The Mayan People And Sandy (Shelton) Davis: Memories Of An Engaged Anthropologist, J.P. Linstroth

The purpose of this essay is to highlight the activism of Shelton Davis and his involvement with the Mayan people during the 1980s. Of particular importance is the portrayal of an immigration hearing of nine Kanjobal Maya defendants in 1983 and the circumstances surrounding the problems of immigration in the state of Florida at that time. The article also explores how Shelton Davis helped save a village of Kaqchikel Maya in the Department of Chimaltenango, Guatemala. Of importance is how to represent varying narratives from three close colleagues of Shelton Davis to an overall conceptualization of the epistemology of narrative …

The objective here is first, to improve automatic assignment of industry codes using LSI (lexical processing) by increasing the algorithm efficiency (both computationally and in term of input requirements), then quantify the lender's risk as "distance to default" (higher distance to default indicates default is less likely to occur), estimate the distance to default for each company and combine the results to obtain an estimate of the distance to default for each NAICS code.

Constitutionalizing Immigration Law On Its Own Path, Anne R. Traum

Courts should insist on heightened procedural protections in immigration adjudication. They should do so under the Fifth Amendment's Due Process Clause rather than by importing Sixth Amendment protections from the criminal context. Traditional judicial oversight and the Due Process Clause provide a better basis than the Sixth Amendment to interpose heightened procedural protections in immigration proceedings, especially those involving removal for a serious criminal conviction. The Supreme Court's immigration jurisprudence in recent years lends support for this approach. The Court has guarded the availability of judicial review of immigration decisions. Following a successful campaign to end the unlawful practices of trafficking that brought them to Manaus, indigenous Tukanoan women from the Upper Rio Negro established a local indigenous organization with which to plan and manage their own ethno-development, including cultural heritage activities, institution building, revenue development, health and legal services, community, and other initiatives. The case provides an opportunity to explore indigenous ethno-development, a concept at the heart of the theory and practice of Shelton (Sandy) Davis.

Religious Affiliation And Attendance As Predictors Of Immigration Attitudes In Nebraska, Courtney Lyons Breitkreutz

This study examines the relationship between religious affiliation, church attendance, and attitudes towards immigration. Following the ethnoreligious perspective, I predict that those who identify as Mainline Protestant, Evangelical Protestant, or Catholic will hold more positive attitudes than those who do not affiliate, which would reflect the teachings of their churches. I also predict that Catholics may have particularly positive attitudes because of social identity theory. Attending church services should be associated with more positive attitudes, according to religious restructuralism. Using 2006 telephone survey data of 1,135 Nebraskans from the Nebraska Annual Social Indicators Survey (NASIS), I use binary logistic regression …

This Article takes a fresh look at the power of courts and creditors to force debtors to repay their obligations through in personam collection techniques. Variously known as “debtor’s examinations,” “turnover orders,” “citations to discover assets,” “supplementary proceedings,” “proceedings supplementary,” and “proceedings in aid of execution,” in personam remedies force the debtor, under threat of the court’s contempt authority, to turn over money or property directly to a creditor. The article addresses the immigrant representation crisis in U.S. immigration courts, highlighting a severe shortage of competent legal representation for individuals in removal proceedings. This crisis is marked by both a lack of quantity and quality of representation, exacerbated by rising deportation rates, detention practices, and resource constraints faced by removal defense providers (RDPs). The study underscores the critical role of legal representation in achieving successful outcomes, with stark disparities in success rates between represented and unrepresented individuals. State (and some local) governments have struggled to find ways to protect immigrants from exploitation by persons falsely holding themselves out as immigration lawyers or claiming expertise as notarios or immigration consultants. Existing legislation ranges from attempts to regulate the activities of nonlawyer immigration service providers (ISPs) by delineating prohibited practices; to requiring ISPs to post a bond or register with the state; to specifically restricting the provision of immigration assistance for compensation by any nonlawyer who is not accredited by the Board of Immigration Appeals to transcription, translation, document procurement and related clerical tasks. There is an enormous unmet need for immigrant legal aid in the United States. This is partly due to regulations that bar federally funded legal services organizations from representing many types of immigrants. The possible repeal of these restrictions is rarely discussed as a means to expand immigrant access to counsel. Legal education has been notably absent from the assessment movement that has been underway in American higher education for over twenty-five years.  Accreditors of virtually every other area of professional education in the United States have adopted assessment of educational outcomes as part of their accreditation process.  Legal education is poised to join this movement as the American Bar Association considers revisions to its Standards for Approval of Law Schools that would emphasize educational outcomes.

After losing sovereign immunity in 1985, SCDOT employees now focus a significant amount of time in processing tort claims and lawsuits filed against the agency. This is an important issue for transportation agencies considering the fact that money spent defending tort claims and lawsuits, is no longer available for safety and mobility improvements on the state highway system.
The South Carolina Department of Transportation (SCDOT) processes approximately one thousand claims per year and is engaged in nearly one hundred lawsuits per year. SCDOT has paid just over a half million ($523,607) to settle on 1007 claims - approximately 1/3 of …

Feminist Advocacy In Community Based Responses To Domestic Violence: Gendered Identity, Ideology And Practices, Andrea J. Nichols

The anti-domestic violence movement began as a feminist grassroots effort. Early feminist advocates relied on survivor-defined and social change practices rooted in feminist identity and ideology. Advocacy has evolved over time, moving from grassroots efforts into professionalized organizations, and now includes collaboration with the justice system in community based responses to domestic violence (CBR). Through inductive analysis of interviews with 26 domestic violence victim advocates and drawing from a gendered organizations framework, I examine how advocates’ feminist identity and ideology shape their practices in CBR. Findings indicate that advocates both resist and reproduce various gendered practices within traditionally feminist anti-domestic …
