dispute Settlement Mechanisms Work For Developing Countries: Designing The Strategy Of Public-Private Partnership, Amrita Bahri

Indian Journal of International Economic Law

With the advent of globalization and industrialization, the significance of WTO DSU as an international institution of trade dispute governance has expanded tremendously, as a landmark achievement of Uruguay Round negotiations. Exploring the fact that whether the ‗pendulum‘ of DSU is tilted towards developed economies, much to the disadvantage of the developing world, it becomes imperative to devise a strategy within the existing framework, to balance the equilibrium of this tilted pendulum. WTO, being recognized as an area of public international law, and expanding its routes to the sphere of private international law, the approach of public private partnership can …

The Eyes That Blind Us: The Overlooked Phenomenon Of Trafficking Into The Agricultural Sector, Shelley Cavalieri Jun 2011

The Eyes That Blind Us: The Overlooked Phenomenon Of Trafficking Into The Agricultural Sector, Shelley Cavalieri

Northern Illinois University Law Review

This article offers an analysis of American anti-trafficking legislation. It documents the level of American preoccupation with trafficking for sex work by using existing data from the Department of Justice to demonstrate just how current anti-trafficking efforts focus their attention on trafficking for sex work, to the detriment of trafficking into other labor sectors. The author offers a critique of this overemphasis, observing how the expectations of the individuals involved in enforcing anti-trafficking laws influence what kinds of cases they consider to be trafficking cases. The article also offers a few modest interventions that might help reallocate some of the …
