Burning Crosses On Campus: University Hate Speech Codes, Alexander Tsesis Jan 2010

Burning Crosses On Campus: University Hate Speech Codes, Alexander Tsesis

Connecticut Law Review

Debates about the value and constitutionality of hate speech regulations on college campuses have deeply divided academics for over a decade. The Supreme Court’s recent decision in Virginia v. Black, recognizing a state’s power to criminalize intentionally intimidating cross burning at long last provides the key to resolving this heated dispute. The opponents of hate speech codes argue that such regulation guts our concept of free speech. One prominent scholar claims that this censorship would nullify the First Amendment and have “totalitarian implications.” Another constitutional expert, Erwin Chemerinsky, asserts that the “public university simply cannot prohibit the expression of hate, …

Review: Richard Whitman, Architecture, Print Culture, And The Public Sphere In Eighteenth-Century France, Jean-François Bédard Jan 2010

Review: Richard Whitman, Architecture, Print Culture, And The Public Sphere In Eighteenth-Century France, Jean-François Bédard

School of Architecture - All Scholarship

This review of Richard Whitman's Architecture, Print Culture, and the Public Sphere in Eighteenth-Century France (Routledge, 2007) examines the relationship between architectural discourse and political power in Frame from 1671 until the end of the ancient regime. The volume successfully foregrounds the socio-political functions of architectural writing, though the use of Habermas' thesis proves to be less convincing. Some of his arguments also tend to be simplistic or schematics .Nonetheless, this volume is a valuable contribution to the study of French architecture during the eighteenth century.

Outside, Hidden And In Between: Locating The Migrant Exotic Dancer In Canadian Legal Discourse And Regulatory Practice, Carolina Santos Ruiz Austria Jan 2010

Outside, Hidden And In Between: Locating The Migrant Exotic Dancer In Canadian Legal Discourse And Regulatory Practice, Carolina Santos Ruiz Austria

Comparative Research in Law & Political Economy

This article examines how objections against commercial sex, re-positioned from religious and moral to secular and modernist stances, converge with Canada’s broader economic and immigration policies. It focuses specifically on immigrant women in exotic dancing and on the exotic dancer visa alongside other temporary work permits issued to women in the “dirty, dangerous and difficult” or “3-D” sectors. This intervention in feminist legal theory draws upon spatial analysis to provide a more profound engagement of the law’s discursive power beyond the rhetorical and symbolic by drawing attention to how law creates and shapes spaces in material terms.

Ill Telecommunications: How Internet Infrastructure Providers Lose First Amendment Protection, Nicholas Bramble Jan 2010

Ill Telecommunications: How Internet Infrastructure Providers Lose First Amendment Protection, Nicholas Bramble

Michigan Telecommunications & Technology Law Review

The Federal Communications Commission (FCC) recently proposed an Internet nondiscrimination rule: "Subject to reasonable network management, a provider of broadband Internet access service must treat lawful content, applications, and services in a nondiscriminatory manner." Among other requests, the FCC sought comment on whether the proposed nondiscrimination rule would "promote free speech, civic participation, and democratic engagement," and whether it would "impose any burdens on access providers' speech that would be cognizable for purposes of the First Amendment." The purpose of this Article is to suggest that a wide range of responses to these First Amendment questions, offered by telecommunications providers …

Media-Rich Input Application Liability, David R. Krohn, Pekarek Jan 2010

Media-Rich Input Application Liability, David R. Krohn, Pekarek

Michigan Telecommunications & Technology Law Review

Until recently, media-rich online interactions were mostly unidirectional: multimedia content was delivered by the service provider to the user. Input from the user came almost exclusively in the form of text. Even when searching the Internet for images or audio, a user typically entered text into a search engine. In addition, search engines indexed multimedia content by analyzing not the content itself but the text surrounding it. This is rapidly changing. With the rise of multimedia-capable smartphones and wireless broadband, applications that allow users to search using non-textual inputs are quickly becoming popular. These applications go much further than simply …

Corpses Revealed: The Staging Of The Theatrical Corpse In Early Modern Drama, N M. Imbracsio Jan 2010

Corpses Revealed: The Staging Of The Theatrical Corpse In Early Modern Drama, N M. Imbracsio

Doctoral Dissertations

My dissertation examines the theatrical depiction of corpses as both stage-objects for theoretical speculation and as performance phenomena of the early modern English stage. Investigating popular drama on the London stage from 1587 -- 1683, I demonstrate that the performance of the dead body by the living actor (what I term the "theatrical corpse") is informed by early modern secular and religious polemics over the materiality of the body, the efficacy of performative behavior, and emerging theories of theatrical presence.

Previously, literary scholars have approached the performance of death on the stage using the insights of psychoanalysis or medical science, …
