The question of how lawmakers should respond to developmental differences between adolescents and adults in formulating juvenile crime policy has been the subject of debate for a generation. A theme of the punitive law reforms that dismantled the traditional juvenile justice system in the 1980s and 1990s was that adolescents were not different from adults in any way that was relevant to criminal punishment – or at least that any differences were trumped by the demands of public safety. This article addresses concerns expressed by members of the International City/ County Management Association (ICMA) regarding whether the supply of qualified local government managers will keep pace with the future demand for this occupation. The authors developed several important observations, which are based on decades of experience with a Master of Public Administration (MPA) program focused on local government management, plus strategic planning experience in over 100 local governments. Every industry strives to be called a "profession", and software engineering is no exception. This paper attempts to define "profession" from three different perspectives and provides a chronological narration of the professionalization efforts of major IT bodies such as the IEEE Computer Society, Association of Computing Machinery and British Computer Society to promote software engineering from "occupation" to "profession". The outcome of this professionalization process is then examined against the three vastly different definitions of "profession" to qualitatively gauge the success of the professionalization process.

The Military Police is a special federal police force in Canada with unique authority, designed to support military commanders both in operations and in garrison. However, it has historically been under the command of non-Military Police officers, and is consequently not governed like other police forces in Canada. Successful evacuations from metropolitan areas require optimizing the transportation network, monitoring conditions, and adapting to changes. Evacuation plans seek to maximize the city's ability to evacuate traffic to flee the endangered region, but once an evacuation begins, real time events degrade even the best plans.

To better understand behavioral responses made during a hurricane evacuation, a survey of potential evacuees obtained data on demographics, driving characteristics, and the traffic information considered prior to and during an evacuation. Analysis showed significant levels of correlation between demographic factors (e.g., gender, age, social class, etc.) and self-assessed driver characteristics, but limited correlation with …

National Security And The Shadows Of Judicial "Common Sense", Alexander A. Reinert

The article critiques Peter Margulies's analysis of cognitive biases in judicial decision-making within national-security cases, particularly his proposed evidentiary presumption to address these biases. While acknowledging Margulies's contribution to the discussion, the article argues that his characterization of cases and proposed solution may oversimplify the complexities of judicial deference and interventionism. It suggests that the central issue in these cases is not excessive deference or interventionism but rather the government's resistance to transparency and the disclosure of sensitive information. The article advocates for a more nuanced approach, emphasizing managed discovery processes to balance national-security concerns with constitutional rights.

Nearly fifty years after the Supreme Court decided Brady v. Maryland, state and federal criminal justice systems appear less than adequate in assuring that prosecutorial disclosure obligations are met. Recent high-publicity cases have highlighted failures to disclose fundamental exculpatory evidence to the defense, whether intentional or not. A November 2009 symposium at the Cardozo School of Law - New Perspectives on Brady and Other Disclosure Obligations: What Really Works? - explored these issues in a unique framework for the criminal justice system. The purpose of this study was to explore and examine the organizational cultures of municipal park and recreation agencies in the United States. Further, the study sought to compare the organizational cultures of municipal park and recreation agencies which have achieved accreditation from the Commission on Accreditation for Park and Recreation Agencies (CAPRA) versus those who have not achieved CAPRA accreditation. Organizational culture according to Schein (1985) included characteristics found within a working environment, a pattern of assumptions, both written and assumed, passed on to new members. In this feature length screenplay, three boys (friends) grow up together in a conflict zone in northern province of India. Braving the hostile socio-political environment, one of them joins a rebel group fighting the state forces for what they call liberation of their land. He soon gets disillusioned with the mindless violence from both the sides but finds himself into this quagmire where neither the rebels nor the state would spare his life. The other two friends who are equally affected by the hostile environment help him to flee the country.

Singapore will soon submit a national report to and subsequently appear before the UN Human Rights Council for a universal periodic review of its human rights laws and practices. This review will elicit a rare and unprecedented expression of whether and how Singapore feels it has adhered to international human rights law, and ways in which it may further refine or calibrate its domestic practices. This article seeks to identify Singapore’s human rights achievements; highlight challenges it should be prepared to address; and recommend measures it should adopt to promote human rights.

A decade after the bombing of Air India Flight 182 in June 1985, many Canadians were shocked to learn that the Babbar Khalsa Society – a militant organization dedicated to the establishment of an independent state in northern India, members of which are believed to have planned the Air India bombing – had been granted charitable status in Canada. When biomedical waste is improperly managed it poses a health hazard and risk to healthcare workers, sanitation workers and the general public in contracting infectious/dangerous diseases. Biomedical waste is also generated from individuals in their homes from the use of syringes or diagnostic lancets that are not properly managed. Biomedical waste is considered special waste and has a health and environmental hazard that can result in infections and diseases such as HIV/AIDs. Beginning with its seminal 1993 decision in Kokkinakis v. Greece, the European Court of Human Rights has defined religious pluralism as an essential good of the liberal democratic society. Yet, in subsequent decisions traversing a range of legal issues [e.g. Sahin, Dahlab, Bayatyan, and Lautsi], the Court has rendered decisions facially at odds with the goal of advancing religious pluralism. Crime victim recoveries are typically available in American states through three separate, but related, avenues: a criminal proceeding (with or without a formal charge); a related civil claim (including a pre-suit settlement); and, a related administrative or special court proceeding. Multiple avenues can be pursued simultaneously. These avenues often, but not always, have constitutional as well as statutory foundations. Unfortunately state crime victims often go without recovery. Barriers to recovery include intrastate and interstate confusion over terms like restitution and victim. More can be done for victims, especially during criminal case sentencing. The United States’ prison at Bagram Airbase in Afghanistan is the latest front in the battle over the extraterritorial reach of the Constitution. Habeas litigation on behalf of Bagram detainees has begun establishing how the writ of habeas corpus extends beyond U.S. territory to active war zones, and it has begun to refine the limits of presidential power in the war on terror. This thesis is a case study of the impact of Hurricanes Katrina and Rita on the Louisiana court system and the response of the court system to the aftermath of these two hurricanes. Although this thesis focuses on one state’s court system’s response to two natural disasters, the research, conclusions and recommendations are transferable to other states. After the start of World War I in 1914, the British government began internment of enemy alien men, disrupting the large German population settled in the country. This move seemed to be in complete contrast in comparison to the lax immigration laws during the long nineteenth century, when Great Britain had one of the most liberal immigration laws of any country in Europe. The British public was proud of this tradition and Britain’s image as an open haven for refugees and individuals seeking a better life. Ricci V. Destefano: A Masculinities Theory Analysis, Ann C. Mcginley

This Article applies masculinity theory to explore the aspects Ricci v. Destefano and its political reverberations. Empirical evidence showed that virtually all written tests have a disparate impact on minorities, that a neighboring city had reached less discriminatory results using a different weighting system, and that other fire departments used assessment centers to judge firefighters' qualifications for promotions. While the black male and all female firefighters were made invisible by the case and the testimony, the fact that Ricci's and Vargas' testimony lionized a particularly traditional form of heterosexual masculinity was also invisible.
