Beyond Rehabilitation: A New Theory Of Indeterminate Sentencing, Michael M. O'Hear
Beyond Rehabilitation: A New Theory Of Indeterminate Sentencing, Michael M. O'Hear
Faculty Publications
Indeterminate sentencing - that is, sentencing offenders to a range of potential imprisonment with the actual release date determined later, typically by a parole board - fell into disrepute among theorists and policymakers in the last three decades of the twentieth century. This sentencing practice had been closely associated with the rehabilitative paradigm in criminal law, which also fell from favor in the 1970’s. In the years that followed, most states eliminated or pared back the various devices that had been used to implement indeterminate sentencing, especially parole release. Yet, sentencing remained indeterminate most places to varying degrees, and now …
Licensee Patent Validity Challenges Following Medimmune: Implications For Patent Licensing, Alfred C. Server, Peter Singleton
Licensee Patent Validity Challenges Following Medimmune: Implications For Patent Licensing, Alfred C. Server, Peter Singleton
UC Law Science and Technology Journal
The recent Supreme Court decision in MedImmune v. Genentech, resolved a jurisdictional question while refusing to address questions regarding application of the common law doctrine of licensee estoppel. This doctrine prevents a licensee enjoying the benefits of a license agreement from challenging the validity of the underlying patent. Although the Supreme Court in Lear v. Adkins rejected application of the doctrine where the licensee had ceased making payments under the agreement, it left open the same question which the MedImmune Court mentioned, but refused to address. Namely: Whether the doctrine still applies to a non-repudiating licensee in good standing. In …

Background: A recent analysis of protein sequences deposited in the NCBI RefSeq database indicates that ~8.5 million protein sequences are encoded in prokaryotic and eukaryotic genomes, where ~30% are explicitly annotated as “hypothetical” or “uncharacterized” protein. Our Comparison of Protein Active-Site Structures (CPASS v.2) database and software compares the sequence and structural characteristics of experimentally determined ligand binding sites to infer a functional relationship in the absence of global sequence or structure similarity. CPASS is an important component of our Functional Annotation Screening Technology by NMR (FAST-NMR) protocol and has been successfully applied to aid the annotation of a number …

Protein vaccines, if rendered immunogenic, would facilitate vaccine development against HIV and other pathogens. We compared in nonhuman primates (NHPs) immune responses to HIV Gag p24 within 3G9 antibody to DEC205 ("DEC-HIV Gag p24"), an uptake receptor on dendritic cells, to nontargeted protein, with or without poly ICLC, a synthetic double stranded RNA, as adjuvant. Priming s.c. with 60 ?g of both HIV Gag p24 vaccines elicited potent CD4+ T cells secreting IL-2, IFN-γ, and TNF-α, which also proliferated. The responses increased with each of three immunizations and recognized multiple Gag peptides. DEC-HIV Gag p24 showed better cross-priming for …
Expanding The Horizons Of Enzybiotic Identification, Jonathan Edward Schmitz
Expanding The Horizons Of Enzybiotic Identification, Jonathan Edward Schmitz
Student Theses and Dissertations
Recently, phage lytic enzymes (also known as endolysins or, simply, lysins) have received considerable attention as potential antibacterial agents. During the infective cycle of double-stranded DNA phage, these peptidoglycan hydrolases are responsible for digesting the cell wall of the host bacterium and freeing newly-assembled viral particles. At the same time, an increasing body of evidence has demonstrated that recombinantly-purified phage lysins—when added exogenously—can potently kill Gram-positive bacteria, whose peptidoglycan is accessible from the extracellular space. Consequently, lysins have been proposed as novel enzybiotic (i.e. enzyme-antibiotic) molecules that could serve as novel weapons in the fight against drug-resistant bacteria. Most lysins …

Patients' Perspectives On Discussing Complementary And Alternative Medicine Therapies With Conventional Doctors, Deborah A. Mcninch
Patients' Perspectives On Discussing Complementary And Alternative Medicine Therapies With Conventional Doctors, Deborah A. Mcninch
Walden Dissertations and Doctoral Studies
Currently, little is known about patients' perceptions and beliefs in discussing complementary and alternative medicine (CAM) with their conventional medical (CM) doctor. The purpose of this descriptive research was to show whether CAM-using patients have an interest in discussing CAM treatments with their CM doctor for comprehensive care as described by the health belief model (HBM) constructs of perceived susceptibility, perceived seriousness, and perceived benefits of taking action. A sample of 165 participants age 18 or older from 2 chiropractic clinics in the midwestern United States completed a Likert-scaled survey. The data were analyzed using descriptive statistics and multiple regression …
Effect Of Clinical Laboratory Practitioner Licensing On Wages, Mary Hotaling
Effect Of Clinical Laboratory Practitioner Licensing On Wages, Mary Hotaling
Walden Dissertations and Doctoral Studies
Professional licensing directly affects about 29% of U.S. workers and is considered a primary means to establish and maintain health care practitioner competence. Clinical laboratory practitioner licensing was largely ignored in the literature with only 2 studies 30 years apart that provided conflicting conclusions regarding wage effects. This research provided the first study of clinical laboratory practitioner licensing effects on wages after controlling for human capital and individual characteristics wage determinants. This nonexperimental correlational study extended the literature on licensing effects on wages, including women's wages and professions not uniformly licensed across 50 states. The theoretical foundation relied on the …
Leadership And Attitudes On Adopting Evidence-Based Practice For Influenza Vaccination, Pamela A. Paparone
Leadership And Attitudes On Adopting Evidence-Based Practice For Influenza Vaccination, Pamela A. Paparone
Walden Dissertations and Doctoral Studies
The United States has set a 90% benchmark for influenza vaccinations for healthcare personnel. Unfortunately, healthcare personnel fall far short of that mark with current rates as low as 62%. Low vaccination rates are responsible for influenza, nosocomial influenza, influenza-like illness, and mortality during influenza season. The purpose of this quantitative correlational study was to understand the relationship between leadership styles, attitudes towards evidence-based practice, and vaccination intention among New Jersey registered nurses (RNs). Diffusion of innovations theory was the theoretical foundation. The 3 instruments used were the Multifactor Leadership Questionnaire, Evidence Based Practice Attitude Scale, and Behavioral Intention Scales, …

Maize And Stone A Functional Analysis Of The Manos And Metates Of Santa Rita Corozal, Belize, Lisa Glynns Duffy
Maize And Stone A Functional Analysis Of The Manos And Metates Of Santa Rita Corozal, Belize, Lisa Glynns Duffy
Electronic Theses and Dissertations
The manos and metates of Santa Rita Corozal, Belize are analyzed to compare traditional maize-grinding types to the overall assemblage. A reciprocal, back-and-forth grinding motion is the most efficient way to process large amounts of maize. However, rotary movements are also associated with some ground stone implements. The number of flat and trough metates and two handed manos are compared to the rotary-motion basin and concave type metates and one-handed manos to determine predominance and distribution. Flat is the predominant type and, together with the trough type, these grinding stones make up the majority of metates at the site. Manos …

A Survey Of The Chemical Content And Medicinal Activity Of Shrub-Steppe Plants Of The Pacific Northwest, Aaron M. John
Undergraduate Honors Theses
A need for new modes of antibiotic therapy has resulted from the increasing incidence of bacterial resistance to drugs. One approach to this problem involves the search for plant compounds that may help to overcome multi-drug resistance. Many plant genera have been utilized in Native American traditional medicine for their beneficial properties. Such plants include the shrub-steppe genera, Eriogonun and Collomia, which have been used as cold remedies, pain relievers, and for antibiotic-related uses. Limited chemical studies of these genera have revealed medicinally useful compounds such as flavonoids and terpenoids, and further research may result in the identification of …

Animal Models For Periodontal Disease, Helieh S. Oz, David A. Puleo
Center for Oral Health Research Faculty Publications
Animal models and cell cultures have contributed new knowledge in biological sciences, including periodontology. Although cultured cells can be used to study physiological processes that occur during the pathogenesis of periodontitis, the complex host response fundamentally responsible for this disease cannot be reproduced in vitro. Among the animal kingdom, rodents, rabbits, pigs, dogs, and nonhuman primates have been used to model human periodontitis, each with advantages and disadvantages. Periodontitis commonly has been induced by placing a bacterial plaque retentive ligature in the gingival sulcus around the molar teeth. In addition, alveolar bone loss has been induced by inoculation or …

A health and human rights framework provides a comprehensive perspective for understanding complex interactions between HIV/AIDS, human rights, and the health of individuals and communities. By helping to identify a broad range of social factors that affect health, such a framework also facilitates the development of interventions and policies that maximize both health and human rights benefits. In this Article, we discuss the various linkages between health and human rights and review the literature on HIV/AIDS and human rights, with a focus on under-resourced settings. In particular, we examine how the framework is relevant to the specific epidemics in Botswana …

Rock Pigeon Use Of Livestock Facilities In Northern Colorado: Implications For Improving Farm Bio-Security., James C. Carlson, Larry Clark, Michael F. Antolin, M. D. Salman
United States Department of Agriculture Wildlife Services: Staff Publications
Rock pigeons (Columba livia) have been implicated in the spread of pathogens within commercial livestock facilities. Currently, there is no data characterizing pigeon habitat use and movement patterns within and among commercial livestock facilities. To better understand the capacity for pigeons to spread pathogens, we used radio-telemetry techniques to estimate the home-range, travel distance, activity, and habitat use of pigeons roosting on and off dairies and feedlots in western Weld County, Colorado. Our observations suggest that pigeons roosting on (resident) and off (nonresident) livestock facilities use habitat differently. Nonresident pigeons used larger home-range areas than did resident pigeons. Nonresident pigeons …

A variety of taxa have been observed to· prey upon Pituophis catenifer, including mammals, birds-of prey, and other snakes. Here, we describe an unusual two-day observation of predation on a mature Great Basin gophersnake by a brown trout (Salmo trutta).
The observation took place in Jones Canyon, Utah, USA, on the grounds of the Jones Hole National Fish Hatchery (JHNFH). Jones Creek' emanates from springs at the head of Jones Canyon on hatchery grounds, and flows north to south 6.4 km to the Green River, approximately paralleling the Utah-Colorado border. The stream runs for about 0.3 km …

Impacts Of Generalist Mesopredators On The Demography Of Small-Mammal Populations In Fragmented Landscapes, Timothy S. Eagan Ii, James C. Beasley, Zachary H. Olson, Olin E. Rhodes Jr.
United States Department of Agriculture Wildlife Services: Staff Publications
Abstract: A consequence of the reduction and subsequent fragmentation of native habitats has been the loss or severe reduction of specialist predator populations from these altered ecosystems, resulting in a “release” of generalist predators. Demographic aspects of small-rodent populations, especially predator-driven density cycles, have been extensively studied. However, the majority of studies examining predator–prey dynamics have been conducted in relatively undisturbed ecosystems, while more limited data are available for regions that have been greatly modified by human settlement. Using raccoons (Procyon lotor (L., 1758)) and white-footed mice (Peromyscus leucopus (Rafinesque, 1818)) as focal species, we used an …

Mechanism For Pre-B Cell Loss In Mutant Ali/Ali Rabbits, Gregory Robert Robbins
Mechanism For Pre-B Cell Loss In Mutant Ali/Ali Rabbits, Gregory Robert Robbins
Dissertations
Pre-B cell receptor (pre-BCR) signaling is a critical checkpoint in B cell development in which B-lineage cells expressing functional μ-chains undergo selective expansion. My dissertation work used a rabbit model system to study how VH structure affects the early stages of B cell development in the bone marrow (BM). Developing B cells in mutant ali/ali rabbits predominantly utilize VH4 during VDJ gene rearrangement. However, most of the VH4-utilizing B cells encounter a severe block early in B cell development. In contrast, wildtype rabbit B cells predominantly rearrange VH1, a gene >90% identical to VH4, and develop normally. We hypothesized that …
Modeling And Surveillance Of Pandemic Influenza Outbreaks, Diana Prieto
Modeling And Surveillance Of Pandemic Influenza Outbreaks, Diana Prieto
USF Tampa Graduate Theses and Dissertations
Pandemic outbreaks are unpredictable as to their virus strain, transmissibility, and impact on our quality of life. Hence, the decision support models for mitigation of pandemic outbreaks must be user-friendly and operational, and also incorporate valid estimates of disease transmissibility and severity. This dissertation research is aimed at 1) reviewing the existing pandemic simulation models to identify their implementation gaps with regard to usability and operability, and suggesting research remedies, 2) increasing operability of simulation models by calibrating them via an epidemiological model that estimates infection probabilities using viral shedding profiles of concurrent pandemic and seasonal influenza, and 3) developing …
