Mindfulness, Emotions, And Mental Models: Theory That Leads To More Effective Dispute Resolution, Peter Reilly Jan 2010

Mindfulness, Emotions, And Mental Models: Theory That Leads To More Effective Dispute Resolution, Peter Reilly

Nevada Law Journal

This Article suggests that law students and lawyers can be introduced to, and even begin to master, some of the same transformational principles, skill sets, and behaviors that poured forth from FDR as a result of his intense physical and personal challenges. At the core of nearly all great negotiators, mediators, lawyers, and leaders is a person who has learned to connect with other people, that is, to build relationships of trust, cooperation, and collaboration. Additionally, this Article argues that where people first learn a sense of self and others through both theoretical and practical knowledge and understanding of mindfulness …

Ugly American Hermeneutics, Francis J. Mootz Iii Jan 2010

Ugly American Hermeneutics, Francis J. Mootz Iii

Nevada Law Journal

This article will appear in a Symposium on comparative legal hermeneutics that includes four articles by American scholars and four articles by Brazilian scholars. I argue that the "ugly American" hermeneutics exemplified in Justice Scalia's opinion in District of Columbia v. Heller is unfortunate, even if we supplement Justice Scalia's hermeneutical fantasy with the much more careful and balanced philosophical work by Larry Solum, Keith Whittington and other scholars. Nevertheless, the pragmatic work of interpretation by lawyers and judges in the day-to-day world of legal practice shows a plain-faced integrity of which we Americans can be proud.

Grounding "Language" In The Senses: What The Eyes And Ears Reveal About Ming 名 (Names) In Early Chinese Texts, Jane Geaney Jan 2010

Grounding "Language" In The Senses: What The Eyes And Ears Reveal About Ming 名 (Names) In Early Chinese Texts, Jane Geaney

Religious Studies Faculty Publications

Scholarship on early Chinese theories of “language” regularly treats the term ming 名 (name) as the equivalent of “word.” But there is a significant difference between a “word” and a “name.”1 Moreover, while a “word” is often understood to mean a unit of language that is identifiable in its sameness across speech and writing, there is reason to believe that a ming was mainly used to mean a unit of meaningful sound.2 Analyzing the function of ming is a prerequisite for understanding early Chinese theories of “language”—if such a term is even appropriate. Such an analysis will also …

Jane Austen In Contemporary Film: Interpretations And Reflections Of Austen's Novels In Contemporary Culture, Lindsay Anderson Jan 2010

Jane Austen In Contemporary Film: Interpretations And Reflections Of Austen's Novels In Contemporary Culture, Lindsay Anderson

Senior Honors Theses and Projects

There is no escaping Jane Austen. Though it has been nearly two hundred years since her death, Austen and her work continues to capture the minds and hearts of readers worldwide. Our fascination with her novels continues to grow, finding new expression in literature, television and film each year. What makes this phenomenon so interesting is the reality that Austen’s novels are so firmly “dated” – that is, so rigorously cemented and relevant to the age in which it was written. Why do readers and viewers continue to find Austen’s works so relevant, given that it is so bound to …

Migration, Food And Cultural Production Across Changing Afro-Ecuadorian Geographies, Amelia J. Swinton Jan 2010

Migration, Food And Cultural Production Across Changing Afro-Ecuadorian Geographies, Amelia J. Swinton

Honors Theses

The human geography of Ecuador is changing. Urban Afro-Ecuadorians now outnumber those living in the two rural regions that have been the ancestral homelands of the population. This physical transformation assaults Ecuador's historically racialized geography, which conflated cities, modernity and white-mestizo identity. Though Afro-Ecuadorians living in the rural north had previously been physically and figuratively located outside of the national project, Ecuador’s new constitution has sought to reverse this institutionalized exclusion. National belonging has been reframed through the concept of interculturality, which recognizes diversity and equality at the same time. I conducted two periods of fieldwork in the north-central Chota …

It's Not Catharsis, It's Cognition: A New Approach To Emotion In Composition, Caronia (Nia) Klein Jan 2010

It's Not Catharsis, It's Cognition: A New Approach To Emotion In Composition, Caronia (Nia) Klein

Masters Theses

Therapeutic writing, or writing as a method of emotional healing, seeks to facilitate psychological healing through self-discovery as a result of analyzing, interpreting, and making conclusions about challenging life experiences. Likewise, in composition theory, expressivist, feminist, and collaborative pedagogies advocate the empowerment of students through discovery and articulation of voice as a way to make meaning and develop as persons and students. Both approaches to writing foreground the use of personal experience as a way to process the external world through the emotional landscape of the writer, yet critics ofemotionally expressive writing decry its usefulness to composition pedagogy because of …

An Economic Model Of Literary Studies, Devin Charles Black Jan 2010

An Economic Model Of Literary Studies, Devin Charles Black

Masters Theses

While much scholarly discussion exists on the future of literary studies and its value to society at large, much of this discussion revolves around economic terminology, such as value, without discussing the issues and concerns of literary studies in a larger economic framework. In this project, I look at the advent ofliterary theory as the catalyst that transformed literary studies into a capitalist economic system. This project aims to look at the complexity of value systems operating within the discipline without championing one theory over another or, indeed, championing or arguing against theory itself. Instead, an economic model allows us …

A pretest - posttest control group design was used to compare the effectiveness of phonological awareness intervention and visual phonics in promoting the development of the following emergent literacy skills: alphabet knowledge, beginning sound awareness, print awareness, rhyme awareness, nursery rhyme awareness, phonological awareness at the syllable level, and name writing abilities. Three groups were formed from twenty-four subjects from at-risk early childhood programs in central Illinois. The …

The subjects were six school-aged children with the diagnosis of Autism Spectrum Disorder (ASD) and Childhood Apraxia of Speech (CAS). The subjects were pulled out of their regular 45 minute individual speech therapy and randomly presented …

What Do Graduates Say About Multicultural Teacher Education?, Anaida Colon-Muñiz, John Brady, Suzanne Soohoo Jan 2010

What Do Graduates Say About Multicultural Teacher Education?, Anaida Colon-Muñiz, John Brady, Suzanne Soohoo

Education Faculty Articles and Research

"We wanted to assess the impact that our teacher preparation course on multicultural education has had on teachers’ self-perceptions and practices as multicultural educators. Lowenstein (2009) stated that not enough work has been done to determine the impact of multicultural education courses on teacher candidates once they are in the field. Although California assessments for teachers assess content background and instruction, there is a dearth of assessments on teachers’ capacity to work with culturally diverse learners."

Increasing Teachers' Metacognition Develops Students' Higher Learning During Content Area Literacy Instruction: Findings From The Read-Write Cycle Project, Margaret Sauceda Curwen, Roxanne Greitz Miller, Kimberly A. White-Smith, Robert C. Calfee

Education Faculty Articles and Research

Success in the 21st century, for individuals and societies, requires competence in comprehending and communicating in the academic disciplines--the natural sciences, history, geography, and more. The Read-Write Cycle (RWC) Project, a three year longitudinal research study conducted from 2005-2008 in ten public elementary schools in southern California, explored the effectiveness of curriculum and instructional strategies that integrate literacy with disciplinary knowledge with the simultaneous goals of: (1) enhancing students' literacy outcomes; and (2) broadening and deepening knowledge of the content area. Funded by the U.S. Institute of Education Sciences, the RWC Project concentrated over years one and two on 1,024 …

Imagination And Representation In Graphic Novels, Louann Reid Jan 2010

Imagination And Representation In Graphic Novels, Louann Reid

The Journal of the Assembly for Expanded Perspectives on Learning

Graphic narratives are garnering both scholarly and pedagogical attention. These visual texts move readers imaginatively into what Maxine Greene calls “illusioned worlds,” and simultaneously make them conscious of the constructed nature of those worlds through the visual and verbal conventions of comics.

The Confluence Of Heroism, Sissyhood, And Camp In The Rawhide Kid: Slap Leather, Frank Bramlett Jan 2010

The Confluence Of Heroism, Sissyhood, And Camp In The Rawhide Kid: Slap Leather, Frank Bramlett

English Faculty Publications

Based on a character from the 1950s, The Rawhide Kid: Slap Leather appeared in 2003 as a five– part serial in which Johnny Bart was reconceived as a gay gunslinger known as the Rawhide Kid.[1] Over the course of the five installments, the narrative arc of Slap Leather establishes the legitimacy of a gay man as both sissy and hero and also creates a safe space for other queers. Even the Sheriff — a straight man with a suspect masculinity — is viable in the Kid's Wild West. As the main character, the Rawhide Kid celebrates a combination of sissy …

Urban Universities: Anchors Generating Prosperity For America's Cities, Sheila A. Martin

Urban Studies and Planning Faculty Publications and Presentations

This paper articulates the value and role of urban universities as anchor institutions and engines of metropolitan success. Founded on their long-term commitment to the metropolitan areas they inhabit, the power of urban universities is magnified by strong collaboration with their traditional partners in government and the nonprofit and for-profit sectors. By expanding the number and scope of these broad-based, robust partnerships supported by targeted federal investment?urban universities can help lead our cities and metropolitan regions to long-term competitiveness, environmental sustainability, and enduring vitality as healthy, high-quality communities.

Meeting Social Emotional Needs In Early Childhood Education, Veronica Armstrong Jan 2010

Meeting Social Emotional Needs In Early Childhood Education, Veronica Armstrong

Graduate Research Papers

Is our nation's educational system heading in the right direction? Tremendous emphasis is being put on academic achievement. With this emphasis comes severe consequences for those schools not meeting standards. This situation is causing many administrators, teachers, and support staff as well as parents, community members, and government officials to have blinders on when it comes to how best to help children succeed. Some believe that the best way to help children learn is to cram it at them quickly and efficiently and hope they retain the information long enough to regurgitate it for the standardized test. Others believe that …

Shifting Borders And Shaded Boundaries: Liminality, Identity, Language, And Place In Jean Toomer's Cane, Kristin Taber Jan 2010

Shifting Borders And Shaded Boundaries: Liminality, Identity, Language, And Place In Jean Toomer's Cane, Kristin Taber

Masters Theses

This thesis locates Jean Toomer’s Cane as Modernist text operating within the context of the Great Migration, pointing out ways in which the text reflects the great sense of anxiety, upheaval, and transformation generated as many members of the African American community left the rural South and moved to urban centers in the North. I analyze various discourses and the shifting balance of power present in the text as the narrative voice awards the most value to the ideologies of the rural and spiritual through contrast with he ideologies of the urban and material. This relationship repeatedly problematizes the text’s …
