Student Attitudes Towards Campus Law Enforcement Exploring Issues Of Confidence And Utilization, Vivian J. Ortiz Jan 2010

Student Attitudes Towards Campus Law Enforcement Exploring Issues Of Confidence And Utilization, Vivian J. Ortiz

Electronic Theses and Dissertations

The assessment of citizen attitudes has, in recent decades, become standard practice within the criminal justice system. However, in assessing the criminal justice system, most research has gathered data on the attitudes and perceptions of specific populations within society (i.e. older citizens) and has not really focused on younger age groups, or more specifically, students enrolled in colleges and universities. The present study examined attitudes of college students in the areas of confidence and utilization of campus police. Utilizing a non-random convenience sample of undergraduate and graduate students (N=393) at a large four-year research institution, participants completed a 21-item survey …

When A Monopolist Deceives, Maurice Stucke Jan 2010

When A Monopolist Deceives, Maurice Stucke

Scholarly Works

This essay uses one context - a monopolist’s deceptive advertising or product disparagement - to illustrate how competition authorities and courts should evaluate a monopolist’s deception under the federal antitrust laws. Competition authorities should target a monopolist’s anticompetitive deception, which courts should treat as a prima facie violation of the Sherman Act without requiring a full-blown rule of reason analysis or an arbitrary, multi-factor standard.

Education In American Prisons : A Review Of The Literature, Ryan Mcnamara Jan 2010

Education In American Prisons : A Review Of The Literature, Ryan Mcnamara

Capstone Projects and Master's Theses

The purpose of this study is to understand how education programs in prison can benefit both prisoners and society in an America with a perennially rising prison population comprised of less educated individuals and budget cuts on education programs within prisons. The study includes a history of prisons in the United States from the pre-revolution English colonies to the present day, a theoretical perspective emphasizing education's ability to rehabilitate as noted by Ubah (2003), and a current research section analyzing studies from 2005-2010. The findings indicate a correlation with participation in educational programs in prison with reduced recidivism rates, an …

Exiting Prostitution: An Integrated Model, Lynda M. Baker, Rochelle L. Dalla, Celia Williamson

Department of Child, Youth, and Family Studies: Faculty Publications

Exiting street-level prostitution is a complex, convoluted process. Few studies have described this process within any formal conceptual framework. This article reviews two general models and two prostitution-specific models and their applicability to the exiting process. Barriers encountered as women attempt to leave the streets are identified. Based on the four models, the barriers, the prostitution literature, and the authors’ experience with prostituted women, a new integrated six-stage model that is comprehensive in scope and sensitive to women’s attempts to exit prostitution is offered as a foundation for continued research on the process of women leaving the streets.

Examining Causes And Prevention Of Violence And Aggression In The Workplace, Rachel Roderick

Seminar Research Paper Series

Violence in the workplace affects every sector and industry in the United States, and it can take on many forms, from verbal threats to front page workplace shooting events – and everything in between. In fact, the issue is so prevalent that death by homicide is the fourth leading cause of workplace deaths.

The impact of workplace violence on employers goes beyond the immediate concern for the safety and welfare of employees. Aside from the expected direct financial costs of increased security, insurance, and legal fees, there are indirect costs that impact the bottom line. Workplaces with employees who experience …

Challenges For Human, Social, Cultural, And Behavioral Modeling, S. K. Numrich, Andreas Tolk Jan 2010

Challenges For Human, Social, Cultural, And Behavioral Modeling, S. K. Numrich, Andreas Tolk

Computational Modeling & Simulation Engineering Faculty Publications

Today's military focus has moved away from the force-on-force battlefield of the past century and into the domain of irregular warfare and its companion security, stability, transition and reconstruction missions. With that change in focus has come a need to examine the operational environment from a wider perspective, one that includes the whole range of human experiences and circumstances. As the set of factors and list of players expands, the need for reliable modeling and simulation increases, if for no other reason than to help the human decision maker make sense of this expanded decision space. However, to do this, …

Faculty & Staff Scholarship

Background

Two counter trends in injury mortality have been separately reported in the US in recent times - a declining suicide rate and a rapidly rising unintentional poisoning mortality rate. Poisoning suicides are especially difficult to detect, and injury of undetermined intent is the underlying cause-of-death category most likely to reflect this difficulty. We compare suicide and poisoning mortality trends over two decades in a preliminary assessment of their independence and implications for suicide misclassification.

Methods

Description of overall and gender- and age-specific trends using national mortality data from WISQARS, the Web-based Injury Statistics Query and Reporting System, maintained by …

Race/Ethnicity And Potential Suicide Misclassification: Window On A Minority Suicide Paradox?, Ian R H Rockett, Shuhui Wang, Steven Stack, Diego De Leo, James L. Frost, Alan M. Ducatman, Rheeda L. Walker, Nestor D. Kapusta

Faculty & Staff Scholarship

Background

Suicide officially kills approximately 30,000 annually in the United States. Analysis of this leading public health problem is complicated by undercounting. Despite persisting socioeconomic and health disparities, non-Hispanic Blacks and Hispanics register suicide rates less than half that of non-Hispanic Whites.

Methods

This cross-sectional study uses multiple cause-of-death data from the US National Center for Health Statistics to assess whether race/ethnicity, psychiatric comorbidity documentation, and other decedent characteristics were associated with differential potential for suicide misclassification. Subjects were 105,946 White, Black, and Hispanic residents aged 15 years and older, dying in the US between 2003 and 2005, whose manner …

Improbable Cause: A Case For Judging Police By A More Majestic Standard, Melanie Wilson Jan 2010

Improbable Cause: A Case For Judging Police By A More Majestic Standard, Melanie Wilson

Scholarly Works

This article presents findings from an empirical study of judicial orders in one Midwestern federal district court over a twenty-four month period. The study analyzes trial court decisions to determine whether, as scholars often contend, judges consistently side with the prosecution when a defendant claims that the police lied during the criminal investigation of her case. The study also looks at the frequency with which defendants make such arguments, the types of case in which defendants claim police lies, and the strength or weakness of the evidence in cases that do and do not persuade trial judges that the police …

"A Guantanamo On The Sea": The Difficulties Of Prosecuting Pirates And Terrorists, Eugene Kontorovich Jan 2010

"A Guantanamo On The Sea": The Difficulties Of Prosecuting Pirates And Terrorists, Eugene Kontorovich

Faculty Working Papers

As a surge in pirate attacks in the seas around the Horn of Africa threatens to seriously damage international trade, the nations of the world have refused to enforce international law against these criminals. The dozens of nations patrolling the Gulf of Aden have ample legal authority to detain and prosecute pirates. Yet the United States and other navies have, as a matter of policy, been releasing apprehended pirates because of the difficulty of detaining or successfully prosecuting them. These fears are not unwarranted. As this Essay shows, while on the one hand international law requires all nations to fight …

An Empirical Examination Of Universal Jurisdiction For Piracy, Eugene Kontorovich, Steven Art Jan 2010

An Empirical Examination Of Universal Jurisdiction For Piracy, Eugene Kontorovich, Steven Art

Faculty Working Papers

This Essay presents the first systematic empirical study of the incidence of universal jurisdiction prosecutions over an international crime. Using data on the number of piracies committed in a twelve year period (1998-2009) obtained from international agencies and maritime industry groups, we determine the percentage of acts of piracy where nations prosecuted under universal jurisdiction we determine the percentage of these cases where nations exercised UJ. Studies of the worldwide use of UJ over other crimes simply count how often UJ has been exercised, but do not attempt to determine the rate of prosecution.

We find that of all clearly …

In 2000 when Governor George Ryan unilaterally imposed a statewide moratorium on executions in Illinois, in response to accumulating evidence of more than a dozen wrongfully convicted persons on death row in Illinois. In 1999 the Illinois legislature created the Capital Litigation Trust Fund, to allow private, appointed defense counsel, state's attorneys , and public defenders to be paid directly for the expenses of a capital trial from state appropriated funds, upon the approval of the trial court judge. Access Denied: Sexual Victimization Of Juveniles In Correctional Facilities - How Senate Bill 585 Could Have Helped, Jillian Malizio

Richmond Journal of Law and the Public Interest

The right to counsel is a fundamental right, one the framers of our Constitution intended to apply to all American citizens. Virginia statutes and case law have protected the rights of incarcerated adults and it is now time to grant those same protections to the juveniles in their custody. Part II of this comment will review the requirement of a prisoner's right to "meaningful access" to the courts from both an adult and juvenile's perspective. An examination of jurisprudence from the Supreme Court of the United States, and Circuit Courts, reveals the history and importance of "meaningful access" and shows …
