Fragmented Lives: Disability Discrimination And The Role Of "Environment-Framing", Ani B. Satz Jan 2011

Fragmented Lives: Disability Discrimination And The Role Of "Environment-Framing", Ani B. Satz

Faculty Articles

This Article presents a novel theory that courts undermine the purpose of the Americans with Disabilities Act (ADA) by implicitly embracing environment-frames that disfavor disability protections. Courts employ environment-frames at two stages of judicial analysis under the Act: the disability eligibility and remedy stages. In determining whether a plaintiff is in the statutorily protected class, courts typically use a broad environment-frame to assess limitation of a "major life activity. " The larger the environment-frame, the more likely a court will view an individual as able to perform a major life activity in some portion of her environment and deny her …

Distribution And Properties Of Vesicular Horizons In The Western United States, Judith K. Turk, Robert C. Graham Jan 2011

Distribution And Properties Of Vesicular Horizons In The Western United States, Judith K. Turk, Robert C. Graham

Conservation and Survey Division: Faculty and Staff Publications

Vesicular horizons are thin (usuallycm) surface or near-surface horizons characterized by the predominance of vesicular porosity. Th ey are widespread in arid and semiarid lands, occurring on every continent and covering 156,000 km2 of the western United States. Vesicular horizons have critical implications for management due to their role in controlling surface hydrology and dust mobilization. Th is study evaluates the distribution and varia-tion in expression of vesicular horizons across the western United States using the soil databases available from the USDA. A vesicular horizon index (VHI) that incorporates vesicular horizon thickness and the size and quantity of vesicular pores …

The Irony Of International Business Law: U.S. Progressivism And China's New Laissez Faire, Andrew B. Spalding Jan 2011

The Irony Of International Business Law: U.S. Progressivism And China's New Laissez Faire, Andrew B. Spalding

Law Faculty Publications

As the financial crisis draws U.S. business overseas and developing countries rise in influence, the regulation of international business has never figured so prominendy in federal law. But the dominant paradigm through which academics and policymakers continue to view that law-the so-called Washington Consensus-proves deeply misleading. A more accurate account of the components, origins, and aims of U.S. international business law reveals two striking ironies.

First, in discrete but critical ways, the United States no longer represents the comparatively laissez-faire approach to federal business regulation. Rather, owing to its origins in the Progressive Era, U.S. federal law directs corporations toward …

The Impact Of Family, Community, And Resilience On African-American Young Adults Who Had Parents Incarcerated During Childhood, Marilyn Diana Ming Jan 2011

The Impact Of Family, Community, And Resilience On African-American Young Adults Who Had Parents Incarcerated During Childhood, Marilyn Diana Ming

Dissertations

Problem. Parental incarceration affects millions of children, and their numbers continue to rise. By losing their parents, children can be exposed to unique risks, relative to the separation. Many children face family structure disintegration, and this can be so disruptive that their normal development is impaired. Evidence suggests that children are impacted psychologically, socially, and financially. The result is the display of problematic behavior, being aggressive or withdrawn at home and in their communities. The concentration of the incarceration trends seems to be in poor African-American communities. Incarceration has left higher numbers of children without parents, making the collateral damage …

Seeking For The Lost: A Papyrological Search For Luke Fifteen's Lost Economics, Erik Yingling Jan 2011

Seeking For The Lost: A Papyrological Search For Luke Fifteen's Lost Economics, Erik Yingling

Student Works

This paper draws upon Egyptian documentary papyri in order to show more fully the quantitative purchasing power of items of economic significance in Luke 15. Specifically, the stories of the lost drachma, lost sheep, and prodigal son each mention economic items which—when compared with the papyrological data—can more fully elucidate areas of economic import which have not been looked at before. In doing so, the article builds upon, and supports, the framework of Roman economic "middling groups" as posited by Longenecker (2009). Furthermore, a close look at Luke 15 when compared with the Egyptian papyrological data suggests the possibility of …

The World Englishes Paradigm And Its Implications For International Students' Acquisition Of Standard American English For University-Level Studies In The United States, Karen Applequist Clement Jan 2011

The World Englishes Paradigm And Its Implications For International Students' Acquisition Of Standard American English For University-Level Studies In The United States, Karen Applequist Clement

All Graduate Theses, Dissertations, and Other Capstone Projects

Because English, as the predominant international language, is now used in many different forms and contexts globally, attitudes are changing towards variety in English, the construct of English proficiency tests, and methods of teaching English. This paper addresses the fact that many students of English are exposed to non-standard indigenized or lingua franca Englishes, thus potentially marginalizing them in their efforts to succeed on international tests of English based on standard American or British conventions. It examines non-standard grammatical features of world Englishes, summarizes the results of studies on bias in English proficiency tests, and details suggestions for best teaching …

Perceptions And Experiences Of Diverse Architectural Technology Students Learning Through Formative Feedback & Formative Assessment: A Multiple-Case Study, Catherine Prunty Jan 2011

Perceptions And Experiences Of Diverse Architectural Technology Students Learning Through Formative Feedback & Formative Assessment: A Multiple-Case Study, Catherine Prunty

Masters

Technological leaps along with increased numbers and greater student diversity is altering the higher education teaching landscape constantly. The academic's workload is escalating all the time, arising from resource constraints in a time of economic stringency. This places even more pressure on dealing with assessment rather than on enhancing learning. Despite evidence that supports formative assessment as being vitally important to students' learning, it is not widely appreciated among lecturers in higher education. As a result, lecturers under pressure, understandably, will maintain existing assessment and teaching systems rather than attempt to apply new techniques. Immeasurable hours, days or even weeks, …

Joint Intentions To Commit International Crimes, Jens David Ohlin Jan 2011

Joint Intentions To Commit International Crimes, Jens David Ohlin

Cornell Law Faculty Publications

The following article is an attempt to provide a coherent theory that international tribunals may use to ground the imposition of vicarious liability for collective crimes. Currently, the case law and the literature is focused on a debate between the Joint Criminal Enterprise (JCE) doctrine applied by the ICTY and the co-perpetration doctrine applied by the ICC, which defines co-perpetrators as those who have joint control over the collective crime. The latter doctrine, influenced by German criminal law theory, has recently won many converts, both in The Hague and in the Academy, because it allegedly avoids many of the pitfalls …

The Blues Is Alright: Blues Music As A Root For Cultural Tourism And Public History, Katherine Duvall Osteen Jan 2011

The Blues Is Alright: Blues Music As A Root For Cultural Tourism And Public History, Katherine Duvall Osteen

Electronic Theses and Dissertations

With a focus on the Mississippi Delta, Elvis Presley's Graceland, and Austin, Texas, this thesis is an exploration of the successes, failures, and necessary re-imaginings of sites of music lore, places in which the blues have played a role in music tourism, and how public history is used in different ways to accomplish a similar goal. For cities with ties to blues history, blues music tourism can become a source for financial stability as well as a teaching opportunity in the form of public history. Beyond a push to increase financial gain in places that are benefiting from blues tourism …

Relationship Between Coastal Vegetation Biomass With Elevation And Salinity Gradients, Ying Chen Jan 2011

Relationship Between Coastal Vegetation Biomass With Elevation And Salinity Gradients, Ying Chen

Electronic Theses and Dissertations

Surges and waves generated by hurricanes and other severe storms can cause devastating damage to property and loss of life in coastal areas. Vegetation in wetlands and coastal fringes can reduce storm surges and waves while complementing traditional coastal defense approaches such as permanent levees, seawalls and gates. The effectiveness of marsh vegetation in attenuating storm surge energy and reducing soil erosion depends on the level of primary production at the time of the storm surge and the ability of marsh vegetation to recover rapidly from damage caused by the storm surge. Marsh production depends on a variety of abiotic …

Board Diversity Revisited: New Rationale, Same Old Story?, Lisa M. Fairfax Jan 2011

Board Diversity Revisited: New Rationale, Same Old Story?, Lisa M. Fairfax

GW Law Faculty Publications & Other Works

Recently, board diversity advocates have relied on market- or economic-based rationales to convince corporate America to increase the number of women and people of color in the boardroom, in lieu of moral or social justifications. This shift away from moral or social justifications has been deliberate, and it stems from a belief that corporate America would better respond to justifications that centered on the corporate bottom line. However, recent empirical data reveals that despite the increased reliance on, and apparent acceptance of, market- or economic-based rationales for board diversity, there has been little change in actual board diversity. This Article …

New Perspectives On The Quatrefoil In Classic Maya Iconography The Center And The Portal, Rachel K. Egan Jan 2011

New Perspectives On The Quatrefoil In Classic Maya Iconography The Center And The Portal, Rachel K. Egan

Electronic Theses and Dissertations

The quatrefoil is a pan-Mesoamerican symbol with considerable time-depth. For the Maya, use of the symbol peaked during the Classic Period, reaching its highest frequency and largest geographical spread. Consequently, understanding its meaning has the potential to illuminate information about Precolumbian Maya worldview. While there have been several studies that focus on Preclassic Period quatrefoils, a similar study is lacking for Classic Period. Furthermore, the evaluations of the quatrefoil that do exist for the Classic Period are limited, often focusing on a select few examples. This thesis attempts to rectify the gap in extant research through an examination of the …

Attributes Influencing Meeting Planners' Destination Selection A Case Of Orlando, Fl, Adi Hayat Jan 2011

Attributes Influencing Meeting Planners' Destination Selection A Case Of Orlando, Fl, Adi Hayat

Electronic Theses and Dissertations

The meetings, incentives, conventions, and exhibitions (MICE) industry generates billions of dollars in direct and indirect spending annually, and is considered one of the fastest growing segments of the tourism industry. Destinations that want to capitalize on this industry must understand what drives its planners. The current study used Orlando, Florida as a case study, and investigated whether there are differences between the three meeting planners' types (association, corporate, 3rd party) in regards to destination selection attributes and the recent recession impact. The study further identified attributes that affect future bookings to Orlando. Data was collected from a nationwide survey …

Effects Of Different Canopy Tree Species On Belowground Biogeochemistry In A Wet Lowland Tropical Forest, Adrienne Blair Keller Jan 2011

Effects Of Different Canopy Tree Species On Belowground Biogeochemistry In A Wet Lowland Tropical Forest, Adrienne Blair Keller

Graduate Student Theses, Dissertations, & Professional Papers

Tropical rain forests are known for their tremendous biological diversity, but the effects of plant diversity on important ecosystem processes remain unclear. Interspecies differences in both the demand for nutrients and in foliar nutrient concentrations could drive differences in litter chemistry that affect both pools and fluxes of belowground resources. Yet, our understanding of the effects of aboveground biogeochemical heterogeneity on belowground ecosystems is poor, especially in the species-rich forests of the wet tropics. To investigate the effects of tree species diversity on belowground biogeochemical processes, I examined how carbon (C), nitrogen (N), and phosphorus (P) cycles vary under canopy …

Future Potential Net Primary Production Trends Of Contiguous United States Rangelands, Adam Lasalle Moreno Jan 2011

Future Potential Net Primary Production Trends Of Contiguous United States Rangelands, Adam Lasalle Moreno

Graduate Student Theses, Dissertations, & Professional Papers

Rangelands are an important ecosystem covering nearly 24% of the earth’s terrestrial vegetation. Climate change is predicted to affect many of the factors that influence the production of rangeland vegetation. Understanding future trends and patterns in net primary production (NPP) requires projected potential NPP to better understand how rangelands will be affected by a changing climate. Here, I used climate data projected from a global climate model (GCM) to drive the biogeochemical model (Biome-BGC) in an attempt to simulate future potential NPP trends in rangelands of the contiguous United States from 2001-2100 on a 100 km2 scale. In response to …

Strange Vicissitudes: The Memory And Uses Of Indian Captivity In The Progressive Era, Molly Kathleen Burnett Varley Jan 2011

Strange Vicissitudes: The Memory And Uses Of Indian Captivity In The Progressive Era, Molly Kathleen Burnett Varley

Graduate Student Theses, Dissertations, & Professional Papers

After the official closure of the frontier in 1890, small town boosters searched for ways to prove their participation in the national development on the frontier, to validate policies that promoted the Americanization of Native Americans, and to record for posterity their role as the vital hinge between past and present.

In seeking to understand the role of tales of Indian captivity in the national cultural identity, historians and scholars have usually focused on narratives from before 1890 or films after the turn of the century, virtually ignoring the tales reprinted during the Progressive Era. Yet as the danger of …

Nineteen characters, including bract and sepal leaves, petal marks, and capsule shape and size …

Cree Contraband Or Contraband Crees? Early Montanan Experiences With Transnational Natives And The Formation Of Lasting Prejudice, 1880–1885, Brenden Rensink Jan 2011

Cree Contraband Or Contraband Crees? Early Montanan Experiences With Transnational Natives And The Formation Of Lasting Prejudice, 1880–1885, Brenden Rensink

Department of History: Dissertations, Theses, and Student Research

To make order from chaos, societies and states often seek to define what constitutes illicit transnational behavior and identify who is committing such trespasses. Public verbalization and acceptance of these definitions aims at bringing a return to order. Foreign, transient, or otherwise peripheral elements of society are often targeted in these efforts. As modern globalization draws exponential links across borders and between nations, cultures, and economies, this process of anxiety, public rhetoric, and attempted enforcement will grow. An example of these phenomena can be drawn from the outcry and debate that raged across the Forty-ninth Parallel between Montana Territory and …

Genocide Of Native Americans: Historical Facts And Historiographic Debates, Brenden Rensink Jan 2011

Genocide Of Native Americans: Historical Facts And Historiographic Debates, Brenden Rensink

Department of History: Dissertations, Theses, and Student Research

One of the most sobering themes that underlie North American history is the demographic collapse that Euro-American contact initiated among many of the continent's indigenous peoples. As twentieth-century scholars consider the post-contact unfolding of Euro-American and Native American histories and the ways in which they have become inextricably intertwined, their oft-divergent trajectories raise immediate questions of causality. There is no doubt that contact with Euro-Americans served as the catalyst for sea changes in Native America, but the demographic decline apparent in historical retrospect was not an inevitable outcome to be imposed upon historical actors or events. To presume that the …

Essays On Consumer Charity, Joseph Thomas Paniculangara Jan 2011

Essays On Consumer Charity, Joseph Thomas Paniculangara

Electronic Theses and Dissertations

Two essays comprise this doctoral dissertation on consumers and their charitable donations. The overall objective is to investigate the role of psychological distance in charitable donations, with each essay dealing with a different moderator of this relationship. In the first essay, I study the interactive effect of social distance and processing mode (affect vs. cognition). Specifically, people tend to donate more if they use their emotions rather than cognition as diagnostic inputs for decision making, especially when donor and recipient are separated by greater social distance. This may be because affect-driven and cognition-driven donors are influenced by different goals. Affect-driven …

Higher Education Professional Pilot Faculty Qualifications: Are The Stakes Rising?, David C. Ison Jan 2011

Higher Education Professional Pilot Faculty Qualifications: Are The Stakes Rising?, David C. Ison

Applied Aerospace Science

"Within the aviation research literature there have been numerous studies that have either included or focused upon the attributes of associated faculty. Although such studies provide compelling data about these individuals, trends or changes in requirements for faculty are not easily identified within the findings. Of particular concern is the fact that credentialization, the escalation of required educational attainment and certification, has been permeating throughout higher education in the United States. It is of interest to see if such pressures are also infiltrating the collegiate aviation environment. Further, data about trends can help future faculty prepare for possible employment, it …

Another Role For Securities Regulation: Expanding Investor Opportunity, Jasmin Sethi Jan 2011

Another Role For Securities Regulation: Expanding Investor Opportunity, Jasmin Sethi

Fordham Journal of Corporate & Financial Law

Securities regulation can be justified on a number of grounds, but furthering the expansion of opportunities for wealth accumulation across sectors of the population has generally not been utilized as an argument for regulation. This article demonstrates how an opportunities-based perspective, informed by the findings from interdisciplinary research, could alter securities policy in four areas: (1) enhancing access to information and financial institutions; (2) requiring disclosures; (3) impacting the behavioral biases of investors; and (4) aligning the incentives of investment professionals to better facilitate the wealth accumulation of their clients. The implications of applying an opportunities-based approach to financial regulation …
