Electronic Portfolios Across The Disciplines: Using Technology As An Authentic Assessment Tool, Beth Klingner, Linda Anstendig

Cornerstone 3 Reports : Interdisciplinary Informatics

Our project has contributed to the 3rd cornerstone by helping students and faculty to think in a more interdisciplinary fashion by making connections across the disciplines, as well as between students’ academic and extra/co-curricular activities. The ePortfolio promotes the collection of and reflection on artifacts via technology, which is another key aspect of this cornerstone. Through ePortfolios, we are enhancing students' informational and technological literacy and helping them to think more deeply and critically about all of their learning experiences.

Historic Preservation And The Wilderness, Seth Kagan Dec 2010

Historic Preservation And The Wilderness, Seth Kagan

Elisabeth Haub School of Law Student Publications

The language of Article XIV of the New York State Constitution has been the focus of a contentious debate over the years: What can be done with the lands within the Forest Preserve without violating the provision to keep the lands “forever wild”? In particular, how does Article XIV treat preservation of historic sites and archaeological resources within the Forest Preserves? The paper discusses competing interests between the “forever wild” provision and that of historic preservation through examination of the legislative history, administrative and judicial action. The paper also contemplates a constitutional convention for the purposes of amending Article XIV …

History Of New York State’S “Forever Wild” Forest Preserve And The Agencies Charged With Carrying Out Article Xiv’S Mandate, Jessica B. Silver Dec 2010

History Of New York State’S “Forever Wild” Forest Preserve And The Agencies Charged With Carrying Out Article Xiv’S Mandate, Jessica B. Silver

Elisabeth Haub School of Law Student Publications

Article XIV is probably the most controversial provision of the New York State Constitution adopted in 1894. The provision declares that State-owned land in the Adirondack and Catskill State Parks shall remain “forever wild.” Yet, implementation of this mandate by the State has varied since its inception; actions are dependent on the views and policies of regulating agency. The paper traces the history of Article XIV through judicial interpretation, Attorney General’s opinions, and implementation activities by the agency charged with its enforcement. The purpose of this paper is to prepare the policy-makers who will have a voice at the next …

Legislative History And Current Bills Related To The Constitution Convention, Michael Friese

Elisabeth Haub School of Law Student Publications

The purpose of this paper is to provide a critical look at the legislative history of Article VII (now Article XIV). Specifically, it will discuss the events leading up to the 1894 Constitutional Convention (the convention was Article XIV and the “Forever Wild Provision” was adopted); the events and legislative acts between the 1894 and 1915 constitutional conventions; the 1915 Constitutional Convention; the events and legislative acts between 1915 and 1938; and the 1938 Constitutional Convention. The paper will also address the delegate election process, as well as proposed reforms to the process. It is the intention of this paper …

“Forever Wild”: Legal Aspects Of Natural Resource Extraction In And Around The New York State Forest Preserve, Michael D. Henderson Dec 2010

“Forever Wild”: Legal Aspects Of Natural Resource Extraction In And Around The New York State Forest Preserve, Michael D. Henderson

Elisabeth Haub School of Law Student Publications

Since its inception in 1894, Article XIV of the New York State Constitution has served as a baseline for environmental protection of the New York Forest Preserve. Yet today it has become apparent to those who study or simply enjoy the Adirondack and Catskill regions that our goal in preservation is much more. We preserve wilderness so we can hold on to a piece of the past, a piece of America’s history. That said the issue is what constitutes wilderness – a legally designated wilderness area, wilderness as a common term or land that embraces the “Forever Wild” aesthetic. This …

Interpreting Article Xiv Of The New York Constitution: The Legal Measures That Mandate Sustainable Economic Development And Maintenance Of Forever-Wild Forest In The Adirondacks, Chih-Yao Sun Dec 2010

Interpreting Article Xiv Of The New York Constitution: The Legal Measures That Mandate Sustainable Economic Development And Maintenance Of Forever-Wild Forest In The Adirondacks, Chih-Yao Sun

Elisabeth Haub School of Law Student Publications

The Forever Wild clause enacted by the legislature aimed at protecting drinking water and commerce. The language of the Forever Wild clause has offered a strong and perpetual protection that serves the purpose of people of New York State. Any amendments will only weaken the article. To support the position that the Forever Wild clause should remain as is, the paper examines the long-ignored economic value provided by the Adirondacks Forest Preserve. The paper also proposes plausible sustainable developments and illustrates why state government has the duty to promote economic well-being in local communities.

On The Role And Regulation Of Proxy Advisors, Paul Rose Dec 2010

On The Role And Regulation Of Proxy Advisors, Paul Rose

Michigan Law Review First Impressions

In anticipation of proxy season-the springtime ritual where companies prepare and deliver proxy statements in preparation for annual shareholder meetings-U.S. public companies typically reexamine their corporate governance structures and policies. Many corporate governance structures that were acceptable ten years ago are now considered outmoded or even evidence of managerial entrenchment. For example, consider the classified board of directors. In recent years, many companies have shifted from a classified board of directors to an annually elected board. A company might adopt an annually-elected board structure for a number of reasons. A classified board can serve as an entrenchment device, for instance, …

Biofuel Ethanol Production By Saccharomyces Bayanus, The Champagne Yeast, Kristen Miller Dec 2010

Biofuel Ethanol Production By Saccharomyces Bayanus, The Champagne Yeast, Kristen Miller

All Theses

The importance of biofuel ethanol is growing as the demand for clean, renewable fuels produced from non-food sources increases. The United States relies mainly on corn and the yeast Saccharomyces cerevisiae for the production of ethanol. A shift to cellulosic feedstocks, as the main source of biomass for ethanol production, would alleviate the pressure on farmers to produce corn for both the food industry and the ethanol industry. Example cellulosic feedstocks include switchgrass, sorghum, and canary grass. The cellulosic feedstocks are typically grown on land that cannot support economic food production, and thus lay unused.
For cellulosic feedstocks to be …

A Numerical And Experimental Study Of Differential Settling In Cohesive Sediment, Chad Heiliger Dec 2010

A Numerical And Experimental Study Of Differential Settling In Cohesive Sediment, Chad Heiliger

All Theses

Accurate sedimentation modeling has important applications in a number of fields. This includes modeling the accumulation of sediment in harbor channels and modeling the sedimentation and accumulation of particles in retention ponds in the still waters behind dams in order to calculate the trap efficiency. By accurately modeling sedimentation, engineering failures such as the 2008 TVA spill at the Kingston Fossil Plant could possibly be avoided. Three different numerical models comparing the settling rates of individual particles in quiescent waters were created to compare the change of settling velocity due to particle size distributions, change of local concentrations, and flocculation …

Prospective Memory In The Nursing Environment: Effects Of Type Of Prospective Task And Prospective Load, Nicole Fink Dec 2010

Prospective Memory In The Nursing Environment: Effects Of Type Of Prospective Task And Prospective Load, Nicole Fink

All Theses

The nursing environment is replete with event-based and time-based prospective memory (PM) tasks (i.e. high prospective load). However, the effects of time-based prospective load, prospective load in naturalistic settings, and prospective load with unique retrospective components for each PM task remains unknown. To address this gap, the current study used a mockup patient room setting to examine the effects of PM type (event-based or time based) and prospective load (1 vs. 4 tasks) with unique prospective and retrospective components) on ongoing task and PM task performance. Registered nurses completed an ongoing documentation task while also remembering to perform 1 or …

Pilot-Scale Constructed Wetland Treatment System For Ammonia Removal From Oil-Field Produced Water, Yun Song Dec 2010

Pilot-Scale Constructed Wetland Treatment System For Ammonia Removal From Oil-Field Produced Water, Yun Song

All Theses

This investigation examined the feasibility of using free-water surface constructed wetland systems (CWTSs) to decrease the ammonia concentration in oil-field produced water. The objective of this research was to design constructed wetland experiments to determine specific conditions that decrease aqueous ammonia concentrations in simulated oilfield produced water. The design of these experiments was based on biogeochemical pathways of nitrification and denitrification. The experiments included three scales: bench-scale, single-cell, and pilot-scale. Bench-scale reactors contained wetland plants (Typha latifolia) and hydrosoil in 5-gallon buckets. Single wetland cells were constructed by adding hydrosoil and plants (T. latifolia and Schoenoplectus californicus) to 70-gallon containers. …

Boxed Up, Alicia Raymond Dec 2010

Boxed Up, Alicia Raymond

Theses & Honors Papers

The purpose of this thesis is to conduct an examination through creative nonfiction of the definition of home and how I personally define and apply this definition to my own life. In the nine essays serving as my thesis, collectively entitled "Boxed Up," I have delved into the definitions of home and how it applies to my family, my experiences and encounters with people around me, and the twelve times that I have moved. The sense and definition of a home has a strong tie to where someone grew up and to what culture one acclimates oneself. There is also …

The Young Adult Addiction Novel: A Modern Tragedy, Carrie Rosson Hicks Dec 2010

The Young Adult Addiction Novel: A Modern Tragedy, Carrie Rosson Hicks

Theses & Honors Papers

This thesis defines tragedy and introduces the young adult addiction novel as a form of modern tragedy. The tragedy genre has altered drastically throughout the ages. The new brands of tragedy reflects the vastly different society in which modern readers live, whereas, original tragedies focused on royalty or political leaders and were often written in verse until the eighteenth. This thesis examines Ellen Hopkins’ Crank (2004) and Melvin Burgess’ Smack (1996). The examination found that Crank is written in free verse, not as a tribute to the great poets of old, but as a way to add emphasis to words, …

Chief Of Mission Authority As A Model For National Security Integration, Christopher J. Lamb, Edward Marks Dec 2010

Chief Of Mission Authority As A Model For National Security Integration, Christopher J. Lamb, Edward Marks

INSS Strategic Perspectives

The inability of the President of the United States to delegate executive authority for integrating the efforts of departments and agencies on priority missions is a major shortcoming in the way the national security system of the U.S. Government functions. Statutorily assigned missions combined with organizational cultures create “stovepipes” that militate against integrated operations. This obstacle to “unity of effort” has received great attention since 9/11 but continues to adversely affect government operations in an era of increasingly multidisciplinary challenges, from counterproliferation to counterinsurgency in Afghanistan. Presidents have tried various approaches to solving the problem: National Security Council committees, “lead …
