Databases In Courts: The Kenyan Experience, Samwel Otieno Oyuuh Feb 2010

Databases In Courts: The Kenyan Experience, Samwel Otieno Oyuuh

Regis University Student Publications (comprehensive collection)

One of the most significant challenges faced by courts today is managing the performance of their case management system to meet growing case loads efficiently and effectively. There are many different types of technology to help in developing an electronic courtroom, but the underlying technology is the database. Databases are used by courts for maintaining case records, personnel and other court management data. But many conditions such as training and technological infrastructure need to be in place to support successful systems. This work presents the results of a survey of case management operations and practices in Kenya. Current state of …

State V. Burgess: A Limitation On A Defendant’S Right To Remain Innocent, Elizabeth Lahey Feb 2010

State V. Burgess: A Limitation On A Defendant’S Right To Remain Innocent, Elizabeth Lahey

The University of New Hampshire Law Review

[Excerpt] “This note will explore the current state of the privilege against self-incrimination, particularly in regard to whether it works to bar negative inferences from being drawn from a defendant’s silence during sentencing in order to determine his remorse for the crime of which he has been convicted. I will focus primarily on the issue in the context of the recent New Hampshire case State v. Burgess. In that case, the court recognized the application of the privilege at sentencing, but nonetheless carved out a unique exception which made negative inferences permissible at sentencing when the defendant has admitted to …

The End Of Originalism, Jeffrey M. Shaman Feb 2010

The End Of Originalism, Jeffrey M. Shaman

San Diego Law Review

Much has been written about originalism - the idea that the Constitution should be interpreted according to its original meaning. This Article goes beyond previous works by asserting that originalism may be nearing its demise. Ironically, the beginning of the end of originalism may have been prompted by the Supreme Court's decision in District of Columbia v. Heller, marking the first time that a majority of the Court signed onto an opinion emphatically taking an originalist slant. Heller may represent the apogee of originalism and, because it exposes the fundamental flaws of originalism, may also mark the beginning of its …

Arts-In-Corrections: A Path To Redemption, Larry Brewster Feb 2010

Arts-In-Corrections: A Path To Redemption, Larry Brewster

Public and Nonprofit Administration

The California Arts-in-Corrections (AI C) program is among the oldest in the nation. The Prison Arts Program (PAP), a three-year pilot program, was the precursor of Arts-in-Corrections In 1983, I found the program to be cost-effective, and in 1986 wrote about the importance of prison art programs in the Journal of American Culture. Twenty-five years later, this paper evaluates the impact Arts-in-Corrections had on the lives of men and women during and following their incarceration. A diverse group of ex-cons as measured by race, age, gender and crimes committed were interviewed, and four of them were students in AIC at …

Degrees Of Emotion: Judicial Responses To Victim Impact Statements, Mary Lay Schuster, Amy Propen Feb 2010

Degrees Of Emotion: Judicial Responses To Victim Impact Statements, Mary Lay Schuster, Amy Propen

English

Emotional standards and hierarchies in the courtroom may affect judicial reactions to victim impact statements. Based on judicial conversations and courtroom observations in two judicial districts in Minnesota, we suggest that judges contrast emotion with reason in order to maintain control of their courtrooms; when faced with emotional expressions in victim impact statements, judges appreciate expressions of compassion and tolerate expressions of grief but are uncomfortable with expressions of anger. These judicial responses to emotional expression, however, must be contextualized; for example, the judges we spoke with often articulated different reactions to impact statements given by victims of sexual assault, …

What's Past Is Prologue? Why The Prison Litigation Reform Act Does Not—And Should Not—Classify Punitive Damages As Prospective Relief, Lisa Benedetti Feb 2010

What's Past Is Prologue? Why The Prison Litigation Reform Act Does Not—And Should Not—Classify Punitive Damages As Prospective Relief, Lisa Benedetti

Washington Law Review

The Prison Litigation Reform Act of 1995 (PLRA) arose from Congress’s intent to curb frivolous and institutionally invasive prisoner civil rights litigation. In furtherance of its goals, the PLRA limits the prospective relief prisoners can receive to such relief that is narrowly tailored to the federal rights violation at issue and the least intrusive means necessary to correct the violation, otherwise known as the need-narrownessintrusiveness standard. Under the PLRA, prospective relief includes all relief other than compensatory monetary damages. However, while the courts have frequently applied and interpreted the PLRA over the past decade, only one circuit has addressed whether …

Killings Of Police In U.S. Cities Since 1980: An Examination Of Environmental And Political Explanations, Stephanie L. Kent Feb 2010

Killings Of Police In U.S. Cities Since 1980: An Examination Of Environmental And Political Explanations, Stephanie L. Kent

Sociology & Criminology Faculty Publications

Most research on killings of police in urban areas attempted to link lethal violence against officers to the violence and disorder in the communities they work.Yet support for this relationship is inconsistent. Fewer studies considered whether local political arrangements affect killings of police. This study attempts to remedy this gap by using recent data to investigate the relationship between the political conditions of large U.S. cities and the number of homicides of police officers in the line of duty in the years 1980, 1990, and 2000. Negative binomial regression analyses suggest that racial income inequality and the size of the …

What Does It Cost To Access Justice In Canada? How Much Is “Too Much”? And How Do We Know? Literature Review, Kim Taylor, Ksenia Svechnikova

Barriers to accessing justice are a serious social concern. It is widely understood among those who work within the justice system, litigants and the general public, that cost is a barrier to accessing justice.
