The Affirmatively Hispanic Judge: Modern Opportunities For Increasing Hispanic Representation On The Federal Bench, Linda Maria Wayner Jul 2010

The Affirmatively Hispanic Judge: Modern Opportunities For Increasing Hispanic Representation On The Federal Bench, Linda Maria Wayner

Texas Wesleyan Law Review

There is an abundance of literature on how race shapes, or has the potential to shape, judicial decision-making. Rather than looking to what occurs once a Hispanic judge dons his or her robes, this Article examines the how and why of getting that judge appointed. Part I of this Article will review both the statistics of the general Hispanic population in the United States and examine how demographic changes warrant a renewed commitment to a diversified judiciary, and similarly review the current Hispanic composition serving on the federal bench. Part II will discuss why we should aim for representational parity …

Sustainable Budgeting, Brian K. Strow, Claudia W. Strow Jul 2010

Sustainable Budgeting, Brian K. Strow, Claudia W. Strow

Economics Faculty Publications

At the forefront of current discussion and social conscience is the importance of ecological sustainability. An also important but often overlooked issue is the importance of sustainable budgeting practices for our various levels of government. Governments often provide social services such as food, clothing, shelter, education, public safety, or health care. If the money to pay for the social services comes from additional government debt, social services to future citizens become imperiled. In this paper, the authors set forth a theoretical framework for sustainable government decision making with special emphasis on sustainable governmental budgeting. The authors outline the intricacies of …

Environmental Security And Sustainable Development In Bangladesh: Lessons Learned From Kita Kyushu Eco Town Project, S.N. Parnini

Research Publications (2006 to 2010)

This paper focuses on how strategies and policies adopted by the Kita-Kyushu Eco-Town project of Japan, the plan of a big industrial city, can be applied to Bangladesh in order to protect the country against environmental threats and ensure sustainable development to establish ecofriendly cities. It gives an account of the multi-pronged approach to the issues of environmental security by analysing threats emanating from environmental pollution in the context of applying the Kita-Kyushu Environmental protection project as a model for Bangladesh. The strategies adopted by Kita-Kyushu were to limit the use of ozone depleting substances (ODS) and to initiate resource …

The Misapplication Of Leung Kwok Hung In Hong Kong: Authorizing The Rationality Requirement For Textually Absolute Rights, Albert Connor Buchman Jul 2010

The Misapplication Of Leung Kwok Hung In Hong Kong: Authorizing The Rationality Requirement For Textually Absolute Rights, Albert Connor Buchman

Washington International Law Journal

The Hong Kong Bill of Rights Ordinance (BORO) guarantees many fundamental rights to Hong Kong’s permanent residents. In these constitutionally significant statutes, two types of rights exist: 1) textually qualified rights, which contain qualifying language indicating for what purposes a legislated restriction is permissible, such as when necessary for national security, public order, public health or morals, and 2) textually absolute rights, which contain no language indicating when a legislated restriction on that right is permissible. In Leung Kwok Hung & Others v. HKSAR, the Hong Kong Court of Final Appeal formulated a rationality requirement for when restrictions are …

Volunteer Management Analysis For The City Of Las Vegas, Robert Fash, Jose Rodriguez, Bertral Washington, Heather Whitesides

UNLV Theses, Dissertations, Professional Papers, and Capstones

The City of Las Vegas current volunteer management program is unable to provide effective administration of its volunteers. We will discuss what type of volunteer management program would work best for the City of Las Vegas? Volunteer management models were examined to determine what best practices can be adopted by the City of Las Vegas. Research shows a correlation between citizen engagement, volunteerism in the community, and a better quality of life for citizens in communities that have active volunteer programs. Thirty-six jurisdictions were surveyed, most of which are in the Western United States, with four jurisdictions being highlighted. The …

Access Denied: Sexual Victimization Of Juveniles In Correctional Facilities -- How Senate Bill 585 Could Have Helped, Jillian Malizio

Law Student Publications

The right to counsel is a fundamental right, one the framers of our Constitution intended to apply to all American citizens. Virginia statutes and case law have protected the rights of incarcerated adults and it is now time to grant those same protections to the juveniles in their custody. Part II of this comment will review the requirement of a prisoner’s right to “meaningful access” to the courts from both an adult and juvenile’s perspective. An examination of jurisprudence from the Supreme Court of the United States, and Circuit Courts, reveals the history and importance of “meaningful access” and shows …

Jamming The Revolving Door: Legislative Setbacks For Mental Health Court Systems In Virginia, Sheila Moheb

Law Student Publications

Part II of this comment will discuss the existing issues that effectuate the tension between the criminal justice system and mentally ill offenders, which provides important context to the debate surrounding the establishment of MHCs. Part III will examine the recent federal support for alternative approaches to handling mentally ill offenders and the different operational tactics implemented by existing MHC programs. Finally, Part IV will study the launch of Virginia’s first MHC in Norfolk, while exploring the latest legislative defeat in Virginia, Senate Bill 158 of the 2010 General Assembly, which sought to establish MHCs statewide.

Regulating The Airwaves In Israel's Burgeoning Democracy: Why The Israeli High Court Of Justice Should Have Acknowledged Free Speech In The Case Of Arutz Seven, Maya Tarr

Cardozo Journal of International and Comparative Law

The note examines the role of the Supreme Court of Israel in promoting democracy and freedom of speech, highlighting its interpretation of Basic Laws to include these rights. It critiques the Court's analysis in the Hok Habezek amendment case for not adequately addressing freedom of speech, despite its significant rulings in cases like Kol Haam v. Minister of Interior Affairs.

Public Welfare, Artistic Values, And The State Ideology: The Analysis Of The 2008 Japanese Supreme Court Obscenity Decision On Robert Mapplethorpe, Yuri Obata Jul 2010

Public Welfare, Artistic Values, And The State Ideology: The Analysis Of The 2008 Japanese Supreme Court Obscenity Decision On Robert Mapplethorpe, Yuri Obata

Washington International Law Journal

On February 19, 2008, the Japanese Supreme Court delivered a decision declaring that a collection of photographs by the late American photographer Robert Mapplethorpe did not violate obscenity laws in Japan. The fact that the Japanese Supreme Court publicly found close-up and detailed images of male genitalia in Mapplethorpe’s work no longer obscene perhaps makes the decision a landmark one since the present-day restriction of sexually explicit expression in Japan respected the obscenity standard from the 1957 precedent, the Lady Chatterley’s Lover decision, which ruled that the translation of D. H. Lawrence’s Lady Chatterley’s Lover was obscene. However, close reading …

A Comparison Of Maine’S Per Capita Spending, 1996-2006 To The Us And Other States, Ryan Boyd Jul 2010

A Comparison Of Maine’S Per Capita Spending, 1996-2006 To The Us And Other States, Ryan Boyd

Muskie School Capstones and Dissertations

The Great Recession of 2008-2010 is showing that the states and national government have spent too much. We need the vision of Thomas Friedman to move beyond our spending and planning habits of the past.1

In 2016, expenditures compared to 2006 will look very different, unlike the previous similarities of 1996 to 2006. This retraction, due to the recession and our government’s embracement of concerns about debt from policy wonks such as former US Comptroller David Walker, debt will have a significant affect on many populations of our society. Maine has been noted as being a state that looks after …

A More Inclusive Democracy: Challenging Felon Jury Exclusion In New York, Paula Z. Segal Jul 2010

A More Inclusive Democracy: Challenging Felon Jury Exclusion In New York, Paula Z. Segal

City University of New York Law Review

New York excludes all individuals who have ever been convicted of a felony from its jury pool except in the most extraordinary circumstances. This practice undermines the representativeness of juries, their inclusiveness, as well as public confidence in the courts. It leaves whole communities underrepresented in one of the foundations of democracy. It also compromises an individual’s constitutional rights. People with felony conviction histories are included in the jury pools of nearly half of United States jurisdictions, yet the effectiveness of judicial systems in those jurisdictions has not been compromised. The mechanisms for insuring that juries are competent and unbiased—voir dire, …

On A Quest For Safer Skies: Managing The Growing Threat Of Wildlife Hazards To Aviation, Gail Keirn, Jonathon D. Cepek, Bradley Blackwell, Travis L. Devaul

United States Department of Agriculture Wildlife Services: Staff Publications

The images remain indelible: On a chilly January day in 2009, a United States Airways Airbus A320 departed from New York’s LaGuardia Airport. About five miles out, flying at 2,000 feet, it collided with a flock of Canada geese (Branta canadensis), severely damaging the plane’s engines. Within minutes of the collision the pilot safely conducted an emergency landing on the Hudson River. All 155 passengers survived.

Identification Of Man-Made Hazards In Aneth Chapter, Navajo Nation, Utah, Eugenia L. Quintana Jul 2010

Identification Of Man-Made Hazards In Aneth Chapter, Navajo Nation, Utah, Eugenia L. Quintana

Architecture and Planning ETDs

Identification of man-made hazards is an initial step in planning recommendations for mitigation of man-made hazards. This project entailed a participatory process that engaged the local community in identifying man-made hazards specific to Aneth. The man-made hazards have challenged the community in managing potential damages, physical, environmental and economic losses due to pollution and contamination from man-made hazards. The development of this professional project has revealed some pathways to environmental protection for the Aneth Chapter, which could be the first Navajo Nation Chapter to move towards the development of a plan for mitigation of man-made hazards based upon the identification …

How The Post-Framing Adoption Of The Bare-Probable-Cause Standard Drastically Expanded Government Arrest And Search Power, Thomas Y. Davies Jul 2010

How The Post-Framing Adoption Of The Bare-Probable-Cause Standard Drastically Expanded Government Arrest And Search Power, Thomas Y. Davies

Law and Contemporary Problems

Davies exposes a story that has been almost entirely overlooked: that the now-accepted doctrine that probable cause alone can justify a criminal arrest or search did not emerge until well after the framing of the Bill of Rights in 1789 and constituted a significant departure from the criminal-procedure standards that the Framers of the Bill thought they had preserved.

What Is Probable Cause, And Why Should We Care?: The Costs, Benefits, And Meaning Of Individualized Suspicion, Andrew E. Taslitz Jul 2010

What Is Probable Cause, And Why Should We Care?: The Costs, Benefits, And Meaning Of Individualized Suspicion, Andrew E. Taslitz

Law and Contemporary Problems

Taslitz defines probable cause as having four components: one quantitative, one qualitative, one temporal, and one moral. He focuses on the last of these components. "Individualized suspicion," the US Supreme Court has suggested, is perhaps the most important of the four components of probable cause. That is a position with which he heartily agree. The other three components each play only a supporting role. But individualized suspicion is the beating heart that gives probable cause its vitality.

However, the increasing employment of non-Indians in tribal casinos prompts new cultural and political challenges. This paper analyzes tribal and commercial casino trade publications in order to demonstrate how tribal casino employee relations play a significant role in transforming public policy and perceptions of tribal government in the United States.
