School Choice is a topic that finds itself at the top of school reform and political agendas across the United States, while also being a significant focal point in the educational literature. However, little attention in the debate has been placed on private, independent school choice – including private religious school choice – despite that data that shows “seventy-nine percent of all private schools had a religious affiliation in 1999– 2000: 30 percent . . . affiliated with the Roman Catholic Church, and 49 percent with other religious groups” (U.S. Department of Education, 2002, p. 3) and that “initial research …

Since apoE allele status is the predominant Alzheimers disease (AD) genetic risk factor, functional single nucleotide polymorphisms (SNPs) in brain apoE receptors represent excellent candidates for association with AD. Therefore, three low density lipoprotein receptor (LDLR) SNPs were evaluated by TaqMan allelic discrimination assays for association with AD and I found that certain haplotypes alter the odds of AD. A SNP within LDLR exon 12, rs688, was identified in silico as neutralizing a putative exon splicing enhancer (ESE). Since LDLR is a major apoE receptor in the brain, I hypothesized that rs688 modulates LDLR splicing in neural tissues and associates …

Physiological Genomics Of Spinal Cord And Limb Regeneration In A Salamander, The Mexican Axolotl, James Robert Monaghan

Salamanders have a remarkable ability to regenerate complex body parts including the limb, tail, and central nervous system. Although salamander regeneration has been studied for several hundred years, molecular-level studies have been limited to a relatively few important transcription factors and signaling molecules that are highly conserved among animals. Physiological genomic approaches were used here to investigate spinal cord and limb regeneration. Chapter 2 reports that hundreds of gene expression changes were identified during spinal cord regeneration, showing that a diverse injury response is activated in concert with extracellular matrix remodeling mechanisms during the early acute phase of natural spinal …

While the construct of rule as a manipulation of purely formal properties of language has been widely abandoned in both formal and functional linguistics, it persists, though with diminished importance, in the field of Second Language Acquisition (SLA). This is true even in Form-Focused Instruction (FFI), including Focus-on-Form (FonF), which emphasizes meaning as both classroom focus and element of language structure. The secession of Kosovo from Serbia in February 2008 represents a stage in the unfolding of a revolution of "constitutional" dimensions in International Law that began with NATO's 1999 intervention in Kosovo against Serbia. NATO's intervention called into question the authority and viability of U.N. Charter system for maintaining international peace. Likewise, the West's decision in 2008 to support Kosovo's secession from Serbia dealt a further blow to the central post-War legal rules and institutions for controlling and mitigating Great power rivalry. At this, the 6th International Conference on Serpentine Ecology, it seems timely to review briefly the present status of the field and to project the needs for future research. Although a great deal of serpentine research was done prior to 1960, as summarized by Krause (1958) and discussed briefly by Brooks (1987), much of our progress in learning how serpentine geology affects plant and animal life occurred in the mid- to late 20th century. Adiantum Viridimontanum, Aspidotis Densa, Minuartia Marcescens, And Symphyotrichum Rhiannon: Additional Serpentine Endemics From Eastern North America, T B. Harris, N Rajakaruna

Serpentine outcrops around the world are known to harbor disproportionately high rates of plant endemism. Remarkable cases of serpentine endemism occur in New Caledonia and Cuba, with 3178 and 920 endemic taxa, respectively, found solely on serpentine. Despite the patchy occurrence of serpentine in eastern North America from Québec and Newfoundland south to Alabama, only one taxon, Cerastium velutinum var. villosissimum, has been broadly recognized as a serpentine endemic for the region. Based on reports in the literature, we suggest that Adiantum viridimontanum, Minuartia marcescens, and Symphyotrichum rhiannon be considered endemic to serpentine soils from the east coast of North …

This essay analyses a recently discovered copy of the first edition of Lady Caroline Lamb's Glenarvon in the Koninklijke Bibliotheek at The Hague filled with annotations and corrections apparently in the hand of its author. This copy shows many of the extensive revisions eventually implemented in the second edition of the novel. Some changes indicated in this special copy were not adopted, however, and a note on the punctuation in a hand not the author's raises the question of whether others edited the work, especially the punctuation. In In re Dispirito, a decision of importance to Chapter 13 debtors’ attorneys, the Bankruptcy Court for the District of New Jersey ruled that an undersecured creditor was entitled not only to adequate protection payments, but that the section 507(b), 11 U.S.C. § 507(b) (2006), “super-priority” status of the inadequate adequate protection provided during the case meant that the Chapter 13 plan had to pay those amounts before paying any of the debtor’s attorneys fees. 371 B.R. 695, 695 (Bankr. In 2008, a report published by McKinsey & Co. predicted that a successful program of action on climate change would require the reduction of greenhouse gas emissions by 76% by the year 2050. In order to achieve this seemingly daunting target, the report recognized that the transfer of environmentally sound technologies (ESTs) from the developed to the developing world was an urgent necessity. The report cited other sources to acknowledge that such technology transfer was unlikely to be achieved even by a combination of market incentives and funding from developed-world governments.

A jurisdiction that seeks to enact a municipal wind energy ordinance must first delineate areas suitable for wind energy projects in its comprehensive plan. Then, the municipality must choose a legal mechanism to regulate wind energy projects within those areas. Lastly, the municipality must write specific regulations addressing details such as size, location, and noise. This paper discusses the choices that a municipality in New York must make in drafting a wind energy ordinance, with reference to how existing codified wind energy ordinances and model municipal wind energy ordinances have dealt with these choices.

Under The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (“BAPCPA”) (S. 256, Pub. L. No. 109–8, 119 Stat. 23), debtors are subjected to a test in order to ensure their creditors are repaid as much as possible. Chapter 13 requires debtors in bankruptcy to file a plan indicting a monthly amount they will repay to creditors over a given set of years. The amount to be repaid is a debtor’s entire “disposable income,” which is income minus expenses. See 11 U.S.C. § 1325 (2007). Deductable expenses are to be calculated the same as a chapter 7 filing. …

In Morris v. St. John National Bank, 516 F.3d 1207 (10th Cir. 2008), the Tenth Circuit addressed the issue of whether a bankruptcy trustee who successfully avoids a lien and preserves the in rem security interest for the bankruptcy estate under the powers granted to him by the Bankruptcy Code automatically assumes all the rights the original lienholder may have against the debtor. The Court, affirming the decisions of the bankruptcy court and bankruptcy appellate panel, concluded the trustee did not automatically assume all the rights the original lienholder may have against the debtor. An important and traditional power afforded by the Bankruptcy Code to debtors and trustees is the power to sell encumbered property free and clear of any liens or encumbrances. See G COLLIER ON BANKRUPTCY, App. Pt. 44, at 44-529 (Alan N. Resnick et al. eds., 15th ed. rev. 2006). Mediation has gained general acceptance in the legal community but has been slow to take root in bankruptcy. See generally Geetha Ravindra, Reflections on Institutionalizing Mediation, 14 DISP. RESOL. MAG. 28, (Spring/Summer 2008). Over the past 20 years, mandatory bankruptcy mediation has become a feasible alternative to traditional litigation of adversary proceedings. In the beginning, creditors and debtors would mediate only if they agreed to mediate.
