A Prosecutor’S Ethical Duty To Divert, Jordan Stevenson Mar 2026

A Prosecutor’S Ethical Duty To Divert, Jordan Stevenson

Legal Writing Competition Winners

In an American courtroom, litigants are divided across an aisle, a gavel grants or divests rights, and a community takes sides. This creates a narrative of duality in the justice system, which many believe is vital to the adversarial legal system. A criminal trial is seen as perpetrator versus victim, but the legal posture is actually government versus individual. In fact, a prosecuting attorney has ethical obligations not just to victims, witnesses, and the broader community, but to defendants as well, in part due to their tremendous discretion to bring or dismiss criminal charges. A prosecutor’s power is far too …

Hands Free Policy Brief, Ryan E. Spohn, Justin Nix, Sadaf Hashimi, Travis Carter, Seth Goldsmith, Nikolas Hahn

Reports

Owning a motor vehicle and a smartphone are modern conveniences that most Nebraskans were accustomed to by 2024. 1 The combination has, however, proven to be a modern challenge for roadway safety. Traffic crashes stemming from cellphone distractions have increased steadily since 2016, and traffic fatalities have fared no better since 2019. 2 Cellphone laws restricting the use of cellular devices while operating a motor vehicle may offer some relief. Although most states, including Nebraska, have text-messaging bans, others have begun instituting additional legislative mandates prohibiting cellphones while driving—often termed a hands-free policy (HFP). The purpose of this policy brief …

Effectiveness Of Peace Education And Recommendations For Implementation In The Sultanate Of Oman's School Curriculum, Vision 2040, Mohamed Al Braiki

Dissertations and Theses

This study explores peace education as an institutional process within the Sultanate of Oman's K–12 education system. Currently, Oman Vision 2040 articulates commitments to social cohesion, global citizenship, and holistic development. Existing empirical research indicates constant challenges related to bullying, student well-being, emotional distress, and school-related harm. This study conceptualizes peace education as a structural and relational mechanism embedded within institutional routines, leadership practices, and conflict-management responses. Using a qualitative integrative review design, the study examines peer-reviewed research, policy documents, and institutional analyses relevant to Oman, the Gulf region, and broader peace education scholarship. The analysis is guided by theoretical …

Navigating Stem Integration: Instructional Strategies Employed By Teachers In High School Classrooms, Yousef Alrashdi, Paul Asunda

Journal of STEM Teacher Education

This study examined the instructional strategies used by high school STEM teachers to incorporate real-world problem solving in their classroom teaching. A qualitative approach was utilized, and data was collected through teacher interviews, classroom observations, and documents. Thematic analysis was used to analyze data, and the following themes emerged: (a) there is no single instructional strategy, but teachers adapt their strategies to the context, (b) the importance of preparation using various sources and building on student’s prior knowledge, (c) a focus on asking "why" questions as a priority, (d) the necessity of making group work tangible, (e) the use of …

Coloring Outside The (Guide)Lines: Hispanic Race/Ethnicity, District Types, And Sentencing Outcomes In Immigration Offense Cases For Noncitizen Defendants, Paige S. Pagano

USF Tampa Graduate Theses and Dissertations

This thesis examines whether sentence length in federal immigration cases varies by Hispanic race/ethnicity, district type, and the intersection of the two among noncitizen defendants sentenced under Chapter 2L of the United States Sentencing Guidelines. Prior research has identified disparities in federal sentencing tied to race/ethnicity, citizenship status, and geographic context, but less attention has been given to how these factors are connected within immigration cases. The analysis uses individual-level case data for Fiscal Year (FY) 2024 from the United States Sentencing Commission, analyzing 14,354 noncitizen defendants sentenced for immigration-related offenses in federal courts across the contiguous United States. Sentence …

Teaching Evidence-Based Practice In Social Work: Practical Instructional Design Approaches For Graduate Students, Nicholas D. Bambach Mar 2026

Teaching Evidence-Based Practice In Social Work: Practical Instructional Design Approaches For Graduate Students, Nicholas D. Bambach

Transforming Libraries for Graduate Students

Across the social and health sciences, evidence-based practice (EBP) serves as a cornerstone of professional education and links research-based knowledge to real-world decision-making. Students are expected to integrate empirical findings with client needs, ethical considerations, and professional best practices. Yet many graduate students struggle to translate theoretical concepts into applied practice. Academic librarians, particularly those serving as subject liaisons and specialists, are well positioned to partner with social work faculty to design scaffolded instructional experiences that integrate research literacy with social work’s ethical and humanistic frameworks. Through librarian–faculty partnerships, librarians can help students critically engage with research evidence while honoring …

Justice-Involved Adults’ Perspectives On Multidisciplinary Treatment Teams During Community Re-Entry, Monique D. Brown Wellons Mar 2026

Justice-Involved Adults’ Perspectives On Multidisciplinary Treatment Teams During Community Re-Entry, Monique D. Brown Wellons

Walden Dissertations and Doctoral Studies

Adults with mental illnesses have been disproportionately represented in the criminal justice system, often due to limited access to timely mental health treatment and fragmented community-based support. When continuity of care was inadequate, justice involvement frequently replaced coordinated interventions designed to promote stabilization and recovery. This qualitative study was guided by the sequential intercept model and the risk-need-responsivity model to examine how multidisciplinary treatment teams influenced rehabilitation and reoffending outcomes among formerly incarcerated adults diagnosed with mental illness. Data was collected through semi-structured interviews with justice-involved adults who described their experiences with multidisciplinary support during their reentry process and analyzed …

Depressive Symptoms, Campus Connectedness, And Campus Climate Related To Sexual Violence And Misconduct, Stephanie A. Navarro Silvera, Amanda S. Birnbaum, Eva S. Goldfarb, Ranju Mainali, Lisa D. Lieberman Mar 2026

Depressive Symptoms, Campus Connectedness, And Campus Climate Related To Sexual Violence And Misconduct, Stephanie A. Navarro Silvera, Amanda S. Birnbaum, Eva S. Goldfarb, Ranju Mainali, Lisa D. Lieberman

Department of Public Health Scholarship and Creative Works

Depression, although a consequence of sexual violence, has not been studied in the context of college students’ views of campus sexual violence climate. Depression is one of the most prevalent and impairing mental health concerns among college students and has well-established links to sexual violence victimization; therefore, it serves as a theoretically and clinically meaningful focal outcome. Therefore, we assessed perceptions of institutional climate in the context of self-reported depression. Undergraduates (n = 716) reported perceptions and experiences of campus sexual violence and misconduct, connectedness, attitude, and depressive symptoms in an online survey. More than a third of participants reported …

Psychologists’ And Psychiatrists’ Views On Criminal Behavior, Fetal Alcohol Spectrum Disorder, And Federally Sentenced Indigenous Women In The Prairie Region And British Columbia, Rina Asghar Mar 2026

Psychologists’ And Psychiatrists’ Views On Criminal Behavior, Fetal Alcohol Spectrum Disorder, And Federally Sentenced Indigenous Women In The Prairie Region And British Columbia, Rina Asghar

Walden Dissertations and Doctoral Studies

The overrepresentation of federally sentenced Indigenous women in Canada reflects longstanding structural and systemic injustices within the criminal justice system. Constituting approximately 5% of the female population, Indigenous female offenders are disproportionately represented, especially in maximum security facilities and structured intervention units. This qualitative study examined psychologists’ and psychiatrists’ perspectives on the potential role of fetal alcohol spectrum disorder (FASD) related neurocognitive impairments in increasing justice system involvement among Indigenous women in Western Canada. Guided by the multidimensional Indigenous developmental framework, which integrates historical trauma theory and attachment theory, nine psychologists and one psychiatrist were interviewed in semi-structured interviews. The …

Encouraging A United Response: A Systematic Review And Mixed-Methods Collaborative Evaluation Of Co-Responder Model Effectiveness In Florida, Kelsey Greenfield Mar 2026

Encouraging A United Response: A Systematic Review And Mixed-Methods Collaborative Evaluation Of Co-Responder Model Effectiveness In Florida, Kelsey Greenfield

USF Tampa Graduate Theses and Dissertations

Even before the deinstitutionalization movement caused the influx of state hospital patients into communities ill-prepared to navigate their needs, law enforcement has been responsible for responding to persons in crisis (PIC) due to mental illness. In response to the high rates of incarceration for persons with mental illness (PMI), a growing number of law enforcement agencies have adopted diversion strategies referred to as police-mental health collaboration (PMHC) models to divert PMI away from the criminal justice system and towards community mental health services. Despite nearly forty years of research, there are still considerable knowledge gaps regarding who benefits from PMHCs …

Ai-Enhanced Citation Mapping: Tools & Strategies For Graduate Instruction, Corinne Bishop Edd, Rachel Trnka Phd, Ven Basco Mar 2026

Ai-Enhanced Citation Mapping: Tools & Strategies For Graduate Instruction, Corinne Bishop Edd, Rachel Trnka Phd, Ven Basco

Transforming Libraries for Graduate Students

AI-enhanced citation mapping tools offer the potential to streamline the discovery process when conducting academic literature searches. Among the wide range of AI-enhanced tools now available, tools like Citation Gecko, Connected Papers, LitMaps, and Research Rabbit are designed to identify, visualize, and uncover relevant connections between sources. While these tools offer the potential to streamline the discovery process, many graduate students may be unaware of how to use AI tools effectively or how to evaluate the relevancy of search results. Graduate students may also mistakenly view the use of an AI-enhanced citation mapping tool as a “one-stop solution” to search …

“Enslavement By Unbridled Passions:” Catholic Magisterial Institutional Attitudes Toward Homosexuals In Poland Between 1945 And 1989, Agnieszka Laddach Mar 2026

“Enslavement By Unbridled Passions:” Catholic Magisterial Institutional Attitudes Toward Homosexuals In Poland Between 1945 And 1989, Agnieszka Laddach

Journal of Global Catholicism

During Communism, the Polish bishops presented a narrative about (homo)sexuality with in order to create the image of a righteous moral and social life that was to influence the Catholics. In my research I conduced a thematic analysis of this narrative. I highlight the doctrinal and Polish social-religious context to foreground tendencies in the formation of Church teaching about homosexuality as well as the importance of the Church in Poland to its formation. Then, I show the factors that characterize the episcopal discourse’s content and language about homosexuality, recognizing that components of episcopal discourse suggest a specificity of Church potential …

Bad Men In The Bordertown: Confronting Police Violence Against Native Americans With The Bad Men Treaty Clauses, Taylor Graham Mar 2026

Bad Men In The Bordertown: Confronting Police Violence Against Native Americans With The Bad Men Treaty Clauses, Taylor Graham

New Mexico Law Review

In nine treaties signed by Tribal Nations and the United States between 1867 and 1868, the United States promised redress to Native Americans for wrongs committed against them by “bad men among the whites.” Today, Native Americans are more likely to be killed by police than any other group, with much of this violence concentrated near the borders of Tribal Nations. Although claims brought under the “bad men” treaty clauses offer an avenue for combatting this epidemic of violence, courts have begun interpreting the clauses to apply only when “wrongs” occur within Tribal boundaries. This article argues that the territoriality …

Weakening The Reasonable Efforts Requirement In New Mexico Termination Of Parental Rights Cases, Monika Myers Mar 2026

Weakening The Reasonable Efforts Requirement In New Mexico Termination Of Parental Rights Cases, Monika Myers

New Mexico Law Review

Parents’ right to control the upbringing of their own children is long-established in the United States. However, in the case of child abuse, neglect, or abandonment, a state can terminate parental rights, permanently severing the legal relationship between a parent and a child. In New Mexico, to terminate parental rights for abuse or neglect the State must prove three elements by clear and convincing evidence: (1) the child is abused or neglected; (2) the conditions that brought the child into care are unlikely to change in the foreseeable future and (3) this is the case despite reasonable efforts by the …

Regression Dressed As Reform: Bharatiya Nyaya Sanhita And The Shifting Contours Of Political Speech, Anushka Singh Mar 2026

Regression Dressed As Reform: Bharatiya Nyaya Sanhita And The Shifting Contours Of Political Speech, Anushka Singh

National Law School of India Review

This paper examines the shifting contours of criminal law in relation to political speech, with a focus on Section 152 of the Bharatiya Nyaya Sanhita (BNS). It advances three arguments. First, the decolonising narrative behind deleting sedition glosses over substantive continuities between colonial and post-colonial periods, with Section 152 BNS refashioning the colonial-era bifurcation between ‘sedition’ and ‘sedition-like’ activity. The BNS provision represents a backslide in the way it converges the various legal and political connotations of sedition from colonial to contemporary times, creating a new criminal category constructed through popular political-extra-legal discourses. Second, Section 152 BNS borrows from the …

An Examination Of The Relationships Between Types Of Strain And Substance Misuse Among Queer Adults, Mckenzie T. Nguyen, Katelyn Mcmahon Mar 2026

An Examination Of The Relationships Between Types Of Strain And Substance Misuse Among Queer Adults, Mckenzie T. Nguyen, Katelyn Mcmahon

The Cardinal Edge

Current research has paid particular attention to outcomes of different strains using samples of sexual and gender minority (SGM) youth; however, minimal research has examined Agnew's (1992) General Strain Theory (GST) using samples of SGM adults. Using a path analysis, this study seeks to investigate how different strains - including financial strain, relationship strain, and victimization - are predictive of drug misuse, and if those effects are mediated by negative mental health outcomes. The study utilizes Meyer's (2016) Generations Study and includes a sample of 1,518 SGM Americans. Results indicate that only financial strain is partially mediated by negative emotions, …
