By combining three tools that independently are beneficial to taxpayers, clever estate planners have devised a transaction - the installment sale of discounted assets to an intentionally defective grantor trust - that saves their ultra-wealthy clients millions of dollars in estate and gift taxes. This transaction, which is a foundational part of many estate plans, takes advantage of rules that Congress never intended to be used in this way. Becasue the Internal Revenue Service has conceded its inability to challenge the transaction based on current law, any solution lies with Congress. Transportation accounts for 70% of oil consumption, and yet only 10-20% the fuel energy is used for vehicle mobility. One of the important losses is the energy dissipation in suspension vibration. The objectives of this thesis are to investigate energy recovery from vehicle suspensions by answering two questions: (1) how much energy is available while meeting the primary functions of shock absorbers? (2) how can the wasted energy be converted efficiently to electricity? A forest carbon (C) sequestration project was conducted to evaluate the economic incentives that would be required by landowners to engage in C trading under different management regimes. Costs associated with joint management for C sequestration and timber would be valuable for establishing sound forest C trading systems. In this study, we calculated the C yield and amortized value of three Wyoming, ponderosa pine stands. The management practices examined were, unmanaged, even-aged (regene-ration after clear-cut) and uneven-aged (selectively harvested). Costs and revenues associated with three stands were converted into 2006 real dollars using the all commodity producer price index to …

Late Holocene Relationships Among Fire, Climate, And Vegetation In Rangeland Ecosystems Of Southwestern Idaho, Nathan A. Nelson, Jennifer Pierce

Rangelands are characterized by more arid climates than forested regions; therefore, establishing fire histories using traditional methods (e.g. fire-scars from trees or charcoal in lake sediments) is problematic. This study uses radiocarbon dating of charcoal preserved in alluvial fans and stream deposits to reconstruct a record of fire and geomorphic response in rangelands of southwestern Idaho. Samples indicate three primary periods of fire-related activity: 4400 – 4000, 2000 – 1400, and 650-400 cal yr BP. Charcoal macrofossil identification and comparison with other regional climate and fire records indicate this area has likely switched between a "fuel-limited" system (fires limited by …

Criminal Offending Among Respondents To Protective Orders: Crime Types And Patterns That Predict Victim Risk, Carol E. Jordan, Adam J. Pritchard, Danielle Duckett, Richard Charnigo

Office for Policy Studies on Violence Against Women Publications

Research has shown that respondents to protective orders have robust criminal histories and that criminal offending behavior often follows issuance of a protective order. Nonetheless, the specific nature of the association between protective orders and criminal offending remains unclear. This study uses two classes of statistical models to more clearly delineate that relationship. The models reveal factors and characteristics that appear to be associated with offending and protective order issuance and provide indications about when a victim is most at risk and when the justice system should be most ready to provide immediate protection.

Internet security requires newer prevention mechanisms to be implemented on web-servers and routers. Firewall/Intrusion Prevention mechanisms (IPS) can be deployed on host servers or routers as an added line of defense against Internet attacks. In this thesis, we evaluate performance of security mechanisms provided by these devices against Distributed Denial of Service (DDoS) attacks. The host based firewalls on Windows servers-2003 and 2008 were evaluated. In this thesis, we also evaluated Juniper Networks Netscreen-5GT firewall/IPS, and Cisco ASA-5510/IPS that are used in protecting web-servers against DDoS attacks. For any analytic self-map φ of {z : |z| < 1} we give four separate conditions, each of which is necessary and sufficient for the composition operator Cφ to be closed-range on the Bloch space B . Among these conditions are some that appear in the literature, where we provide new proofs. We further show that if Cφ is closed-range on the Bergman space A2 , then it is closed-range on B , but that the converse of this fails with a vengeance. Our analysis involves an extension of the Julia-Carathéodory Theorem.

Objective To test the diagnostic use of the triage white blood cell (WBC) count in differentiating major from minor injuries. Methods We conducted a retrospective study of a prospectively collected database of trauma patients 13 years of age or older at a Level I trauma center from January 2005 through December 2008. We excluded all patients with obvious life-threatening injuries requiring immediate surgery, isolated head trauma, transferred from another institution or dead on arrival. We recorded age, sex, injury mechanism, vital signs, WBC, base deficit (BD), lactate (LAC) and calculated injury severity scores (ISS). Major injury was defined as either …

The Unjustified Judicial Creation Of Class Certification Merits Trials In Securities, Michael J. Kaufman, John M. Wunderlich

University of Michigan Journal of Law Reform

The class action device is vital to deterring securities fraud and remedying its victims, who almost never suffer losses sufficient to justify an individual suit. Nonetheless, the federal courts have begun to convert the class certification process into a premature trial on the merits, thereby precluding victims of securities fraud from pursuing otherwise valid claims of financial wrongdoing. In particular, in a series of important decisions, the federal courts have required plaintiffs to prove the essential elements of their securities fraud claims at the preliminary class certification stage.

Nowadays, nanoelectroctronic, electro-nanotechnologies environmental friendly products become the roadmap in industry. Hence, nanoscale of reinforcement into lead-free solder becomes more popular rather than the micro size of reinforcement. In this paper, Cobalt nanoparticles-reinforced Sn-Ag-Cu composite solders were prepared by thoroughly blending 0.75 wt% of cobalt nanoparticles with near eutectic cement tended to suppress the growth of Cu3Sn intermetallic layer. However, upon addition of Co nanoparticles, the growth of Cu6Sn5 was enhanced. This paper addresses the relationship between the roles of the internal auditor (IA) and authority. The internal auditor's varying roles that include control oversight, decision support, risk management support, governance, system involvement, technical and intimidation, are determined by how the internal auditor himself perceives his work and the extent of which he enjoys role clarity. The results show that although the management intimidation role is dominant in explaining the variance in authority, this construct only explains l3.7 percent variance in authority. BACKGROUND AND PURPOSE: 17-O-acetylacuminolide (AA), a diterpenoid labdane, was isolated for the first time from the plant species Neouvaria foetida. The anti-inflammatory effects of this compound were studied both in vitro and in vivo. EXPERIMENTAL APPROACH: Plant extracts were initially tested against LPS-stimulated release of tumor necrosis factor alpha (TNF-α) from murine macrophages (RAW264.7 cells). Based on bioassay-guided fractionation, the active compound was identified as AA. AA was tested for its ability to reduce nitric oxide (NO) production, and the inducible nitric oxide synthase (iNOS) expression. Purpose: The purpose of our study was to examine the relationship between child maltreatment, physical and sexual victimization, and partner violence victimization with human immunodeficiency virus (HIV) risk behaviors among a sample of homeless young adults from the midwestern United States.
Methods: Data are from the Homeless Young Adult Project. A total of 199 young adults aged 19–26 years were interviewed over 14 months using a systematic sampling strategy. The final sample included 172 young adults who were homeless or had a history of running away and being homeless.

Farming, ranching, and other agricultural activities are in a relatively unique position amongst all human-caused sources of global warming. Unlike fossil fueled power plants and vehicles, for example, agriculture will suffer direct economic losses from the impacts of global warming on its products, such as through reduced crop yields. Also unlike other causes of global warming, agriculture can both mitigate global warming and increase revenue through a range of different practices, such as carbon sequestration and investments in carbon-friendly renewable energy.
