Rocky Mountain Birds: Birds And Birding In The Central And Northern Rockies, Paul A. Johnsgard Nov 2011

Rocky Mountain Birds: Birds And Birding In The Central And Northern Rockies, Paul A. Johnsgard

Zea E-Books Collection

“The Rocky Mountain region has fascinated me ever since I traveled to Glacier and Yellowstone National Parks as a teenager, and saw for the first time such wonderful birds as ospreys, American dippers, and Lewis’s woodpeckers.”

This book is in part based on the author’s earlier Birds of the Rocky Mountains (1986, revised 2009), but over a third of the original text has been eliminated. The rest has been updated, expanded and modified to be less technical and more useful to birders in the field. Bird enthusiasts will find viewing locations and updated contact information for hundreds of sites in …

Identification Of Novel Stat3 Target Genes Associated With Oncogenesis, Rachel Haviland Nov 2011

Identification Of Novel Stat3 Target Genes Associated With Oncogenesis, Rachel Haviland

USF Tampa Graduate Theses and Dissertations

Cytokine and growth factor signaling pathways involving STAT3 are frequently constitutively activated in many human primary tumors, and are known for the transcriptional role they play in controlling cell growth and cell cycle progression. However, the extent of STAT3's reach on transcriptional control of the genome as a whole remains an important question. We predicted that this persistent STAT3 signaling affects a wide variety of cellular functions, many of which still remain to be characterized.

We took a broad approach to identify novel STAT3 regulated genes by examining changes in the genome-wide gene expression profile by microarray, using cells expressing …

Life Force Of Nature, Sooyoung Kim Nov 2011

Life Force Of Nature, Sooyoung Kim

Theses

My work strives to illustrate the bond between Mother Nature and human beings. Primarily, I seek the harmony created by balanced compositions of natural and man-made objects. Any accidental visual conflict arising from this pairing is also a subject matter I find myself exploring within the execution my pieces. In our high-speed daily lives, we often find ourselves unsettlingly disconnected from nature. Stephen Harrod Buhner describes this feeling as "a loss of connection to plants, to the land, to Earth, [that] leaves the holes with which we are naturally born unfilled," and proposes that "the solution is reconnection to the …

Get The Balance Right!: Squaring Access With Patent Protection, Kristen Jakobsen Osenga

McGeorge School of Law Global Center for Business and Development Annual Symposium

Moderator: Michael Mireles, Associate Professor of Law, University of the Pacific, McGeorge School of Law

This panel will examine the impact of human rights norms on substantive intellectual property law. The focus of the panel is whether intellectual property law is adequately flexible to provide access to knowledge, in the form of primary and secondary materials as well as scientific materials, access to medicines, and access to food, such as seeds. The panel will further explore whether any flexibilities incorporated into intellectual property law harm the incentives provided by that law, including an analysis of parallel importation.

Cftc V. Gibraltar Monetary Corp. And Vicarious Liability Under The Commodity Exchange Act, Jason E. Friedman Nov 2011

Cftc V. Gibraltar Monetary Corp. And Vicarious Liability Under The Commodity Exchange Act, Jason E. Friedman

Fordham Law Review

This Comment analyzes CFTC v. Gibraltar Monetary Corp., a 2009 decision in which the U.S. Court of Appeals for the Eleventh Circuit introduced a control requirement into the Commodity Exchange Act's vicarious liability provision. In so doing, the court rejected the U.S. Commodity Futures Trading Commission's long-held totality of the circumstances approach, in which any one factor, including control, is not dispositive of an agency relationship. This decision has created an undesirable situation in which retail foreign exchange dealers and futures commission merchants need not investigate the character of their introducing entities before retaining them, allowing them to easily avoid …

The More You Gain, The More You Lose: Sentencing Insider Trading Under The U.S. Sentencing Guidelines, Danielle Demasi Chattin Nov 2011

The More You Gain, The More You Lose: Sentencing Insider Trading Under The U.S. Sentencing Guidelines, Danielle Demasi Chattin

Fordham Law Review

Insider trading defendants are sentenced under the general economic crime provisions of the U.S. Sentencing Guidelines. These provisions provide a chart, which prescribes a gradually increasing offense level based on “the gain resulting from the offense.” Only two circuit courts have yet to define “gain” for sentencing purposes, resulting in a split in methodology. Due to the tremendous weight the Guidelines place on the amount of “gain” when calculating a sentence, the potential result of using different methodologies to calculate “gain” is the difference between freedom and years of incarceration. This Note examines the problems involved with both of the …

A Case Study In Frontier Warfare: Racial Violence, Revenge, And The Ambush At Fort Laurens, Ohio, Kyle Somerville Nov 2011

A Case Study In Frontier Warfare: Racial Violence, Revenge, And The Ambush At Fort Laurens, Ohio, Kyle Somerville

Journal of Contemporary Anthropology

In February of 1779, a combined British and Native American raiding party ambushed a small group of American soldiers at an isolated fort on the Ohio frontier. The attack resulted in the deaths of at least 13 soldiers, many of who died from massive head injuries that, to modern researchers, do not appear to have been tactically necessary. However, rather than being an isolated instance of savagery or wartime atrocity this paper considers the ideological and cultural bases of violence behind the trauma, and will argue that the Fort Laurens ambush was just one example of violence in a long …

Too 'High' Tech: Metonymical Fallacies And Fetishism In The Perception Of Technology, Aníbal García Arregui Nov 2011

Too 'High' Tech: Metonymical Fallacies And Fetishism In The Perception Of Technology, Aníbal García Arregui

Journal of Contemporary Anthropology

This paper suggests that technology is excessively ‘high’ in two senses. The first sense refers to a high level of logical or grammatical abstraction: artifacts and machines are designated (in medias, everyday and scientific discourses) as ‘technology’, a word that etymologically refers to the knowledge surrounding those artifacts. Following the Logical Types Theory, the fact of designating concrete artifacts with the level of abstraction which corresponds to the totality containing those artifacts, leads us into metonymical or “vicious circle fallacies” (Whitehead & Russell, 1962). The second sense of ‘highness’ is symbolic. Recent works on Anthropology of Technology show that machines …

Broken Borders, Broken Laws: Aligning Crime And Punishment Under Section 2l1.1(B)(7) Of The U.S. Sentencing Guidelines, Genevieve Quinn Nov 2011

Broken Borders, Broken Laws: Aligning Crime And Punishment Under Section 2l1.1(B)(7) Of The U.S. Sentencing Guidelines, Genevieve Quinn

Fordham Law Review

Despite the intensifying militarization of the United States’ borders, roughly 4,000 undocumented immigrants attempt to cross into the U.S. each day. Increased border security has not stopped the flow; rather, it has diverted migrants’ journeys into the most perilous stretches of borderlands and coastlines. In response, migrants increasingly rely on human smugglers to guide them across the border, even in the face of the well-known risks of injury and death. Under section 2L1.1(b)(7) of the U.S. Sentencing Guidelines, defendants convicted of smuggling illegal immigrants are subject to a sentence enhancement for any bodily injury or death that occurs. The Guidelines …

Plant Pathology Faculty Publications

EDS1, PAD4, and SAG101 are common regulators of plant immunity against many pathogens. EDS1 interacts with both PAD4 and SAG101 but direct interaction between PAD4 and SAG101 has not been detected, leading to the suggestion that the EDS1-PAD4 and EDS1-SAG101 complexes are distinct. We show that EDS1, PAD4, and SAG101 are present in a single complex in planta. While this complex is preferentially nuclear localized, it can be redirected to the cytoplasm in the presence of an extranuclear form of EDS1. PAD4 and SAG101 can in turn, regulate the subcellular localization of EDS1. We also show that the Arabidopsis genome …
