Organizations Matter: They Are Institutions, After All, John Linarelli Jan 2010

Organizations Matter: They Are Institutions, After All, John Linarelli

Scholarly Works

Judge Posner (2010) offers a substantial agenda for organization economics. He advises us on how organization economics can shed substantial light on some of the most pressing social problems of the day. I comment on two of the areas he selects for discussion and offer some comments on the relationship of organization economics to new institutional economics. Judge Posner surely is right to argue that organization economics can help us understand the failures of corporate governance in regulating executive pay. Moreover, with additional and more institutionally nuanced theorizing, organizational economics should further our understanding of the work of judiciaries in …

Relationships, The Rules Of Professional Conduct And Land Use: Ethical Quagmires For Land Use Attorneys, Patricia E. Salkin Jan 2010

Relationships, The Rules Of Professional Conduct And Land Use: Ethical Quagmires For Land Use Attorneys, Patricia E. Salkin

Scholarly Works

This article begins to fill the void by introducing the application of the various Rules of Professional Conduct, as adopted by the specific opining jurisdiction, through a review of the relevant reported opinions of the various committees and sometimes courts, in the land use context. Part I discusses the challenges that arise for lawyers vis-à-vis their clients in the land use context. This is followed by a discussion in Part II of the ethics and professionalism issues that confront lawyers who serve on local boards.

High-Cost Religion, Religious Switching, And Health, Christopher P. Scheitle, Amy Adamczyk Jan 2010

High-Cost Religion, Religious Switching, And Health, Christopher P. Scheitle, Amy Adamczyk

Publications and Research

Previous research has devoted significant attention to understanding the link between health and personal religious beliefs and practices, typically finding that more religious people tend to have better health. However, almost no attention has been given to how switching religious groups or leaving religion altogether is related to self-reported health. Due to selection and causation mechanisms, switching from high-cost groups that are theologically and culturally exclusive could be associated with poor health more than switching from other religious groups. Using data from the 1972 through 2006 General Social Surveys, we examine the relationship between health and religious switching as moderated …

An Assessment Of Delivery Risks In Transportation Projects, Velvet Fitzpatrick, Kumares C. Sinha Jan 2010

An Assessment Of Delivery Risks In Transportation Projects, Velvet Fitzpatrick, Kumares C. Sinha

JTRP Technical Reports

A large number of uncertainties exist in the delivery of highway projects, and it is important to describe the extent so that budgeting and programming can be carried out in a manner that duly accounts for such uncertainties. The study investigates the sources of delivery variability (risk factors) that occur in the period between project proposed date and the letting date. Data on 366 highway projects were collected from the Indiana Department of Transportation Management Information Portal. Using statistical and econometric techniques, the data was analyzed to identify the potential risk factors and to determine the magnitude and direction of …

Birmingham's Jewish Women And Social Reform 1880-1980, Kaye Cochran Nail Jan 2010

Birmingham's Jewish Women And Social Reform 1880-1980, Kaye Cochran Nail

All ETDs from UAB

Many historians and scholars have argued that Jewish women kept a low profile during periods of southern social reform since the late nineteenth century. This thesis reveals a little known pattern of activism among some Birmingham Jewish women, encompassing many trends of social change over one hundred years, from 1880 to 1980. Nineteenth century Jewish women immigrants and migrants brought to the South a social conscience rooted in the traditions of their Jewish faith. They mentored their daughters, sisters, and neighbors in the ways of community goodwill. During the Progressive Era, their numbers and voices grew in the public sphere, …

"I'M Not Gay, M'Kay?": Should Falsely Calling Someone A Homosexual Be Defamatory?, Haven Ward Jan 2010

"I'M Not Gay, M'Kay?": Should Falsely Calling Someone A Homosexual Be Defamatory?, Haven Ward

Georgia Law Review

This Article argues a statement misidentifying a personas homosexual should be deemed not defamatory as a matter of law. Whether a statement is defamatory changes as social mores and policies evolve, such that a statement deemed defamatory in the past may not be defamatory now. For example, historically, courts deemed statements misidentifying a person as homosexual defamatory per se. As society's opinion of homosexuality began to improve, courts instead required proof of special damages for a plaintiff to maintain a defamation action for such statements. No American court, however, has yet held that such a statement is not defamatory as …

Congressional End-Run: The Ignored Constraint On Judicial Review, Luke M. Milligan Jan 2010

Congressional End-Run: The Ignored Constraint On Judicial Review, Luke M. Milligan

Georgia Law Review

This Article identifies an untended connection between
the research of legal academics and political scientists. It
explains how recent developments in constitutional theory,
when read in good light, expose a gap in the judicial
politics literature on Supreme Court decision making. The
gap is the "congressional end-run."
End-runs occur when Congress mitigates the policy cost
of adverse judicial review through neither formal limits on
the Court's autonomy nor substitution of its constitutional

interpretationfor that of the Court, but through a different
decision which cannot, as a practical if not legal matter,
be invalidated by the Court. End-runs come in several …

A Blueprint For Planning And Designing Staged-Authentic Heritage Attractions In Small Island Nations, Earney F. Lasten Jan 2010

A Blueprint For Planning And Designing Staged-Authentic Heritage Attractions In Small Island Nations, Earney F. Lasten

Electronic Theses and Dissertations

The purpose of this largely qualitative study was to develop a blueprint for planning and designing a staged-authentic heritage tourist attraction for small island nations. Data were gathered and analyzed in three phases. In Phase I, existing and potential supply, demand, and external variables associated with staged-authentic heritage attractions were identified, and a preliminary planning model and conceptual framework was developed. In Phase II, the model was refined. A blueprint containing seven major questions and 26 sequential steps was developed. In Phase III, the blueprint was tested using focus groups and an online tourist survey in the Caribbean region (Aruba) …

General Managers' Perceptions Of Corporate Social Responsibility In Florida Hotels, Judith L. Holcomb Jan 2010

General Managers' Perceptions Of Corporate Social Responsibility In Florida Hotels, Judith L. Holcomb

Electronic Theses and Dissertations

The objective of the study was to identify and measure the magnitude of the gap that may exist between the corporate level Corporate Social Responsibility (CSR) culture and its ensuing policies and their equivalent at the property level. This gap was hypothesized to be a function of a number of personal characteristics of the General Managers (GMs) coupled with the organizational profile of the hotel. The data were collected via an online survey based on a CSR scale developed by Turker (2009) in combination with other original and previously used smaller scales. The study‟s population consisted of general managers of …

Domestic Violence Or Elder Abuse? Why It Matters For Older Women, Teresa Kilbane, Marcia K. Spira Jan 2010

Domestic Violence Or Elder Abuse? Why It Matters For Older Women, Teresa Kilbane, Marcia K. Spira

Social Work: School of Social Work Faculty Publications and Other Works

Law enforcement and legal services are 2 systems that respond to reports of abuse against women through programs such as adult protective services (APS) and domestic violence (DV). APS and DV systems operate independently and define the cause of the abuse differently. The designation of a woman as having suffered domestic violence or having been abused often depends on which system she enters. This designation can lead to different options for women to obtain services. Aging may further complicate access and usability of these systems to respond to the needs of abused elderly. Using vignettes, this article explores the definitions …

Teaching Posthumanist Ethics In Law School: The Race, Culture, And Gender Dimensions Of Student Resistance, Maneesha Deckha Jan 2010

Teaching Posthumanist Ethics In Law School: The Race, Culture, And Gender Dimensions Of Student Resistance, Maneesha Deckha

Animal Law Review

This Essay challenges laws’ hegemonic humanist boundaries by analyzing the challenges involved in mainstreaming posthumanist subjects into the legal curricula. Posthumanist subjects in legal education are perceived as marginal and unworthy of serious discussion and scholarship. The author identifies the problems that can arise in introducing posthumanist critical content through her experience of teaching animal law as an optional course and as a part of a compulsory first-year course on property law and in advising on an upper-year student-led conference. She argues that the biases related to gendered, racialized, and otherwise differentiated norms inherited by the legal education system as …

Liberating Animal Law: Breaking Free From Human-Use Typologies, Jessica Eisen Jan 2010

Liberating Animal Law: Breaking Free From Human-Use Typologies, Jessica Eisen

Animal Law Review

Animal protection laws have traditionally categorized animals according to the manner in which humans use them. Animals have been categorized as companion animals, animals used in medical testing, animals raised for slaughter, and wildlife, and the protection afforded to animals has been ostensibly commensurate to their use categorization.

This Article focuses on two alternative strategies that provide legal protection for animals without relying on human use as their primary mode of categorization. First, the Article looks at protecting animals as a single category, in particular through the use of constitutional provisions. The Article then looks at a species-based model that …

Should They Go The Way Of The Horse And Buggy? How The New York City Horse-Drawn Carriage Industry Has Survived Thirty Years Of Opposition, Katherine Hutchison Jan 2010

Should They Go The Way Of The Horse And Buggy? How The New York City Horse-Drawn Carriage Industry Has Survived Thirty Years Of Opposition, Katherine Hutchison

Animal Law Review

This Comment reviews the history of the horse-drawn carriage industry in New York City and details legislative efforts to regulate the business. Many cities in the United States feature horse-drawn carriages as a tourist attraction, but they are most associated with New York. The long-standing controversy over the working and living conditions of the horses that pull the cabs has garnered less national attention than other animal welfare issues, despite the fatalities and injuries suffered by the equines on traffic-choked Manhattan streets. Supporters of the industry defend it as an important contributor to the local economy, an iconic symbol of …

Teacher Workload: A Formula For Maximizing Teacher Performance And Well-Being, Norma A. Sugden Jan 2010

Teacher Workload: A Formula For Maximizing Teacher Performance And Well-Being, Norma A. Sugden

Walden Dissertations and Doctoral Studies

Research has shown that teacher workload is intensifying and teachers are increasingly leaving the profession prior to having taught for 35 years. The purpose of this mixed method, sequential, phenomenological study was to determine (a) how workload intensification impacts teacher performance and well-being, (b) whether or not workload intensification was a primary factor in teachers’ choosing to leave the profession early, and (c) a formula for maximizing teacher performance and well-being. Apple’s workload intensification thesis was the theoretical framework for this study. Quantitative data obtained via a survey (N=484), together with qualitative data collected via four focus group sessions and …

Internet Governance And Democratic Legitimacy, Olivier Sylvain Jan 2010

Internet Governance And Democratic Legitimacy, Olivier Sylvain

Faculty Scholarship

Even as the Internet goes pop, federal policymakers continue to surrender their statutory obligation to regulate communications in the first instance to extralegal nongovernmental organizations comprised of technical experts. The Federal Communications Commission’s conclusion that a major broadband service provider's network management practices were unreasonable is a case in point. There, in the absence of any decisive legislative or even regulatory guidance, the FCC turned principally to the engineering principles on which the Internet Engineering Task Force bases transmission standards: to wit, (1) decentralization, (2) interoperability, and (3) user empowerment. This impulse to defer as a matter of course to …

Penetrating The Silence In Sierra Leone: A Blueprint For The Eradication Of Female Genital Mutilation, Chi Adanna Mgbako, Meghna Saxena, Anna Cave, Nasim Farjad, Helen Shin Jan 2010

Penetrating The Silence In Sierra Leone: A Blueprint For The Eradication Of Female Genital Mutilation, Chi Adanna Mgbako, Meghna Saxena, Anna Cave, Nasim Farjad, Helen Shin

Faculty Scholarship

The African grassroots movement to eradicate female genital mutilation (also known as “female genital cutting” and “female circumcision,” hereinafter “FGM”) is widespread. While many African countries and grassroots organizations have made great strides in their efforts to eliminate FGM, Sierra Leone lags behind. In Sierra Leone, FGM is practiced within the bondo secret society, an ancient, all-female commune located in West Africa and also known as the sande. The bondo society’s traditional role was to direct girls’ rites of passage into adulthood. In order to become a member of the bondo, a girl or woman must undergo various rituals, the …
