Intellectual Property Law And The Sumptuary Code, Barton C. Beebe
Intellectual Property Law And The Sumptuary Code, Barton C. Beebe
Faculty Articles
This Article assesses intellectual property law’s emerging role as a modern form of sumptuary law. The Article observes that we have begun to rely on certain areas of intellectual property law to provide us with the means to preserve our conventional system of consumption-based social distinction, our sumptuary code, in the face of incipient social and technological conditions that threaten the viability of this code. Through sumptuary intellectual property law, we seek in particular to suppress the revolutionary social and cultural implications of our increasingly powerful copying technology. Sumptuary intellectual property law is thus taking shape as the socially and …

Is The Law Hopeful?, Annelise Riles
Is The Law Hopeful?, Annelise Riles
Cornell Law Faculty Working Papers
This essay asks what legal studies can contribute to the now vigorous debates in economics, sociology, psychology, philosophy, literary studies and anthropology about the nature and sources of hope in personal and social life. What does the law contribute to hope? Is there anything hopeful about law? Rather than focus on the ends of law (social justice, economic efficiency, etc.) this essay focuses instead on the means (or techniques of the law). Through a critical engagement with the work of Hans Vaihinger, Morris Cohen and Pierre Schlag on legal fictions and legal technicalities, the essay argues that what is “hopeful” …
Examining Narratives Of Place: Representations Of Xinjiang In Tourism And Geography Education, Michael Church
Examining Narratives Of Place: Representations Of Xinjiang In Tourism And Geography Education, Michael Church
Graduate Student Theses, Dissertations, & Professional Papers
This thesis examines how Xinjiang Uyghur Autonomous Region, located in northwest China, is represented in tourism and geographic education literature. The research demonstrates the limited and distorted place narratives of Xinjiang that are promoted by the government-backed tourist enterprise in China for consumption by English language speakers; as well as, the inadequate and uncritical representations of the region currently available to students in the United States. Qualitative content analysis methodology is employed to investigate the narrative representations of Xinjiang contained within tourist brochures, geography textbooks, and regionally appropriate curricular guides. The thesis includes a body of geographic lesson plans pertaining …

Why The Xwisten Crossed The River: Lithic Transport Strategies On The Canadian Plateau, Michael Todd Wanzenried
Why The Xwisten Crossed The River: Lithic Transport Strategies On The Canadian Plateau, Michael Todd Wanzenried
Graduate Student Theses, Dissertations, & Professional Papers
As has been the case for thousands of years a single kind of stone material, referred to by different researchers as arrowstone, basalt, vitreous trachydacite, and/or dacite, provided the majority (often more than 75%) of many lithic assemblages in the Mid- Fraser region of south-western British Columbia. Most explanations for this have largely been insufficient for explaining the differential transport of lithic materials; no one has addressed why, in a lithic rich environment where a variety of jaspers, chalcedonies, and pisolites can be found in relative close proximity to many winter villages, Mid-Fraser foragers would target resources located much further …

Dance Matters: Performing India, Pallabi Chakravorty, N. Gupta
Dance Faculty Works
This volume presents a multidisciplinary perspective on dance scholarship and practice as they have evolved in India and its diaspora, outlining how dance histories have been written and re-written, how aesthetic and pedagogical conventions have changed and are changing, and how politico-economic shifts have shaped Indian dance and its negotiation with modernity.. Written by eminent and emergent scholars and practitioners of Indian dance, the articles make dance a foundational socio-cultural and aesthetic phenomena that reflects and impacts upon various cultural intercourses -- from art and architecture to popular culture, and social justice issues. They also highlight the interplay of various …

Clovis Excavations At Topper 2005-2007: Examining Site Formation Processes At An Upland Paleoindian Site Along The Middle Savannah River, D. Shane Miller
Clovis Excavations At Topper 2005-2007: Examining Site Formation Processes At An Upland Paleoindian Site Along The Middle Savannah River, D. Shane Miller
Occasional Papers – Southeastern Paleoamerican Survey
With this inaugural issue of the Occasional Papers series of the Southeastern Paleoamerican Survey, we are pleased to offer this monograph by D. Shane Miller which was based on his masters thesis research at the Topper site. His excavations, conducted over 2006-2007, resulted in a 64m square block, the largest contiguous unit yet excavated at Topper. Situated in a previously plowed firebreak on the southern hillside exhibiting partial erosion, it was decided to take advantage of this situation and recover the basal Clovis remains in the undisturbed portion of the profile. This strategy worked well and allowed Miller to fairly …
Drag Kinging In Amsterdam: Queer Identity Politics, Subcultural Spaces, And Transformative Potentials, Michael Korcek
Drag Kinging In Amsterdam: Queer Identity Politics, Subcultural Spaces, And Transformative Potentials, Michael Korcek
Lawrence University Honors Projects
In this ethnography of the drag king subculture in Amsterdam I locate the transformative and subversive potential of drag king performances on the larger queer community. Based upon four months of fieldwork spent interviewing drag king performers and queer community members while also attending queer parties, I will show how the burgeoning community of drag kings in Amsterdam work to reconfigure structures of domination within and outside of the LGBTQ community. Despite the history of Dutch tolerance and the sexually liberal atmosphere of Amsterdam, many members of the queer community, including but not limited to lesbian, bisexual, trans, and queer …
All Carrots And No Sticks: Moving Beyond The Misapplication Of Burlington Industries, Inc. V. Ellerth, E. Jacob Lindstrom
All Carrots And No Sticks: Moving Beyond The Misapplication Of Burlington Industries, Inc. V. Ellerth, E. Jacob Lindstrom
UC Law SF Journal on Gender and Justice
In pair of 1998 cases, Burlington Industries, Inc. v. Ellerth and Faragher v. City of Boca Raton, the U.S. Supreme Court crafted a new framework for employer liability in sexual harassment cases. Thenceforth, employers were to be strictly liable for the harassment of employees by supervisors, but employers would also be able to employ an affirmative defense if (a) the employer acted reasonably in preventing and correcting harassment and (b) the employee acted unreasonably in avoiding or stopping the harassment. The Court marketed this new framework as a compromise between the competing values of eliminating harassment (hence, strict liability) and …

Am I That Race - Punjabi Mexicans And Hybrid Sensitivity, Or How To Do Theory So That It Doesn't Do You, Faljuni A. Sheth
UC Law SF Journal on Gender and Justice
This paper explores the conceptual and racial status of "Punjabi Mexicans" at the turn of the twentieth century. In the literature, this group appears to be a "given," i.e., it is portrayed as a coherent identity that emerges from a simple set of circumstances. Yet, it is anything but a given; its existence and its collective and individual consciousness is created out of a complex nexus of legal, political, social, and natural environments that spurred the migration of East-Indian men and Mexican women from their homelands and to their adopted lands. By understanding human beings as subjects rather than as …

Surrogacy in the United States is a multi-million dollar industry in which well paid professionals seek out highly specialized women to fulfill the difficult job of being a surrogate. Surrogates enter lengthy contracts in which they agree, in intricate detail, to provide a service for significant compensation - surrogates are paid well over $22 million dollars a year. This article argues that surrogates are also professionals in this for-profit industry and are required to report surrogacy compensation as income. As a corollary, surrogates may deduct most of their surrogacy related expenses as business deductions. Being a surrogate is a highly …

Renegotiating Barbuda's Commons: Recent Changes In Barbudan Open-Range Cattle Herding, Andrew Sluyter, Amy E. Potter
Faculty Publications
Barbuda remains little developed and sparsely populated relative to its neighbors in the Leeward Lesser Antilles, a rather extraordinary and relatively unknown Caribbean place. Much of its distinctiveness derives from the communal land-tenure system, itself rooted in three centuries of open-range cattle herding. Yet, as revealed through interviews, newspaper archives, and landscape observations, openrange cattle herding has declined over the past three decades, with related changes in land tenure. As the new Barbuda Land Act came into effect in 2008, codifying the communal tenure system, the very landscape elements that manifest open-range herding have become obscure. In particular, the rock-walled …

Erasing The Steps Of Kingdom: Indigenous Autonomy In Chiapas, Mexico And The Zapatistas' Re-Conception Of Power, Tara Brian
Honors Theses
Although the Zapatista rebellion in Chiapas, Mexico in 1994 emerged from a long history of guerrilla struggle in Central America, the indigenous movement offered something new: a bold re-conception of power and a novel approach to revolution that shifted the locus of struggle away from state capture to the realm of civil society, opened the revolution to previously excluded participants, and conceived of innovate means to manage power within Zapatista autonomous zones. In this thesis, I begin with a discussion of the ways in which the Zapatistas’ rhetoric of revolution and power has inspired theorists and activists around the world …
Migration, Food And Cultural Production Across Changing Afro-Ecuadorian Geographies, Amelia J. Swinton
Migration, Food And Cultural Production Across Changing Afro-Ecuadorian Geographies, Amelia J. Swinton
Honors Theses
The human geography of Ecuador is changing. Urban Afro-Ecuadorians now outnumber those living in the two rural regions that have been the ancestral homelands of the population. This physical transformation assaults Ecuador's historically racialized geography, which conflated cities, modernity and white-mestizo identity. Though Afro-Ecuadorians living in the rural north had previously been physically and figuratively located outside of the national project, Ecuador’s new constitution has sought to reverse this institutionalized exclusion. National belonging has been reframed through the concept of interculturality, which recognizes diversity and equality at the same time. I conducted two periods of fieldwork in the north-central Chota …
The Yin And Yang Of Kinship And Business: Complementary Or Contradictory Forces?, Alex Stewart, Michael A. Hitt
The Yin And Yang Of Kinship And Business: Complementary Or Contradictory Forces?, Alex Stewart, Michael A. Hitt
Management Faculty Research and Publications
Are the social domains of kinship and business on balance complementary or contradictory? Do ventures that invest heavily in both – conventionally referred to as “family firms” – bear a net gain or net loss? We are scarcely the first to raise these questions. How then will we try to contribute to an answer? We try this in five ways, all of them based on previous literature. First, we develop the dichotomy of kinship and business by taking seriously the metaphor of yin and yang, merging it with the anthropological constructs of structural domains such as “domestic” and “public.” This …
Bridging The Digital Divide: Framing Whiteness, Martha L. Wilkinson
Bridging The Digital Divide: Framing Whiteness, Martha L. Wilkinson
Masters Theses
The American Recovery and Reinvestment Act of 2009 signed by President Obama established the Broadband Technology Opportunities Program (BTOP) for the purpose of building and strengthening broadband infrastructures. (National Telecommunications and Information Administration, 2010). In the twin cities of Champaign and Urbana, Illinois efforts were made by a local Broadband Access Committee (BAC) to obtain funding for various projects. One project involved installing fiber-optic rings to connect buildings including schools, hospitals, and police/fire departments, along with other vital agencies. Additionally, this money would also be utilized to bring fiber to the home (FTTH) to neighborhoods indentified as underserved. Additional grants …

Wise Teaching To Students’ Kinesthetic Intelligence: The Teacher As Surrogate, Guru, Foreshadower, Choreographer, Or Expeditionist, Sara K. Schneider
The Journal of the Assembly for Expanded Perspectives on Learning
Based on the degree of the teacher’s perceived skill, engagement, and role play with her students, this model posits six distinct styles of teaching to students’ kinesthetic intelligence and differentiates their effects on learning.
