The Business Of Punishing: Impediments To Accountability In The Private Corrections Industry, Stephen Raher Jan 2010

The Business Of Punishing: Impediments To Accountability In The Private Corrections Industry, Stephen Raher

Richmond Journal of Law and the Public Interest

To understand the contemporary use of contractor-operated prisons, one must appreciate the political and economic developments which allowed privatization to enter the corrections industry. Accordingly, this article starts with a brief history of privatized corrections in the United States. The following section explores how the modem marketplace for private prisons has been shaped by two prominent dynamics-the emergence of a national market for prison beds and the massive expansion of the nation's immigrant detention system. The paper then considers the general implications of non-governmental prison operation, with a focus on how contractors have exploited their private status to the detriment …

Contingent Equal Protection: Reaching For Equality After Ricci And Pics, Jennifer S. Hendricks Jan 2010

Contingent Equal Protection: Reaching For Equality After Ricci And Pics, Jennifer S. Hendricks

Michigan Journal of Gender & Law

This Article uses the term contingent equal protection to describe the constitutional analysis that applies to a range of governmental efforts to ameliorate race and sex hierarchies. "Contingent" refers to the fact that the equal protection analysis is contingent upon the existence of structural, de facto inequality. Contingent equal protection cases include those that involve explicit race and sex classifications, facially neutral efforts to reduce inequality, and accommodation of sex differences to promote equality. Uniting all three kinds of cases under a single conceptual umbrella reveals the implications that developments in one area can have for the other two.

Private Oppression: How Laws That Protect Privacy Can Lead To Oppression, Teri Dobbins Baxter

Scholarly Works

This article explores the problems that can arise when laws protect the privacy of some individuals at the expense of others. These issues will be viewed through the lens of the controversial case of the children taken into state custody from the Yearning for Zion Ranch in Texas. Specifically, the article examines the allegations that led government authorities to intervene and remove the children from the Ranch and the difficulties that the government faces when such allegations are made against residents of isolated communities who have little interaction with the larger American society. The article will further demonstrate how privacy …

An Exclusionary Rule For Police Lies, Melanie Wilson Jan 2010

An Exclusionary Rule For Police Lies, Melanie Wilson

Scholarly Works

Although the Supreme Court has often said that truth is an imperative to justice, we now know that police officers, the key investigative component in our criminal justice system, lie. How often do the police lie? No one knows for sure. But credible reports of police lies are common.

Because our legal system treats the police as if they were impartial fact gatherers, trained and motivated to gather facts both for and against guilt, rather than biased advocates attempting to disprove innocence, which is the reality, the criminal justice system lacks the appropriate structure to expose and effectively deal with …

International Human Rights Law In Japan: The View At Thirty, Timothy Webster

Faculty Publications

Japanese courts have become increasingly open to the use of international human rights law in the past two decades. This paper examines several of the key decisions that reflect the judiciary's embrace of international law, particularly in the areas of criminal procedure and minority rights. I argue that the judiciary has eclipsed the other branches of government as the primary disseminator of human rights norms in Japan.

Impact Of Globalization On Central Appalachian Women: Social Capital And Social Support Networks, Jennifer Lanham Jan 2010

Impact Of Globalization On Central Appalachian Women: Social Capital And Social Support Networks, Jennifer Lanham

Electronic Theses and Dissertations

Social networks and capital often sustain community and individual survival. This phenomenological study was designed to illuminate the experience of job loss within the context of globalization, describing the phenomenon from the perspective of rural women and its meaning for those participants. Using a phenomenological approach, this qualitative study explored eight rural women in Appalachian Kentucky who had experienced apparel factory layoffs as a result of global outsourcing. A modified form of van Kaam's method (Moustakas, 1994) was used for phenomenological analysis of the data. Data were analyzed using an eight-step technique to identify essential characteristics of rural women's lived …

The Expanding Definition Of Crime And Its Effect On The Individual: A Multilevel Modeling Analysis, Teresa A. Dalton Jan 2010

The Expanding Definition Of Crime And Its Effect On The Individual: A Multilevel Modeling Analysis, Teresa A. Dalton

Electronic Theses and Dissertations

Incarceration is one of the most extreme exercises of state power. For the past twenty-five years the rates at which states have been locking up their residents have been growing at a distressing pace. While violent crime rates have been declining, arrest rates for lower-level crimes have been steadily rising. Two new indices are developed to explain the relationship between lower-level crime and violent crime--the punitive severity index (PSI) and the punitive progression index (PPI). The PSI is the ratio of low-level crime to violent crime, a static indicator of punitiveness, while the PPI is a measure of the rate …

Reconstituting The “Un-Person”: The Khmer Krom &The Khmer Rouge Tribunal, Mahdev Mohan Jan 2010

Reconstituting The “Un-Person”: The Khmer Krom &The Khmer Rouge Tribunal, Mahdev Mohan

2008 Asian Business & Rule of Law initiative

Despite the grand promise of victim participation at the ongoing trials of Extraordinary Chambers in the Courts of Cambodia (“ECCC”), this article notes the plight of an undeserved ethnic community, the members of which have become forgotten victims of genocide. The Article argues that if the ECCC’s trials are to have any resonance for the Khmer Krom, its affiliates and victims’ lawyers should avoid “othering” Khmer Krom victims of genocide, and instead adopt ethnographic approaches to lawyering that seek to ascertain communal desires for vindication.

Key Insights from the conference included: (1) The relationships between powerful criminal groups and states are complex and create transnational issues of corruption and the production, transportation, marketing, and consumption of illegal products and services that have national security implications for most states in the Western Hemisphere. (2) The Colombian government has successfully responded to challenges from the FARC and several criminal groups, but the challengers have responded with adaptations that ensure their survival. The Structure And Content Of Online Child Exploitation Networks, Richard Frank, Bryce Westlake, Martin Bouchard Jan 2010

The Structure And Content Of Online Child Exploitation Networks, Richard Frank, Bryce Westlake, Martin Bouchard

Faculty Publications

The emergence of the Internet has provided people with the ability to find and communicate with others of common interests. Unfortunately, those involved in the practices of child exploitation have also received the same benefits. Although law enforcement continues its efforts to shut down websites dedicated to child exploitation, the problem remains uncurbed. Despite this, law enforcement has yet to examine these websites as a network and determine their structure, stability and susceptibleness to attack. We extract the structure and features of four online child exploitation networks using a custom-written webpage crawler. Social network analysis is then applied with the …
