Indian Patent Law And Trips: Redrawing The Flexibility Framework In The Context Of Public Policy And Health, V. K. Unni

This panel will examine the impact of human rights norms on substantive intellectual property law. The focus of the panel is whether intellectual property law is adequately flexible to provide access to knowledge, in the form of primary and secondary materials as well as scientific materials, access to medicines, and access to food, such as seeds. The panel will further explore whether any flexibilities incorporated into intellectual property law harm the incentives provided by that law, including an analysis of parallel importation.

The Unforeseen Costs Of Going To Trial: The Vitality Of 212(C) Relief For Lawful Permanent Residents Convicted By Trial, Mark J. Difiore

Before 1996, a Lawful Permanent Resident (LPR) who was made deportable by a criminal conviction could apply for discretionary relief from deportation under section 212(c) of the Immigration and Nationality Act. This relief, commonly known as "212(c) relief," was repealed in 1996. In 2001, the Supreme Court confronted the issue of whether an LPR with a pre-1996 deportable conviction could apply for 212(c) relief in his later post-repeal removal proceedings. The Court decided that an LPR who pleaded guilty to his pre-1996 conviction could still apply for 212(c) relief following the 1996 repeal. The status of those LPRs who were …

Access To Justice? The View From The Street, Mary Stratton
Canadian Forum on Civil Justice
Once homeless, our odds for accessing any kind of justice are low. Whether we are chronically or just periodically homeless, we will be familiar with social injustice. The likelihood is high that we also have unresolved legal problems spanning multiple areas of law. Seventeen participants in the Alberta Legal Services Mapping Project (ALSMP) reported being currently homeless. Their experiences, joined with reports from legal and social service providers across Alberta, are the focus of this article.

Legislative Study: A Framework To Strengthen Massachusetts Community Mediation As A Cost-Effective Public Service, Susan Jeghelian, Madhawa Palihapitiya, Kaila Eisenkraft
Massachusetts Office of Public Collaboration Publications
This report presents a study of community mediation commissioned by the Massachusetts Legislature in July 2011. The study was conducted by the state office of dispute resolution now known as the Massachusetts Office of Public Collaboration at the University of Massachusetts Boston. The office has been serving as a neutral forum and state-level resource for over 20 years. Its mission is to establish programs and build capacity within public entities for enhanced conflict resolution and intergovernmental and cross-sector collaboration in order to save costs and enable effective problem-solving and civic engagement on major public initiatives.

In Memoriam: The Honorable Leroy Rountree Hassell, Sr., Hon. Harry L. Carrico

Leroy Rountree Hassell, Sr. passed away on February 9, 2011. News of his death devastated those of us associated with him onthe Supreme Court of Virginia. We had lost a dear friend, one always conscious of the needs of his associates and anxious about making sure they were comfortable. Even more, the court lost its peerless leader, and the people of the Commonwealth of Virginialost a dedicated public servant. He will be sorely missed in allcorners of our great state.
