Workers At Risk: Regulatory Dysfunction At Osha, Thomas Mcgarity, Rena I. Steinzor, Sidney A. Shapiro, Matthew Shudtz Jan 2010

Workers At Risk: Regulatory Dysfunction At Osha, Thomas Mcgarity, Rena I. Steinzor, Sidney A. Shapiro, Matthew Shudtz

Faculty Scholarship

The Occupational Safety and Health Administration was born with a heavy load to bear – the obligation of ensuring that every worker in America has a safe and healthful workplace for his or her entire working life. In its early years, OSHA acted with great vigor, establishing important standards for occupational health and safety that have prevented hundreds of thousands of injuries and illnesses. But the agency has not aged gracefully. Today its enforcement staff is stretched thin and the rulemaking staff struggle to produce health and safety standards that can withstand industry legal challenges. In short, OSHA is a …

Affordable Private Education And The Middle Class City, Nicole Stelle Garnett Jan 2010

Affordable Private Education And The Middle Class City, Nicole Stelle Garnett

University of Chicago Law Review

City leaders, who have struggled for decades with public education reform, are well aware that good schools are needed to attract residentially mobile families to urban neighborhoods. But, while critically important, public education reform alone is not enough. Rather, state and local officials hoping to make our central city neighborhoods attractive places to raise children should come to understand that affordable private schools serve an important urban-development function: they partially unbundle the residential and educational decisions of families with children. Most middle class families, however, cannot afford to send their children to private schools. Thus, state and local officials hoping …

Rethinking The Theory And Practice Of Local Economic Development, Richard C. Schragger Jan 2010

Rethinking The Theory And Practice Of Local Economic Development, Richard C. Schragger

University of Chicago Law Review

Scholars of urban law and policy tend to assume that local officials can exert some influence over city well-being. More specifically, the literature assumes that government policies—either at the federal, state, or local level—can influence local economic growth and decline, the most important determinants of a city's health. This connection between policy and local economic outcomes implies a theory of how cities form and grow, however, and legal scholars have not adequately articulated such a theory. This Article argues that we need a better (and more self-conscious) account of city formation and local economic growth. The Article then tests our …

The Foreclosure Crisis And The Antifragmentation Principle In State Property Law, David A. Dana Jan 2010

The Foreclosure Crisis And The Antifragmentation Principle In State Property Law, David A. Dana

University of Chicago Law Review

This Article explains how excessive fragmentation of property interests in mortgages has prevented reasonable modifications in loan terms and helped to create the current foreclosure crisis. The Article argues that Anglo-American property law reflects an antifragmentation principle. This principle offers historical grounding for and constitutional legitimacy to proposals to restructure the servicing of troubled loans so as to produce loan modifications when doing so would produce more net economic value than foreclosure. The Article also considers some reforms that could be adopted to prevent future cycles of excessive fragmentation of property interests in mortgages.

The Steep Costs Of Using Noncumulative Zoning To Preserve Land For Urban Manufacturing, Roderick M. Hills Jr, David Schleicher Jan 2010

The Steep Costs Of Using Noncumulative Zoning To Preserve Land For Urban Manufacturing, Roderick M. Hills Jr, David Schleicher

University of Chicago Law Review

In cities around the country, huge swaths of property in desirable locations house only empty warehouses, barely-used shipping facilities, and heavily subsidized industrial-age factories, often right across the street from high-end condos and office buildings. The reason is a widely-used, but poorly understood form of local industrial policy known as non-cumulative zoning. In contrast with traditional Euclidean zoning, in which manufacturing uses were prohibited in residential areas but not vice versa, areas that are zoned non-cumulatively allow only manufacturing uses and bar any residential (and sometimes even commercial uses) of property. The arguments for non-cumulative zoning are always the same: …

An Empirical Survey Of Climate Change Litigation In The United States, David Markell, J. B. Ruhl Jan 2010

An Empirical Survey Of Climate Change Litigation In The United States, David Markell, J. B. Ruhl

Scholarly Publications

A quickly growing number of commentators have suggested that the U.S. courts are already significant drivers of climate change policy, and that their role is likely to increase. In addition to fashioning law on their own, judicial decisions have significant implications for the work of the other branches of government. This Article provides a chronicling of every climate change case filed through December 31, 2009 (more than 130 such cases). It presents basic information about the cases, e.g., the types of cases, where they have been brought, the types of parties involved, and the outcomes. It also analyzes the data …

Host Recognition And Acceptance Behaviour In Cotesia Sesamiae And C. Flavipes (Hymenoptera: Braconidae), Parasitoids Of Gramineous Stemborers In Africa, Meshack Obonyo, Fritz Schulthess, Bruno Le Ru, Johnnie Van Den Berg, Paul André Calatayud

All Peer-Reviewed Publications

The host recognition and acceptance behaviour of two braconid larval parasitoids (Cotesia sesamiae and C. flavipes) were studied using natural stemborer hosts (i.e., the noctuid Busseola fusca for C. sesamiae, and the crambid Chilo partellus for C. flavipes) and a non-host (the pyralid Eldana saccharina). A single larva was introduced into an arena together with a female parasitoid and the behaviour of the wasp recorded until it either stung the larva or for a maximum of 5 min if it did not sting the larva. There was a clear hierarchy of behavioural steps, which was similar for both parasitoid species. …

Adult Attention-Deficit Hyperactivity Disorder, Laura E. Knouse, Steven A. Safren Jan 2010

Adult Attention-Deficit Hyperactivity Disorder, Laura E. Knouse, Steven A. Safren

Psychology Faculty Publications

Attention-Deficit Hyperactivity Disorder (ADHD) in adults is a valid and impairing disorder for which psychopharmacological and psychosocial treatments are recommended. Self-report ratings scales for adult ADHD can serve several functions in clinical work with this population including screening, providing information, in a comprehensive assessment, and tracking treatment-related change. The use of two symptom-based ratings scales for screening and tracking treatment progress- the Current Symptoms Scale (CSS) [5] and the Adult ADHD Self-Report Scale (ASRS) [6] - is outlined for the practicing clinician. Key issues in the assessment of adult ADHD are briefly discussed, highlighting the role of rating scales within …

Statutory Good-Faith Immunity For Government Physicians: Cogent Policy Or A Denial Of Justice?, Andrew Flavelle Martin Jan 2010

Statutory Good-Faith Immunity For Government Physicians: Cogent Policy Or A Denial Of Justice?, Andrew Flavelle Martin

Articles, Book Chapters, & Popular Press

Recent events such as the SARS outbreak and the controversy over pediatric forensic pathology in Ontario have increased awareness and scrutiny of physicians employed by the government, including medical officers of health, coroners, and pathologists. At common law, physicians are held to a standard of care that can be summarized as reasonable professional competence. Statutory provisions effectively neutralize this standard of care for government physicians by providing civil immunity so long as they act in “good faith”. The appropriate-ness of this protection from civil liability is assessed in this paper.

The author argues that statutory good-faith immunity is inconsistent with …
