A Gendered Assessment Of The "Threat Of Victimization", David May, Nicole E. Rader, Sarah Goodrum Jan 2010

A Gendered Assessment Of The "Threat Of Victimization", David May, Nicole E. Rader, Sarah Goodrum

Safety, Security and Emergency Management Faculty and Staff Scholarship

Rader has called for a change in how researchers study fear of crime, suggesting that fear of crime, perceptions of risk, and experiences with victimization are interrelated dimensions of the larger ‘‘threat of victimization’’ concept. In this study, the authors examine how each independent dimension affects additional theoretical dimensions of the ‘‘threat of victimization’’ and how these relationships vary by gender. Using data from residents of Kentucky, the authors estimate a series of multivariate linear and logistic regression models. The findings presented here suggest that gender differences do exist in the components of the threat of victimization and that many …

Against Civil Gideon (And For Pro Se Court Reform), Benjamin H. Barton Jan 2010

Against Civil Gideon (And For Pro Se Court Reform), Benjamin H. Barton

College of Law Faculty Scholarship

This Article argues that the pursuit of a civil Gideon (a civil guarantee of counsel to match Gideon v. Wainright’s guarantee of appointed criminal counsel) is an error logistically and jurisprudentially and advocates an alternate route for ameliorating the execrable state of pro se litigation for the poor in this country: pro se court reform.

Gideon itself has largely proven a disappointment. Between overworked and underfunded lawyers and a loose standard for ineffective assistance of counsel the system has been degraded. As each player becomes anesthetized to cutting corners a system designed as a square becomes a circle.

There is …

Mental Health Courts: Serving Justice And Promoting Recovery, Ginger Lerner Wren Jan 2010

Mental Health Courts: Serving Justice And Promoting Recovery, Ginger Lerner Wren

Annals of Health Law and Life Sciences

This article begins and ends with a call for more empirical research to understand the connection between societal views of mental illness and the legal system. The author asserts that changing social perceptions of mental illness certainly affect legal outcomes and commitment levels, but the degree remains unknown. This article explores the above two topics through the framework of the Circuit Court 'split' regarding the Constitutional rights of persons committed to state mental health institutions. A main facet of the 'split' is centered on the Circuits' disagreement about whether or not all mentally ill patients committed to institutions deserve the …

Foreign Fishing Piracy Vs. Somalia Piracy – Does Wrong Equal Wrong?, Leticia M. Diaz, Barry Hart Dubner Jan 2010

Foreign Fishing Piracy Vs. Somalia Piracy – Does Wrong Equal Wrong?, Leticia M. Diaz, Barry Hart Dubner

Barry Law Review

This article is a sequel to the authors' last article, On the Evolution of the Law of International Sea Piracy, published in December 2009. That article attempted to illustrate the enormous problem of sea piracy off of Somalia. This article was inspired by the authors' attendance and participation at a two-day conference sponsored by the Harvard Kennedy School’s Belfer Center for Science and International Affairs. After the conference the authors were inspired to write this article, setting forth a view of why Somali piracy started and some of the problems created by these illegal acts.

Prevention Of Fetal Alcohol Damage In Northern Native Communities: A Practical School-Based Approach, Steven Jacquier, Judith Kleinfeld, David Gilliam

SPS Faculty Publications

This article describes a Fetal Alcohol Syndrome prevention program, "FASD in Lab Mice," that had a dramatic effect in increasing Alaska Native students' understanding of the lifelong neurological and physical damage caused by drinking during pregnancy and, more importantly, led them to engage in active prevention efforts in their own and other Native communities. Informational programs typically used in the schools create little student interest and students often do not see connections between their own experience and the atypically extreme examples such prevention programs tend to emphasize. The "FASD in Lab Mice" prevention program, using actual experiments conducted by the …

Erie And Federal Criminal Courts, Wayne A. Logan Jan 2010

Erie And Federal Criminal Courts, Wayne A. Logan

Scholarly Publications

Today, low-level state and local criminal laws figure critically in federal prosecutions, serving as the initial bases for police seizures that yield evidence leading to more serious federal charges (usually involving drugs or firearms). While police resort to such laws as pretexts to stop and arrest individuals has been frequently addressed, this article provides the first analysis of how federal courts actually interpret and apply the laws. In doing so, the article reveals a surprising reality, long dismissed as a doctrinal impossibility: federal judicial use of the analytic framework of Erie v. Tompkins to resolve criminal cases.

As the article …

Empowering Female Offenders To Reach Success In Probation And Parole, Patricia Lewis

Capstone Research Projects

Responding to the need for gender specific programs within the criminal justice system, this study evaluates a women’s life skills group that is geared towards education and empowerment for female offenders at the Board of Probation and Parole (BOPP) in a small southeastern city. The researcher evaluated the effectiveness of this group using a single system model. The desired outcome of the group was to enhance the women’s knowledge in areas such as self-esteem, parenting, domestic violence, job readiness, and health. Findings reveal overall satisfaction of the participants with the life skills group as well as improvement in individual life …

Campus Rape Phenomenon, Keriann Speranza Jan 2010

Campus Rape Phenomenon, Keriann Speranza

Undergraduate Review

Rape is a serious crime affecting all colleges and universities, but it is rarely brought to the attention of the media, administrators, faculty, students, and community. Research shows that between 14% and 27.5% of college women have been sexually assaulted (Humphrey & Kahn, 2000). The 2005 Bureau of Justice Statistics Report on violent victimization of college students indicates that between the years 2000 and 2004, 74% of rapes and sexual assaults were committed by someone known to the victim (Gross, Winslett, Roberts, Gohm, 2006). This report also suggested that campus rape is the most underreported violent crime in the United …

Some People Just Shouldn’T Have Kids!: Probation Conditions Limiting The Fundamental Right To Procreate And How Texas Courts Should Handle The Issue, Kellie Brady

Texas Wesleyan Law Review

This Comment focuses on the ability of a judge to limit the fundamental rights of a probationer through the imposition of probation conditions; more specifically, the ability of judges to limit the fundamental right to procreate. Although courts across the nation are split on the issue, Texas courts could have addressed this as recently as September 2008 when Salazar's case came before the Travis County court. But, with no objection, and consequently no appeal, the trial court's order will stand as issued. This Comment will start with a brief history-the history behind the fundamental right to procreate and the history …

Service Learning With Individuals With Disabilities: Emerging Themes, Angela Brickhouse, Jennifer Harris, Kelly Mcgraw, Lauren Wernli Jan 2010

Service Learning With Individuals With Disabilities: Emerging Themes, Angela Brickhouse, Jennifer Harris, Kelly Mcgraw, Lauren Wernli

Theses & Honors Papers

In this study, 92 students, enrolled in introductory level courses at a small liberal arts university in rural central Virginia, were asked to fulfill 15 hours of service learning with individuals with disabilities. Students were required to keep journal reflections after each hour they completed. The researchers analyzed this data qualitatively by looking at themes and changes in attitude toward individuals with disabilities across the service learning activities. Data was organized into case studies representing each service learning activity. Then, common themes across the activities were discussed to assess the impact the activities had on attitudes of the college students …
