The Marketplace Metaphor And Commercial Speech Doctrine: Or How I Learned To Stop Worrying About And Love Citizens United, Darrel C. Menthe
UC Law Constitutional Quarterly
In this article, I place the Citizens United decision in historical and doctrinal context, and argue that the decision indicates a terminal stage of the development and application of the "marketplace of ideas" metaphor in First Amendment law. I argue that the "good news" about the Citizens United decision is that it sets the stage for the abolition of the commercial speech doctrine, which resulted in lower protection for commercial speech, as previously set forth in the 1980 Central Hudson decision. This is good news because the commercial speech doctrine has become a doctrinal anomaly that threatens to undermine the …

Pyruvate carboxylase (PC) catalyzes the ATP-dependent carboxylation of pyruvate to oxaloacetate, an important anaplerotic reaction in mammalian tissues. To effect catalysis, the tethered biotin of PC must gain access to active sites in both the biotin carboxylase domain and the carboxyl transferase domain. Previous studies have demonstrated that a mutation of threonine 882 to alanine in PC from Rhizobium etli renders the carboxyl transferase domain inactive and favors the positioning of biotin in the biotin carboxylase domain. We report the 2.4 Å resolution X-ray crystal structure of the Rhizobium etli PC T882A mutant which reveals the first high-resolution description of …

This Article provides an overview of United States consumer protection law in the growing number cases with an international dimension that arise with economic globalization, expanding transnational corporations, worldwide production chains, manufacturing outsourcing and more efficient international communication. U.S. consumer protection law remains primarily state law, including tort and product liability law, contract and warranty law, and general and product-specific consumer protection statutes. (This refers to the private law remedies for consumer goods which are the substantive laws addressed in this article.) There is little treaty-based, constitutional or federal law except for federal regulatory law that largely adopts state law …
Unrooted Stem Cutting Physiology; Water Use And Leaf Gas Exchange Of Severed Stem Cuttings, Peter Alem
Unrooted Stem Cutting Physiology; Water Use And Leaf Gas Exchange Of Severed Stem Cuttings, Peter Alem
All Theses
Stem cuttings are one of the most frequently used and successful methods of vegetative plant propagation. The understanding of unrooted cutting physiology, especially gas exchange and water flux, is crucial for successful propagation of healthy plants. Prior to root initiation, water uptake is limited and leafy stem cuttings are most vulnerable to wilting.
Experiments were carried out in the greenhouse with poinsettia cuttings to determine water uptake, photosynthesis, transpiration and stomatal conductance from the time of severing to rooting, including time spent in storage. Water uptake through the severed stem was investigated in the laboratory and growth chamber. Cutting gas …

Trends In Body Fat, Body Mass Index And Physical Fitness Among Male And Female College Students, Peter Pribis, Carol A. Burtnack, Sonya O. Mckenzie, Jerome Thayer
Faculty Publications
There have been many publications in recent years reporting on the quantity of physical activity among college students using indirect indicators such as steps walked per day or time spent on physical activities. The purpose of this study was to describe the trends of physical fitness related to BMI and body fat among university students between 1996 and 2008. The results showed a significant decline in the average fitness levels measured as an estimation of VO2max for male and female students (p < 0.001 for both sexes). The linear trend for BMI by years was not significant for both sexes (p for males = 0.772, p for females = 0.253). On average, in the last 13 years, % body fat was increasing 0.513%/year for males and 0.654%/year for females. There is a significant indirect correlation between the student's VO2max levels and % body fat, r = -0.489; p < 0.001 for males; and r = -0.416, p < 0.001 for females. Approximately 23.9% of the variance in the VO2max levels in males and 17.3% in females can be explained by the variance in % body fat. The results support recent findings that physical fitness among college students is declining and body fatness is increasing. © 2010 by the authors.

Browse all Theses and Dissertations
Locking compression plates are proven to be safe for use in open reduction and internal fixation (ORIF) especially in osteoporotic bones. Because of various combinations of holes, the system provides more options for clinicians to use either locking screws or non-locking screws. This clinical research introduces screw like plugs which can be used along with the screws in case of locking compression plates. Experimental work was performed to determine the effectiveness of the plugs. The results showed that there is not a significant difference between the groups which used plugs and did not use the plugs, both in case of …

Cellular And Molecular Dissection Of Pluripotent Adult Somatic Stem Cells In Planarians, Norito Shibata, Labib Rouhana, Kiyokazu Agata
Biological Sciences Faculty Publications
Freshwater planarians, Plathelminthes, have been an intriguing model animal of regeneration studies for more than 100 years. Their robust regenerative ability is one of asexual reproductive capacity, in which complete animals develop from tiny body fragments within a week. Pluripotent adult somatic stem cells, called neoblasts, assure this regenerative ability. Neoblasts give rise to not only all types of somatic cells, but also germline cells. During the last decade, several experimental techniques for the analysis of planarian neoblasts at the molecular level, such as in situ hybridization, RNAi and fluorescence activated cell sorting, have been established. Moreover, information about genes …

Metabolizability Of Dried Distillers Grains Plus Solubles In Finishing Cattle Diets, R.H. Pritchard, J.W. Mccarthick, J. Knock, D.L. Boggs, C.J. Mueller
South Dakota Beef Report, 2010
The feeding value of dried distillers grains plus solubles (DDGS) is a combination of its contributions to protein nutrition as well as caloric intake of cattle. When DDGS is included in diets at levels where dietary CP has been met, the feeding value would primarily be a function of caloric density. A replicated 4 x 4 metabolism study was conducted to measure the caloric value of DDGS at high inclusion levels. Diets were formulated to contain 0, 12, 24, or 36% DDGS. These finishing diets were fed to yearling steers during a 21 d adaptation prior to total fecal and …

Adaptation To The Health Consequences Of Climate Change As A Potential Influence On Public Health Law And Policy: From Preparedness To Resilience, Lindsay Wiley
Scholarly Articles in Law Reviews & Journals
Because the health effects of climate change are likely to be significant and far-reaching, a key component of climate change adaptation will be our public health infrastructure. Perhaps counter-intuitively, recent emphasis in public health law on preparedness for extraordinary events may be to the detriment of our ability to cope with the health impacts of climate change. While existing emergency preparedness law will necessarily be an important backdrop for health-focused climate change adaptation efforts (especially with regard to natural disasters and infectious disease outbreaks), the focus on emergency preparedness in recent years does not necessarily situate us well for handling …

Department of Psychology: Faculty Publications
This study examined the factor structure for three of the Child Feeding Questionnaire (CFQ) subscales, a widely used measure of parental feeding practices, among 296 low-income parents of African American preschool children. Confirmatory factor analysis showed an overall poor fit among CFQ subscales; Restriction, Pressure to Eat, and Concern about Child Weight, (χ2, (df = 87 = 300.249, CFI = 1.00, NNFI = 1.07, RMSEA = .091). Additionally, Cronbach’s Alpha coefficients for 2 of the three subscales were below acceptable recommendations (Restriction = 0.69; Pressure to Eat = 0.58). These results suggest further psychometric clarification is needed to understand commonly …

The Social Determinants Of ‘Health’ Of Embryos: Practices, Purposes, And Implications, Roxanne Mykitiuk, Jeff Nisker
Articles & Book Chapters
An increasing focus on the biomedical determinants of the health of embryos and fetuses is resulting from new technical possibilities, clinical considerations and research purposes (Nisker and White, 2005), but also from social factors, and for a variety of reasons. An exploration of the determinants of health of embryos, just as an exploration of the determinants of child or adult health, must take into consideration traditional social determinants, including those related to the consequences of poverty, such as poor nutrition and toxic environments (World Health Organization, 1948; Wilkinson and Marmot, 2003; Raphael, 2004), but also laws, policies and institutions, which …

Internal Displacement In Colombia: Violence, Resettlement, And Resistance, Juan Esteban Zea
Dissertations and Theses
The majority of the estimated four million internally displaced persons (IDPs) in Colombia who have fled from their lands and homes have migrated to urban centers. This study, performed in Bogotá, Colombia between April and September 2009, examines how IDPs cope with living in a new, urban environment after violent displacement. I held interviews with IDPs, the non-displaced public, and government workers; performed participant-observation in government offices and neighborhoods; and examined archival material. The work examines cultural anthropological topics of violence, migration, and resistance. A discussion of state and structural violence reveals the current hardships many rural Colombians face. Family Relationship Quality And Acculturation: Examination Of Their Relationship Among Latino Adolescent Sexual Offenders, Lindsey B. Patterson
Family Relationship Quality And Acculturation: Examination Of Their Relationship Among Latino Adolescent Sexual Offenders, Lindsey B. Patterson
Dissertations and Theses
Research on child sexual abuse (CSA), from the perspective of the perpetrator, has been conducted to better inform intervention and prevention programs. Although information from perpetrators can be beneficial for these programs, much of the research is limited by the diversity of sample populations of sex offenders. Moreover, potentially distinct variables relevant to specific populations (e.g., Latinos) have not been thoroughly studied in relation to CSA. To better understand the perpetration of CSA on variables that may be of particular concern to Latinos (i.e., relationship quality in familial supervision and acculturation strategies), the purpose of the present study was to …

Use Of Media Technologies By Native American Teens And Young Adults: Evaluating Their Utility For Designing Culturally-Appropriate Sexual Health Interventions Targeting Native Youth In The Pacific Northwest, Stephanie Nicole Craig Rushing
Dissertations and Theses
American Indian and Alaska Native (AI/AN) youth are disproportionally burdened by high rates of sexually transmitted infections and teen pregnancy, heightening their need for sexual health interventions that are aligned to their unique culture and social context. Media technologies, including the Internet, cell phones, and video games, offer new avenues for reaching adolescents on a wide range of sensitive health topics. While several studies have informed the development of technology-based interventions targeting mainstream youth, no such data have been reported for AI/AN youth. To fill this gap, I: a) quantified media technology use in a select group of AI/AN teens …
