In July 2010 the International Court of Justice rendered its Advisory Opinion on the legality of Kosovo's declaration of independence and the Constitutional Court of Spain rendered an opinion concerning the autonomy of Catalonia. Two very different cases, from very different places, decided by very different courts. Nonetheless, they each provide insights on the issue of separatism in the midst of European integration. Does the Kosovo opinion open the door for other separatist groups? Does the process of European integration increase or undercut separatism? This qualitative study investigates the influence of single-sex education on leadership formation at an all boys, urban Catholic high school where a majority of the students come from disadvantaged backgrounds. The researcher has found an association between graduation from a single-sex school and leadership attainment. In order to understand what it is about a single-sex education that might nurture leadership development the author completed an instrumental case study of the school seeking to identify those elements that might nurture leadership formation.

This Essay begins with a confession. In taking implicit association tests ("IATs") designed to measure my unconscious attitude toward two particular demographic groups, I discovered that I, an African-American, harbored a "slight automatic preference" for Europeans over blacks and for "other people" over "Arab-Muslims." Both of these results were contrary to my professed or conscious assertions of neutrality. Why would a pro-integration scholar who seeks to promote cross-racial understanding and inclusion exhibit such implicit biases? And why is it that a majority of others who take these tests register similar implicit biases? The point of my confession is to underscore …

Although brand-name pharmaceutical companies routinely procure patents on their innovative medications, such rights are not self-enforcing. Brand-name firms that wish to enforce their patents against generic competitors must commence litigation in the federal courts. Such litigation ordinarily terminates in either a judgment of infringement, which typically blocks generic competition until such time as the patent expires, or a judgment that the patent is invalid or not infringed, which typically opens the market to generic entry. As with other sorts of commercial litigation, however, the parties to pharmaceutical patent litigation may choose to settle their case. Certain of these settlements have …

Patrick J. Rohan’s connection to St. John’s reaches back more than half a century. He graduated from St. John’s University in 1954 and from the School of Law in 1956. Two years later, he joined the Law School faculty, where he served for fifty-two years until his retirement in June 2009. He died just a few months later, on November 26, 2009. The School of Law community mourns the passing of this man of St. John’s—Dean Emeritus, Professor of Law, alumnus, supporter, and friend.

Predatory Mite Fauna Of Phytoseiidae Of Northwest Iran (Acari: Mesostigmata), Hasan Rahmani, Karim Kamali, Farid Faraji

To determine the predatory mite family Phytoseiidae associated with spider mites in northwest Iran, a survey was carried out during 2006-2007. Nineteen species from 7 genera of the family Phytoseiidae were collected and identified. Measurements are given and some morphological characters are discussed. A key is provided to identify the adult females of the known 27 species of Phytoseiidae of that area. Seed Morphology Of Ebenus L. Species Endemic To Turkey, Fatma Bayrakdar, Zeki̇ Aytaç, Zeki̇ye Suludere, Selami̇ Candan

In the present study, seed surface morphology of species of the genus Ebenus L. in Turkey, all of which are endemic, was studied. E. plumosa var. speciosa has the biggest and E. laguroides var. laguroides has the smallest seeds. The seed shapes are spheroid in E. reesei, orbiculate in E. pisidica, and oblong-spheroid in others. Ornamentation is striate in E. macrophylla, rugose in E. haussknechtii, and reticulate or multi-reticulate in others. Microphylle is subterminal in all Turkish Ebenus species.

In this work, a route for the conversion of arene cis-dihydrodiols to their trans isomers was examined. Arene trans-dihydrodiols are potentially important chiral building blocks in synthetic chemistry and are more stable than their cis analogues. While the cis-arene dihydrodiols can be produced on a relatively large scale by fermentation, their trans isomers cannot. This dissertation studies environmental regulation issues in the hog production industry as well as forces behind the reorganization of the industry during the past two decades. Federal and State-level environmental regulations imposed on U.S. hog production during the year 2003 are examined in Chapter 1. Based on the number of regulations passed by the Federal government and states, the 2003 regulatory index is constructed. The regulatory stringency index suggests that state-level regulations vary across states and have increased over the years. Background: Previous studies suggest many pregnant women are under-consuming fatty fish and are deficient in omega-3 (ω-3) fatty acids.

Background: Previous studies suggest many pregnant women are under-consuming fatty fish and are deficient in omega-3 (ω-3) fatty acids.

Methods: A 10-question survey distributed to expectant mothers via an online survey and via paper form through 3 obstetric clinics over a 2-month period.

Results: Of the 104 participants, 82% consumed less than 2-3 servings of fish per week, and at least 30% were confused about mercury content. Over 60% of doctors did not provide recommendations regarding ω-3 intake. One-third of participants …

Probiotic bacteria in the human colon that produce C2 – C4 short chain fatty acids (SCFA) and Lactobacillus species that produce lactate in addition to SCFAs are known to have positive health benefits. These organic acids were extracted with ether from murine cecal material (from Dr. Gary Huffnagle, Univ. of Mich.) and derivatized for quantitative measurement by gas chromatography-mass spectrometry. Antibiotic-treated animals gavaged with Candidaalbicans had a lower level of cecal butyrate relative to untreated animals, but a higher level of butyrate when treated mice were also administered Lactobacillus johnsonii NF-1. Weight management is integral to cardiovascular risk reduction. However, minimal weight loss is achieved during participation in many cardiac rehabilitation (CR) programs. The objective of the present study was to establish if brief interventions by a registered dietitian (RD) during cardiac rehabilitation sessions improved the health status of patients with cardiovascular disease. An RD provided individualized nutrition counseling, answered nutrition questions, and reviewed weekly progress in a CR program for a four-month period. At baseline and upon completion of 19 CR sessions, nutrition knowledge was assessed using a 38-question test, and body weight was measured. Upon completing CR, patients rated …

The inhibition of plasminogen activator inhibitor-1 (PAI-1) is anticipated to increase our understanding of various human ailments with which high levels of PAI-1 have been associated, including diabetes, stroke, and atherosclerosis. Previous accounts have reported the synthesis of inhibitors that bind to PAI-1 with a low affinity, inhibit the serpin plasma protein antithrombin III, and/or fail to inhibit PAI-1 when vitronectin, a cofactor of PAI-1 is present. The synthesis of small-molecule inhibitors of PAI-1 that improve upon these properties has been the main goal of this research. The issue of the patentability of electromagnetic and acoustic signals has not been litigated in Canada. If, however, the issue does come forward for litigation, Canadian courts may decide differently than their American colleagues did. The Supreme Court of Canada’s ‘Harvard Mouse’ decision shows that the Canadian law on patentable subject matter differs from American law. Under the Canadian definition of manufacture, electromagnetic and acoustic signals could constitute patentable subject matter.

Growth and yield (kg/ha-1) of the channel catfish (Ictalurus punctatus, Rafinesque, 1818) and the channel x blue hybrid catfish [I. punctatus female x I. furcatus (Lesueur,1840) male], which shared the Jubilee strain of channel catfish as the maternal parent, were compared in sixteen 0.1 ha earthen ponds (14,852 fish/ha-1) during the April to November growing season. Each fish genetic group was fed a commercially formulated 32% protein feed daily to apparent satiation or at 80% of the mean daily satiation ration. Background: Transient receptor potential vanilloid 1 (TRPV1) channels are important membrane sensors on peripheral nerve endings and on supportive non-neuronal synoviocytes in the knee joint. TRPV 1 ion channels respond with activation of calcium and sodium fluxes to pH, thermal, chemical, osmotic, mechanical and other stimuli abundant in inflamed joints. In the present study, the kaolin/carrageenan (k/c) induced knee joint arthritis model in rats, as well as primary and clonal human synoviocyte cultures were used to understand the reciprocal interactions between reactive nitroxidative species (ROS) and functional TRPV1 channels. Cass Sunstein has long argued that judicial minimalism promotes democracy. According to Sunstein’s view, a court can encourage the political branches of government to address an issue by using doctrines such as vagueness, nondelegation, and desuetude. Although much has been written about minimalism, very little has been said about the democracy-promotion thesis in particular. Yet it is one of the central claims of contemporary minimalism. This article attempts to remedy the deficiency. It argues that minimalism does not promote democracy because minimalist decisions lack the depth necessary to trigger democratic deliberation. In 1964, President Lyndon B. Johnson called for a Nationwide War on the Sources of Poverty to “strike away the barriers to full participation” in our society. Central to that war was an understanding that given poverty’s complex and multi-layered causes, identifying, implementing, and monitoring solutions to it would require the “maximum feasible participation” of affected communities. Equally central, however, was an understanding that such decentralized problem-solving could not be fully effective without national-level orchestration and support. Antipredatory defense of pronghorn (Antilocapra americana) neonates (≤1 month old) by adult females (>18 months old) is well documented throughout the geographic range of this species. However, reports of male pronghorn defending neonates against predators are limited to a single study in northwestern Wyoming where occurrences were documented of adult males assisting female pronghorn in defending neonates against coyotes (Canis latrans). To our knowledge, defense of neonatal pronghorn by yearling males (12–18 months old) has not been reported previously for this species. We report occurrences of antipredatory defense of neonatal pronghorn by yearling males in southwestern South Dakota

The aquatic nuisance diatom Didymosphenia geminata was established in Rapid Creek in the Black Hills of South Dakota in 2002. Shortly thereafter, large declines (>50%) of the naturalized brown trout Salmo trutta population were observed. We evaluated the influence of water resources and D. geminata on (1) declines in brown trout biomass, (2) changes in food resources, and (3) diet of brown trout in Black Hills streams. Drought conditions were largely responsible for trout declines in Black Hills streams. Coarse woody debris (CWD), an essential component of healthy forests, has typically been defined as dead and down, large woody material. Quantification of this resource provides a useful metric for assessing wildlife habitat, fuel loading, and more recently, carbon sequestration. Although many CWD sampling methods exist, accurate estimation is difficult and expensive. Double sampling incorporates auxiliary data that is positively correlated with the attribute of interest as a means of reducing sampling costs and/or increasing estimation precision.
