Minarets, like church steeples, are a physical manifestation of religion. There is little doubt, then, that their recent banning in Switzerland following a referendum constitutes a breach of the right to freedom of religion, with respect to the right to manifest ones religion. This right is protected under a number of instruments, including the Universal Declaration of Human Rights (Article 18), the International Covenant on Civil and Political Rights (ICCPR) (Article 18), and the European Convention on Human Rights (Article 9). Development And Validation Of The Workplace Intergenerational Atmosphere Scale, Scott P. King

This dissertation details the development and validation of the Workplace Intergenerational Atmosphere (WIA) scale over two studies. Given the growing number of older adults in the American workforce and the possibility of four generations working side by side, the WIA scale was designed to measure attitudes and perceptions about workers of different ages in the workplace. In Study 1, using a sample of workers from a non-profit organization, 23 initial items were reduced to 18, including five subscales: Intergenerational Contact, Workplace Intergenerational Retention, Positive Affect, Workplace Generational Inclusiveness, and Lack of Stereotypes. The Use Of Behavioral Agreements By Senior Student Affairs Officers And Counseling Center Directors To Manage Student Mental Health Concerns And Minimize Threatening Behavior, Douglas A. Geiger

This qualitative investigation examines the use of behavioral agreements by Senior Student Affairs Officers and Counseling Center Directors to manage student mental health concerns and minimize behavior that poses threats to campus communities. Six pairs of Senior Student Affairs Officers and Counseling Center Directors at the same institution were interviewed for this study. In addition, documents concerning mental health and threat assessment policy and protocols are also examined and discussed. An expanded theory of practice known as Student Intervention Facilitators is presented as an option to mandated psychotherapy.

Bush. The last twenty years have seen an amazing rise in sophisticated and elegant theories of retributive justice of a Kantian, and more recently, an expressivist variety - a “retributivist revival.” As pure philosophical theorizing goes, this must surely be counted as real progress. Rates of nonmedical psychostimulant use among emerging adults have been previously examined using self-report, but rates among adolescents have not been well documented. Additionally, few studies have examined the relation of nonmedical psychostimulant use and sleep. One purpose of this study was to examine rates of nonmedical psychostimulant use and sleep among adolescents and emerging adults utilizing the same self-report measures. Fourth Amendment Remedial Equilibration: A Comment On Herring V. United States And Pearson V. Callahan, David B. Owens

In two recent decisions, the Supreme Court addressed remedies under the Fourth Amendment by assuming that this remedial construction did not alter the value of the underlying right meant to be protected by the Constitution. First, in Herring v. United States, the court broadened exceptions to the exclusionary rule and implied that suppression may not be required for "negligent" errors generally. Then, in Pearson v. Callahan, the Court abandoned it's "battle-of-order" rule - which required courts to consider the right before inquiring whether that right was "clearly established" at the time of the violation - when considering qualified …

Taking The High Road: Why Prosecutors Should Voluntarily Waive Peremptory Challenges, Maureen A. Howard

In this Article, I review the efficacy of peremptory challenges and conclude that both empirical and anecdotal evidence confirm such challenges are of little utility. I contend that the marginal benefit of peremptory challenges to a criminal prosecutor is outweighed by the damage done to both the actual and perceived fairness of the system, and that imbalance should persuade prosecutors to consider a wholesale voluntary waiver of peremptory challenges.

This Article demonstrates the existence and delineates the scope of a federal constitutional definition of "dying declarations" that is distinct from the definitions set forth in the Federal Rules of Evidence and their state counterparts. This Article further demonstrates that states have state constitutional definitions of "dying declarations" (for purposes of interpreting state constitutional analogues to the Confrontation Clause of the Sixth Amendment) that may differ in important respects from the federal constitutional definition of "dying declarations."

This research was conducted to explore how the San Jose Mercury News (formerly San Jose Mercury Herald) covered the Santa Clara Valley's transition from an agricultural community known as "The Valley of Heart's Delight" to Silicon Valley, focusing on the changes made in the reporting of farm and ranch news.

Mental competency as a prerequisite for due process was established by the United States Supreme Court‟s Dusky decision (1960). The Court mandated that a defendant must possess reasonable levels of factual and rational understanding in order to competently participate in the adjudication process. The precise definitions of competence were not included in any of the Court‟s decisions regarding the concept of Competency to Stand Trial (CST). Therefore, learning ways to navigate differences in social identity becomes important work leaders must now do. Competing claims for legal protection based on religion and on sexual orientation have arisen fairly frequently in Canada in the past decade or so. Monitoring is used in order to ensure the efficiency of the sequestration process and that the CO 2 will remain in the target formation for extended periods of time. This essay explores the contradictions and puzzles of modern juvenile justice, and illustrates the enduring power of the child-saving philosophy of the juvenile court in an era of punitiveness toward offenders both young and old. The exponential growth in incarceration in the U.S. since the 1970s has been more restrained for juveniles than adults, even in the face of a youth violence epidemic that lasted for nearly a decade. It is difficult to say precisely when the business improvement district (BID) was born. BIDs emerged out of legal structures and concepts that date back many decades, but the specific BID form is a relatively recent development. By some accounts, the first BID in the United States was the Downtown Development District of New Orleans, which was established in 1975. Few BIDs were created before 1980, and in most places the surge in BID formation did not really get going until around 1990 – the year that Philadelphia's Center City District was first established.
