Tax Reform Commissioners In The Sweep Of California's Fiscal History, Steven M. Shefrin Jan 2010

Tax Reform Commissioners In The Sweep Of California's Fiscal History, Steven M. Shefrin

UC Law Constitutional Quarterly

What role do tax reform commissions play in California fiscal history? The recent California Commission on the 21st Century Economy-the Parsky Commission-temporarily raised hopes for substantive tax reform in California. However, its apparent failure raises broader questions about the role of tax commissions. Have they ever led to fundamental tax policy changes in the state and, if so, what made them successful?

To address these questions, this paper explores the experiences of two important California tax commissions, the 1906 and 1929 commissions, and places them into the history of taxation in California. Both the recommendations of the 1906 and 1929 …

The Marketplace Metaphor And Commercial Speech Doctrine: Or How I Learned To Stop Worrying About And Love Citizens United, Darrel C. Menthe Jan 2010

The Marketplace Metaphor And Commercial Speech Doctrine: Or How I Learned To Stop Worrying About And Love Citizens United, Darrel C. Menthe

UC Law Constitutional Quarterly

In this article, I place the Citizens United decision in historical and doctrinal context, and argue that the decision indicates a terminal stage of the development and application of the "marketplace of ideas" metaphor in First Amendment law. I argue that the "good news" about the Citizens United decision is that it sets the stage for the abolition of the commercial speech doctrine, which resulted in lower protection for commercial speech, as previously set forth in the 1980 Central Hudson decision. This is good news because the commercial speech doctrine has become a doctrinal anomaly that threatens to undermine the …

The Role Of Extracellular Matrix Proteins, Biglycan And Fibromodulin, In Temporomandibular Joint Osteoarthritis, Mildred Christine Embree Jan 2010

The Role Of Extracellular Matrix Proteins, Biglycan And Fibromodulin, In Temporomandibular Joint Osteoarthritis, Mildred Christine Embree

MUSC Theses and Dissertations

Temporomandibular joint osteoarthritis (TMJ OA) is a degenerative joint disease, which ultimately results in severe pain, permanent cartilage destruction, and TMJ dysfunction. The extracellular matrix (ECM) micro-environment is critical for maintaining the TMJ mandibular condylar cartilage tissue integrity and is important for regulating chondrocyte activity. The small leucine-rich repeat proteoglycans (SLRPs) are a family of ECM proteins that are highly expressed in cartilage and bone. The goals of this study were to determine the role of two members of the SLRP family, biglycan (Bgn) and fibromodulin (Fmod), in the development of TMJ OA pathology and to identify the early cellular …

Relative Frequency Of Breast Cancer Website Information Topics: Environmental Risk, Prevention, Detection, Treatment, Awareness, Social Support, And Survivorship, Rose Clark-Hitt, Marleah Dean, Sandi W. Smith, Samantha Nazione, Charles K. Atkin, Pamela Whitten

Communication Faculty Publications

The Internet is a popular source for Americans searching for health information (Fox, 2006; Hess et al., 2005). The potential for Internet usage for breast cancer information seeking makes it important to understand the types and relative frequency of content on environmental risk factors, prevention, detection, treatment, awareness, social support, and survivorship on popular breast cancer web pages. The top search results for websites in the most popular three search engines (Google, MSN, and Yahoo) were used to identify websites and web pages, and a total of 415 web pages were analyzed. This study demonstrates that about half of the …

Accessing Children's Perspectives Through Participatory Photo Interviews, Jane Jorgenson, Tracy Sullivan Jan 2010

Accessing Children's Perspectives Through Participatory Photo Interviews, Jane Jorgenson, Tracy Sullivan

Communication Faculty Publications

In this article we seek to contribute to the emerging conversation on child-centered research methods by reflecting on the use of participatory photo interviewing to understand children's experiences with household technology. Participatory photo interviews attempt to engage children as active research participants by giving them cameras and inviting them to take pictures dealing with various aspects of their lives. The photos are later used in the interview process to jointly explore the subjective meaning of the images. We focus here on how children oriented to the research task, and in particular, on the ethnographic insights obtained by attending to the …

Radical Nephrectomy With Ivc Thrombectomy (Level-Iii) Conducted On Veno-Veno Bypass, Tariq S. Hakky, Lucas R. Wiegand, Devannand Mangar, Angel Alsina, Philippe E. Spiess

Urology Faculty Publications

Introduction: We report a 43 year old man who was diagnosed with a level-I thrombus and was managed on oral sunitinib for two months by a community Urologist. The thrombus progressed to a level-III and he subsequently developed a pulmonary embolus, which required oral anticoagulation. He was then referred to our facility for definitive surgical care. A computed tomography scan demonstrated a 12 by 15 centimeter right renal mass and on magnetic resonance venography of the abdomen a tumor-thrombus extending into the infradiaphragmatic inferior vena cava was noted. Pre-operatively consults with hepatobiliary, vascular, and chest surgeons were obtained.

Methods: The …

The Distinct Roles Of Prior It Use And Habit Strength In Predicting Continued Sporadic Use Of It, E. Vance Wilson, En Mao, Nancy K. Lankton Jan 2010

The Distinct Roles Of Prior It Use And Habit Strength In Predicting Continued Sporadic Use Of It, E. Vance Wilson, En Mao, Nancy K. Lankton

Accounting Faculty Research

This article studies prediction of continued IT use in conditions where individuals use the technology sporadically. Our study augments the unified theory of acceptance and use of technology (UTAUT) model [Venkatesh et al., 2003] with measures of prior IT use frequency and habit strength. We find these two factors provide distinct predictions which explain most of the effects that occur within the model under sporadic use conditions.

Access For Laparoendoscopic Single Site Surgery, Sharona B. Ross, C. Whalen Clark, Connor A. Morton, Alexander S. Rosemurgy Jan 2010

Access For Laparoendoscopic Single Site Surgery, Sharona B. Ross, C. Whalen Clark, Connor A. Morton, Alexander S. Rosemurgy

Surgery Faculty Publications

Laparoscopic surgery is the standard of care for many abdominal and pelvic operations and is widely applied today. LESS (Laparo-Endoscopic Single Site) surgery, originally attempted in the 1990s, is an advanced minimally invasive approach that allows laparoscopic operations to be undertaken through a small (<15 mm) incision in the umbilicus, a preexisting scar. The presence of a preexisting scar allows LESS surgery to be essentially scarless, which is the key benefit to LESS operations. Herein, we review our experience with over 500 LESS operations and discuss the key techniques to establishing access to the peritoneal cavity. We review the options for obtaining access, available instrumentation, common challenges and solutions for access. We conclude that LESS surgery is safe and provides outcomes with superior cosmesis relative to conventional laparoscopy. LESS surgery should be embraced, as patient demand is rapidly increasing.

Soil- And Groundwater-Quality Data For An Abandoned Cattle And Hog Feedlot In Henderson County, Kentucky, E. Glynn Beck, James S. Dinger, Eugenia Pena-Yewtukhiw, John H. Grove Jan 2010

Soil- And Groundwater-Quality Data For An Abandoned Cattle And Hog Feedlot In Henderson County, Kentucky, E. Glynn Beck, James S. Dinger, Eugenia Pena-Yewtukhiw, John H. Grove

Information Circular--KGS

Groundwater samples collected from a livestock well in southwestern Henderson County, Ky., contained nitrate-N concentrations greater than 20 mg/L, two times the U.S. Environmental Protection Agency’s maximum contaminant level. The well is located in an abandoned cattle and hog feedlot. The feedlot is located in an upland bedrock setting with Pleistocene loess overlying Pennsylvanian bedrock. One hundred twenty-one soil cores were collected to better define the areal extent of organic-rich soil believed to be the source of the elevated nitrate-N in the groundwater. Cores were collected on 25-ft centers to a depth of 4 ft below the land surface. Soil …

Sources And Occurrences Of Nonpoint-Source Chemicals In Groundwater, Jackson Purchase Region, Kentucky, R. Stephen Fisher, E. Glynn Beck

Report of Investigations--KGS

Nitrate concentrations that exceed U.S. Environmental Protection Agency drinking-water standards have been reported in Jackson Purchase Region groundwater since the 1960's. More recently, other nonpoint-source chemicals such as pesticides and volatile organic compounds have also been found. The sources of these chemicals and the pathways by which they reach domestic groundwater supplies must be determined to protect human health and to design effective land-management practices.

To investigate the occurrence of nonpoint-source chemicals in Jackson Purchase groundwater, 60 wells were selected on the basis of geographic location, hydrostratigraphic unit penetrated, and well type (bored or drilled); distances to row crops, known …

An Investigation Of Institutional Arrangements For Design And Delivery Of Multimodal Public Transport In Melbourne, Kathren Lazanas, Dr John Stone Jan 2010

An Investigation Of Institutional Arrangements For Design And Delivery Of Multimodal Public Transport In Melbourne, Kathren Lazanas, Dr John Stone

World Transit Research

Intermodal service coordination designed to achieve a „seamless network‟ is a common feature of high-quality public transport systems. This paper explores the intention and the reality of the institutional arrangements that govern the coordination of bus, tram and train services in Melbourne under the franchise agreements.
State Government policies and contractual obligations set out the intended lines of responsibility for the planning of transport networks in relation to design and delivery of coordinated multimodal services. Interviews, designed to examine the practical application of these policies and obligations, were conducted during 2009 with staff from the Department of Transport, the private …

An Evaluation Of Habitat Models For The Common Loon (Gavia Immer), Alexis M. Rudko Jan 2010

An Evaluation Of Habitat Models For The Common Loon (Gavia Immer), Alexis M. Rudko

Master's Theses and Capstones

The Loon Preservation Committee (LPC) has been collecting field data for the common loon (Gavia immer) in New Hampshire for thirty-six years. A habitat model for lakes throughout New Hampshire was created by Dr. Mark Brennan for the time period 1980--2002. This project re-evaluates Brennan's habitat model using new data from 2003--2008. Two additional models, one with all lakes and another with the three largest lakes excluded, were created and compared to Brennan's model to see if the overall accuracy improved. These models show which lakes have high and low potential for loon habitat. The results of the re-evaluation of …

Meaningful Measurement: Is Fluency A Valid And Reliable Measure Of Reading Progress For Struggling Adolescent Readers? Examining The Efficacy Of Pearson's Aimsweb For Struggling Adolescent Readers, Elizabeth A. York

Master's Theses and Capstones

A growing body of research draws into question the validity and reliability of measurements of fluency as indicators of literacy growth for older, struggling readers (Paris, Carpenter, Paris and Hamilton, 2005; Scammacca, Roberts, Vaughn, Edwards & Torgesen, 2007; Yovanoff, Duesbery, Alonzo & Tindal, 2005). Nevertheless, many high schools utilize such measures. This study examines the validity and reliability of Pearson's AIMSweb as a tool for assessing the literacy development of 17 9th grade students with special education identifications. Evidence from this study draws into question the reliability and validity of AIMSweb measures for this population. Additional research with a larger …

Increasing Written Language Skills Utilizing Writing Software And Traditional Methods, Caroline Larson

Undergraduate Honors Theses

A grid based computer program, Clicker5, appeared to have many features that logically may assist struggling writers. It utilizes pictures, sound, speech synthesis, word banks and a spelling checker. Karemaker et al. (2008) examined the use of Clicker5 and observed increased attention and focus during reading, and greater gains in word recognition and rhyme awareness. Scattered research exists on some of the multimedia features that Clicker5 utilizes (e.g. auditory and visual instruction, specific feedback, student specific examples, Wissick & Gardner, 2000; composition processes and revision facilitation, MacArthur 2000; spell checkers with strategy instruction, and speech synthesis to increase error …

How Our Health Depends On Biodiversity, Eric Chivian M.D., Aaron Bernstein M.D., M.P.H.

Ecosystem Disruption & Climate Change

The eminent Harvard biology Professor Edward O.Wilson once said about ants, “We need them to survive, but they don’t need us at all.” The same, in fact, could be said about countless other insects, bacteria, fungi, plankton, plants, and other organisms. This fundamental truth, however, is largely lost to many of us. Rather, we humans often act as if we are totally independent of Nature, as if our driving thousands of other species to extinction and disrupting the life-giving services they provide will have no effect on us whatsoever.

This summary, using concrete examples from our award-winning Oxford University Press …

Psychometric Properties Of The Pyramids And Palm Trees Test, Gerasimos Fergadiotis, Heather Wright, Gilson Capilouto

Speech and Hearing Sciences Faculty Publications and Presentations

The Pyramids and Palm Trees Test (PPT) is a nonverbal measure of semantic memory that has been frequently used in previous aphasia, agnosia, and dementia research. Very little psychometric information regarding the PPT is available. The purpose of this study was to investigate the psychometric properties of the PPT in a population of healthy college students. Results indicated that the PPT achieved poor test–retest reliability, failed to obtain adequate internal consistency, and demonstrated poor convergent validity, but showed acceptable discriminant validity. The results of this study suggest that the PPT lacks acceptable reliability and validity for use with a college …

Working Mothers' Decisions, Experiences And Feelings About Using On-Site Childcare, Stephanie Larae Hixson-Somanchi

Dissertations and Theses

On-site childcare is an ever-increasing form of childcare. By understanding the decisions, experiences and feelings of mothers using on-site centers, informed policy decisions about viable childcare models can be made. In the broadest terms current literature reveals that economic, societal, functional, and psychological factors influence a mother's decisions in regards to using childcare. This study used these markers as the basis for the development of questions to ascertain the experiences, feelings and decisions of mothers using on-site childcare. A phenomenological method was used. Twenty-four participants using on-site childcare from four organizations in different industries were located through a snowball sample …
