Coming To Terms With Ruthlessness: Sovereign Equality, Global Pluralism, And The Limits Of International Criminal Justice, Brad R. Roth
Coming To Terms With Ruthlessness: Sovereign Equality, Global Pluralism, And The Limits Of International Criminal Justice, Brad R. Roth
Santa Clara Journal of International Law
Nullum crimen sine lege and related doctrines that limit extraterritorial jurisdiction and confer immunity ratione materiae are not inconvenient obstacles to be circumvented, but crucial safeguards to be respected. These doctrines respond to the reality that the international community remains beset by serious moral disagreement, both about what count as just ends and about which harsh measures those ends might justify in circumstances of high-stakes political conflict. In such a world, in which very few hands are truly clean, unilateral invocations of universal principles must be viewed skeptically, and associated exercises of power treated guardedly. Prosecutions undertaken in the name …

Isolation And Characterization Of Microsatellite Loci From Wild Striped Snakehead (Channa Striata)., Yasmeen Sameer Mahmoud Salah
Student Works (2010-2019)
Channa striata (better known as Haruan in Malaysia), is a freshwater species that is well known as a protein source and also for its pharmaceutical value among wounded patients. Unfortunately stocks have declined over the past few years, thus an in-depth study is needed to rule out genetic irregularities that might be causing the slow extinction of the species. This study was conducted for the purpose of studying the population diversity and genetic structure of Channa striata (striped snakehead) in seven different locations around the peninsular of Malaysia. Microsatellite markers were isolated and identified using Random Amplified Microsatellite (RAM) primers. …

Computational Identification Of Micro Rna In Musa Sp Est Sequences., Tan Yew Seong
Student Works (2010-2019)
MicroRNAs (miRNAs) are small single-stranded non-protein-coding RNAs of about 22 nucleotides that play an important role in post-transcriptional gene regulation in animals and plants by targeting mRNAs for direct cleavage of mRNAs or repression of mRNA translation. In this study, a homology search based approach has been used for identifying the novel miRNA genes of Musa sp. using the BLAST program with a total of 42,978 Musa sp. expressed sequence tags (EST) were compared to a total of 959 previously known plant miRNA sequences. Forty-seven candidate miRNA with homology to previously known miRNAs were identified. By using the mFold3.1 program, …

Isolation And Development Of Microsatellite Markers Of Channa Striata., Faiza Omar
Student Works (2010-2019)
Channa striata, locally known as haruan has long been regarded as a valuable edible fish and it is also consumed for its putative effects on wound healing. The main objective of the project was to develop microsatellite markers for use in the study of genetic diversity of the wild Channa striata populations in Malaysia. In this study, seven new microsatellite loci were isolated from Channa striata using a Random Amplified Microsatellite (RAMs) based technique which was an efficient and reliable method. Ten primers were used in population genetic studies of Channa striata.Sixty sets of microsatellite primer pairs were used in …
Biofouling And Short-Term Dynamics On Fish Cage Netting In Relation To Fish Rearing And Environmental Factors., John Madin
Student Works (2010-2019)
Four studies were conducted in a floating net-cages farm at Matang Mangrove Forest Reserve (MMFR), Perak, Malaysia, to elucidate the biofouling assemblages on cage nettings and factors that influence their development. In the first study (Chapter 3),biofouling on 1.6 cm mesh net panels (size 0.2 m x 2 m) suspended inside (homemade pellet ‘P’, trash fish ‘T’) and outside (O) experimental net-cages in a fish farm were monitored every week until net openings were completely occluded by macrofouling organisms. Eight species (7 phyla) of sessile organisms and 27 species (3 phyla) of nonsessile associates were recorded.Colonization by macrofouling organisms usually …

The aim of this study was to develop an optimal freezing protocol for African catfish(Clarias gariepinus) sperm with special reference to type of extender and cryoprotectant, molarity, equilibration duration, vapour temperature and vapour exposure duration. Using Tris-Citric Acid Yolk Extender (TCAYE), a 3x3x3x3 factorial experiment was carried out consisting of 3 molarities of glycerol (0.5, 1.0 and 2.0 M), 3 equilibration durations (120,140 and 160 minutes), 3 vapour temperatures (-80, -90 and -100oC) and 3 vapour exposure durations (5, 10 and 15 minutes). In addition, using Fish-Ringer Extender (FRE), a 3x3x3 factorial experiment was also conducted involving 3 equilibration durations …
Estimation Of The Product Yield And Collection Efficiency Of Peripheral Blood Stem Cell Harvesting Using Peripheral Blood Cd34+ Cells Quantification / Habsah Aziz, Aziz Habsah
Student Works (2010-2019)
Peripheral blood stem cells (PBSC) have been used for transplantation since the early 1990s. CD34+ has been used as a marker of hematopoietic stem cells to determine the optimal timing for PBSC harvesting. However, a wide ranges of CD34+ cells cut-off values from 8/ul to 66/ul have been used to initiate PBSC harvesting in autologous patients. We performed here a study to determine the peripheral blood CD34+ cells cut-off value for the prediction of stem cell yield of 2 x106 CD34+ cells/kg body weight patients, to study the correlation between peripheral blood CD34+ cells and stem cell yield, to study …

PREFACE
In researching the life of Monsignor Erwin A. Juraschek, I was reminded of the Hindu goddess Kali who has ten hands. How anyone could take on so many tasks and do them so well is truly amazing. In 1960, for instance, he was associated with twelve different organizations, and was active in all of them. That, in addition to all of his regular parochial duties. He led an extremely full life, and I find it interesting that Msgr. Juraschek’s first assignment as a pastor was at St. Thomas More, the “man for all seasons.” He was no less, and …
A Standard Clause Analysis Of The Frustration Doctrine And The Material Adverse Change Clause, Andrew A. Schwartz
A Standard Clause Analysis Of The Frustration Doctrine And The Material Adverse Change Clause, Andrew A. Schwartz
Publications
In the darkest depths of a corporate merger agreement lies the MAC clause, a term that permits the acquirer to walk away from a transaction if, between signing and closing, the target company experiences a "Material Adverse Change." Multibillion-dollar deals rise or fall based on the anticipated interpretation of a MAC clause, and invocation of the clause in a sensitive transaction could trigger the collapse of the global financial system. In short, the MAC clause is the most important contract term of our time. And yet--due to an almost total lack of case law--no one knows what it means.

Nudge, Choice Architecture, And Libertarian Paternalism, Pierre Schlag
Nudge, Choice Architecture, And Libertarian Paternalism, Pierre Schlag
Publications
In Nudge, Cass Sunstein and Richard Thaler describe how public and private institutions can improve on individual choices by nudging individuals into making selections that are right for them. Rejecting the Econ-101 caricature of the rational utility maximizer as inaccurate, Sunstein and Thaler apply the insights of behavioral economics to show how institutions can improve the delivery of services. Moving beyond attempts to remedy individual cognitive errors, Sunstein and Thaler also argue for "libertarian paternalism" - which they herald as the "Third Way." This Review assesses their claims critically, finding their development of "nudge" and "choice architecture" to be …
Lactate Dyscrasia: A Novel Explanation For Amyotrophic Lateral Sclerosis, Sivan Vadakkadath Meethal, Craig Atwood
Lactate Dyscrasia: A Novel Explanation For Amyotrophic Lateral Sclerosis, Sivan Vadakkadath Meethal, Craig Atwood
Research outputs pre 2011
Amyotrophic lateral sclerosis (ALS; Lou Gehrig’s disease) is a progressive debilitating neurodegenerative disease with no cure. We propose a novel molecular model for the pathogenesis of ALS that involves an adenosine triphosphate (ATP)-dependent muscle neuronal lactate shuttle (MNLS) at the neuromuscular junction (NMJ) to regulate the flow of lactate from muscle to neurons and vice versa. Failure of the MNLS due to respiratory chain dysfunction is proposed to result in lactate toxicity and degeneration of nerve endings at the NMJ leading to nerve terminus dysjunction from the muscle cell. At a critical threshold where denervation outpaces reinnervation, a vicious cycle …

Assemblage Turnover And Taxonomic Sufficiency Of Subtidal Macroalgae At Multiplespatial Scales, Dan A. Smale, Gary A. Kendrick, Thomas Wernberg
Research outputs pre 2011
Spatial variability in the structure of subtidal macroalgal assemblages in southwest Australia was examined at multiple spatial scales using a three-factor hierarchal design. Spatial extents ranged from metres (between quadrats) to many hundreds of kilometres (between regions), and the study encompassed N2000 km of temperate coastline. In addition, the influence of taxonomic resolution, from species level data to class level, on spatial patterns was investigated to assess the potential evolutionary timescales of the pattern and for developing cost effective regionally applicable surrogates for biodiversity monitoring. Almost 300 species were identified from 14 sites, representing considerable biodiversity and a significant subset …
Evolving Group Strategies For Ipd, Philip Hingston
Evolving Group Strategies For Ipd, Philip Hingston
Research outputs pre 2011
The Iterated Prisoners Dilemma (IPD) is often used to model cooperation between self-interested agents. In an earlier study, we introduced a framework using IPD to study the effects of species-level competition on the evolution of cooperative behaviour. In this paper, we extend the previous work, using co-evolutionary simulations of interactions between species of IPD-playing agents to investigate how group strategies may evolve. We find that the ability to cooperate more with agents of the same species greatly increases the ferocity of competition between species.

Research outputs pre 2011
Background The low-density lipoprotein receptor related protein 1 (LRP1) has been implicated in Alzheimer's disease (AD) but its signalling has not been fully evaluated. There is good evidence that the cytoplasmic domain of LRP1 is involved in protein-protein interactions, important in the cell biology of LRP1. Results We carried out three yeast two-hybrid screens to identify proteins that interact with the cytoplasmic domain of LRP1. The screens included both conventional screens as well as a novel, split-ubiquitin-based screen in which an LRP1 construct was expressed and screened as a transmembrane protein. The split-ubiquitin screen was validated in a screen using …

Proximity To Rocky Reefs Alters The Balance Between Positive And Negative Effects On Seagrass Fauna, Fernando Tuya, Mathew Vanderklift, Glenn Hyndes, Thomas Wernberg, Mads Thomsen, Christine Hanson
Research outputs pre 2011
Proximity to habitat margins can alter the balance between positive and negative forces on species abundance. Based on this idea we examined abundance patterns of herbivorous gastropods in seagrasses adjacent to rocky reefs. We tested whether the balance between the intensity of predation (negative effect) and recruitment of new individuals (positive effect) changes with increasing distance from reefs. Abundances of gastropods varied with distance to reefs, but the direction of changes in abundance was taxon-specific: some taxa decreased in abundance with increasing distance from reefs (e.g. Pyrene bidentata), while others showed the opposite pattern (e.g. Cantharidus lepidus). Predators were more …

Android Forensics: Simplifying Cell Phone Examinations, Jeff Lessard, Gary Kessler
Research outputs pre 2011
It is hardly appropriate to call the devices many use to receive the occasional phone call a telephone any more. The capability of these devices is growing, as is the number of people utilizing them. By the end of 2009, 46.3% of mobile phones in use in the United States were reported to be smart phones (AdMob, 2010). With the increased availability of these powerful devices, there is also a potential increase for criminals to use this technology as well. Criminals could use smart phones for a number of activities such as committing fraud over e-mail, harassment through text messages, …

The Adsl Router Forensics Process, Patryk Szewczyk
Research outputs pre 2011
In 2010 the number of threats targeting ADSL routers is continually increasing. New and emergent threats have been developed to bypass authentication processes and obtain admin privileges directly to the device. As a result many malicious attempts are being made to alter the configuration data and make the device subsequently vulnerable. This paper discusses the non-invasive digital forensics approach into extracting evidence from ADSL routers. Specifically it validates an identified digital forensic process of acquisition. The paper then discusses how the approach may be utilised to extract configuration data ever after a device has been compromised to the point where …

A Zebrafish Melanophore Model Of Amyloid (Beta) Toxicity, Morgan Newman, Lachlan Wilson, Esther Camp, Giuseppe Verdile, Ralph Martins, Michael Lardelli
Research outputs pre 2011
Reliable animal models are required to facilitate the understanding of neurodegenerative pathways in Alzheimer’s disease. Animal models can also be employed to search for disease-modifying drugs. The embryos and larvae of zebrafish are particularly advantageous for this purpose. For Alzheimer’s disease, drugs that can ameliorate amyloidb (Ab) toxicity have therapeutic and=or prophylactic potential. We attempted to generate a zebrafish model of Ab toxicity that would be viable and fertile but have a highly visible pigmentation phenotype in larvae. The larvae could then be arrayed in microtiter plates to screen compound libraries for drugs acting to reduce Ab toxicity. We used …

Towards A Corporeal Aesthetics Of Plants: Ethnographies Of Embodied Appreciation Along The Wildflower Trail, John Charles Ryan
Research outputs pre 2011
This paper argues for the application of ethnographic practice, specifically participant observation and semi-structured interviewing, in the development of a corporeal aesthetics of flora. The study is characterized as an ethnography of botanists and, building upon emerging work in cultural ecology and human–plant geographies, is situated within the proposed context of cultural botany. During the Southwest Australian spring wildflower season between August and October of 2009 I conducted interviews with professional and amateur botanists, as well wildflower enthusiasts and tourists, at two places of remarkable floristic diversity: the Lesueur-Eneabba region and the Fitzgerald River National Park. Interview transcripts suggest the …

Using Nicknames, Pseudonyms And Avatars On Heartnet: A Snapshot Of An Online Health Support Community, Debbie Rodan, Lynsey Kay Uridge, Lelia Green
Research outputs pre 2011
Cardiovascular disease remains one of the leading causes of death and long-term disability for the ageing Australian population. During recovery from a heart event, many people seek an alternative to traditional support groups and look to the Internet and World Wide Web to establish a connection with others who have had a similar experience. HeartNET provides just such an alternative support structure for anyone affected by heart disease. One issue faced by members of any online support community is whether to remain anonymous by using pseudonyms, nicknames or avatars or whether to accept a certain level of risk, usually in …

Turban Snails As Habitat For Foliose Algae: Contrasting Geographical Patterns In Species Richness, Thomas Wernberg, Fernando Tuya, Mads Thomsen, Gary Kendrick
Research outputs pre 2011
Understanding patterns of species richness is a major goal for ecologists, especially in space-limited habitats where many organisms live on top of others (epibiosis, e.g. by algae growing on gastropods in marine environments). We tested the hypotheses that species richness of epiflora on the gastropod Turbo torquatus would not differ between regions with similarly rich algal floras, and that epifloral richness would increase with increasing gastropod size. Macroalgal floras of Hamelin Bay (HB), Marmion (M), Jurien Bay (JB) and Kalbarri (K), Western Australia, ranged from ~20 to 40 species reef–1 (JB = HB = M ≥ K). Epiflora on small …

A Tale Of Two Worlds: A Second Life For Higher Education?, Daniel Demaiolo, Donna Walsh
AMTP Proceedings 2010
This exploratory research investigates the virtual world industry, explanations for its growth and emerging trends for entrepreneurial ventures and marketing communications. It then explores the effectiveness of operating and promoting higher education in Second Life. Results illustrate consumers 17-24 years old still rely on traditional media for information related to higher education. Developing a business model and marketing mix in Second Life, that often features uncensored content, may not be an appropriate method of connecting with the target demographic. Benefits of utilizing virtual worlds are considered; further research is recommended; suggestions are offered to increase Second Life’s viability in higher …

Aztec Musical Styles In Carlos Chavez's "Xochipilli: An Imagined Aztec Music" And Lou Harrison's "The Song Of Quetzalcoatl": A Parallel And Comparative Study., Shawn M. Roberts
Graduate Theses, Dissertations, and Problem Reports (ETD)
From the appearance of Amaldeo Roldan's Ritmica No. 5 and No. 6 in 1930 and Edgard Varese's Ionisation in 1931, until the United States involvement in World War II brought a hiatus to the genre, over fifty works for percussion ensemble were published. At the height of this outpouring, two works for percussion ensemble on a similar cultural topic were written, Carlos Chavez's Xochipilli: An Imagined Aztec Music (1940) and Lou Harrison's The Song of Quetzalcoatl (1941). Within Chavez and Harrison's titles are the names of two well-known and highly revered Aztec deities, Xochipilli and Quetzalcoatl. Consequently, this project determines …
Prudentialism In Mcdonald V. City Of Chicago, Neil S. Siegel
Prudentialism In Mcdonald V. City Of Chicago, Neil S. Siegel
Faculty Scholarship
At least two kinds of prudential argument have been identified in the literature on constitutional interpretation: court-centered prudentialism and system-centered prudentialism. Commentators often characterize court-centered prudentialism as animated by concern over the Supreme Court’s preservation of its public legitimacy, which can be undermined when the Justices decide controversial questions in ways that cause backlash. By contrast, system-centered prudentialism asks not only what judicial decision is best for the Court’s effectiveness, but also what response is best for the constitutional system as a whole when the Court’s legitimacy is not at stake.
The Court’s recent decision in McDonald v. City of …
