Optical Isolation For Audio Amplifiers, Matthew Young Jan 2010

Optical Isolation For Audio Amplifiers, Matthew Young

Honors Capstones

Audio amplifier power supplies have typically utilized power transformers to provide safety isolation from a wall outlet. These transformers provide ohmic disconnect between the power supply and the AC mains. The power transformer and its inherent weight and expense can be eliminated by implementing an off line rectified system for high voltage portions of the amplifier. An optical isolator circuit has been designed to allow audio signals to pass while providing the isolation necessary to protect users from a wall outlet power source short circuit. The optical isolator used to pass the input signal in this design is a Fairchild …

Stealth Preemption: The Irs's Nonprofit Corporate Governance Initiative, James J. Fishman Jan 2010

Stealth Preemption: The Irs's Nonprofit Corporate Governance Initiative, James J. Fishman

Elisabeth Haub School of Law Faculty Publications

The Internal Revenue Service, the primary federal regulator of charities, has initiated a corporate governance initiative. The intervention by the Internal Revenue Service into an area traditionally the preserve of state nonprofit corporate law has little relationship to issues of tax compliance. This corporate governance initiative has been accomplished in the face of IRS acknowledgement that it has no statutory authority relating to these issues. Yet, the power of the Service to recognize tax exempt status and the method it has used to ensure it vision of correct corporate governance practices through a series of questions when an organization applies …

The Untold Story Behind California's Scapegoat: An Analysis Of Proposition 13, Corinne Williams Jan 2010

The Untold Story Behind California's Scapegoat: An Analysis Of Proposition 13, Corinne Williams

CMC Senior Theses

The California experience previous to the passage of Proposition 13 taught the citizens of California that even with representation, the freedoms of individuals could be threatened. This lesson is especially true when we see the assessment scandals, a rapidly increasing real estate market and the failure of California’s representative officials to respond to the threat to individual liberty. In addition to watching corrupt tax assessors take advantage of the system, individuals were tired of paying inflated property taxes that were changing drastically from year to year. People’s homes were literally being taken from them by the power of the tax …

Examining The Impact Of California's Medical Marijuana Program On Public Health, John C. Lamb Jan 2010

Examining The Impact Of California's Medical Marijuana Program On Public Health, John C. Lamb

CMC Senior Theses

The debate surrounding marijuana legalization has increased its popularity in recent years, as the state of California seriously considers the complete legalization of the substance for those ages 21 and over. This would make California the first government in recorded history to regulate the cultivation and sale of marijuana on a commercial level. Advocates back the economic positives concerning high tax revenues, but those opposed argue that the dangers associated with public health greatly outweigh any monetary gain. The present study attempts to reveal the possible public health concerns, even potential benefits, caused by marijuana use and its distribution. Specifically, …

A Valuation Of U.S. Not-For-Profit Summer Camps With A Comparison Of Two Members Of The Association Of Hole In The Wall Camps, Kristine N. Staley Jan 2010

A Valuation Of U.S. Not-For-Profit Summer Camps With A Comparison Of Two Members Of The Association Of Hole In The Wall Camps, Kristine N. Staley

CMC Senior Theses

Despite their prevalence throughout the United States, summer camps are rarely considered as businesses or high-functioning not-for-profit entities. This paper explores the camping industry with a focus on not-for-profit camps. It adapts typical not-for-profit efficiency metrics to camps in order to demonstrate that powerful missions are not always enough to keep not-for-profits in operation. The paper examines two members of the Association of Hole in the Wall Camps which serve children with serious and life-threatening illnesses. Ultimately, this paper is a tool for donors to observe how organizational performance is a crucial factor when donating to organizations with similar mission.

Baseless Pleas: A Mockery Of Justice, Mari Byrne Jan 2010

Baseless Pleas: A Mockery Of Justice, Mari Byrne

Fordham Law Review

This Note addresses the ethicality of the baseless plea, a guilty plea entered by a defendant for a crime that everyone in the courtroom—judge, prosecutor, defense attorney, and defendant—knows the defendant did not commit. Used in the interest of efficiency and leniency, the baseless plea allows a defendant to plead guilty to a crime that has no basis in the facts of the case. Though used by courts in numerous jurisdictions, baseless pleas have been largely unaddressed as courts have sought to conceal the practice and as commentators have therefore failed to detect it. This Note seeks to remedy that …

Asset Forfeiture: State Restrictions And Equitable Sharing, Charles Kucher Jan 2010

Asset Forfeiture: State Restrictions And Equitable Sharing, Charles Kucher

Master's Theses and Capstones

Civil asset forfeiture is criticized for its lack of procedural protections for property owners and for skewing the priorities of law enforcement. Federal civil forfeiture law allows federal agencies to prosecute civil forfeiture cases for state and local law enforcement agencies, a practice that is criticized for allowing the circumvention of state laws. This thesis looks at three factors governing forfeiture at the state level (standard of proof, conviction requirement and financial incentive) and examines their effect on federal equitable sharing payments. The results indicate that both conviction requirement and standard of proof affect equitable sharing payments and suggests that …

Property In Crisis, Nestor M. Davidson, Rashmi Dyal-Chand Jan 2010

Property In Crisis, Nestor M. Davidson, Rashmi Dyal-Chand

Fordham Law Review

Property law generally develops gradually, with doctrine slowly accreting in the interstices of daily conflict and the larger culture of property likewise emerging at a glacial pace. In times of crisis, however, fundamental questions about the nature of ownership and the balance between the individual and the state instantiated in the structure of property rise rapidly to the surface. Our current economic crisis—the deepest since the Great Depression—is no exception. This economic crisis, more than many in our history, began with property, sparked in no small measure by structural flaws in the residential market and an ownership society that advocated …

Using Airborne Laser Altimetry To Characterize Surface Fuels In Western Montana, Tim E. Wallace Jan 2010

Using Airborne Laser Altimetry To Characterize Surface Fuels In Western Montana, Tim E. Wallace

Graduate Student Theses, Dissertations, & Professional Papers

Quantifying surface fuels in forests is problematic for land managers due to the difficulty in measuring fuels of different sizes and spatial variability. Estimating fuel loads is important for identifying departures from historical fire regimes, predicting fire behavior and effects, and prioritizing parcels for fuels reduction. Current field methods of estimation are not always cost-effective nor can they be practical for full coverage at landscape scales. Several studies have examined remote sensing techniques for estimating fuel loads. One of the most promising is Light Detection and Ranging (LiDAR), which thus far has been applied primarily to forest canopies. Metrics derived …

Disquietude, Pamela A. Caughey Jan 2010

Disquietude, Pamela A. Caughey

Graduate Student Theses, Dissertations, & Professional Papers

ARTIST STATEMENT In a post 9/11 world, the global war on terrorism influences our thinking and casts a perpetual shadow that is inescapable. We live in a state of disquietude. Amidst unspeakable events and traumas, we experience censored media, invasion of privacy in the name of heightened "homeland security," eroded freedom of speech, and constant rhetoric serving the politics of fear. Art in the age of terrorism is an attempt to bring interpretation and meaning to these timely issues by portraying multiple perspectives, which address the philosophical, social, political and cultural interventions that the war against terrorism has created. It …

Independent Crime Laboratories: The Problem Of Motivational And Cognitive Bias, Paul C. Giannelli Jan 2010

Independent Crime Laboratories: The Problem Of Motivational And Cognitive Bias, Paul C. Giannelli

Utah Law Review

Law enforcement influence over laboratory decisions is a serious problem. In an ideal world, independent crime laboratories would be the solution. Crime laboratories, however, have historically developed within police agencies, and decades of entrenchment make it difficult to remove laboratories completely from law enforcement control. This does not mean, of course, that the status quo should be preserved. If located within law enforcement agencies, forensic laboratories should be as autonomous as possible and should be run in accordance with scientific norms, including procedures to protect against all types of bias. The NAS Report was not the last messenger. Within months …

Preventive Detention, Character Evidence, And The New Criminal, Ted Sampsell-Jones Jan 2010

Preventive Detention, Character Evidence, And The New Criminal, Ted Sampsell-Jones

Utah Law Review

The criminal law is changing in a profound way. Anglo-American criminal law has traditionally focused on deterring and punishing discrete acts of misconduct. In the last few decades, however, American criminal law has shifted its focus from deviant acts to dangerous individuals. Incapacitation, which once played only a peripheral role in the criminal law, has moved to center stage. To a substantial extent, it has supplanted the two formerly dominant theories of punishment—deterrence and retribution. This dramatic change has been noted, often with some dread, by both legal scholars and sociologists.

The Quest To Save Journalism: A Legal Analysis Of New Models For Newspapers From Nonprofit Tax-Exempt Organizations To L3cs, Nikki Usher, Michelle D. Layser Jan 2010

The Quest To Save Journalism: A Legal Analysis Of New Models For Newspapers From Nonprofit Tax-Exempt Organizations To L3cs, Nikki Usher, Michelle D. Layser

Utah Law Review

The proliferation of online news sources masks a deepening crisis in American journalism. Newspapers, which continue to be the linchpin of original news reporting, are facing unprecedented economic pressures⎯largely due to the rise of new media⎯that have forced nearly all major newspapers to lay off large numbers of journalists, reduce the scope of coverage, and sometimes cease operating entirely. The current economic crisis has only exacerbated existing forces already undermining the viability of the newspaper industry. The traditional support from commercial advertising and paper subscription base now seems antiquated, and the question looming before American journalism is what the next …

The Recurring Paradox Of Groups In The Liberal State, Frederick Mark Gedicks Jan 2010

The Recurring Paradox Of Groups In The Liberal State, Frederick Mark Gedicks

Utah Law Review

A much-noted contradiction of liberal theory is its tolerance of illiberal individuals and groups. This is an apparent consequence of the foundational premise of liberalism, that consensus on the good life is not achievable in conditions of religious and moral pluralism. Without consensus on a single substantive conception of the good, it follows that all such conceptions should be tolerated unless they harm the lives, liberties, or property of others. The liberal state, in other words, is procedural rather than substantive.

Childhood Obesity And Adolescent Obesity In Taiwan And United States, Eric Yao-Tieng Huang Jan 2010

Childhood Obesity And Adolescent Obesity In Taiwan And United States, Eric Yao-Tieng Huang

Graduate Research Papers

The prevalence of obesity in children and adolescents has been increasing over the last two decades. Besides sedentary activity and high-calorie diet, there are numerous obesity-related factors that could be generalized to two categories: (a) intrapersonal factors (e.g., age, gender, socioeconomic status) and (b) interpersonal factors (e.g., friends, family, social support, social climate). The purpose of this literature review was to examine these factors behind the issue of childhood obesity and adolescent obesity in Taiwan and United States. Strong evidence shows a similar trend that both American and Taiwanese adolescents are living sedentary lifestyles, habituated to bad eating habits, and …

Criminal Justice Law Reform: Stealing A Page From The American Playbook, James Stribopoulos Jan 2010

Criminal Justice Law Reform: Stealing A Page From The American Playbook, James Stribopoulos

Articles & Book Chapters

Criminal justice law reform is a major component of the Federal Government's current legislative agenda. Unfortunately, instead of basing reforms on criminological research or the advice of experts, our current Government, by its own admission, is far more interested in what ordinary Canadians think about the criminal justice system.
