The Speluncean Explorers--Further Proceedings, Anthony D'Amato Jan 2010

The Speluncean Explorers--Further Proceedings, Anthony D'Amato

Faculty Working Papers

Lon L. Fuller's The Case of the Speluncean Explorers is a classic in jurisprudence. The case presents five judicial opinions which clash with each other and produce for the reader an exhilarating excursion into fundamental theories of law and the state and the role of courts vis-i-vis legislatures and executives. Though the issues articulated by Fuller are timeless, the past thirty years in jurisprudential scholarship have produced at least one major new vantage point—the "rights thesis".

Article Iii And The Scottish Enlightenment, James E. Pfander Jan 2010

Article Iii And The Scottish Enlightenment, James E. Pfander

Faculty Working Papers

Historically-minded scholars and jurists invariably turn to English law and precedents in attempting to recapture the legal world of the framers. Blackstone's famous Commentaries on the Laws of England offers a convenient reference for moderns looking backwards. Yet the generation that framed the Constitution often relied on other sources, including Scottish law and legal institutions. Indeed, the Scottish judicial system provided an important, but overlooked, model for the framing of Article III. Unlike the English system of overlapping jurisdiction, the Scottish judiciary featured a hierarchical, appellate-style judiciary, with one supreme court sitting at the top and an array of inferior …

Imaginative Science Education: Exploring The Wonders Of Water, Emily R. Fletcher Jan 2010

Imaginative Science Education: Exploring The Wonders Of Water, Emily R. Fletcher

Graduate Student Independent Studies

The imagination is central to all learning. This paper provides science educators with a better understanding of imagination's role in learning and how it may be routinely engaged in the education of budding scientists. Both theoretical and practical dimensions are addressed. Part one defines the imagination, provides an overview of Kieran Egan's (1997) theory of lmaginative Education, introduces Egan's framework for developing lessons using Imaginative Education, and provides an argument for imaginative science education. Part two provides an example of science curriculum that shows practical application of lmaginative Education in a museum science camp setting. The curriculum explores the scientific …

Responses Of Bats To Forest Fragmentation In The Mississippi River Alluvial Valley, Arkansas, Usa, Rex E. Medlin Jr., Matthew B. Connior, Karen F. Gaines, Thomas S. Risch Jan 2010

Responses Of Bats To Forest Fragmentation In The Mississippi River Alluvial Valley, Arkansas, Usa, Rex E. Medlin Jr., Matthew B. Connior, Karen F. Gaines, Thomas S. Risch

Faculty Research & Creative Activity

Intense conversion of bottomland hardwood forests to rice and soybeans in the Mississippi River Valley of Arkansas has restricted the remaining forest to isolated fragments. Habitat fragmentation has proven to be detrimental to population sustainability of several species, and is the subject of intense study with often species and latitude specific responses. We compared both coarse land area classes and landscape fragmentation metrics from six 30 km × 30 km subsets centered on publicly owned management areas to bat captures obtained from a 2005 population study. Patch density was the strongest predictor of total captures (R 2 = 0.801, p …

Reconstitution Of The Olfactory Epithelium Following Injury In Apoe-Deficient Mice, Britto P. Nathan, Salina Gairhe, Ikemefuna Nwosu, Stephen Clark, Robert G. Struble Jan 2010

Reconstitution Of The Olfactory Epithelium Following Injury In Apoe-Deficient Mice, Britto P. Nathan, Salina Gairhe, Ikemefuna Nwosu, Stephen Clark, Robert G. Struble

Faculty Research & Creative Activity

ApoE, a protein component of lipoproteins, is extensively expressed in the primary olfactory pathway. Because apoE has been shown to play a vital role in nerve repair and remodeling, we hypothesized that apoE expression will increase in the injured olfactory epithelium (OE), and that apoE deficiency in apoE knockout (KO) mice will lead to delayed/incomplete reconstitution of the OE following injury. To directly test this hypothesis, we compared OE regeneration in wild-type (WT) and KO mice following injury induced by intranasal irrigation of Triton X-100. OE was collected at 0, 3, 7, 21, 42, and 56 days post lesion. The …

Understanding Video Games, Nicholas Cameron Edwards Jan 2010

Understanding Video Games, Nicholas Cameron Edwards

Self-Designed Majors Honors Papers

In this thesis, I attempt to offer an introduction to the medium of video games. I begin with the seemingly simple, but actually quite impossible, task of defining games, drawing upon, but ultimately rejecting, a number of proposed definitions. I then attempt to explain the complicated nature of the medium and its equally complicated relationships to other media in light of Roland Barthes' theory of the Death of the Author, and I conclude that games are fundamentally new and worthwhile. Having made the abstract argument that the medium is capable of producing art, I acknowledge Roger Ebert's point that it …

Roman L. Hruska U.S. Meat Animal Research Center: Reports

This review, which represents a summarization of research results generated during an approximately 22-yr period, involves preweaning, postweaning, and carcass trait comparisons of progeny sired by Bos indicus (Brahman, Boran, Nellore, Indu-Brazil, Gir, Sahiwal), B. indicus-derivative (Brangus, Beefmaster, Santa Gertrudis, Gelbray, Simbrah), non-B. indicus (Tuli, Romosinuano, Bonsmara, Senepol) subtropically adapted, and traditional Bos taurus (Angus, Hereford, Charolais, Gelbvieh, Red Poll) sire breeds. Relative to Brahman-sired progeny, preweaning (weaning weight) and postweaning (postweaning ADG, feedlot ADG, final feedlot BW) performance is expected to be less for progeny sired by non-B. indicus subtropically adapted sire breeds. The non-B. indicus subtropically adapted sire …

Super Shedding Of Escherichia Coli O157:H7 By Cattle And The Impact On Beef Carcass Contamination, Terrance M. Arthur, Dayna M. Brichta-Harhay, Joseph M. Bosilevac, Norasak Kalchayanand, Steven D. Shackelford, Tommy L. Wheeler, Mohammad Koohmaraie

Roman L. Hruska U.S. Meat Animal Research Center: Reports

Beef carcass contamination is a direct result of pathogen transfer from cattle hides harboring organisms such as enterohemorrhagic Escherichia coli. Hide contamination occurs from direct and indirect fecal contamination in cattle production and lairage environments. In each of these environments, individual animals shedding E. coli O157:H7 at high levels (>104 CFU/g of feces, hereafter referred to as “super shedders”) can have a disproportionate effect on cattle hide and subsequent carcass contamination. It is not known what criteria must be met to cause an animal to shed at levels exceeding 104 CFU/g. Understanding the factors that play …

Tenderness – An Enzymatic View, Caroline M. Kemp, Paul L. Sensky, Ronald G. Bardsley, Peter J. Buttery, Tim Parr Jan 2010

Tenderness – An Enzymatic View, Caroline M. Kemp, Paul L. Sensky, Ronald G. Bardsley, Peter J. Buttery, Tim Parr

Roman L. Hruska U.S. Meat Animal Research Center: Reports

One of the most common causes of unacceptability in meat quality is toughness. Toughness is attributed to a range of factors including the amount of intramuscular connective tissue, intramuscular fat, and the length of the sarcomere. However, it is apparent that the extent of proteolysis of key proteins within muscle fibres is significant determinant of ultimate tenderness. The objective of this manuscript is to describe the main endogenous proteolytic enzyme systems that have the potential to be involved in muscle postmortem proteolysis and whether the experimental evidence available supports this involvement.

Dimensionality Of Business Ethics In China, Marc Sardy, J. Mark Munoz, James Jianmin Sun, Ilan Alon

Faculty Publications

Purpose – The purpose of this paper is to explore the ethical dimensions in China. It reviews the extant business ethics literature on China, collects data on ethical conduct from a large Chinese university, and analyzes the data to examine emerging trends. Design/methodology/approach – Factor analysis and multidimensional scaling (MDS) are applied to an established survey instrument after reliability is confirmed. Findings – Principal-components factor analysis uncovers six main factors. MDS further reduces the explanatory variables into four ethical dimensions, while increasing the number of useable observations. These four dimensions are then correlated with some demographic and psychographic variables. Results …

Private Oppression: How Laws That Protect Privacy Can Lead To Oppression, Teri Dobbins Baxter

Scholarly Works

This article explores the problems that can arise when laws protect the privacy of some individuals at the expense of others. These issues will be viewed through the lens of the controversial case of the children taken into state custody from the Yearning for Zion Ranch in Texas. Specifically, the article examines the allegations that led government authorities to intervene and remove the children from the Ranch and the difficulties that the government faces when such allegations are made against residents of isolated communities who have little interaction with the larger American society. The article will further demonstrate how privacy …
