Deontology, Political Morality, And The State Symposium: Political Theory And Criminal Punishment, Youngjae Lee
Deontology, Political Morality, And The State Symposium: Political Theory And Criminal Punishment, Youngjae Lee
Faculty Scholarship
Sometimes the government makes a policy choice, and, as a result, innocent persons die. How should we morally assess such deaths? For instance, is the government’s choice of the reasonable doubt standard or its decision to restrict the death penalty to certain narrow categories responsible for deaths of innocents? If so, does the deontological norm against harming people dictate that the government loosen the evidentiary standard for conviction or widen the availability of capital punishment? This Article argues that the traditional distinctions between intending and foreseeing harm and between causing harm and allowing harm to occur are insufficient to absolve …
Desert, Deontology, And Vengeance First Annual Edward J. Shoen Leading Scholars Symposium: Paul H. Robinson, Youngjae Lee
Desert, Deontology, And Vengeance First Annual Edward J. Shoen Leading Scholars Symposium: Paul H. Robinson, Youngjae Lee
Faculty Scholarship
In a series of recent writings, Paul Robinson has defended “empirical desert” as the way of deriving distributive principles for determining who should be punished and by how much. Desert is, of course, an idea with a long history, and its precise role in criminal law has been much debated. In addressing various criticisms of desert in criminal law, Robinson distinguishes empirical desert from what he calls “deontological desert” and “vengeful desert.” Robinson’s strategy, which I call “divide and deflect,” fights off various objections traditionally leveled against the use of desert in criminal law by arguing that most of those …
Empowering Adolescents: A Multiple Case Study Of U.S. Montessori High Schools, Wendy J. Larue
Empowering Adolescents: A Multiple Case Study Of U.S. Montessori High Schools, Wendy J. Larue
Walden Dissertations and Doctoral Studies
The standards-based, teach-and-test methods that have come to proliferate secondary education since the inception of the No Child Left Behind Act (NCLB) fail to adequately prepare students for higher education and employment. This system lacks opportunities for developing 21st century skills such as higher-level thinking, problem solving, and group dynamics, as well as opportunities for fostering spiritual growth and personal development. This problem impacts graduates of U.S. high schools because they are unprepared for higher education and the 21st century workplace. Using qualitative multiple case study methodology, this study examined five U.S. Montessori high schools through the lens of cultural-historical …
Integrity And The Incongruities Of Justice: A Review Of Daniel Markovits, A Modern Legal Ethics, Benjamin C. Zipursky
Integrity And The Incongruities Of Justice: A Review Of Daniel Markovits, A Modern Legal Ethics, Benjamin C. Zipursky
Faculty Scholarship
Daniel Markovits’ recent book, A Modern Legal Ethics: Adversary Advocacy in a Democratic Age, begins by articulating an ethical quandary common to litigators: how can I advocate zealously for a client whose story might not be true and whose causes might not be just? In Markovits’ hands, the dilemmas of the adversary advocate are transformed into a philosophical puzzle about the nature of integrity and the very idea of fidelity to a client. Lawyers face a far more onerous ethical burden than is sometimes recognized, Markovits argues, for the adversary advocate in our legal system is professionally obligated to lie …
The Experiences Of Alternately Certified Teachers With Teacher Mentoring, Teacher Effectiveness, And Student Achievement, Charyl L. Pace
The Experiences Of Alternately Certified Teachers With Teacher Mentoring, Teacher Effectiveness, And Student Achievement, Charyl L. Pace
Walden Dissertations and Doctoral Studies
Alternately certified teachers (ACTs) are teachers who receive teacher training in an accelerated program provided by alternate certification programs (ACPs). Induction/mentoring programs are provided to ACTs as a source of additional training. The purpose of this qualitative case study was to examine ACTs' perceptions of their effectiveness as teachers in relation to their students' achievement and the support provided to them as new teachers by their induction/mentoring training. The research question explored if there was a relationship between the amount of support provided to the ACTs from their induction/mentoring programs and the ACTs' perception of their effectiveness in relation to …
Faculty Hiring Committees Perceptions Of Hiring Processes And Subjectivity, Laura Caraleen Foster
Faculty Hiring Committees Perceptions Of Hiring Processes And Subjectivity, Laura Caraleen Foster
Dissertations and Theses @ UNI
Hiring the most capable applicants has a large impact on the bottom line of an organization. The most effective tools to identify talent are well known to IndustrialOrganizational Psychologists, but these analytical tools are used less frequently than less effective intuitive procedures, such as the traditional unstructured job interview. In a survey of university faculty, we found that the most important factor influencing the use of a selection tool was its perceived validity, but these perceptions were not wellcalibrated to actual criterion related validity. We found some evidence that perceived validity was influenced by implicit beliefs about hiring. A body …

Allowing The Accidental; The Interplay Between Intentionality And Realism In Photographic Art, Katrina Mitcheson
Allowing The Accidental; The Interplay Between Intentionality And Realism In Photographic Art, Katrina Mitcheson
Contemporary Aesthetics (Journal Archive)
We experience photographs both as intentional and as prone to the accidental. The photograph is both capable of being an artwork with its own, constructed world and of drawing our attention to the reality of the objects used in creating it. In this article I employ the insights contained in the concepts of Barthes’ studium and punctum in order to explore how the artist’s intentions and the realism of photography interact aesthetically. I advance the idea that a unique aesthetics of photography can be rooted in the tension between the intentional, culturally coded message of a photograph and the emanation …
The Value Of Fictional Worlds (Or Why 'The Lord Of The Rings' Is Worth Reading), James Harold
The Value Of Fictional Worlds (Or Why 'The Lord Of The Rings' Is Worth Reading), James Harold
Contemporary Aesthetics (Journal Archive)
Some works of fiction are widely held by critics to have little value, yet these works are not only popular but also widely admired in ways that are not always appreciated. In this paper I make use of Kendall Walton’s account of fictional worlds to argue that fictional worlds can and often do have value, including aesthetic value, that is independent of the works that create them. In the process, I critique Walton’s notion of fictional worlds and offer a defense of the study and appreciation of fictional worlds, as distinguished from the works of fiction with which they are …
Musical Presence: Towards A New Philosophy Of Music, Charles Ford
Musical Presence: Towards A New Philosophy Of Music, Charles Ford
Contemporary Aesthetics (Journal Archive)
Most recent writings about the philosophy of music have taken an analytic or linguistic approach, focusing on terms such as meaning, metaphor, emotions and expression, invariably from the perspective of the individual listener or composer. This essay seeks to develop an alternative, phenomenological framework for thinking about music by avoiding these terms, and by extrapolating from the writings of Hegel, Husserl, and Heidegger. On the basis of discussions of musical time, its multiple levels of matter, and its internal dialectics, the essay presents a particular understanding of “style” as the primary basis for mediation between production and reception. It concludes …
Sailing The Seas Of Cheese, Erik Anderson
Sailing The Seas Of Cheese, Erik Anderson
Contemporary Aesthetics (Journal Archive)
Memphis Elvis is cool; Vegas Elvis is cheesy. How come? To call something cheesy is, ostensibly, to disparage it, and yet cheesy acts are some of the most popular in popular culture today. How is this possible? The concepts of cheese, cheesy, and cheesiness play an important and increasingly ubiquitous role in popular culture today. I offer an analysis of these concepts, distinguishing them from nearby concepts like kitchy and campy. Along the way I draw attention to the important roles of cultural/historical context, background knowledge, and especially artist’s intentions as they are relevant to aesthetic assessments involving cheese and …
Developing Trust And Managing Differences In Perception: Building Relationships Between The Missoula Police Department And Local News Media, Melissa Jensen
Developing Trust And Managing Differences In Perception: Building Relationships Between The Missoula Police Department And Local News Media, Melissa Jensen
Graduate Student Theses, Dissertations, & Professional Papers
Finding the right balance in the relationships that develop between law enforcement officers and members of the media can be difficult for both sides. Police officers who work with the media are trying to navigate through the process of informing the public of crime activity, while protecting those involved in the cases being reported on by the media. Reporters on the other hand are trying to navigate their way through the sometimes unclear process of gathering criminal justice information to report crime stories to the public, while learning the proper procedures for working with law enforcement.

One of the most fundamental issues in teaching, arguably the biggest, is discovering the most effective lesson elements for each group of learners. This includes a solid curriculum, performance objectives, age-appropriate pedagogical ingredients, ability-level activities and assessments focused on measuring learning to create a great lesson. When these elements are blended artistically with a variety of classroom management skills, necessary equipment, instructional support resources, behavior management rules and high expectations in a nurturing environment, the teacher has created the best possible learning atmosphere for each individual student.
Below, the authors have identified twelve important instructional elements for teachers to incorporate …

Strategies For The Scientific Progress Of The Developing Countries In The New Millennium: The Case Of Serbia In Comparison With Slovenia And South Korea, Vuk Uskoković, Milica Ševkušić, Dragan P. Uskoković
Pharmacy Faculty Articles and Research
The underlying premise of this essay is the hypothesis that quality and significance of scientific research in any given society could be used as mirrors reflecting its true prosperity. By comparing the two cases of comparatively prosperous scientific management of South Korea and Slovenia, with the example of Serbia, illustrating the poor scientific and industrial productivity typically faced by the developing countries, a few general guidelines for the evolution of a society towards higher scientific and social prominence are outlined. It is argued that the most favourable pattern of growth should be based on the parallel progress in control of …
Evaluating E-Learning, D D Williams, Charles R. Graham
Evaluating E-Learning, D D Williams, Charles R. Graham
Faculty Publications
Technological innovations have spurred exponential use of electronic resources for learners of all ages over the last decade. These global developments also require continual advancement of electronic e-learning evaluation. Evaluation is the process of clarifying what should be and comparing that to what is, to facilitate evaluative decisions about success and ways to achieve it. This article outlines a process for doing evaluations of e-learning and identifies common critical-evaluation elements. An extended case vignette of an e-learning evaluation and references to others and related literature illustrate the use of these critical elements and associated emerging results.

Using Asynchronous Video To Achieve Instructor Immediacy And Closeness In Online Classes: Experiences From Three Cases, Michael Griffiths, Charles R. Graham
Faculty Publications
This research sought to understand the experiences of students and instructors with asynchronous video (video-mail) using webcams in three online sections of teacher education classes at Brigham Young University. We examined the experiences of students through scores and comments posted in student ratings surveys, and the experiences of instructors through personal reports. These experiences were evaluated in terms of the observed existence of instructor immediacy and of closeness. Immediacy is defined in this study as the verbal and non-verbal signals normally achieved in face-to-face communications between instructor and students that can help establish a close and trusting relationship whereby students …
Addressing And Improving Technology Integration Skills For Preservice Teachers Using The Teacher Work Sample, Charles R. Graham, Tonya Tripp, Nancy Wentworth
Addressing And Improving Technology Integration Skills For Preservice Teachers Using The Teacher Work Sample, Charles R. Graham, Tonya Tripp, Nancy Wentworth
Faculty Publications
This study explores the efforts at Brigham Young University to improve preservice candidates’ technology integration using the Teacher Work Sample (TWS) as an assessment tool. Baseline data that was analyzed from 95 TWSs indicated that students were predominantly using technology for productivity and information presentation purposes even though they had been taught to use technology for active student learning. Researchers discovered that decisions made about technology integration were heavily influenced by field instructors and TWS rubrics. An intervention plan was developed to train field instructors and 99 TWSs were analyzed the following year. The TWSs showed noticeable improvements including increases …

Norms, Conformity, And Controls, William B. Tayler, Robert J. Bloomfield

Research in behavioral economics suggests that in addition to their traditional incentive effects, formal control systems can influence psychological motivations. We extend this literature by demonstrating experimentally that formal controls directly influence people’s sense of what behaviors are appropriate in the setting (personal norms), and indirectly alter people’s tendency to conform to the behavior of those around them (descriptive norms). These effects persist even after the controls are changed, so that the effects of current controls can be strongly influenced by past control strength. Our results support those who are incorporating psychological factors into principal-agent models (such as Fischer and …
Arts Voices: Middle School Students And The Relationships Of The Arts To Their Motivation And Self-Efficacy, Heather Moorefield-Lang
Arts Voices: Middle School Students And The Relationships Of The Arts To Their Motivation And Self-Efficacy, Heather Moorefield-Lang
The Qualitative Report
This study explores the question "Does arts education have a relationship to eighth-grade rural middle school students' motivation and self-efficacy?" Student questionnaires, focus-group interviews, and follow-up interviews were data collection methods used with 92 eighth-grade middle school students. Strong emphasis was placed on gathering personal narratives, comments, and opinions directly from the students. Content analysis was used to analyze the student interviews. Middle school students felt that there were both positive and negative relationships between their arts education classes and their motivation and self-efficacy. The students in this study had much to share on the arts courses offered in their …
A Qualitative Approach To Understanding Audience's Perceptions Of Creativity In Online Advertising, Andrew Mcstay
A Qualitative Approach To Understanding Audience's Perceptions Of Creativity In Online Advertising, Andrew Mcstay
The Qualitative Report
In this paper I seek to inquire upon audience's perceptions of creativity in online advertising - a heretofore poorly understood area. This paper initially outlines current academic understanding of creativity in online advertising, mainly derived from quantitative assessments. It then advances a qualitative methodology including diary-interviews and ethnographic online interviews across 41 participants. My starting point is a critique of the most comprehensive conceptual intervention in the area of advertising creativity - Smith and Yang's (2004) typology of "relevance" and "divergence". I assess to what extent this typology emerges from my participants' data. Two key features of relevance - contextual …
(Re)Constructing Reflexivity: A Relational Constructionist Approach, Diane Marie Hosking, Bettine Pluut
(Re)Constructing Reflexivity: A Relational Constructionist Approach, Diane Marie Hosking, Bettine Pluut
The Qualitative Report
This article distinguishes three discourses of reflexivity in relation to human inquiry. One of these arises from a post-modern, relational constructionist perspective which radically re-conceptualizes reflexivity: (a) as a local and co-constructed process oriented towards the question (b) how are we 'going on' together, and therefore paying attention to (c) the realities and relations we are co-creating during the research process and so (d) is concerned with local pragmatic and ethical issues (Gergen & Hosking, 2006; McNamee, 1994) rather than with the quality of truth claims. Regular reflexive dialogues as part of, and directed at, the research process can heighten …
A Case Of One Professor's Teaching And Use Of Nature Of Science In An Introductory Chemistry Course, Mehmet Karakas
A Case Of One Professor's Teaching And Use Of Nature Of Science In An Introductory Chemistry Course, Mehmet Karakas
The Qualitative Report
In this article I provide a qualitative analysis of one faculty's teaching and answer the following research question: How does one chemistry professor who teaches introductory science incorporate aspects of the nature of science (NOS) into his course? This study concentrates on a single case in one private higher institution in the Northeastern United States. The participant's teaching style is presented through a combined presentation of interviews, classroom observations, and classroom activities. Six main themes emerged from the field notes in the areas of teacher actions, student teacher interactions, start of the lecture, incorporating NOS language in instruction, class size, …
Issues In The Analysis Of Focus Groups: Generalisability, Quantifiability, Treatment Of Context And Quotations, Lilla Vicsek
Issues In The Analysis Of Focus Groups: Generalisability, Quantifiability, Treatment Of Context And Quotations, Lilla Vicsek
The Qualitative Report
In this paper I discuss some concerns related to the analysis of focus groups: (a) the issue of generalisation; (b) the problems of using numbers and quantifying in the analysis; (c) how the concrete situation of the focus groups could be included in the analysis, and (d) what formats can be used when quoting from focus groups. Problems with respect to generalisation are discussed; types of generalisation are presented which can be used in focus group research. Arguments are made against using a primarily quantitative perspective in the evaluation of focus group data. It is argued that the situation of …
Theoretical Versus Grass-Roots Development Of A Community Partnership, Socorro Escandón
Theoretical Versus Grass-Roots Development Of A Community Partnership, Socorro Escandón
The Qualitative Report
The purpose of this qualitative study was to examine Bracht, Kingbury, and Rissel's five-stage community development model as applied to a grass-roots community action group. The sample consisted of low-income, predominantly Hispanic women in a community action group in a Southwestern barrio, some of whom were experiencing domestic violence. The community group organizer was interviewed, and a content analytic table was constructed. Results showed that the community group's efforts would have benefited from a theoretically organized approach. The window of opportunity continues to be open for community development researchers to offer theoretical assistance to groups that are forming and to …
Depression: The Differing Narratives Of Couples In Couple Therapy, Eija-Liisa Rautiainen, Jukka Aaltonen
Depression: The Differing Narratives Of Couples In Couple Therapy, Eija-Liisa Rautiainen, Jukka Aaltonen
The Qualitative Report
How does the spouse of a person with depression take part in constructing narratives of depression in couple therapy? In this study we examined couples' ways of co-constructing narratives of depression in couple therapy. Three couple therapy processes were chosen for the study, one spouse in each couple having been referred to an outpatient clinic for treatment for his/her depression. Four sessions from each systemic couple therapy process (Jones & Asen, 2000) were analyzed using narrative analysis. According to our findings, couples co-constructed narratives of depression, each in their own way. It is crucial to focus not only on the …

Action Research In Practice: Issues And Challenges In A Financial Services Case Study, Peter Marshall, Phyl Wilson, Kristy De Salas, Judy Mckay
The Qualitative Report
In this paper we give a direct and personal account of the issues and challenges that occurred in an action research study. The research team consisted of five researchers from two Australian universities. The action research case was carried out in a small financial services company and concerned the development of an information systems strategy. However, the focus of the paper is not on information systems, but on the general methodological issues and problems of action research. The authors hope that readers will benefit from the direct and transparent account of the practical methodological problems encountered in the study.
