Cyberspace, Exceptionalism, And Innocent Copyright Infringement, Jacqueline D. Lipton Jan 2011

Cyberspace, Exceptionalism, And Innocent Copyright Infringement, Jacqueline D. Lipton

Vanderbilt Journal of Entertainment & Technology Law

Direct copyright infringement attracts strict liability. However, as a theoretical matter, it is not necessarily clear why. Legislatures and courts have typically imposed strict liability where: (a) a defendant has notice of a plaintiff's rights, particularly where those rights involve a property interest; (b) a mens rea requirement on the part of the defendant would create an untenable burden on the plaintiff; (c) it is easier for the defendant to avoid harming the plaintiff than it is for the plaintiff to avoid the harm; or, (d) it is more administratively or economically efficient for the defendant to bear the risk …

¡Pendejo! Preschoolers’ Profane Play: Why Children Make Art, Marissa Mcclure Jan 2011

¡Pendejo! Preschoolers’ Profane Play: Why Children Make Art, Marissa Mcclure

Journal of Social Theory in Art Education

In this article, I address the concept of critical coalitions in play from two perspectives. First, I consider young children’s art making with digital video through contemporary play frames that propose moving beyond the dichotomy of subject (child as actor; active meaning-maker) and object (child as dupe; susceptible to media and moral panic). This reaffirms that play is at once contradictory, pleasurable, fantastic, and culturally purposeful. Analysis of young children’s digital video as play within frameworks proposed by Wilson (1976), Walkerdine (2007), and Freud (1922/1948) allows for an expansion of philosophical ideas about young children’s art making. This coalition between …

An Examination Of The Impact Of Smart Pen Technology On Mathematics Achievement And Attitudes Of Community College Students, Amy Marie Marolt Jan 2011

An Examination Of The Impact Of Smart Pen Technology On Mathematics Achievement And Attitudes Of Community College Students, Amy Marie Marolt

Electronic Theses and Dissertations

This study sought to examine the impact of instructional use of smart pen technology on the mathematics achievement and attitudes of community college students enrolled in a College Algebra course. This quasi-experimental, mixed-methods study utilized a nonequivalent control-group design. In this study, two sections of College Algebra were analyzed with one section serving as a treatment group which had access to an online archival of smart pen documents. The other section served as a control group which had access to an online archival of digital documents which did not have smart pen capabilities. The first hypothesis sought to analyze the …

Biopharmaceutic And Pharmacokinetic Evaluation Of Hesperidin And Hesperetin For Ocular Delivery, Ramesh Srirangam Jan 2011

Biopharmaceutic And Pharmacokinetic Evaluation Of Hesperidin And Hesperetin For Ocular Delivery, Ramesh Srirangam

Electronic Theses and Dissertations

The bioflavonoid hesperidin and its aglycone hesperetin are promising candidates for the treatment of diabetic retinopathy and diabetic macular edema because of their pharmacological properties. The objective of this project was to characterize the biopharmaceutic and pharmacokinetic characteristics of hesperidin and hesperetin for ocular delivery, especially with respect to the distribution of these compounds to the posterior segment of the eye. Hesperidin and hesperetin were found to be water insoluble compounds. Although they demonstrated good permeability across the ocular tissues, hesperetin's permeability was found to be higher than that of hesperidin. Hesperidin demonstrated symmetrical transcorneal and transretinal permeation whereas hesperetin …

Learning Through Quests And Contests: Games In Information Literacy Instruction, Maura A. Smale Jan 2011

Learning Through Quests And Contests: Games In Information Literacy Instruction, Maura A. Smale

Publications and Research

Games-based learning is an innovative pedagogical strategy employed at all levels of education, and much research in education, psychology, and other disciplines supports its effectiveness in engaging and motivating students, as well as increasing student learning. Many libraries have incorporated games into their collections and program-ming. College and university libraries have begun to use games for information literacy and library instruction. Academic librarians use commercially-produced games, create their own games, and employ game principles and mechanics to enhance their tradi-tional instructional offerings. While there may be impediments to implementing games-based learning for information literacy, the promising benefits of this approach …

Financing Direct Democracy: Revisiting The Research On Campaign Spending And Citizen Initiatives, John M. De Figueiredo, Chang Ho Ji, Thad Kousser Jan 2011

Financing Direct Democracy: Revisiting The Research On Campaign Spending And Citizen Initiatives, John M. De Figueiredo, Chang Ho Ji, Thad Kousser

Faculty Scholarship

The conventional view in the direct democracy literature is that spending against a measure is more effective than spending in favor of a measure, but the empirical results underlying this conclusion have been questioned by recent research. We argue that the conventional finding is driven by the endogenous nature of campaign spending: initiative proponents spend more when their ballot measure is likely to fail. We address this endogeneity by using an instrumental variables approach to analyze a comprehensive dataset of ballot propositions in California from 1976 to 2004. We find that both support and opposition spending on citizen initiatives have …

The Law And Policy Of Judicial Retirement, Mitu Gulati, Stephen J. Choi, Eric A. Posner Jan 2011

The Law And Policy Of Judicial Retirement, Mitu Gulati, Stephen J. Choi, Eric A. Posner

Faculty Scholarship

Lifetime tenure maximizes judicial independence by shielding judges from political pressures, but it creates problems of its own. As is widely known, judges with judicial independence may implement their political preferences or shirk in other ways. Less attention has been given to another problem: that judges will remain in office after their abilities degrade as a result of old age. The U.S. federal system addresses these problems in an indirect way. When judges’ pensions vest, they receive a full salary regardless of whether they work or not; thus, the effective compensation for judicial work falls to zero. Judges can retire, …

The Federal Common Law Crime Of Corruption, Lisa Kern Griffin Jan 2011

The Federal Common Law Crime Of Corruption, Lisa Kern Griffin

Faculty Scholarship

This contribution to the North Carolina Law Review’s 2010 symposium, Adaptation and Resiliency in Legal Systems, considers the compatibility between the common law nature of honest services fraud and the dynamic quality of public integrity offenses. Corruption enforcement became a focal point of recent debates about over- criminalization because it typifies expansive legislative mandates for prosecutors and implicit delegations to courts. Federal prosecutions of political corruption have relied primarily on an open-textured provision: 18 U.S.C. § 1346, the honest services extension of the mail fraud statute. Section 1346 raises notice concerns because it contains few self-limiting terms, but it has …

Four Constitutional Limits That The Minimum Coverage Provision Respects, Neil S. Siegel Jan 2011

Four Constitutional Limits That The Minimum Coverage Provision Respects, Neil S. Siegel

Faculty Scholarship

Opponents of the minimum coverage provision in the Affordable Care Act charge that if Congress can require most people to obtain health insurance or pay a certain amount of money, then Congress can impose whatever mandates it wishes—or, at least, whatever purchase mandates it wishes. This Essay refutes that claim by identifying four limits on the Commerce Clause that the minimum coverage provision honors. Congress may not use its commerce power: (1) to regulate noneconomic subject matter; (2) to impose a regulation that violates constitutional rights, including the right to bodily integrity; (3) to regulate at all, including by imposing …

The Deepwater Horizon (DWH) well blowout released more petroleum hydrocarbons into the marine environment than any previous U.S. oil spill (4.9 million barrels), fouling marine life, damaging deep sea and shoreline habitats and causing closures of economically valuable fisheries in the Gulf of Mexico. A suite of pollutants — liquid and gaseous petroleum compounds plus chemical dispersants — poured into ecosystems that had already been stressed by overfishing, development and global climate change. Beyond the direct effects that were captured in dramatic photographs of oiled birds in the media, it is likely that there are subtle, delayed, indirect and potentially …

Picturing Flag Violence In Civil War Sheet Music: The Case Of “Down With The Traitors’ Serpent Flag”, Kenneth Hartvigsen Jan 2011

Picturing Flag Violence In Civil War Sheet Music: The Case Of “Down With The Traitors’ Serpent Flag”, Kenneth Hartvigsen

Faculty Publications

Published in Chicago in 1861, “Down with the Traitors’ Serpent Flag” is one of thousands of political parlor songs from the American Civil War. Many of these songs are unremarkable musically and were preserved in homes, archives, and museum collections largely for their vibrant illustrations. In my presentation I examine this song’s lithographic cover illustration—a Union soldier grinding a Confederate flag into the dust—within a broader discourse of Civil War flag imagery taken from songs, political cartoons, and cartes-de-visite.

Compelling secrets exist within this colorful image that may not first meet the eye; to uncover these meanings along with the …
