Are Lawyers Unsung Disaster Heroes?: The Importance Of Well-Prepared Domestic Legal And Regulatory Frameworks For Effective Disaster Response, Elyse Mosquini

Emory International Law Review

The aftermath of a natural disaster unquestionably calls for action amid chaos. No matter its character'a sudden-onset earthquake, seasonal hurricane, or flooding'a natural disaster's immediate-term impact is similar: families and communities confronting loss of life and property and struggling to meet their basic needs. The affected population may be displaced from their homes, supply chains of essential items such as food and fuel may be cut off, and social services may be interrupted. When these basic needs outstretch local capacities, the complexity of the response operation mounts. This Article highlights the importance of well-prepared domestic regulatory frameworks for effective disaster …

Trichloroethylene Exposure And Traumatic Brain Injury Interact And Produce Dual Injury Based Pathology And Pioglitazone Can Attenuate Deficits Following Traumatic Brain Injury, Andrew David Sauerbeck Jan 2011

Trichloroethylene Exposure And Traumatic Brain Injury Interact And Produce Dual Injury Based Pathology And Pioglitazone Can Attenuate Deficits Following Traumatic Brain Injury, Andrew David Sauerbeck

University of Kentucky Doctoral Dissertations

The development of Parkinson's disease (PD) in humans has been linked to genetic and environmental factors for many years. However, finding common single insults which can produce pathology in humans has proved difficult. Exposure to trichloroethylene (TCE) or traumatic brain injury (TBI) has been shown to be linked to PD and it has also been proposed that multiple insults may be needed for disease development.

The present studies show that exposure to TCE prior to a TBI can result in pathology similar to early PD and that the interaction of both insults is required for impairment in behavioral function, and …

The Association Between Emotional Intelligence, Body Mass Index And Eating Behaviors Among College Students, Feai-Voon Wong

University of Kentucky Master's Theses

Available research has shown a relationship between emotional intelligence (EI) and health behaviors. However, the link between EI and eating behaviors has not been well explained. Thus, the purpose of this study was to investigate the correlations among EI, eating behaviors, as measured by the Dutch Eating Behavior Questionnaire (DEBQ), and body mass index (BMI) in college students. One hundred and eighty four students (118 (64%) female, 66 (36%) male, average BMI = 23.8kg/m2) were recruited to complete an online survey. The survey consisted of basic demographic questions, academic information with grade point average (GPA), ACT and SAT …

Healing Healthcare Design For Adolescent Patients: Promoting Holistic Quality Of Life, Eun Young Kim

University of Kentucky Master's Theses

This study examined environmental preferences for adolescent patients in hospital patient rooms and activity rooms to determine age-appropriate healing design elements. The health-related quality of life (HRQOL) concept was adapted to this study as a theoretical framework. In order to develop an age-appropriate healing design, a comprehensive understanding of adolescents‘ cognitive developmental stages and their expectations in hospital settings needs to be recognized. Thirty-two adolescent outpatients aged 15 to 18 participated in the survey. Data collection consisted of three different instruments: Emotional state survey with demographics, Photo analysis with semantic differentials, and environmental preference value survey. Comfort, sadness and stress …

Participation In Agricultural Governmental Cost Share Programs In The Kentucky River Watershed, Pedro Miguel Fernandes Da Costa

University of Kentucky Master's Theses

The purpose of this study is to review existing literature of factors that influence farmers’ decision to participate in conservation programs. This study is also intended to collect county data and information on conservation programs and participation in the Kentucky River watershed region, which can be analyzed and used to draw differences in characteristics of the region that would suggest willingness to participate in a trading scheme for improvements in water quality.

The results suggest that more participation in a trading scheme from some counties than others should be expected. Counties with more farms and larger farms will probably have …

A Qualitative Inquiry Into Understanding The Experience Of Wilderness Family Therapists, Lauren W. Smith Jan 2011

A Qualitative Inquiry Into Understanding The Experience Of Wilderness Family Therapists, Lauren W. Smith

University of Kentucky Master's Theses

Wilderness therapy is a unique approach to therapy that incorporates nature and experiential learning as a part of the therapeutic process. Wilderness therapy has proven to be a successful means of treatment, but research suggests the importance of family involvement for sustainable change post-wilderness therapy treatment. Wilderness family therapy was created as a result of this research; however, limited research reflects the experience and outcomes of wilderness therapy that includes more intense family involvement. Moreover, research lacks data collected from the therapists within the wilderness family therapy programs. Because the therapist plays an integral role in the success of treatment, …

Reconstituting Land Use Federalism To Address Transitory And Perpetual Disasters: The Bimodal Federalism Framework, Blake Hudson Jan 2011

Reconstituting Land Use Federalism To Address Transitory And Perpetual Disasters: The Bimodal Federalism Framework, Blake Hudson

Journal Articles

Scholars analyzing the intersection of federalism and disaster law and policy have primarily focused on the difficulties federalism poses for interjurisdictional coordination of disaster response. Though scholars have highlighted that rising disaster risks and costs are associated with “land-use planning that exacerbates, rather than mitigates, disaster risk,” a more holistic analysis of land-use-related disaster law and policy is needed. This Article provides a more comprehensive framework within which to analyze prospective mitigation or prevention of disaster risk and costs through a rebalancing - or reconstituting - of the respective roles of the federal and state governments in land-use planning. The …

Re-Regulating The Baby Market: A Call For A Ban On Payment Of Birth Mother Living Expenses, Andrea B. Carroll Jan 2011

Re-Regulating The Baby Market: A Call For A Ban On Payment Of Birth Mother Living Expenses, Andrea B. Carroll

Journal Articles

More than fifty years ago, state law on domestic infant adoption changed to uniformly prohibit the practice of baby selling, a development that eliminated the “black market” for babies that many argued previously existed. Nonetheless, one need not look far to find that the United States’ domestic adoption system is broken even today, and the cost structure of the domestic adoption scheme is the greatest offender. A domestic adoption currently costs in the neighborhood of $40,0000, with the vast majority of the associated expenses coming not from the payment of any professional fees, but rather from the payment of living …

Commerce In The Commons: A Unified Theory Of Natural Capital Regulation Under The Commerce Clause, Blake Hudson Jan 2011

Commerce In The Commons: A Unified Theory Of Natural Capital Regulation Under The Commerce Clause, Blake Hudson

Journal Articles

Scholars continue to debate the scope of Congress’s Commerce Clause authority and whether fluctuations in the U.S. Supreme Court’s Commerce Clause jurisprudence place federal environmental regulatory authority at risk. Yet when one analyzes major Commerce Clause cases involving resource regulation since the beginning of the modern regulatory state, a consistent theme emerges: both the Supreme Court and Circuit Courts of Appeal have consistently upheld federal authority to regulate depletable natural resources, the appropriation of which is non-excludable - key characteristics of a commons. Commerce Clause jurisprudence can be interpreted as treating appropriation of this natural capital, here described as “privatized …

The Improper Dismissal Of Title Vii Claims On "Jurisdictional" Exhaustion Grounds: How Federal Courts Require That Allegations Be Presented To An Agency Without The Resources To Consider Them, Katherine Macfarlane Jan 2011

The Improper Dismissal Of Title Vii Claims On "Jurisdictional" Exhaustion Grounds: How Federal Courts Require That Allegations Be Presented To An Agency Without The Resources To Consider Them, Katherine Macfarlane

Journal Articles

Title VII of the Civil Rights Act of 1964 represents a watershed moment in American history. With Title VII's passage, Congress acknowledged the need to “back” the civil rights movement with “federal legislative power.” Title VII was meant to eliminate practices that inhibit employment opportunity equality. Beyond eliminating those practices, Title VII was also designed to assure equality of employment opportunities and to eliminate conduct that “fostered racially stratified job environments to the disadvantage of minority citizens.” This Title renders unlawful the refusal or failure to hire or “otherwise to discriminate against any individual with respect to his compensation, terms, …
