The high profile cases Bilski v. Kappos and Association for Molecular Pathology v. United States Patent and Trademark Office have renewed public debate about the proper scope of patentable subject matter. The subject matter inquiry has traditionally been treated as a threshold inquiry in patent law, serving a gate-keeping function by defining the types of inventions that are eligible for patent protection. The quote in the title of this Essay comes from Justice Breyer, expressing his frustration with the language of section 22(b)(1) of the National Childhood Vaccine Injury Act. Justice Breyer made this comment during the October 12, 2010, oral argument in Bruesewitz v. Wyeth, Inc., a case about the availability of state tort claims based on vaccine design defects. The recovery of the Bald Eagle (Haliaeetus leucocephalus) in North America during the 20th century is a conservation success story. Once threatened with extinction, the species now is common throughout much of its range (Buehler 2000). Federal and state laws such as the Endangered Species Act (ESA; 16 U.S.C. 1531-1544) that were used to protect Bald Eagles and important habitats used by eagles are considered key actions that fostered the species' recovery. In 2007, the Bald Eagle was formally removed from the federal list of threatened and endangered species (50 CFR Part 17). The following year, the Bald …

This summer was marked by continuing high water tables along the Missouri River and good water levels in the eastern Rainwater Basin. As a result, American and Least Bitterns, King Rail, Common Moorhen, and several American Coot nests in Sarpy Co were reported. However, Great and Snowy Egrets were scarce, and Black-necked Stilts were absent from the eastern Rainwater Basin after several good breeding years there.

One of the most obvious impacts roads have on the natural world is direct mortality to individual animals that attempt to cross roads. A less obvious but likely more important impact of roads on many species is habitat fragmentation. The ability for individuals to travel between subpopulations is the key to genetic diversity as well as ultimately the survival of the species. A professor and students in an undergraduate honors research seminar were inspired to playfully link old and contemporary literacy theories to a 2.0 media artifact, the popular YouTube video Kittens! Inspired by Kittens! (KIbK) starring 6 year-old Maddie. In this article KIbK is theorized drawing on frames of school-based reading instruction, social identities, identity formation in communities of practice, Bakhtin’s theory of intertextuality, and Bourdieu’s theory of social reproduction. The authors found that KIbK was a powerful touchstone and Vygotskian tool for their project of linking theory to practice. Accurate cell settling velocity determination is critical for perfusion culture using a gravity settler for cell retention. We have developed a simple apparatus (a 'settling column') for measuring settling velocity and have validated the procedure with 15-μm polystyrene particles with known physical properties. The measured settling velocity of the polystyrene particles is within 4% of the value obtained using the traditional Stokes' law approach. The settling velocities of three hybridoma cell lines were measured, resulting in up to twofold variation among cell lines, and the values decreased as the cell culture aged. Comparing Narratives Of Personal And Preferred Partner Characteristics In Online Dating Advertisements, Elizabeth M. Morgan, Tamara C. Richards, Emily M. Vanness

This study explored online personal ads of 294 heterosexual and homosexual men and women in the United States through a qualitative analysis and comparison of participant-generated “personal” and “preferred partner” narratives. Nine characteristics were identified and combined into three overarching categories: physical, lifestyle, and personality characteristics. These three personal and preferred partner characteristics were examined for difference by gender, sexual orientation, age and desired relationship type of the advertisers. Main effects emerged for all four predictors, most notably for age and desired relationship type. Atherosclerosis causes hundreds of thousands of deaths in the US alone every year. Fibrous cap rupture is one of the leading causes of these fatalities. Thin cap atheromas are commonly regarded as vulnerable plaque, however the effect of calcium upon a thin fibrous cap with lipid pool is poorly understood. Some studies have shown that calcium adds to stability of the lesion, while others have proven otherwise. An article by Li et al. 2007 suggests location is the key factor. Sarcopenia is a growing health problem in this country as more Americans are living well into old age. It has been thought that a higher protein intake may be related to greater lean muscle mass as well as greater muscular strength and physical functioning. The purpose of this research was to examine protein intake and its relationship to lean body mass and physical functioning in a nationally representative sample of U.S. adults.

Chlorella variabilis NC64A, a unicellular photosynthetic green alga (Trebouxiophyceae), is an intracellular photobiont of Paramecium bursaria and a model system for studying virus/algal interactions. We sequenced its 46-Mb nuclear genome, revealing an expansion of protein families that could have participated in adaptation to symbiosis. NC64A exhibits variations in GC content across its genome that correlate with global expression level, average intron size, and codon usage bias. Although Chlorella species have been assumed to be asexual and nonmotile, the NC64A genome encodes all the known meiosis-specific proteins and a subset of proteins found in flagella. The Herpes Simplex Virus Type 1 Ul20 Protein And The Amino Terminus Of Glycoprotein K (Gk) Physically Interact With Gb, Vladimir N. Chouljenko, Arun V. Iyer, Sona Chowdhury, Joohyun Kim, Konstantin G. Kousoulas

Herpes simplex virus type 1 (HSV-1) glycoprotein K (gK) and the UL20 protein (UL20p) are strictly required for virus-induced cell fusion, and mutations within either the gK or UL20 gene cause extensive cell fusion (syncytium formation). We have shown that gK forms a functional protein complex with UL20p, which is required for all gK and UL20p-associated functions in the HSV-1 life cycle. Recently, we showed that the amino-terminal 82 amino acids (aa) of gK (gKa) were required for the expression of the syncytial phenotype of the mutant virus gBΔ28 lacking the carboxyl-terminal 28 amino acids of gB (V.
