Exhausted Or Unlicensed: Can Field-Of-Use Restrictions In Biotech License Agreements Still Prevent Off-Label Use Promotion After Quanta Computer?, Kristal M. Wicks

The University of New Hampshire Law Review

[Excerpt] “In the biotechnology (biotech) industry, companies must be increasingly aware of their intellectual property and how their licensing strategies can impact their rights. When licensing patented technology, it is common practice for biotech companies to include restricted field-of-use provisions in their license agreements. Such provisions permit a licensee to only use licensed technology in a defined field and restrict use or development in another field. This licensing strategy plays an important role within the biotech industry because it allows companies to more effectively control their intellectual property and to more efficiently research and develop pharmaceutical products.

A problem that …

A Chinese Case Study In Using Psychoanalysis For Ethnography, Maris Boyd Gillette Dec 2010

A Chinese Case Study In Using Psychoanalysis For Ethnography, Maris Boyd Gillette

Southern Anthropologist

In this article I explore a surprising conversation that I had with a Chinese Muslim woman named Sheng Lanying. Her persistent tendency to see images of Mao that were no longer present led me to examine how personal, emotional meanings informed her experience of nation-building. After providing basic historical context about the Chinese revolution, I present the conversation between Sheng and me. Then I discuss how anthropologists can use, and have used, psychoanalysis for ethnography. I next apply the psychoanalytic approach that I find most useful to Sheng’s memories. I conclude with a discussion of what anthropologists can gain from …

Recommendations For The Chamlidere Petrified Forest Management Plan, Fatma Ertem Dec 2010

Recommendations For The Chamlidere Petrified Forest Management Plan, Fatma Ertem

Graduate Theses and Dissertations

Anything inherited from our ancestors or from nature can be considered as our heritage. Heritage can be classified as cultural and natural heritage. Turkey has been the cradle of many civilizations, religions, and ethnic groups because of the unprecedented natural heritage and critical geopolitical location of Anatolia. Given all the treasure of cultural and natural heritage in Turkey, heritage management practices have not been emphasized as they deserve. A petrified forest was found in Chamlidere, Ankara (Turkey) in 2004. Chamlidere petrified forest preserves information related to the biodiversity of forests in the Galatian Volcanic Province during the Early-Middle Miocene. When …

The Life Of An Unknown Assassin: Leon Czolgosz And The Death Of William Mckinley, Cary H. Federman Dec 2010

The Life Of An Unknown Assassin: Leon Czolgosz And The Death Of William Mckinley, Cary H. Federman

Department of Justice Studies Faculty Scholarship and Creative Works

The purpose of this essay is to examine the discourses that surrounded the life of Leon Czolgosz, the assassin of President William McKinley. The gaps in Czolgosz’s life, his peculiar silences, his poor health and the ambiguity and thinness of his confession, rather than taken as instances of mental and physical distress, have, instead, been understood as signs of a revolutionary anarchistic assassin. Czolgosz is an expression of a cultural tradition in somatic form. I argue that the discursive construction of criminality, already present in the late nineteenth century within the medical and human sciences, is what shaped Czolgosz’s life …

An Integrated Pest Management Analysis For Controlling Pocket Gophers At Adobe Road Vineyards, Eric C. Browning Dec 2010

An Integrated Pest Management Analysis For Controlling Pocket Gophers At Adobe Road Vineyards, Eric C. Browning

Agribusiness

This study was undertaken to determine the economical threshold that commercial growers can endure before they need to begin controlling pocket gophers (Thomomys bottae), specifically in wine-grape vineyards. Pocket gophers cause extensive damage to grapevine roots year round and can cause economical loss from the elaborate underground tunnels they create while burrowing.

This report represents six different methods of controlling pocket gophers in a wine-grape vineyard during the late summer and early fall seasons. An analysis of control and cost analysis has been performed to forecast the most economical way for commercial growers to control gophers. Four different restricted use …

A Stylistic Analysis Of Three Flute Pieces By David Froom: Circling For Flute And Clarinet, To Dance To The Whistling Wind For Solo Flute, And Lightscapes For Flute And Piano, Candice Behrmann

Glenn Korff School of Music: Dissertations, Theses, Student Creative Work, and Performances

American composer David Froom has worked with groups such as the New York New Music Ensemble and the 21st Century Consort. His music has been performed extensively, and he continues to receive commissions from individuals throughout the United States. He is best known for his piano sonata (1980) and his chamber concerto (1991); his flute music is relatively unknown.

This study focuses on three of Froom‘s flute works: Circling (2002), To Dance to the Whistling Wind (1993), and Lightscapes (2006). It provides an analysis of each work and examines Froom‘s use of motivic and intervallic relationships in each movement. Scores …

Three Works For Flute By Ian Clarke: An Analysis And Performance Guide, Shelly L. Monier

Glenn Korff School of Music: Dissertations, Theses, Student Creative Work, and Performances

British flutist Ian Clarke is currently recognized as one of the leading flutist/composers of today. His compositions have been performed at national conventions and used in competitions hosted by the British Flute Society and the National Flute Association and have been included in the Peters Edition reference of the Edexcel GCSE (General Certificate of Secondary Education) Anthology of Music as a music example of extended instrumental techniques. Many of his works, while heavily influenced by popular music, explore unconventional sounds, using inventive avant-garde flute techniques and notations that are unfamiliar to many flutists. Since there has been little scholarly research …

A Comprehensive Simulation Model For Floating Gate Transistors, Steven Joseph Rapp Dec 2010

A Comprehensive Simulation Model For Floating Gate Transistors, Steven Joseph Rapp

Graduate Theses, Dissertations, and Problem Reports (ETD)

Floating-gate transistors have proven to be extremely useful devices in the development of analog systems; however, the inability to properly simulate these devices has held back their adoption. The objective of this work was to develop a complete simulation model for a floating-gate (FG) MOSFET using both standard SPICE primitives and also MOSFET models taken directly from foundry characterizations. This new simulation model will give analog designers the ability simulate all aspects of floating-gate device operation including transient, AC and DC characteristics. This work describes the development of this model and demonstrates its use in various applications.

The Politics And Policy Of Small City Downtown Development, Thomas K. Bias Dec 2010

The Politics And Policy Of Small City Downtown Development, Thomas K. Bias

Graduate Theses, Dissertations, and Problem Reports (ETD)

Many theories on successful small city development and revitalization efforts hinge on three major areas; Policies and programs, quality of life, and strong coalitions between government, non-profit groups, local business, and residents. This dissertation examines the affects that government policies and programs (e.g., Main Street programs, zoning laws, etc.) have on the success of small city development and revitalization efforts. Using original survey data from a sample of key small city policy makers across the United States, this dissertation explores how perceptions of small city downtowns are influenced by government efforts to improve them. Regression analysis is employed to determine …

Effectiveness Of Cetylpyridinium Chloride, Chlorhexidine Gluconate, Chlorine Dioxide, And Essential Oils Against F. Nucleatum, P. Gingivalis, S. Mutans And S. Sobrinus---A Biofilm Approach, Kristafer Lee Adkins

Graduate Theses, Dissertations, and Problem Reports (ETD)

Results of evaluating chemotherapeutic effectiveness have focused on planktonic, two-dimensional bacterial existence. Biofilms exist as three-dimensional structures which shelter bacteria deep within. Current research is needed to evaluate the effectiveness of various chemotherapeutics against bacteria residing inside of a biofilm. In order to do so, this study evaluated the effectiveness of four common chemotherapeutics (cetylpyridinium chloride, chlorhexidine gluconate, chlorine dioxide, and essential oils) against four bacteria (S. mutans, S. sobrinus, F. nucleatum and P. gingivalis) in both planktonic and biofilm modeled culture media. Data was obtained through the measurement of zones of inhibition (ZOI) surrounding test discs placed on experimental …

A Study And Performance Analysis Of Selected Art Songs By Un-Yeong Na, Min Sue Kim Dec 2010

A Study And Performance Analysis Of Selected Art Songs By Un-Yeong Na, Min Sue Kim

Graduate Theses, Dissertations, and Problem Reports (ETD)

Korea's history spans over 5,000 years. A rich culture of Korean arts developed through the foresight and vision of Korean nobility and the artistic "underground" during periods of occupation. Korea was exposed to Western cultural influences beginning with the arrival of American Christian missionaries in the mid-19th century and the Japanese invasion and occupation (1910-1945). During the Japanese colonial period, the Korean people were forced to accept new cultural ideas including new forms and styles of music. After the emancipation from Japan, music in Korea was already becoming settled in the Western music system. Some composers who were active during …

A Degradation Model For Solid Oxide Fuel Cell Anodes Due To Impurities In Coal Syngas, Fatma Nihan Cayan Dec 2010

A Degradation Model For Solid Oxide Fuel Cell Anodes Due To Impurities In Coal Syngas, Fatma Nihan Cayan

Graduate Theses, Dissertations, and Problem Reports (ETD)

Solid Oxide Fuel Cells (SOFCs) offer great promise as a clean and efficient alternative to conventional power generation technologies. A major advantage of SOFCs in comparison to other fuel cell types is that they can be operated directly on a wide variety of fuels including biogas, hydrocarbon fuels and coal-derived synthesis gas (syngas). SOFC operating on coal syngas is an especially attractive prospect given the abundant coal resources in the world. However, coal syngas usually contains various impurities such as phosphorus, arsenic, zinc, sulfur, mercury, selenium, and vanadium which affect the performance and durability of SOFCs. At low impurity concentrations, …

Milwaukee Independent Charter Schools Study: Report On One Year Of Student Growth, John F. Witte, Patrick J. Wolf, Alicia Dean, Deven Carlson Dec 2010

Milwaukee Independent Charter Schools Study: Report On One Year Of Student Growth, John F. Witte, Patrick J. Wolf, Alicia Dean, Deven Carlson

School Choice Demonstration Project

The general purpose of this evaluation is to assess the effectiveness of independent charter schools in promoting two desirable student outcomes: student achievement growth and educational attainment. Independent charter schools are authorized by non-district entities and are considered “independent” because they are not a part of the Milwaukee Public School District. We will estimate achievement growth of independent charter school students in grades 3-8 over four years in reading and math on the Wisconsin Knowledge and Concepts Examination (WKCE). Similarly, in later reports we will track student attainment, specifically whether uppergrade cohorts in our evaluation graduate from high school. Case …

Age-Associated Changes In Synaptic Lipid Raft Proteins Revealed By Two-Dimensional Fluorescence Difference Gel Electrophoresis, Lei Jiang, Jianwen Fang, David S. Moore, Natalia V. Gogichaeva, Nadezhda A. Galeva, Mary L. Michaelis, Asma Zaidi Dec 2010

Age-Associated Changes In Synaptic Lipid Raft Proteins Revealed By Two-Dimensional Fluorescence Difference Gel Electrophoresis, Lei Jiang, Jianwen Fang, David S. Moore, Natalia V. Gogichaeva, Nadezhda A. Galeva, Mary L. Michaelis, Asma Zaidi

Faculty and Staff Publications

Brain aging is associated with a progressive decline in cognitive function though the molecular mechanisms remain unknown. Functional changes in brain neurons could be due to age-related alterations in levels of specific proteins critical for information processing. Specialized membrane microdomains known as 'lipid rafts' contain protein complexes involved in many signal transduction processes. This study was undertaken to determine if two-dimensional fluorescence difference gel electrophoresis (2D DIGE) analysis of proteins in synaptic membrane lipid rafts revealed age-dependent alterations in levels of raft proteins. Five pairs of young and aged rat synaptic membrane rafts were subjected to DIGE separation, followed by …

Stoneridge Investment Partners, Llc V. Scientific-Atlanta, Inc.: The Evisceration Of Investor Protection, William A. Gregory, Sherri Johnson

Southern Illinois University Law Journal

In Stoneridge Investment Partners, LLC v. Scientific-Atlanta, Inc. the United States Supreme Court interpreted Securities and Exchange Commission Rule 10b-5 and the Private Securities Litigation Reform Act of 1995 to determine whether a person liable for aiding and abetting the securities fraud of another party can be held liable as a primary violator of Rule 10b-5 for purposes of private civil actions on the theory that he participated in a scheme to defraud. In deciding that an aider and abettor is not so liable, the Court reaffirmed its prior holding in Central Bank of Denver v. First Interstate Bank of …

Toward A New Standard For The Admission Of Expert Evidence In Illinois: A Critique Of The Frye General Acceptance Test And An Argument For The Adoption Of Daubert, Paul A. Rodrigues Dec 2010

Toward A New Standard For The Admission Of Expert Evidence In Illinois: A Critique Of The Frye General Acceptance Test And An Argument For The Adoption Of Daubert, Paul A. Rodrigues

Southern Illinois University Law Journal

Illinois courts continue to apply the general acceptance test announced in Frye v. United States, as opposed to the Daubert approach used by the federal courts, to determine the admissibility of expert evidence. This article reviews both standards and argues that Illinois should abandon the Frye test in favor of the current federal admissibility standard laid out in the line of cases beginning with Daubert v. Merrell Dow Pharmaceuticals, Inc. The recent Illinois Supreme Court decision in People v. McKown demonstrates the flaws of the current Frye analysis. The case fails, however, to adequately draw boundaries between “novel scientific evidence” …

A Dignified Death? Don’T Forget About The Physically Disabled And Those Not Terminally Ill: An Analysis Of Physician-Assisted Suicide Laws, Cyndi Bollman Dec 2010

A Dignified Death? Don’T Forget About The Physically Disabled And Those Not Terminally Ill: An Analysis Of Physician-Assisted Suicide Laws, Cyndi Bollman

Southern Illinois University Law Journal

There are presently two states which have legalized physician-assisted suicide by enacting death with dignity statutes: Oregon and Washington. In late 2009, the Montana Supreme Court essentially legalized physician-assisted death by stating that there was no state law to suggest that it was against public policy. Under the presently-enacted death with dignity statutes of Oregon and Washington, a person who suffers from a physically incapacitating ailment cannot be assisted by her physician in suicide because she is unable to ingest the lethal prescription herself. Additionally, the laws of Oregon and Washington each restrict physician-assisted suicide to patients who are terminally …
