Creativity Through Humor And Playfulness; All In A Day's Work, Eugene Pohancsek Jr.

Creativity and Change Leadership Graduate Student Master's Projects

This project focuses on the fundamental aspects of creativity and its relationship to humor in the workplace. Since employees spend about one-third of their waking hours at work it has been shown that humor and play can be beneficial in the work environment. In the first section entitled Discovering, my philosophical views unfold as it relates to creativity. This foundation is crucial in understanding how the person can positively influence their creative environment. This philosophical review moves into the sections entitled Recognizing and Humor Style. These sections review current trends and research around humor in the workplace. In the concluding …

Biogeography Of Alien Vertebrates In The Galapagos Islands: Patterns, Processes, And Conservation Implications, Reese Brand Phillips Dec 2010

Biogeography Of Alien Vertebrates In The Galapagos Islands: Patterns, Processes, And Conservation Implications, Reese Brand Phillips

Biology ETDs

Alien species are one of the principal threats to global biodiversity. Insular ecosystems have proven exceptionally susceptible to invasion by aliens and vulnerable to their negative effects. Some of the most destructive alien species are vertebrates, in part due to their having been introduced to islands worldwide. Rodents (Rattus spp. and Mus musculus) are among the most widespread and devastating invasive species for insular flora and fauna. In this research I investigate the biogeographic patterns and processes of alien vertebrates in the Galapagos Islands, focusing on the mechanisms that influence their dispersal and colonization within the archipelago. In the first …

Defiling The Retaliation Doctrine: Kasten V. Saint-Gobain And The Anti-Retaliation Provision Of The Fair Labor Standards Act, Madeline Engel Dec 2010

Defiling The Retaliation Doctrine: Kasten V. Saint-Gobain And The Anti-Retaliation Provision Of The Fair Labor Standards Act, Madeline Engel

Chicago-Kent Law Review

The anti-retaliation provision of the Fair Labor Standards Act makes it unlawful for an employer to retaliate against an employee who has "filed any complaint" under the FLSA. In Kasten v. Saint-Gobain Performance Plastics Corp., the Seventh Circuit declared its position in a growing circuit split as to whether an employee can "file" a verbal complaint of an alleged FLSA violation. Kasten answered the question in the negative, holding that verbal complaints are not protected activity under the Act. This note analyzes relevant Supreme Court precedent and the evolution of the circuit split, as well as principles of statutory …

Prolegomenon On The Status Of The Hopey, Changey Thing In American Criminal Justice, Frank O. Bowman Iii Dec 2010

Prolegomenon On The Status Of The Hopey, Changey Thing In American Criminal Justice, Frank O. Bowman Iii

Faculty Publications

This is an introductory essay to Volume 23, Number 2, of the FEDERAL SENTENCING REPORTER, which considers the state of American criminal justice policy in 2010, two years after the "Change" election of 2008. Part I of the essay paints a statistical picture of trends in federal criminal practice and sentencing over the last half-decade or so, with particular emphasis on sentence severity and the degree of regional and inter-judge sentencing disparity. The statistics suggest that the expectation that the 2005 Booker decision would produce a substantial increase in the exercise of judicial sentencing discretion and a progressive abandonment of …

Strangers And Pilgrims: The Challenge Of The Real, Robert K. Thomas

BYU Studies

This article is a classic speech by Robert K. Thomas and is an excerpt of a forthcoming publication of Thomas's best speeches. Thomas (1918–1998) served the Brigham Young University community for thirty-two years as an English professor, founder and director of the Honors Program, and academic vice president. This speech describes how genuine faith can successfully confront the challenges we face when our goals seem to be thwarted by the realities of our world. The speech concludes with Hebrews 11, which states that many great, faithful men and women died without seeing the fulfillment of promises they had received and …

Perceived Slant Of Binocularly Viewed Large-Scale Surfaces: A Common Model From Explicit And Implicit Measures, Z. Li, Frank H. Durgin Dec 2010

Perceived Slant Of Binocularly Viewed Large-Scale Surfaces: A Common Model From Explicit And Implicit Measures, Z. Li, Frank H. Durgin

Psychology Faculty Works

It is known that the perceived slants of large distal surfaces, such as hills, are exaggerated and that the exaggeration increases with distance. In a series of two experiments, we parametrically investigated the effect of viewing distance and slant on perceived slant using a high-fidelity virtual environment. An explicit numerical estimation method and an implicit aspect-ratio approach were separately used to assess the perceived optical slant of simulated large-scale surfaces with different slants and viewing distances while gaze direction was fixed. The results showed that perceived optical slant increased logarithmically with viewing distance and the increase was proportionally greater for …

Criminal Offending Among Respondents To Protective Orders: Crime Types And Patterns That Predict Victim Risk, Carol E. Jordan, Adam J. Pritchard, Danielle Duckett, Richard Charnigo Dec 2010

Criminal Offending Among Respondents To Protective Orders: Crime Types And Patterns That Predict Victim Risk, Carol E. Jordan, Adam J. Pritchard, Danielle Duckett, Richard Charnigo

Office for Policy Studies on Violence Against Women Publications

Research has shown that respondents to protective orders have robust criminal histories and that criminal offending behavior often follows issuance of a protective order. Nonetheless, the specific nature of the association between protective orders and criminal offending remains unclear. This study uses two classes of statistical models to more clearly delineate that relationship. The models reveal factors and characteristics that appear to be associated with offending and protective order issuance and provide indications about when a victim is most at risk and when the justice system should be most ready to provide immediate protection.

Experimental Evaluation Of Select Servers And Firewalls Under Denial Of Service Security Attacks, Raja Sekhar Reddy Gade Dec 2010

Experimental Evaluation Of Select Servers And Firewalls Under Denial Of Service Security Attacks, Raja Sekhar Reddy Gade

Theses and Dissertations - UTB/UTPA

Internet security requires newer prevention mechanisms to be implemented on web-servers and routers. Firewall/Intrusion Prevention mechanisms (IPS) can be deployed on host servers or routers as an added line of defense against Internet attacks. In this thesis, we evaluate performance of security mechanisms provided by these devices against Distributed Denial of Service (DDoS) attacks. The host based firewalls on Windows servers-2003 and 2008 were evaluated. In this thesis, we also evaluated Juniper Networks Netscreen-5GT firewall/IPS, and Cisco ASA-5510/IPS that are used in protecting web-servers against DDoS attacks. It was found that the host based firewalls and protection mechanisms on the …

Separation Of Law And State, Talia Fisher Dec 2010

Separation Of Law And State, Talia Fisher

University of Michigan Journal of Law Reform

In the framework of the jurisprudential literature, the law-state bond is assumed as a given. Points of dispute emerge only at more advanced stages of the discussion, with respect to such questions as the duty to obey state law or the appropriate extent of state intervention in social relations. This Article will be devoted to a reconsideration of the presupposition of the law-state link and to challenging the state's status vis-à-vis the law-both in its role as the producer of legal norms and its capacity as the arbiter of disputes.

The Article opens with a comparative elucidation of the Hobbesian …

Agriculture's Fate Under Climate Change: Economic And Environmental Imperatives For Action, John N. Moore, Van Bruggen Dec 2010

Agriculture's Fate Under Climate Change: Economic And Environmental Imperatives For Action, John N. Moore, Van Bruggen

Chicago-Kent Law Review

Farming, ranching, and other agricultural activities are in a relatively unique position amongst all human-caused sources of global warming. Unlike fossil fueled power plants and vehicles, for example, agriculture will suffer direct economic losses from the impacts of global warming on its products, such as through reduced crop yields. Also unlike other causes of global warming, agriculture can both mitigate global warming and increase revenue through a range of different practices, such as carbon sequestration and investments in carbon-friendly renewable energy. This article explains how global warming affects agriculture, especially in the Midwest and Great Plains, and how agriculture contributes …

Privacy Implications Of Smart Meters, Cheryl Dancey Balough Dec 2010

Privacy Implications Of Smart Meters, Cheryl Dancey Balough

Chicago-Kent Law Review

Many people worry about the erosion of privacy in our society given developments in technology, but that loss of privacy may take a quantum leap as electric "smart meters" make it possible for strangers to know on a real-time basis what is occurring in our houses and apartments. Perhaps the greatest concern is that current laws and regulations do not fully protect us from this unprecedented threat to two of our most basic rights—to be left alone in our own homes and to control personal information. Utility companies across the country are replacing conventional electric meters with smart meters designed …

High Fat Diet-Induced Animal Model Of Age-Associated Obesity And Osteoporosis, Ganesh V. Halade, Md M. Rahman, Paul J. Williams, Gabriel Fernandes Dec 2010

High Fat Diet-Induced Animal Model Of Age-Associated Obesity And Osteoporosis, Ganesh V. Halade, Md M. Rahman, Paul J. Williams, Gabriel Fernandes

Internal Medicine Faculty Publications

Osteoporosis and obesity remain a major public health concern through its associated fragility and fractures. Several animal models for the study of osteoporotic bone loss, such as ovariectomy (OVX) and denervation, require unique surgical skills and expensive set up. The challenging aspect of these age-associated diseases is that no single animal model exactly mimics the progression of these human-specific chronic conditions. Accordingly, to develop a simple and novel model of post menopausal bone loss with obesity, we fed either a high fat diet containing 10% corn oil (CO) or standard rodent lab chow (LC) to 12-month-old female C57Bl/6J mice for …

Socioeconomic Determinants Of Infant Mortality Rate Disparities, Alex Krasikov Dec 2010

Socioeconomic Determinants Of Infant Mortality Rate Disparities, Alex Krasikov

All Theses

This study examines variation in infant mortality rate (IMR) between black and white populations. Data were drawn from CDC Birth Cohort Linked Birth Infant Data for 2004. Author examined numerous socioeconomic factors that could explain the gap in IMR between two races. Each potential factor was examined separately before introducing into a complete model. The proposed model explains about 11 percentage points in difference between groups, and showed factors that can be affected by change in public policy, play statistically significant role in IMR disparity. We can look at the IMR as a socioeconomic indicator that highlights both negative and …

Barriers And Best Practices For Material Management In The Healthcare Sector, Carlos Callender, Scott Erwin Grasman Dec 2010

Barriers And Best Practices For Material Management In The Healthcare Sector, Carlos Callender, Scott Erwin Grasman

Engineering Management and Systems Engineering Faculty Research & Creative Works

The primary focus of the healthcare sector has been to provide patients with the best quality of care. Recently, the escalating cost of supplies and the severe competition among healthcare providers has significantly increased the pressure on material managers to operate more cost-efficiently without compromising high patient care standards. While other sectors have experienced success through the deployment of supply chain management practices, the healthcare sector has not seen major improvements in this area; however, in spite of the uniqueness and complexity of the healthcare supply chain, opportunities for improvements are plentiful. This article provides an assessment of material management …

A Reinforcement Learning Approach For Inventory Replenishment In Vendor-Managed Inventory Systems With Consignment Inventory, Zheng Sui, Abhijit Gosavi, Li Lin Dec 2010

A Reinforcement Learning Approach For Inventory Replenishment In Vendor-Managed Inventory Systems With Consignment Inventory, Zheng Sui, Abhijit Gosavi, Li Lin

Engineering Management and Systems Engineering Faculty Research & Creative Works

In a Vendor-Managed Inventory (VMI) system, the supplier makes decisions of inventory management for the retailer; the retailer is not responsible for placing orders. There is a dearth of optimization models for replenishment strategies for VMI systems, and the industry relies on well-understood, but simple models, e.g., the newsvendor rule. in this article, we propose a methodology based on reinforcement learning, which is rooted in the Bellman equation, to determine a replenishment policy in a VMI system with consignment inventory. We also propose rules based on the newsvendor rule. Our numerical results show that our approach can outperform the newsvendor. …

Economic Governance And Space Law: Emerging Foundations For Development Of “Common Pool Resources” In Outer Space, Valnora Leister Dec 2010

Economic Governance And Space Law: Emerging Foundations For Development Of “Common Pool Resources” In Outer Space, Valnora Leister

Indian Journal of International Economic Law

As commercial space faring capabilities spread, a need is growing for new approaches to safeguard the common interests of humanity in space. The 1967 Outer Space Treaty declares in its opening article that, “exploration and use of outer space, including the Moon and other celestial bodies, shall be carried out for the benefit and in the interests of all countries, irrespective of their degree of economic or scientific development, and shall be the province of Mankind”. However, to date, little has been done to develop outer space for the benefit of humanity. So far, space has been explored mainly by …

A New Liability Regime For The Space Sector – An Economic Imperative, Lotta Viikari Dec 2010

A New Liability Regime For The Space Sector – An Economic Imperative, Lotta Viikari

Indian Journal of International Economic Law

It is not always easy to establish liability pursuant to international law of outer space, yet damages in the space sector can be considerable. The damaging potential of space activities can exceed the capacity of any single space faring entity to make reparation. Absolute and unlimited liability could render the highly hazardous activities uninsurable. Complex causation questions may complicate the situation further. The mere determination of the liable entity can be a problem. Accordingly, allocation of losses within a larger community of relevant entities to balance the competing concerns would seem useful. It could better retain the economic viability of …
