To understand the contemporary use of contractor-operated prisons, one must appreciate the political and economic developments which allowed privatization to enter the corrections industry. Accordingly, this article starts with a brief history of privatized corrections in the United States. The following section explores how the modem marketplace for private prisons has been shaped by two prominent dynamics-the emergence of a national market for prison beds and the massive expansion of the nation's immigrant detention system. Proponents of MHCs assert that alternative court systems will provide efficient jail diversion programs and reduce the number of individuals with mental illness in the criminal justice system by directing them to appropriate community treatment facilities. At the same time, MHCs must serve as only one branch of a larger, cohesive community effort to deter individuals with mental illness from incarceration, if not from conviction. Both advocates and adversaries of MHCs remain wary of the potential misuse of mental health courts, which may subject people with mental illness to greater criminalization or lead to greater fragmentation of the mental health …

This paper seeks to lay out a proposal to redefine what it takes to receive tax-deductible donations. Part II of this paper will summarize the current state of the law as it applies to the charitable contribution deduction and the qualification for tax exemption under the Internal Revenue Code. Part III discusses the Charities Act 2006, a recent British act aimed at attempting to redefine charity for England and Wales by requiring organizations to prove that they provide a public benefit before receiving the benefits of being a charity. Louisiana had experimented with various techniques and treatments to control reflection cracking since the 1970s; however, the cost-effectiveness and performance of these methods had not been reliably evaluated. In addition, scientific evaluation and testing of these treatment methods was not performed on many projects. Reducing Distracted Driving: Regulation And Education To Avert Traffic Injuries And Fatalities, Lawrence O. Gostin, Peter D. Jacobson

In this article, we consider the legal and policy implications of distracted driving (the tendency of people to use electronic devices while operating a motor vehicle). After reviewing the empirical evidence showing that distracted driving has serious adverse consequences, we discuss the legal basis for governmental interventions to reduce distracted driving. These interventions include laws restricting the use of electronic devices while driving, especially sending text messages. Since drivers have at best a reduced expectation of privacy, these restrictions should easily survive legal challenges. In District of Columbia v. Heller the Supreme Court held that individuals have a constitutional right to own firearms, notably to keep a loaded handgun at home for self-protection. The historic shift announced by Heller was the recognition of a personal right, rather than a collective right tied to state militias. In McDonald v. Chicago, the Supreme Court – in a familiar 5-4 ideological split – held that the 2nd Amendment applies not only to the federal government, but also to state and local gun control laws. This project is designed as a case study investigating the relationship and practices between residents and police officers in the William Wells Brown neighborhood of Lexington, Kentucky toward the issue of drug-related crime. Employing Michel Foucault‘s work on governmentality and his concept of Splendor, I explore how governance is practiced within the daily negotiations of the WWB neighborhood. I approach this project through the lens of policing because some residents, especially those who comprise the William Wells Brown Neighborhood Association, form a limited partnership with the police department in combating the threat of drug crime in the neighborhood. On November 29, 2009, Swiss voters adopted a ballot initiative introducing a constitutional ban on the construction of minarets. This Article provides a thick description of the minaret vote's context. A legal analysis addresses the implications of the ban under national, regional, and international normative frameworks. The Article argues that the ban is irreconcilable with the Swiss constitutional bill of rights and several international human right provisions. In Switzerland, however, respect for the vox populi potentially trumps any concern over conflicting international obligations, and there is no effective judicial review of initiatives. Officers from the Lexington Division of Police have begun planning the implementation of a popular United Kingdom crime prevention program, Secured by Design, in Lexington, Kentucky. Many municipalities in the United States operate crime prevention by design programs, focusing on how the built environment affects criminal behavior. The United States public post-secondary education system varies in its reliance on state support. Some states have a historic predisposition to a private post-secondary education sector, while others have a tradition of strong public institutions. In all cases, public post-secondary relies on state revenue for their general operating and capital budgets. Effective operation in the current fiscal environment requires a clear understanding of different factors affecting a state’s funding level and the challenges presented in periods of slow economic growth.

The responsibility of hospitals to provide charity care raises fundamental questions about the structure of the United States' health care system. There has been little concrete effort to reassess the obligations of hospitals. This Article seeks to fill that gap by proposing a novel framework for analyzing hospitals' community obligations. This new framework challenges traditional notions of individual charity care and provides a normative basis for encouraging a shift toward public health benefits.

Studies in the past few years have found that California has the highest recidivism rate in the nation. Until just a few decades ago, many did not believe that the rate of recidivism could be decreased for Robert Martinson’s 1974 study stated that “nothing worked” when trying to rehabilitate criminals. However, a renewed interest has proven that criminals can be rehabilitated. Thus, the California Department of Corrections and Rehabilitation (CDCR), as well as various independent researchers have begun to study the effects of programming on inmates.
