Competence To Stand Trial: Special Challenges For The Population Diagnosed With Intellectual Disabilities And Borderline Intellectual Functioning, Diomaris E. Jurecska
Doctor of Psychology (PsyD)
This study contributes to the psychometric validity of the psychological tests most frequently used to determine competency to stand trial for people with intellectual disabilities. First, the relationship between The MacArthur Competence Assessment Tool (MacCAT-CA) and the Competence Assessment to Stand Trial for Defendants with Intellectual Disabilities (CAST-MR) was analyzed, including their respective determination of competency for currently adjudicated adults with intellectual disabilities. Second, the relationship between performance on the Malingered Incompetence Legal Knowledge test (MILK), a new measure designed to evaluate malingering by people with intellectual disabilities in a legal context, and the Test of Memory Malingering (TOMM) was …

U.S. Legal Education Methods And Ideals: Application To The Japanese And Korean Systems, Matthew J. Wilson
Cardozo Journal of International and Comparative Law
The article examines the adoption of American-style legal education in Japan and South Korea, highlighting both the opportunities and challenges these reforms present. While these countries aim to enhance legal professionalism and competency by integrating practical skills and interactive teaching methods, they face significant cultural, structural, and systemic barriers. The analysis underscores the importance of adapting legal education to local contexts while balancing theoretical and practical training to meet global legal demands.
Comparison And Analysis Of Korea And Japan Status Of Forces Agreements And Their Implications For Iraq's Sofa, Jiyoung Cha
Comparison And Analysis Of Korea And Japan Status Of Forces Agreements And Their Implications For Iraq's Sofa, Jiyoung Cha
Cardozo Journal of International and Comparative Law
The note examines the tension between protecting U.S. military personnel's rights and respecting host nations' sovereignty through Status of Forces Agreements (SOFAs), focusing on cases from Korea, Japan, and Iraq. It argues that while SOFAs are designed to protect U.S. soldiers, they often infringe on host countries' sovereignty, leading to diplomatic tensions. The analysis highlights the imbalance in SOFAs, favoring the U.S. and undermining host nations' sovereignty, as perceived by citizens and governments. The author suggests that the U.S. needs to adjust its SOFA approach to avoid diplomatic tensions, recommending a more balanced jurisdictional framework.

Adjustment To Correctional Confinement: Investigating The Correlates Of Violence And Disorder In A Jail Environment, Fred W. Meyer Iii
Adjustment To Correctional Confinement: Investigating The Correlates Of Violence And Disorder In A Jail Environment, Fred W. Meyer Iii
UNLV Theses, Dissertations, Professional Papers, and Capstones
This study examines the individual- and institutional-level variables that are correlated with violence and disorder within a jail facility. Previous research indicates that deviant behavior is one of the main challenges that negatively impacts the safe and effective management of correctional facilities. While many studies have been conducted on prison populations, few studies have focused upon jail populations. Using official institutional data, this study explores the factors associated with general infractions and violent misconduct among a stratified random sample of inmates (n=447) incarcerated during a one year period in a large county jail facility. The logistic regression and conjunctive analyses …
Immediate Aftercare Program For Survivors And Families Of Homicide Victims: The Case Of Cobb County Government, Susan B. Stern
Immediate Aftercare Program For Survivors And Families Of Homicide Victims: The Case Of Cobb County Government, Susan B. Stern
Dissertations, Theses and Capstone Projects (Full IR Collection)
Cobb County, Georgia is a rapidly growing, upscale, suburban county in the metro-Atlanta region. However, the County lacks the ability to provide a comprehensive array of services to family members of homicide victims and other non-natural death cases. While various counseling and service programs exist in the area, there is no singular focus on the delivery of services to homicide survivors, families, and friends. Other than the general information provided to surviving family members by the Medical Examiner’s Office at the time of death, there is little to no emphasis currently placed on services to or the needs of those …

An Examination Of The Relationship Between The Hypersexual Environment Of Las Vegas And Forcible Rape, Lisa Ann Dooley
UNLV Theses, Dissertations, Professional Papers, and Capstones
The purpose of this study was to examine whether rates of forcible rape in Nevada are high, possibly a side effect of living in a hypersexual city. The study will explore whether these rates compare to other cities of the same size that are tourism focused and whether rates of forcible rapes are higher in counties without prostitution than with prostitution. This paper will also consider rates of sexual victimization among undergraduate students at the University of Nevada, Las Vegas, University of British Columbia, and Simon Fraser University. Lastly, the study will consider whether the hypersexual nature of the city …

Investigating Snps Flanking The D1s80 Locus In A Tamil Population From India, Kuppareddi Balamurugan, Robert S. Pomeroy, George Duncan, Martin Tracey
Biology Faculty Articles
D1S80 is a 16-bp variable number of tandem repeats minisatellite. We analyzed single nucleotide polymorphisms (SNPs) flanking this locus in a Tamil population. Alleles ranged from 15 through 41 repeats, with alleles 18 and 24 being predominant with frequencies of 31% and 34.5%, respectively, suggesting a bimodal allelic distribution. All the 18-repeat alleles are associated with HinfI(+) and Fnu4HI(-) restriction site polymorphisms at the 5. and 3. ends, respectively. Allele 24 is associated with HinfI(-) and Fnu4HI(+). Of the alleles tested, 98.5% have a linkage of two specific SNP polymorphisms. If an allele is positive for …

No Second Chances: Leandra's Law And Mandatory Alcohol Ignition Interlocks For First-Time Drunk Driving Offenders, Joseph Marutollo
Pace Law Review
This Comment will examine whether it was prudent for New York to mandate alcohol ignition interlocks for all convicted DWI offenders. This Comment begins with an examination of the recent history of alcohol ignition interlocks in New York State. This Comment will then focus on three major critiques of alcohol ignition interlocks: first, whether first-time offenders should be treated the same way as serious alcohol abusers; second, whether mandating alcohol ignition interlocks for first-time offenders is an efficient way to curb drunk driving; and third, whether mandatory alcohol ignition interlock laws violate the separation of powers doctrine through Pennsylvania case …
Constitutionality Of Cyberbullying Laws: Keeping The Online Playground Safe For Both Teens And Free Speech, Alison V. King
Constitutionality Of Cyberbullying Laws: Keeping The Online Playground Safe For Both Teens And Free Speech, Alison V. King
Vanderbilt Law Review
The Internet is a blessing and a curse. Along with the manifold benefits the Internet provides-electronic research, instantaneous news, social networking, online shopping, to name a few-comes a host of dangers: online harassment and cyberbullying, hacking, voyeurism, identity theft, phishing, and perhaps still more perils that have yet to appear. The Internet creates a virtual world that can result in very real consequences for people's lives. This creates a challenge for parents, schools, and policymakers attempting to keep pace with rapidly developing technologies and to provide adequate protections for children. The even greater challenge, however, is to balance these vital …

The Effectiveness Of Counselors As Care Managers In Improving Self-Management And Medical Outcomes In Persons With Poorly Controlled Diabetes, Ularisi Rebecca Green
The Effectiveness Of Counselors As Care Managers In Improving Self-Management And Medical Outcomes In Persons With Poorly Controlled Diabetes, Ularisi Rebecca Green
Counseling & Human Services Theses & Dissertations
This study investigated whether providing counselors as care managers to individuals who were having difficulty managing their Type II diabetes improved their self-management, health, and functioning. Counselors used the Motivational Interviewing Model and met weekly over a six month period with patients who had Type II diabetes who had been identified as not functioning well in managing their disease. The success of the intervention was determined by a number of measures including physical symptoms of patients; patients' perceptions of the care they received; and patients' self-efficacy in managing their diabetes. The results of this study suggested that providing counselors as …
Untangling Fear Of Crime: A Multi-Theoretical Approach To Examining The Causes Of Crime-Specific Fear, Mariel Alper
Untangling Fear Of Crime: A Multi-Theoretical Approach To Examining The Causes Of Crime-Specific Fear, Mariel Alper
Sociology & Criminal Justice Theses & Dissertations
Fear of crime has been a major research topic over the past several decades. However, multiple explanations have been proposed and no clear theoretical model exists. Building on existing research, this study attempts to build a crime type-specific theoretical model of fear. In particular, the predictive power of three theoretical models is explored. This study addresses several methodological shortcomings by measuring offense type-specific, emotionally-based fear of violent and property crime. The results suggest that the predictors of each type of fear vary, and some theoretical models are a better explanation of one type of fear than the other. Overall, the …
Domestic Violence And Recidivism: Does Stake In Conformity Matter?, Sara R. Olson
Domestic Violence And Recidivism: Does Stake In Conformity Matter?, Sara R. Olson
Sociology & Criminal Justice Theses & Dissertations
Domestic violence is a pervasive problem throughout society and has been in existence since the beginning of interpersonal relationships. There have been changes in how the academic community, law enforcement, and the general public respond to this problem in the last thirty years. Punishments have become more punitive and mandatory arrest policies have been instituted. Mandatory arrest for domestic violence batterers has increased the number of batterers that are involved with the criminal justice system. In response to this increase, diversion to batterer treatment and other community based programs has taken the place of jail time for many offenders. This …
