Financial Instability, Tax Policy, And The Tax Expenditure Concept, Timothy Edgar
Financial Instability, Tax Policy, And The Tax Expenditure Concept, Timothy Edgar
All Papers
As a public policy goal, moderation of financial instability has gained some prominence in the face of the current credit contraction. Not surprisingly perhaps, the role of tax policy in exacerbating instances of financial instability has begun to receive some attention in the tax-policy literature. Consistent with the general thrust of that literature, this paper explores, in a very preliminary way, how some selected tax-base rule choices line up with an explicit goal of ensuring that the tax system supports regulatory and monetary policies intended to moderate financial instability. The paper frames the inquiry in terms of Hyman Minsky's "financial …
International Civil Service Ethics, Professionalism And The Rule Of Law, Lorne Sossin, Vasuda Sinha
International Civil Service Ethics, Professionalism And The Rule Of Law, Lorne Sossin, Vasuda Sinha
All Papers
While the idea of public service independence and its relationship to the rule of law has received significant recognition in the Canadian context, it raises the question of whether an analogous set of ethical norms operate at the international level, in settings such as the United Nations and its agencies, the European Commission and other settings of multilateral governance. Is an independent, global or multilateral public service a necessary precondition for an international rule of law? By what mechanisms does the operation of bureaucracy in multilateral governance strengthen (or erode) the international rule of law?In this brief paper, we examine …
An Idea Of American Indian Land Justice: Examining Native Land Liberation In The New Progressive Era, Richael Faithful
An Idea Of American Indian Land Justice: Examining Native Land Liberation In The New Progressive Era, Richael Faithful
Celebrating WCL Student Authors
This article is inspired by Professor Robert Odawi Porter’s remarks during the 2009 D.C. Federal Indian Bar conference in which he outlined a seemingly radical proposal for “land liberation” for American Indian tribes – the abandonment of United States trusteeship over tribal land, and return of title and associated rights to numerous tribes who have lost their land due to nefarious governmental policies and bad deals. In an effort to bridge Porter’s visionary legal viewpoint with renowned economist and philosopher, Amartya Sen’s recent visionary contribution on justice, An Idea of American Indian Land Justice, helps revive an Indian law, critical …
Hibernacula Microclimate And White-Nose Syndrome Susceptibility In The Little Brown Myotis (Myotis Lucifugus), Laura Grieneisen
Hibernacula Microclimate And White-Nose Syndrome Susceptibility In The Little Brown Myotis (Myotis Lucifugus), Laura Grieneisen
Master’s Theses
The objective of this project was to determine the relationship between hibernacula microclimate and White-nose Syndrome (WNS), an emerging infectious disease in bats. Microclimate was examined on a species scale and at the level of the individual bat to determine if there was a difference in microclimate preference between healthy and WNS-affected little brown myotis (Myotis lucifugus) and to determine the role of microclimate in disease progression. There is anecdotal evidence that colder, drier hibernacula are less affected by WNS. This was tested by placing rugged temperature and humidity dataloggers in field sites throughout the eastern USA, experimentally determining the …
The Effects Of Apomorphine On Sexual Behavior And Aggression In Male Golden Hamsters, Molly Hyer
The Effects Of Apomorphine On Sexual Behavior And Aggression In Male Golden Hamsters, Molly Hyer
Master’s Theses
The general dopamine agonist apomorphine has been shown to have mostly facilitative effects on sexual behavior in rodents (Domingues & Hull, 2005; Bitran & Hull, 1987). A study looking at the effectsof apomorphine on sexual behavior in male golden hamsters observed that after systemic injections of apomorphine the males became aggressive towards the estrous females (Floody, unpublished). Studies on aggressive behavior have shown that apomorphine has facilitative effects on aggression in rodents (Nelson & Trainor, 2007; van Erp & Miczek, 2000; Ferrari, van Erp, Tornatzky, & Miczek, 2003). The studies presented here attempt to unravel the effects that apomorphine has …

A Good Drought Plan May Save Your Ranch And Improve Your Bottomline, Matthew C. Stockton, Sunil P. Dhoubhadel
A Good Drought Plan May Save Your Ranch And Improve Your Bottomline, Matthew C. Stockton, Sunil P. Dhoubhadel
Cornhusker Economics
If you are a beef cattle producer that depends on rain fed pasture then you know how costly a severe drought can be. Whatever actions are taken to mitigate drought, there is always an associated cost whether it be physical or psychological. From an economic perspective, drought mitigation is managed from two main objectives – demand management and/or supply management. Demand management options include decreasing the demand for feed, such as selling livestock, weaning calves early and moving them to a dry lot or sale and/or reducing the grazing time in pastures. Supply management includes options that increase the supply …
A Trade Secret Approach To Protecting Traditional Knowledge, Deepa Varadarajan
A Trade Secret Approach To Protecting Traditional Knowledge, Deepa Varadarajan
Faculty Publications
This Article argues that the doctrinal and normative divide between traditional knowledge protection and intellectual property law has been overemphasized, and that trade secret law can help narrow it. First, in terms of doctrinal fit, trade secret doctrine offers a viable model for protecting a subset of traditional knowledge that is not already publicly available. Broadly speaking, trade secret law imposes liability for the wrongful acquisition, use, or disclosure of valuable information that is the subject of reasonable secrecy efforts. Second, in addition to its practical import, the underlying justifications of trade secret law offer a useful normative guide for …
Franz Kafka, Lawrence Joseph, And The Possibilities Of Jurisprudential Literature, Patrick J. Glen
Franz Kafka, Lawrence Joseph, And The Possibilities Of Jurisprudential Literature, Patrick J. Glen
Georgetown Law Faculty Publications and Other Works
The purpose of this article is twofold. First, it offers a complementary reading of Franz Kafka’s writings on the law and Lawrence Joseph’s novel Lawyerland. This reading focuses on the distinct perspectives offered by these authors. Whereas Kafka approaches the law from the perspective of the litigant or accused, Joseph’s perspective, through the eyes of his lawyers and judges, is that of the consummate insider. The importance of perspective rests with the fact that although law might constitute an objective system, its experience is inevitably subjective. The absurd malevolence of law in Kafka can thus be rationalized by the system …
The Evolution Of International Environmental Law, Edith Brown Weiss
The Evolution Of International Environmental Law, Edith Brown Weiss
Georgetown Law Faculty Publications and Other Works
In the last forty years, international environmental law has evolved rapidly, as environmental risks have become more apparent and their assessment and management more complex. In 1972, there were only a few dozen multilateral agreements, and most countries lacked environmental legislation. In 2011, there are hundreds of multilateral and bilateral environmental agreements and all countries have one or more environmental statutes and/or regulations. Many actors in addition to States shape the development, implementation of, and compliance with international environmental law. Moreover, environment is increasingly integrated with economic development, human rights, trade, and national security. Analyzing the evolution of international environmental …
Elucidating The Biochemical Wizardry Of Triterpene Metabolism In Botroycoccus Braunii, Thomas Daniel Niehaus
Elucidating The Biochemical Wizardry Of Triterpene Metabolism In Botroycoccus Braunii, Thomas Daniel Niehaus
Theses and Dissertations--Plant and Soil Sciences
B. braunii is a green alga that has attracted attention as a potential renewable fuel source due to its high oil content and the archeological record of its unique contribution to oil and coal shales. Three extant chemotypes of B. braunii have been described, namely race A, race B, and race L, which accumulate alkadienes and alkatrienes, botryococcene and squalene and their methylated derivatives, and lycopadiene, respectively. The methylated triterpenes, particularly botryococcenes, produced by race B can be efficiently converted to high quality combustible fuels and other petrochemicals; however, botryococcene biosynthesis has remained enigmatic.
It has been suggested that botryococcene …
Morphological And Ultrastructural Changes In Tissues Of Intermediate And Definitive Hosts Infected By Protostrongylidae, Abdurakhim Ergashevich Kuchboev, Eric P. Hoberg
Morphological And Ultrastructural Changes In Tissues Of Intermediate And Definitive Hosts Infected By Protostrongylidae, Abdurakhim Ergashevich Kuchboev, Eric P. Hoberg
Turkish Journal of Zoology
Cellular and subcellular mechanisms involved in tissue responses to larval and adult lungworms (Protostrongylidae) were respectively explored through experimental and natural infections in molluscan intermediate (Xeropicta candacharica) and ruminant definitive hosts (Ovis aries). Reaction to developing larval stages in the gastropod is manifested as cellular infiltration involving lymphocytes and macrophages into the infected tissue, which restricts damage and may result in destruction and elimination of parasites from the intermediate host. Variations in the patterns of localization for infective third-stage larvae in the foot tissue of the intermediate host are described. In the definitive host, evaluation of lung tissue by histology …

The Structure And Defensive Efficacy Of Glandular Secretion Of The Larval Osmeterium In Graphium Agamemnon Agamemnon Linnaeus, 1758 (Lepidoptera: Papilionidae), Jagannath Chattopadhyay
Turkish Journal of Zoology
Histomorphological study of the larval (final instar) osmeterium gland in Graphium agamemnon agamemnon Linnaeus shows that each fully protruded Y-shaped osmeterium is composed of 2 elongated hollow tubular arms, which arise from a basal peduncle. The surface of the osmeterium has irregular folds, and papillae arise from some cells. There is an oval opening (gland pore, structurally less complicated than in other evolved species) in the proximal second seventh of the segment on each tubular arm on its posterior face. Histologically, 2 main types of secretory cells can be observed (excluding the muscle fiber cells and supporting cells): i) ellipsoid …

Descriptive Characteristics Of Haemopoietic Cell Lineages In A Facultative Air Breathing Fish Clarias Batrachus (L.), Krishna Gangopadhyay, Sumit Homechaudhuri
Turkish Journal of Zoology
Haemopoietic tissues of the head kidney of Clarias batrachus were studied for morphometric analysis and ultrastructural descriptions of the erythropoietic and leucopoietic cell populations. Eight successive steps of developing erythrocytes from small lymphoid haemoblasts (SLHs) to mature erythrocytes (MEs) were distinguished. Progressive loss of RNA and synthesis of haemoglobin during haemopoiesis were coupled with denser nucleus and changes in cellular shapes. Transmission electron microscopy aided in clear distinction between cell lineages in the development of erythrocytes, granulocytes, and lymphocytes. Ultrastructural analysis of the pronephric stromal cells forming adherent multilayer of haemopoietic microenvironment was explicit in describing their ability to promote …

Collagen Binding Proteins In Helicobacter Pylori, Carmel Cremin
Collagen Binding Proteins In Helicobacter Pylori, Carmel Cremin
Masters
Helicobacter pylori is a human pathogen and the causative agent of chronic gastritis, peptic ulcer and gastric malignancies. A number of H. pylori virulence factors have been described including, CagA, VacA, neutrophil activating protein, and expression of receptors for binding to extracellular matrix proteins (adhesins). H. pylori interacts with extracellular matrix (ECM) proteins such as collagen IV, laminin, vitronectin and fibronectin, that can be exposed due to loss of integrity of the gastric epithelial cell layer. These interactions may be important in the pathogenesis of the organism. This study examines the interaction of H. pylori with collagen IV in an …
Feminist Legal Theory As Embodied Justice, Roxanne Mykitiuk, Isabel Karpin
Feminist Legal Theory As Embodied Justice, Roxanne Mykitiuk, Isabel Karpin
Articles & Book Chapters
This chapter examines a shift within feminist legal theory from a central concern with sexual difference to one of embodied difference. The subject at the center of this theorizing is marked by bodily (as opposed to sexual) difference from the normative, self-actualizing individual of legal subjecthood. Bioethical and biotechnological inquiries too are concerned with bodily differentiation. Bodies discussed in these contexts are often anomalous or pathologized. They are brought under scrutiny, when they deviate from what is often regarded as "normal," that which is both valorized for its "species typicality" and, by extension, held out as the "natural" state of …
Reading Queer Subtexts In Children’S Literature, Jessica Kander
Reading Queer Subtexts In Children’S Literature, Jessica Kander
Master's Theses and Doctoral Dissertations
The purpose of this project is to explore and to challenge heteronormative assumptions regarding childhood and adolescence. I will show how these assumptions affect the literature published and made available to young readers, and how, often, overtly queer texts are not available for young readers. Such omissions leave young readers, especially those with lesbian, gay, bisexual, and/or transgendered (LGBT) identities, to find depictions of queerness in subtexts underlying seemingly “straight” texts. While these queer subtexts can be recognizable to readers through the use of culturally and historically significant markers that are understood to represent queerness, even a text with a …

Abandoned Love: The Impact Of Wyatt V. Stickney On The Intersection Between International Human Rights And Domestic Mental Disability Law, Michael L. Perlin
Articles & Chapters
Wyatt v. Stickney - the first case to find (40 years ago) a constitutional right to treatment for persons institutionalized because of mental disability - is the most important institutional rights case litigated in the history of domestic mental disability law. It spawned “copycat” litigation in multiple federal district courts and state superior courts, led directly to the creation of “Patients’ Bills of Rights” in most states, and inspired the creation of the Developmental Disabilities Assistance and Bill of Rights Act, the Mental Health Systems Act Bill of Rights, and the federally-funded Protection and Advocacy System. Its direct influence on …
