Legitimacy And Deterrence Effects In Counter-Terrorism Policing: A Study Of Muslim Americans, Tom R. Tyler, Stephen J. Schulhofer, Aziz Huq Feb 2010

Legitimacy And Deterrence Effects In Counter-Terrorism Policing: A Study Of Muslim Americans, Tom R. Tyler, Stephen J. Schulhofer, Aziz Huq

Public Law and Legal Theory Working Papers

This study considers the circumstances under which members of the Muslim American community voluntarily cooperate with police efforts to combat terrorism. Cooperation is defined to include both a general receptivity toward helping the police in anti-terror work, and the specific willingness to alert police to terror related risks in a community. Two perspectives on why people cooperate with law enforcement, both developed with reference to general policing, are compared in the context of anti-terror policing and specifically among members of the Muslim American community. The first is instrumental. It suggests that people cooperate because they see tangible benefits that outweigh …

Human Rights And Domestic Violence: An Advocacy Manual, Human Rights Clinic Feb 2010

Human Rights And Domestic Violence: An Advocacy Manual, Human Rights Clinic

Human Rights Institute

Though international law is traditionally called “the law of nations,” it governs far more than relations between the countries of the world. International human rights law pushes the boundaries of State responsibility and allows individuals to directly demand accountability for both governmental action and inaction that violates basic human rights. International human rights treaties declare the minimum standards by which States (i.e. nation-states, or countries) are expected to comply. The theme of the 2010 Fourteenth Annual Domestic Violence Conference at Fordham Law School, “Expanding Our Vision: Human Rights, Victims’ Rights, and Approaches to Diverse Families,” for which this manual was …

A Critical Analysis Of The Theoretical And Empirical Literature Comparing The Effects Of Traditional Versus Community Policing On Quality Of Life And Associated Quality Of Life Issues, Rodney Polite Feb 2010

A Critical Analysis Of The Theoretical And Empirical Literature Comparing The Effects Of Traditional Versus Community Policing On Quality Of Life And Associated Quality Of Life Issues, Rodney Polite

Graduate Student Dissertations, Theses, Capstones, and Portfolios

There are two major issues that will be addressed in this study to determine if they influence the selection of an appropriate policing strategy. The first is citizen perception of whether crime has decreased or increased in their community. The second is whether the length of time a citizen has lived in the community has an effect on their perception of crime and their attitude towards a specific policing strategy.

Historically, each policing strategy, although at times labeled differently (professional policing, team policing, neighborhood policing, zero-tolerance policing), has evolved and adapted based on various dynamics within police organizations and the …

The Post-Medellin Case For Legislative Standing, James A. Turner Feb 2010

The Post-Medellin Case For Legislative Standing, James A. Turner

Celebrating WCL Student Authors

After the terrorist attacks against the United States on September 11, 2001, the balance of power between the executive and legislative branches of government in this country shifted. President Bush expanded the executive’s unilateral authority in international affairs and war powers. Both President Bush and President Obama have extended executive power, and then staunchly protected their expansion of authority from limitation by the legislative and judicial branches. Further, Bush’s use of presidential signing statements to undermine legislative intent suggests that the executive’s power to avoid legislative input may be virtually limitless.

The Supreme Court’s 2008 Medellín v. Texas decision appeared …

The International Implications Of Quality-Of-Life Policing As Practiced In New York City, Bruce D. Johnson, Andrew Golub, James E. Mccabe Feb 2010

The International Implications Of Quality-Of-Life Policing As Practiced In New York City, Bruce D. Johnson, Andrew Golub, James E. Mccabe

Criminal Justice Faculty Publications

The New York City Police Department (NYPD) has made enforcement of laws against disorder and quality-of-life offenses a central part of its policing strategy. Concomitantly, New York City (NYC) experienced a renaissance in orderliness, cleanliness, tourism, real estate value, and crime reduction, although other problems such as poverty, unemployment, drug abuse, racial tensions, and homelessness persist. This paper examines quality-of-life policing practices in NYC, describes the philosophical underpinnings, explores the critical response to the program, and presents lessons of potential relevance to other policing organizations in the USA and around the world.

Studying Japanese Law Because It's There, Tom Ginsburg Feb 2010

Studying Japanese Law Because It's There, Tom Ginsburg

Public Law and Legal Theory Working Papers

John Haley’s essay offers a number of reasons why the study of Japanese law is as relevant as ever. This reply extends and, in part, challenges Haley’s claims, focusing especially on the relevance of Japanese experience for questions of institutional development and change. The reply also emphasizes non-instrumental rationales for the study of foreign legal systems.

John Paul Stevens And Equally Impartial Government, Diane Marie Amann Feb 2010

John Paul Stevens And Equally Impartial Government, Diane Marie Amann

Scholarly Works

This article is the second publication arising out of the author's ongoing research respecting Justice John Paul Stevens. It is one of several published by former law clerks and other legal experts in the UC Davis Law Review symposium edition, Volume 43, No. 3, February 2010, "The Honorable John Paul Stevens."

The article posits that Justice Stevens's embrace of race-conscious measures to ensure continued diversity stands in tension with his early rejections of affirmative action programs. The contrast suggests a linear movement toward a progressive interpretation of the Constitution’s equality guarantee; however, examination of Stevens's writings in biographical context reveal …

Criminology And Criminal Justice: Differences In Programs At The Master's Level, Ruth Triplett, Elizabeth Monk-Turner

Sociology & Criminal Justice Faculty Publications

Our aim in this work is to: (1) determine how distinct the program structure and curriculum content for graduate education in Criminology was compared to Criminal Justice; and (2) evaluate whether the diversity or consistency of the curriculum in either field varied depending of what type of department was offering the degree. Differences in department titles, hours required for the M.A. degree, program descriptions, curriculum content and curriculum content by department type between M.A. programs in Criminology and Criminal Justice were examined. The results suggested there is both consistency and difference in program structure and in curriculum content across the …

Losing The Loss Calculation: Toward A More Just Sentencing Regime In White-Collar Criminal Cases, Derick R. Vollrath Feb 2010

Losing The Loss Calculation: Toward A More Just Sentencing Regime In White-Collar Criminal Cases, Derick R. Vollrath

Duke Law Journal

The sentencing regime that governs white-collar criminal cases requires reform. The U.S. Sentencing Guidelines recommend sentences that are generally too high and place a grossly disproportionate emphasis on the concept of "loss"-the dollar value of the harm that a court finds a white-collar criminal to have caused. This concept of loss is ill defined, and often artificial to the point of being arbitrary. Moreover, the loss calculation fails to adequately approximate a defendant's culpability, dwarfing traditionally relevant considerations such as the manner in which the defendant committed the crime and the defendant's motive for doing so. Fortunately, the Supreme Court …

Identification And Quantitation Of 3,4-Methylenedioxy-N-Methylamphetamine (Mdma, Ecstasy) In Human Urine By 1h Nmr Spectroscopy. Application To Five Cases Of Intoxication, Jonathan Liu, John Decatur, Gloria Proni, Elise Champeil

Publications and Research

Identification of 3,4-methylenedioxy-N-methylamphetamine (MDMA, ecstasy) in five cases of intoxication using nuclear magnetic resonance (NMR) spectroscopy of human urine is reported. A new water suppression technique PURGE (Presaturation Utilizing Relaxation Gradients and Echoes) was used. A calibration curve was obtained using spiked samples. The method gave a linear response (correlation coefficient of 0.992) over the range 0.01–1 mg/mL. Subsequently, quantitation of the amount of MDMA present in the samples was performed. The benefit and reliability of NMR investigations of human urine for cases of intoxication with MDMA are discussed.
