The Capabilities Conception Of The Individual, John B. Davis Dec 2009

The Capabilities Conception Of The Individual, John B. Davis

Economics Faculty Research and Publications

This paper advances a capabilities conception of the individual, and considers some of the problems involved in developing such a conception. It also makes claims about the nature of the capability space as a whole, frames personal development in terms of the idea of moving though the capability space, and argues that people are alike in being increasingly heterogeneous. A key problem for a capabilities conception of the individual is that some capabilities, such as belonging to social groups and having social identities, can undermine individuality. The paper discusses an example in which people can have social identities but can …

Obstetrics and Gynaecology, East Africa

Background: Group B streptococci (GBS), or Streptococcus agalactiae, are the leading bacterial cause of meningitis and bacterial sepsis in newborns. Here we compared different culture media for GBS detection and we compared the occurrence of different genotypes and serotypes of GBS isolates from the vagina and rectum.

Methods: Streptococcus agalactiae was cultured separately from both rectum and vagina, for a total of 150 pregnant women, i) directly onto Columbia CNA agar, or indirectly onto ii) Granada agar resp. iii) Columbia CNA agar, after overnight incubation in Lim broth.

Results: Thirty six women (24%) were colonized by GBS. Of these, 19 …

The Vaginal Microflora In Relation To Gingivitis, Rutger Persson, Jane Hitti, Rita Verhelst, Mario Vaneechoutte, Rigmor Persson, Regula Hirschi, Marianne Weibel, Marilynn Rothen, Marleen Temmerman, Kathleen Paul

Obstetrics and Gynaecology, East Africa

Background: Gingivitis has been linked to adverse pregnancy outcome (APO). Bacterial vaginosis (BV) has been associated with APO. We assessed if bacterial counts in BV is associated with gingivitis suggesting a systemic infectious susceptibilty.

Methods: Vaginal samples were collected from 180 women (mean age 29.4 years, SD ± 6.8, range: 18 to 46), and at least six months after delivery, and assessed by semi-quantitative DNA-DNA checkerboard hybridization assay (74 bacterial species). BV was defined by Gram stain (Nugent criteria). Gingivitis was defined as bleeding on probing at ≥ 20% of tooth sites.

Results: A Nugent score of 0–3 (normal vaginal …

Identity And Democracy: Linking Individual And Social Reasoning, John B. Davis, Solange Regina Marin Dec 2009

Identity And Democracy: Linking Individual And Social Reasoning, John B. Davis, Solange Regina Marin

Economics Faculty Research and Publications

Following Amartya Sen's approach, John Davis and Solange Regina Marin look at individual and social reasoning when examining the complex relationship between identity and democracy. They characterize democracy as a process of social or public reasoning that combines the individual reasoning of all citizens. Identity is explained in terms of personal identity, social identity, and individual identity. They argue that democracy in combining the individual reasoning of all citizens responds to individuals’ different personal identity concerns and needs, reflects their shared social identity interests and goals, and accords them rights and responsibilities associated with their many different individual identities.

The Incidence Of Tobacco Taxation: Evidence From Geographic Micro-Level Data, Andrew R. Hanson, Ryan Sullivan Dec 2009

The Incidence Of Tobacco Taxation: Evidence From Geographic Micro-Level Data, Andrew R. Hanson, Ryan Sullivan

Economics Faculty Research and Publications

This paper uses a recent increase in Wisconsin’s tobacco tax as a natural experiment to measure the economic incidence of tobacco taxation, using micro-level data on cigarette prices from retail locations in Wisconsin and states that share its border. We find that Wisconsin’s $1 tobacco tax increase was over-shifted to consumers; they pay the entire amount of the tax as well as a premium of between 8–17 cents per pack of cigarettes. We also use geo-coded data to test if the incidence of the tobacco tax is different for locations near the border of states with different tobacco taxation.

Negligence And Insufficient Activity: The Missing Paradigm In Torts, David Gilo, Ehud Guttel Dec 2009

Negligence And Insufficient Activity: The Missing Paradigm In Torts, David Gilo, Ehud Guttel

Michigan Law Review

Conventional wisdom in tort law maintains that the prevention of undesirable risks mandates restriction of harmful conduct. Against this widely held conviction, this Article shows that undesirable risks often stem from insufficient, rather than excessive, activity. Because negligence requires investments in only cost-justified care, parties might deliberately limit their activity so that the size of the ensuing risk would be lower than the cost of welfare-enhancing precautions. Parties' incentives to strategically restrict their activity levels have striking implications for the inducement of efficient harm prevention. The overlooked paradigm of insufficient activity calls for the imposition of a new form of …

Shareholder Compensation As Dividend, James J. Park Dec 2009

Shareholder Compensation As Dividend, James J. Park

Michigan Law Review

This Article questions the prevailing view that securities-fraud actions suffer from a circularity problem. Because shareholder plaintiffs are owners of the defendant corporation, it is commonly argued that shareholder compensation is a payment from shareholders to themselves with substantial transaction costs in the form of attorney fees. But shareholder compensation is no more circular than a dividend, which is a cash payment to shareholders from the company they own with substantial transaction costs in the form of taxes. In fact, shareholder compensation is less circular than a dividend because it is a transfer to shareholders who purchased stock when the …

Law's Expressive Value In Combating Cyber Gender Harassment, Danielle Keats Citron Dec 2009

Law's Expressive Value In Combating Cyber Gender Harassment, Danielle Keats Citron

Michigan Law Review

The online harassment of women exemplifies twenty-first century behavior that profoundly harms women yet too often remains overlooked and even trivialized. This harassment includes rape threats, doctored photographs portraying women being strangled, postings of women's home addresses alongside suggestions that they are interested in anonymous sex, and technological attacks that shut down blogs and websites. It impedes women's full participation in online life, often driving them offline, and undermines their autonomy, identity, dignity, and well-being. But the public and law enforcement routinely marginalize women's experiences, deeming the harassment harmless teasing that women should expect, and tolerate, given the internet's Wild …

Dimensions Of Loss From Mental Illness, Amy E. Z. Baker, Nicholas Procter, Tony Gibbons Dec 2009

Dimensions Of Loss From Mental Illness, Amy E. Z. Baker, Nicholas Procter, Tony Gibbons

The Journal of Sociology & Social Welfare

This review explores the nature, scope and consequences of loss resulting from mental illness. Losses are described within four key themes: self and identity, work and employment opportunities, relationships, and future-oriented losses. In reflecting upon review findings, several assumptions about loss are illuminated. Findings are situated within the cornerstones of recent mental health reform, specifically a recovery-oriented approach and social inclusion. Particular attention is directed towards notions of risk and responsibility and tensions in realizing the impact of loss within an individualized recovery framework. Implications and recommendations for policy and practice are highlighted.

E-Therapy As A Means For Addressing Barriers To Substance Use Disorder Treatment For Persons Who Are Deaf, Dennis Moore, Debra Guthmann, Nikki Rogers, Susan Frake, Jared Embree

The Journal of Sociology & Social Welfare

Persons who are deaf face a number of challenges with regard to vulnerability for substance use disorders. Moreover, accessible treatment for this condition can be difficult to establish and maintain. The Deaf community may be one of the most disenfranchised groups in America in regard to appropriate access to substance use disorder (SUD) prevention and treatment services. This article reviews findings related to substance use disorder and treatment for this condition among persons who are deaf. It also reviews a promising approach for addressing treatment needs via e-therapy, and it highlights the challenges and concerns regarding e-therapy for this population. …

Does The Gi Bill Support Educational Attainment For Veterans With Disabilities? Implications For Current Veterans In Resuming Civilian Life, Alexa Smith-Osborne

The Journal of Sociology & Social Welfare

A secondary data analysis of the 2001 National Survey of Veterans (NSV) for 2075 Gulf War-era veterans was conducted to investigate whether the GI Bill (the Servicemen's Readjustment Act of 1944, most recent provisions of which have been entitled the Montgomery GI Bill and the Post 9/11 GI Bill), considered as a social welfare policy, demonstrated protective effects for veterans with disabilities in terms of successful re-entry and sustained enrollment in higher education. Regression analyses to test the mediation effects of use of the GI Bill, use of non-Veterans' Administration (VA)financial aid, and use of VA health services suggested mediation …

Parental Cognitive Disabilities And Child Protection Services: The Need For Human Capacity Building, Sandra T. Azar, Kristin N. Read

The Journal of Sociology & Social Welfare

Theories regarding the social cognitive origins of parenting risk have recently emerged. This work not only has implications for the nature of interventions with parents, but also for the approaches taken by the social service systems that work with them. This paper reviews the evidence that there is a significant number of parents with cognitive disabilities within child protection caseloads and outlines the types of human capacity building and organizational development that are needed to support the parents' needs. Such capacity building will not only increase the effectiveness of child protection interventions with parents with cognitive disabilities (PCD), but will …
