Epiphenomenal Indigent Defense, Darryl K. Brown Jun 2010

Epiphenomenal Indigent Defense, Darryl K. Brown

Missouri Law Review

There are some much-studied, recurring social events and behaviors that, although centrally important to public policy and social life, have proven intractable to explanation and prediction. As currently salient examples, consider stock market crashes and recessions. Economists cannot consistently see them coming nor explain them after the fact in consistent detail. Another example is crime rates, which rise, and in recent decades fall, without any discernable strong causal link to familiar variables such as employment or imprisonment rates. This Article describes why we can add state funding for indigent defense counsel to that list and what this conclusion means for …

Role Of Individuals Discrimination In Free Exercise Claims: Putting Iqbal In Its Place, The, Leila Mcneill Jun 2010

Role Of Individuals Discrimination In Free Exercise Claims: Putting Iqbal In Its Place, The, Leila Mcneill

Missouri Law Review

Ashcroft v. Iqbal has been widely discussed for three reasons: (1) its extension of Twombly's pleading standard to cases outside the realm of antitrust suits, (2) its application of the collateral order doctrine to a district court order denying an official's motion to dismiss on the basis of qualified immunity in a Bivens claim, and (3) its implication for national security and postSeptember 11th terrorist detainments and investigations. However, Iqbal also implicates the nature of what constitutes unconstitutional religious discrimination under the First Amendment's Free Exercise Clause. Therefore, the Iqbal Court's discussion of religious liberty will present problems of interpretation …

Good Agricultural Practices For Food Safety Of Fresh Produce, Laurie Hodges Jun 2010

Good Agricultural Practices For Food Safety Of Fresh Produce, Laurie Hodges

Department of Agronomy and Horticulture: Faculty Publications

What are the guiding principles of food safety for fresh produce?

• Once contaminated, removing or killing pathogens on produce is very difficult.

• Preventing microbial contamination at all steps, from production to distribution, is strongly favored over treatments to eliminate contamination that may have occurred.

• Document the implementation of prevention programs, and educate workers at all levels of the agricultural and packing environments on food safety.

Key Signatures of a Credible Food Safety Program

The following is a condensed checklist of practices and conditions that reduce the potential for fresh produce to be exposed to pathogenic microbes. Review …

Adaptive Critics For Dynamic Optimization, Raghavendra V. Kulkarni, Ganesh K. Venayagamoorthy Jun 2010

Adaptive Critics For Dynamic Optimization, Raghavendra V. Kulkarni, Ganesh K. Venayagamoorthy

Electrical and Computer Engineering Faculty Research & Creative Works

A novel action-dependent adaptive critic design (ACD) is developed for dynamic optimization. the proposed combination of a particle swarm optimization-Based actor and a neural network critic is demonstrated through dynamic sleep scheduling of wireless sensor motes for wildlife monitoring. the objective of the sleep scheduler is to dynamically adapt the sleep duration to node's battery capacity and movement pattern of animals in its environment in order to obtain snapshots of the animal on its trajectory uniformly. Simulation results show that the sleep time of the node determined by the actor critic yields superior quality of sensory data acquisition and enhanced …

Hydrodynamic Fin Function Of Brief Squid, Lolliguncula Brevis, William J. Stewart, Ian K. Bartol, Paul S. Krueger Jun 2010

Hydrodynamic Fin Function Of Brief Squid, Lolliguncula Brevis, William J. Stewart, Ian K. Bartol, Paul S. Krueger

Biological Sciences Faculty Publications

Although the pulsed jet is often considered the foundation of a squid's locomotive system, the lateral fins also probably play an important role in swimming, potentially providing thrust, lift and dynamic stability as needed. Fin morphology and movement vary greatly among squid species, but the locomotive role of the fins is not well understood. To begin to elucidate the locomotive role of the fins in squids, fin hydrodynamics were studied in the brief squid Lolliguncula brevis, a species that exhibits a wide range of fin movements depending on swimming speed. Individual squid were trained to swim in both the …

Noxious Odor In Residential Environments : Coping In Reactive And Proactive Ways In Three New Jersey Communities, Maria Beatriz Yabur May 2010

Noxious Odor In Residential Environments : Coping In Reactive And Proactive Ways In Three New Jersey Communities, Maria Beatriz Yabur

Dissertations

Currently little is known about the effects of noxious odor on people's daily lives. This lack of knowledge is apparent in the rules and regulations concerning odor. This dissertation addresses this lack of knowledge by looking at the effects of current noxious odor on residents' lives in three residential communities in northern New Jersey: West Caldwell, Newark's North Ward and Garfield- Lafayette in Jersey City. The research examines the coping process residents adopt to deal with this environmental annoyance.

In this study I explore two ways residents cope with odor: reactively (trying to keep the odor out of their homes) …

Teaching Conflict Reconciliaton To Those Who Use Technological Communication - A Ministry For Postmodern People, Jeffrey E. Skopak May 2010

Teaching Conflict Reconciliaton To Those Who Use Technological Communication - A Ministry For Postmodern People, Jeffrey E. Skopak

Doctor of Ministry Major Applied Project

With a large group of postmoderns at Fountain of Life Lutheran Church I have access to the community I wish to study and assist with biblical communication, conflict, and reconciliation tools. With that in mind, the purpose of this project is to equip postmodern people with biblical communication, conflict, and reconciliation tools so that they may maintain and nurture healthier relationships with other people by better understanding and using biblical communication, conflict, and reconciliation tools. In order to accomplish this task I have developed four critical events that focus on the topics of communication, relationships, conflict, and reconciliation. These critical …

A Dual Function Of V0-Atpase A1 Provides An Endolysosomal Degradation Mechanism In Drosphila Melanogaster Photoreceptors, W. Ryan Williamson, Dong Wang, Adam Haberman, R. Robin Heisinger May 2010

A Dual Function Of V0-Atpase A1 Provides An Endolysosomal Degradation Mechanism In Drosphila Melanogaster Photoreceptors, W. Ryan Williamson, Dong Wang, Adam Haberman, R. Robin Heisinger

Biology: Faculty Scholarship

The vesicular adenosine triphosphatase (v-ATPase) is a proton pump that acidifies intracellular compartments. In addition, mutations in components of the membrane-bound v-ATPase V0 sector cause acidification-independent defects in yeast, worm, fly, zebrafish, and mouse. In this study, we present a dual function for the neuron-specific V0 subunit a1 orthologue v100 in Drosophila melanogaster. A v100 mutant that selectively disrupts proton translocation rescues a previously characterized synaptic vesicle fusion defect and vesicle fusion with early endosomes. Correspondingly, V100 selectively interacts with syntaxins on the respective target membranes, and neither synaptic vesicles nor early endosomes require v100 for their acidification. In …

Historic And Modern Social Movements For Reparations: The National Coalition For Reparations In America (N’Cobra) And Its Antecedents, Adjoa Aiyetoro, Adrienne D. Davis May 2010

Historic And Modern Social Movements For Reparations: The National Coalition For Reparations In America (N’Cobra) And Its Antecedents, Adjoa Aiyetoro, Adrienne D. Davis

Women, Gender & Sexuality Studies Faculty Research

Most of the legal scholarship on reparations for Blacks in America focuses on its legal or political viability. This literature has considered both procedural obstacles, such as statutes of limitations and sovereign immunity, as well as the substantive conception of a defensible cause of action. Indeed, Congressman John Conyers introduced H.R. 40, a bill to study reparations, in 1989 and every Congressional session since, and there have been three law suits that have received national attention. This Essay takes a different approach, considering reparations as a social movement with a rich and under-explored history. As Robin Kelley explains, such an …

Effects Of Monoclonal Anti-Abeta Antibodies On The Amyloid Beta Peptide Fibrillogenesis And Their Involvement In The Clearance Of Alzheimer's Disease Plaques, Jeffy Pilar Jimenez May 2010

Effects Of Monoclonal Anti-Abeta Antibodies On The Amyloid Beta Peptide Fibrillogenesis And Their Involvement In The Clearance Of Alzheimer's Disease Plaques, Jeffy Pilar Jimenez

USF Tampa Graduate Theses and Dissertations

Alzheimer’s disease (AD) is the most common cause of senile dementia worldwide. AD is a neurodegenerative disorder characterized by the loss of memory and language skill, collapse of the cognitive function, and distortion of social behavior. As of today, the onset mechanisms of AD and cure are unknown; however, three hallmarks are commonly encountered: extra and intracellular accumulation of amyloid beta (A!) peptide plaques, formation of intracellular neurofibrillary tangles, and inevitable neuronal death. Hypothetically, a possible scenario provoking or involved in the onset of AD is a cascade effect that starts with an imbalance in the production and clearance of …

"Speaking" Subalterns: A Comparative Study Of African American And Dalit/Indian Literatures, Mantra Roy May 2010

"Speaking" Subalterns: A Comparative Study Of African American And Dalit/Indian Literatures, Mantra Roy

USF Tampa Graduate Theses and Dissertations

“Speaking Subalterns” examines the literatures of two marginalized groups,African Americans in the United States and Dalits in India. The project demonstrates how two disparate societies, USA and India, are constituted by comparable hegemonic socioeconomic-cultural and political structures of oppression that define and delimit the identities of the subalterns in the respective societies. The superstructures of race in USA and caste in India inform, deform, and complicate the identities of the marginalized along lines of gender, class, and family structure. Effectively, a type of domestic colonialism, exercised by the respective national elitists, silence and exploit the subaltern women and emasculate the …

Ecotourism And Water Quality: Linking Management, Activities And Sustainability Indicators In The Caribbean, Ken Darrie Thomas May 2010

Ecotourism And Water Quality: Linking Management, Activities And Sustainability Indicators In The Caribbean, Ken Darrie Thomas

USF Tampa Graduate Theses and Dissertations

Ecotourism from its genesis and founding theories has been set out to conserve and preserve the environment through sustainable operation that includes surrounding communities in efforts to reduce their poverty levels. Over the years ecotourism has been hypothesized to have departed from this ideal with several researchers, through social, qualitative analyses, have said that these non-sustainable ecotourism operations are simply due to poor management. This work sought to test this central hypothesis as a first approach to quantitatively linking ecotourism activities to management with surface water quality as the key indicator of sustainable ecotourism as a complex system through systems …

Emergent Morphogenetic Design Strategies, Dawn Gunter May 2010

Emergent Morphogenetic Design Strategies, Dawn Gunter

USF Tampa Graduate Theses and Dissertations

Emergent morphogenetic designs provide a superior architectural response to programmatic, technical, structural, environmental and spatial requirements that conventional unit based architectural forms are too inflexible to fully address.

Architecture has reached an exciting stage in its development, where structures are attempting to behave more like nature, which does not function as a static state, but as a complex grouping of symbiotic processes which are constantly evolving to adapt to environmental changes.

Digital fabrication and materials engineering have promoted an explosion in formal architectural typologies. By utilizing these digital tools and enhanced materials to embrace a morphogenetic design strategy, architecture can …

Axon Guided Axon Growth In Drg Neurons From The Spinal Cord Of Rat Embryos, Neha Jain May 2010

Axon Guided Axon Growth In Drg Neurons From The Spinal Cord Of Rat Embryos, Neha Jain

Theses

Early studies in the area of neuronal physiology and injury have shown that axons are guided by a number of physical as well as chemical cues. Although the guidance effect of initial axons and their processes on later axons has been shown from a development point of view, little light has been thrown on the subject from the injury point of view. This important ability of axons which plays a key role during development and formation of neuronal networks could become crucial in repairing damaged nerves and disrupted neuronal tracts.

In the following study, the guidance effect of an older …

Corporate Governance Reform In A Time Of Crisis, Christopher M. Bruner May 2010

Corporate Governance Reform In A Time Of Crisis, Christopher M. Bruner

Scholarly Works

In this article I argue that crisis-driven corporate governance reform efforts in the United States and the United Kingdom that aim to empower shareholders are misguided, and offer an explanation of why policymakers in each country have reacted to the financial crisis as they have. I first discuss the risk incentives of shareholders and managers in financial firms, and examine how excessive leverage and risk-taking in pursuit of short-term returns for shareholders led to the crisis. I then describe the far greater power and centrality that U.K. shareholders have historically possessed relative to their U.S. counterparts, and explore historical and …

The Design Integration Of An Animal Shelter Into Martin Luther King Middle School, Anna Givens May 2010

The Design Integration Of An Animal Shelter Into Martin Luther King Middle School, Anna Givens

Theses and Dissertations

This thesis explores the design integration of an animal shelter into an existing school in an at-risk neighborhood. The connection between at-risk students and homeless animals is valuable to the design. A large central courtyard located within Martin Luther King Middle School serves as a connection between both students and animals. Because the animal shelter is located in a central location within the school, students and animals have a greater ability to form a connection necessary for the program to work. This thesis is about the interaction between both animals and students through the process of design.

Milk Winter, Elizabeth Cundiff Mcconaghy May 2010

Milk Winter, Elizabeth Cundiff Mcconaghy

Theses

Milk Winter is a collection of non-fiction essays and fiction short stories representing defining moments in the life of the writer as she navigates early married life, social landscapes, fear and neurosis, devastation and attempts at grace. This collection explores the narrow space between tragedy and hilarity, concluding that to cross that space is to receive circumstances as they are given. Milk Winter shows early adult life in its searing, soaring moments and resolves, in the end, to accept them all.
