Etsu Today - Fall 2011, University Marketing And Communication, East Tennessee State University

ETSU Today [magazine]

Dear ETSU Family and Friends, On January 14, 2012, I will have been an employee of East Tennessee State University for 27 years. Each position I have occupied during that time—faculty member, department chair, dean, vice president, and president—has brought immense professional and personal satisfaction to me. Now, it is time to seek the next logical progression in my ETSU career: President Emeritus status. It is my intention to end what will be a 15-year tenure as your President on that anniversary date, January 14, 2012, and to assume the role of President Emeritus, contingent upon the approval of Chancellor …

Revisiting The Original Tea Party: The History Of Regulating Food Consumption In America, Alison Peck Oct 2011

Revisiting The Original Tea Party: The History Of Regulating Food Consumption In America, Alison Peck

Law Faculty Scholarship

In response to concerns over rising obesity rates, state and federal policymakers have introduced laws that seek to internalize the public health costs of consuming unhealthy foods. These laws range from taxes on sugared beverages to mandatory nutritional information disclosures and beyond. Vocal opponents to such laws, including many Tea Party members, characterize such laws as government overreaching into the private sphere. That opposition often evokes Revolutionary images and ideology, with references to the Boston Tea Party, the Founding Fathers, and the framing of the Constitution. This article challenges the symbolism used by these opponents by examining the pre-Revolutionary non-importation …

Citation Advantage Of Open Access Legal Scholarship, Carol Watson, James M. Donovan

Articles, Chapters and Online Publications

In this study focusing on the impact of open access on legal scholarship, the authors examine open access articles from three journals at the University of Georgia School of Law and confirm that legal scholarship freely available via open access improves an article’s research impact. Open access legal scholarship—which today appears to account for almost half of the output of law faculties—can expect to receive fifty-eight percent more citations than non–open access writings of similar age from the same venue.

Social Goals In Urban Physical Education: Relationships With Effort And Disruptive Behavior, Alex C. Garn, Nate Mccaughtry, Bo Shen, Jeffrey J. Martin, Mariane Fahlman

Kinesiology, Health and Sport Studies

This study investigated the relationships among four distinct types of social goals, effort, and disruptive behavior in urban physical education. Social responsibility, affiliation, recognition, status goals, along with effort and disruptive behavior in physical education were reported by high school physical education students (N = 314) from three urban schools. Findings from correlation and structural equa- tion modeling analyses revealed that social responsibility goals had a positive relationship with effort and an inverse relationship with disruptive behavior. Social status goals demonstrated a positive relationship with disruptive behavior and no relationship with effort. Social recognition goal results were mixed, as …

A Cure For A "Public Concern": Washington's New Anti-Slapp Law, Tom Wyrwich Oct 2011

A Cure For A "Public Concern": Washington's New Anti-Slapp Law, Tom Wyrwich

Washington Law Review

In March 2010, the Washington State Legislature passed its Act Limiting Strategic Lawsuits Against Public Participation. The new Act fills a critical void in Washington’s protection of free expression and petition rights. The Washington Act protects the free expression of Washington citizens by shielding them from meritless lawsuits designed only to incur costs and chill future expression. This Comment offers interpretive guidance for Washington courts by examining the new law, its legislative history, its constitutional underpinnings, and its relationship to the influential California anti-SLAPP statute on which it is modeled. Although the Washington Act shares many identical provisions with the …

Beyond Equality? Against The Universal Turn In Workplace Protection, Jessica A. Clarke Oct 2011

Beyond Equality? Against The Universal Turn In Workplace Protection, Jessica A. Clarke

Indiana Law Journal

Sexual harassment law and family leave policy originated as feminist reform projects designed to protect women in the workplace. But many academics now ask whether harassment and leave policies have outgrown their gendered roots. The anti-bullying movement advocates taking the “sexual” out of harassment law to prohibit all forms of on-the-job mistreatment. Likewise, the work-life balance movement advocates taking the “family” out of leave policy to require employers to accommodate all types of life pursuits. These proposals are in line with recent cases and scholarship on civil rights that reframe problems once seen as issues of inequality as deprivations of …

Equal Citizenship And The Individual Right To Vote, Jospeh Fishkin Oct 2011

Equal Citizenship And The Individual Right To Vote, Jospeh Fishkin

Indiana Law Journal

An emerging consensus among election law scholars urges courts to break out of “the stagnant discourse of individual rights and competing state interests” and instead adopt a jurisprudence of “structural” democratic values that sidelines individual rights. This structuralist approach won out in the great “rightsstructure” debate in election law, and came to dominate the field, during a period in which the main controversies—vote dilution, gerrymandering, ballot access, campaign finance—were all ones in which the structuralist move was illuminating. However, structuralism is now causing both scholars and courts to evaluate the new wave of vote denial controversies, over such issues as …

Background: In all amyloid diseases, protein aggregates have been implicated fully or partly, in the etiology of the disease. Due to their significance in human pathologies, there have been unprecedented efforts towards physiochemical understanding of aggregation and amyloid formation over the last two decades. An important relation from which hydrodynamic radii of the aggregate is routinely measured is the classic Stokes-Einstein equation. Here, we report a modification in the classical Stokes-Einstein equation using a mixture theory approach, in order to accommodate the changes in viscosity of the solvent due to the changes in solute size and shape, to implement a …

Faculty Publications

Baseline data collected in two brief intervention projects (BI-Court and Truancy Project) were used to assess similarities and differences in subgroups of at-risk youth. Classifications of these subgroups were based on their psychosocial characteristics (e. g., substance use). Multigroup latent class analysis identified two BI-Court subgroups of youth and three truant subgroups. These classes can be viewed as differing along two dimensions, substance use involvement and emotional and behavioral issues. Equality tests of means across the latent classes for BI-Court and Truancy Project youths found significant differences that were consistent with their problem group classification. These findings highlight the importance …

Diving Into The New Innovation Landscape: The Eastern Current, Arnoud De Meyer Oct 2011

Diving Into The New Innovation Landscape: The Eastern Current, Arnoud De Meyer

Research Collection Lee Kong Chian School Of Business

Thirty years ago, when the business world sought innovation, most eyes looked West – mainly to the OECD countries considered to be the most economically advanced. We focused on technology-based product innovations, which were conceived for Western customers, developed in laboratories close to the headquarters of Western companies, and rolled out in the world’s wealthiest markets: North America, Western Europe and Japan, an honorary member of the Western club. This is no longer the case. Now, when the business world asks where the next innovative product or process will come from, what it will consist of, where it will be …

Examining The Chinese Approach To Crisis Management: Cover-Ups, Saving Face, And Taking The “Upper Level Line”, Lan Ye, Augustine Pang

Research Collection Lee Kong Chian School Of Business

In 2008, the Sanlu Group, a former giant in the Chinese dairy industry and a quintessential Chinese organization, was confronted with the melamine-contaminated milk crisis. Its products were blamed for causing at least six babies' deaths and damaging the kidneys of about 294,000 babies. Sanlu was criticized for its crisis handling, which resulted in its collapse several months later. Using the contingency theory of strategic conflict management and Coombs' typology of crisis communication strategies, this study explored Sanlu's crisis management as a mirror to understanding the Chinese approach to crisis management. Findings showed that influenced by political, social, and cultural …

Don't Sit So Close To Me: Unconsciously Elicited Affect Automatically Provokes Social Avoidance, Na Wyer, G Calvini Oct 2011

Don't Sit So Close To Me: Unconsciously Elicited Affect Automatically Provokes Social Avoidance, Na Wyer, G Calvini

School of Psychology

Behavior may be automatically prompted by cues in our social environment. Previous research has focused on cognitive explanations for such effects. Here we hypothesize that affective processes are susceptible to similar automatic influences. We propose that exposure to groups stereotyped as dangerous or violent may provoke an anxiety response and, thus, a tendency to move away. In the present experiment, we subliminally exposed participants to images of such a group, and found that they displayed greater avoidance in a subsequent interaction. Critically, this effect was explained by their increased sensitivity to threat-related information. These findings demonstrate an affective mechanism responsible …

Racial/Ethnic Matching Of Clients And Therapists In Mental Health Services: A Meta-Analytic Review Of Preferences, Perceptions, And Outcomes, Timothy B. Smith, Raquel R. Cabral Oct 2011

Racial/Ethnic Matching Of Clients And Therapists In Mental Health Services: A Meta-Analytic Review Of Preferences, Perceptions, And Outcomes, Timothy B. Smith, Raquel R. Cabral

Faculty Publications

The effects of matching clients with therapists of the same race/ethnicity have been explored using a variety of approaches across several decades. We conducted a meta-analysis of three variables frequently used in research on racial/ethnic matching: Clients' preferences for a therapist of their own race/ethnicity, clients' perceptions of therapists, and therapeutic outcomes. Across 52 studies of preferences, the average effect size was d = .63, indicating a moderately strong preference for a therapist of one's own race/ethnicity. Across 81 studies of individuals' perceptions of therapists, the average effect size was d = .32, indicating a tendency to perceive therapists of …
